Have you tried contacting your Senator or Congressman?

Although I didn't actually try to expedite Pras' K-1, I found that there was an issue about her mum's wish to attend the wedding (a very big issue amongst desis). I contacted the offices of (retiring) Sen. Sarbanes and Congressman (running for Sarbanes' seat) Cardin over the last month.

Cardin's office phoned me this morning stating that they had emailed the Delhi embassy last friday, and were still waiting for a response.


I received this from the congressman's office, anyone know what it means?

"The case is still with an adjudications officer. If information becomes
available while you are out of town, I will call you at the number listed
below."

I'm aware of the other types of visas, however the K1 seems to be faster and would work more to our benefit which is why I was asking the question to a group of K1 visa applicants...

My questions were more along the lines of what are your thoughts on us claiming we are engaged to get the visa? do you suggest waiting out the 90 days to see if things are working, or would you suggest fake the marriage right away so she can begin applying for AOS and work here? would it work? has anyone here done that? heard stories?

As per the Embassy webpage a Marriage Certificate for all previous marriages is required for all applicants. Here is what it says on the London Embassy webpage:

On the day of the formal visa interview all applicants for immigrant, fiancé(e), Kii and V visas, including children and babies, will be required to present the following documents where applicable. All documents, except passports and photographs, must be submitted in single copy, with the original document or certified copy bearing the appropriate seal or stamp of the issuing authority. If only the original of the birth, marriage and/or other certificates is available, the applicant may submit one photocopy thereof but must bring the original(s) with him/her to the interview for inspection by the consular officer.

As far as forging...I'd say that's a big NO....first of all, they have your sigs all over the place...can your parents duplicate it to not arouse suspicion? And if they send it back again because the sigs don't match...imagine what that would do to your petition.

Not to mention, you get this RFE, your parents sign and mail it straight out....but then there's a paper trail that you were actually OUT OF THE COUNTRY at the time the documents were returned in such a timely fashion...don't you think that would be a little odd? You yourself even said that it would take a while to get them to you, so if they are mailed back before that timeframe, it's clear its not your siggy. There is a paper trail that can be followed.

Furthermore...are you willing to put your parents in risk of being found to have forged government documents? It's prolly an outside chance that anything would happen to them.,..but it IS illegal & could you imagine if some yahoo gov't employee decided to press charges? All for saving you a month of time, or a few bucks in int'l courier fees?

Have you tried counseling???? You have your NOA2...would that not allieviate some stress on the situation? A couselor might be able to help you two cut thru the fighting bs to let you both see how much you love one another.

Coming on a 90 day and having no 'roots' is pretty hard. It does get easier! Is it a case of this visit just clouding everything? Because when he'd be here the next time, he'd be here for good...and being able to fly on his own, like having a job, making friends of his own, etc. When I lived in the UK, the adjustment was soooo hard in the beginning because I was so dependant on D that it had us at each other more than we ever would have been. But that was really mostly me lashing out, because I felt like such a fish out of water there. As I settled in and got my bearings and made a life of my own....girlfriends, knowing the public transport & doing things on my own, my own gym membership, etc....things calmed down and it was all quite lovely.

I'm really sorry to hear this and hope that you two find the path that best works for you. Temporary stress does play a big factor in things, and this uncertainty of this whole process can be so awful.

I hope you don't think I'm too presumptuous here, just wanting to share my experience. But I wish you luck no matter what path you choose.

Well i have just cancelled the honeymoon and all the flights for friends and family and just called to let her know that there is nothing to worry about.

She asked me how i felt and i said devostated and that i still loved her and wanted to be with her and that this was so tough.

She agreed and said that she still wanted to marry me and felt the same but not just yet, she said it was all just too much too soon.

I said ok but what do we do now? we cannot continue a long distance relationship as its just to hard after two years of being apart, we are both on the verge of a nervous breakdown!

As i could earn enough money for us both to live on here in the UK we are talking about spending 6 months together over here or maybe up till Jan. No promises and we are both thinking this over.

The reason i say all this and tell my story is because i think people on here should know about the hard times and not just the joy of getting a visa. Ever since i got it our relationship went down hill due to the fact that it became real. We were going to get married and she had enjoyed all the plans and dresses. I think its something we should all think about.

One step at a time.... for us. I love her and she loves me and everything is fine when we are together its the distance which is the hard part.



Dre, this is a really mature way of handling this horrible situation....you both are being upfront and honest, and as you two still want to be together, so it's only a matter of figuring out what that is. I love the way you're both trying to work at this together, it shows the bond of love! As everyone has said, the visa is good for 6 months, so all is not lost. I think the fact that your fiance is having reservations may just be a result of cold feet....usually a wedding is enough stress, but add to a pending immigration and it can be quite overwhelming.

You two love each other and want to be together, so I hope you both can fight through this AWFUL fking distance problem. It's shiznit, we all feel it....D and I have 'freaked out' over the distance on more than one occassion....when you feel you just don't have the strength to go on because you miss 'having a real life'. But we always have fought through those feelings because our eye is on the prize and just when we think we can't take it anymore, we find the strength to go on because it's such a once in a lifetime love.

