K-3 Spouse Visa Process & ProceduresDS-3032. What exactly is an agent?
You can Email the choice of agent the moment you are able to get the NVC Case numner from NVC... Keep checking the NVC number once you receive the NOA2.

K-3 Spouse Visa Process & ProceduresVisa process ???

We did a CR1 in about 134 days... Mailed 4/8 and interview 8/17. Most other CR1's were around 155 days,,, And, K3's should be 3-4 weeks faster...

But, it really depends on Service center and luck... No one really knows why two petitions sent at the same time to the same service center have drastically
different timelimes.

Good Luck,

K-3 Spouse Visa Process & ProceduresMARRIAGE CONTRACT(SECPA)
If doing a CR1 you will need NSO copies to send to NVC,,, if doing a K-3 you will need NSO copies to present to the Embassy,,, For filing the I-130 the local register copy is fine (That is what we used as well).

K-3 Spouse Visa Process & Proceduressubmission of I-130 W/O folder
There should be no problem (it is not a requirment).

The purpose of a cover sheet and/or folder is make it easier for the immigration folks to process the paperwork.

Making the processing easier,,, may result in faster processing,,,

K-3 Spouse Visa Process & ProceduresUnemployment benefits used for support
Try to find a co-sponser,, as a backup to your income,,,

Also, might want to pursue the CR1 rather then the K3,,, not much time difference,, will be cheaper once she gets to the USA
and she can look for work once she receives the SSN card in 2 weeks or so after entering the country.

We did a CR1 in a little over 4 months end to end.

Another point with the CR1 route,,, the NVC will accept the I864.. so if there is a problem you can get it fixed before the interview,,,
otherwise the local consulate will be the one to validate the I864... If you have a problem at the interview I suspect it will take alot
longer to resolve.

K-3 Spouse Visa Process & ProceduresPhilippine passport name change.
Passport name makes no difference as the visa and green card will be issued in the name on the passport submitted during the st lukes medical exam. As far as getting a new passport in married name,,, the processing time is the same as getting new passport... my wife changed her passport after the nvc stage and before the st lukes exam... the consulate changed the immigration paperwork to reflect the name change...

K-3 Spouse Visa Process & Procedures1-130 is ready but confused about middle name
The birth certificate name would not match anyway,,, It has the birth name,,, Not the married name. They use the name as depicted on the
passport to generate the visa. We originally submitted her maiden name passport to the NVC... And, then gave St Lukes (Medical Exam) her
new passport with the married name. The US Consulate issued the visa and changed all of the paperwork to reflect the married name.

As far as visa issuance, Interviewed Monday and received the visa the same week,,, delivered to a hotel in Metro Manila.

K-3 Spouse Visa Process & Procedures1-130 is ready but confused about middle name
The K3 is all but obsolete these days... In our case the K3 was never sent to the NVC... It seems to have been terminated as the I130
reached the NVC first. This seems to be very common these days. Personally, I would do both again... As you just never know which
one will give you a better time-line.

BTW... Our CR1 visa was issued in August of 2009.

Also, you might want to clarify the K3 filing comment. The K3 is filed after you file the I130.

The K3 visa application process is as follows.

1. File the I130 (CR1 visa)
2. Receive NOA #1 from the I130 application
3. File the I129F (following the K3 visa instructions) which includes submitting the I130 NOA #1.

Good Luck and happy immigrating...

On the G325a and the I130,,, We used the new married name,,, as you stated "her maiden name will become her middle name"...

Note: Seen previous post... She was a K1 and married in the USA... That is different then your situation...

US Embassy and Consulate DiscussionCouple to attend K1 interview together?
QUOTE (oceanapart @ Jul 25 2009, 12:04 PM) <{POST_SNAPBACK}>
Hi everyone,

I hope all is well and everyone is making progress with their visa journey. Our K1 was approved two months ago and interview is scheduled in Manila on 8/25/2009. I will visit my fiance for the 3rd time within the last 1.5 yr and we're thinking if we both should attend the interview. Please let us know if it is advisable to attend interview together.

Thank you

Our CR1 was approved in May and we will have our interview on 8/17. I am planning to attend the interview. I think it can only help. I read elsewhere you will be allowed into the embassy, but, may or may not be able to participate in the interview. Depends on the Consular Officer. And if you are there they could interview you seperately if they want... And compare answers.

I am thinking to go into the embassy and give her my passport to take into the interview with her,,, as additional proof of a continued bonafide marriage. I read that here on VJ too. Sounds like good advise. At that point they can decide whether or not to involve me.

Good Luck,

US Embassy and Consulate Discussion2nd K-1 for a different fiance questions
They will only care,,, if there was a short marriage and therefore potential fraud. They will ask how long the
previous marriage was and possibly why the divorce. But, with the marriage being 10 years,,, You will
have ni issues.

US Embassy and Consulate DiscussionDS-230 wrong spelled name
Just make sure that you have all of the documents that support the name variation in posession of the petitioner. Good news is,,, If the NVC has a problem and issues an RFE,,, if you have the documentation available,, Usually only takes a couple of weeks for the RFE to be resolved. Better an issue at the NVC then CSC.

US Citizenship General DiscussionThree years vs. Five
QUOTE (jsnearline @ Jun 24 2009, 05:56 PM) <{POST_SNAPBACK}>
Does anyone know why the spouse of a US citizen gets a two year head start vs. anyone else who wants to naturalize? Why not apply the same five (or three) year rule to everyone? That way, once you get to the naturalization stage, you wouldn't have to prove anything regarding a bona fide marriage. It could simplify the process and speed up adjudications as well.

I might tend to be a bit factitious. But, I like to think it is because they had to put up with our crapola for 3 years...

It is a joke... ok?

I agree,, don't waste your money,, on the n400,,, He will get derivative status (Citizenship) from you. Just file for a US Passport for him once you get your naturalization document. That will be his proof of US Citizenship.