I hope and pray that your fiance get the time she needs to resolve her anxiety, and at the same time, you both are together soon enough to give you the strength to remember what it is you're fighting for. Nothing good comes easy. Trite, but true! Hang in there you both can make it if you perservere!

I have a son who was born in USA from Cubans parents. He is 17 and works as a part time and studies at college and he will finish next year. When he was about 11 he went to Cuba and met a lot of friends and he has keep communication with them by mail, email and phone. He is in love with one of those girls and they are a kind of fiancé since almost 2 years, she is also 17 and we have also communication with her parents without any problem. My son wants to marry her next year here in US and bring her with a Fiancé Visa.
My questions are:
1-Can they do it because of their ages? (Remember we and her parents can sing if it were necessary)
2-Who can make him an affidavit, can it be done for a friend of us?
3-He never thought he will have to prove his love, and then he has a lot of pictures/letter/postcards of her everywhere but he did not keep any envelop. How can he prove his love….he will go next March, what can he do to help that process?
4-She does not have any relative in US, is that good or bad for that process?

I'm sorry but in order to file a K-1 both parties have to be legally able to marry at the time of filing. Her being 17 MAY be a problem. It is not 'oh by the time it comes I'll be legally able'

Because following this logic...a separated petitioner could file without a previouse divorce being filed. And we all know that's not possible.


Oh....filing in Nov married and here by Feb? I will run around my block naked if that happens.

But it's not cos of the love factor...although why anyone would want to sponsor someone they don't love is beyond me. And one also has to ask oneeself why a woman would pull up her whole life and uproot her kid if not for love. But nowhere in the K1 does it say anything about 'love'.

Although both parties should be on the same page.

Here is the situation :

4 years ago I had a daughter with my now ex-girlfriend. I put in my SSN# at the hospital to accept that's my daughter etc. so I'm legally the father of my child .

3 years ago my fiancee in Vietnam got pregnant with her now x-boyfriend and gave birth to her daughter . The fact is after 4 months of prenancy, the father of the kid found out it was a girl so he left both of them until now. so her daughter never had a father legally or spritually . even in the paper the father name is UNKNOWN .

so now I'm filling the K1 , my fiancee parents don't want her grand-daughter to go over here (USA) with us, because she raised the kid since she was 1 year old (my fiancee must work to support the whole family)and they can't live without her now . It won't be a problem for me if she(my fiancee)brings the kid with her, but she told me let's wait until her daughter grows older.



So what should I do ? what steps do I need to do ? Do you have the similar problem and how did you resolved it ? Will the consular officer focus on the children factor ?

Sounds to me that your issue is between you and your fiancee as to what to do...so I don't know why you're asking questions about the CO.

Has your fiancee decided to move here despite her family's objections? If so, is she planning on bringing her child? Because I'm not getting the impression that you have those details solidified, so I'm a little unsure as to what you're asking.

OP, she didn't just cheat...she pimped herself out for money. But these are all our opinions, and tbh, you already know what you're going to do. To us, it's crystal clear what you should do...and the fact that you started this thread makes me think you came here hoping to hear 'oh give her a chance...blah blah blah' If that's the case, I'm sorry you didn't get what you are looking for.

You need to do some soul searching on what kind of woman you want by your side. The money you wasted now will be nothing compared to the money you'll lose later should you continue. But if it's ok to you to have a woman who whores herself out for money even though you're already sending her some....to have one lie to your face (you know what I mean) and deny until you show her you have the proof...well, that's not much of a person imo...and I'd rather be alone than with someone like that.

If you are an independent contractor, you are self employed. The State Department is the one that will be approving the visa based upon your ability to support your fiancee. If you are self employed, then they want tax returns along with two years of bank statements to prove the income reported on the tax returns actually exists. With the ability to produce tax returns from software on your home computer, anyone can show really good income. That is why they ask for independent verification of financial ability. The commercial rating is essentially an independent rating of your ability to pay bills in regards to your work environment. I'm a little surprised that is acceptable.

If you have just started a job, then your employer can write a letter for you explaining the job, and your potential for income from it.

Otherwise, you might be looking for another sponsor.


What I did was I got a second job working in an office :( it's no fun, but I felt more comfortable going the employee way than the whole 'self-employed' way.

I didn't do it for the K-1 interview as I hear London is ok with self-sponsoring. But I'm planning ahead for AOS. Man, am I tired! lol

As a contractor, independent or otherwise, don't you have a contract? Something that delineates the terms of the agreement with whoever is paying you? Contractors do get paid for their work, and at the IRS' insistence the payments are documented, they're just not called 'employee's salary'.

I did when I was an independent contractor, and then with each job that I was called in to perform I got paid for the work and statements documenting the payments. At the end of the year a Form 1099 for tax purposes.

I have a reasonable amount of cash assets ($25k or so) but I haven't worked for a few months now. I may soon be returning to a job I held previously, a newspaper motor route (not exactly prestigious, but it's decent money...). For tax purposes, this is considered self-employment (independent contractor). Is there any way I can do this and viably sponsor my fiancee without waiting until next year's tax return?

I'm also confused on "report of commercial rating concern" -- can anyone enlighten me as to what this is?
