IR-1 / CR-1 Spouse Visa Process & ProceduresAdvice? - NVC - Passport name from maiden to married
Looking for a little information. We submitted the maiden name passport bio page with the DS-230 at the NVC, Looks like our case
should be completed tomorrow 6/26.

Note: all paperwork except the passport Bio page was submitted with the married name. Also, the NVC Benificiary name was always
the Married name until today. When I called today,, they asked if she had another possible name, The NVC name is now her
maiden name.

Now we have a new passport with the married name. Suggestions? My thoughts are to wait until an interview date is established before
attempting to correct the name in the paperwork.

Suggestions? Should we attempt to get this fixed before the interview? Or just bring the old and new passport to the interview and have
the Manila Emassy resolve at that point?

All suggestions welcome.

When I see a question like this,, First thing I do is to look at YOUR timeline. You have not kept it up to date, If members don't take the time to fill out their timelines,,, how can we be expected to derive good dates. We all should try to keep our timelines accurate. That I think is a reasonable cost of membership to VJ.

Hello my friend, If I am not mistaken, the 5 months is for the California Service Center,,, then you have the NVC timeline...
Plus the embassy processing time.

You are right in that our timeline is about 5 months end to end...

But, if you ask Immigration,,, they would probably state 5 months CSC + 2 months NVC + 2 months Embassy = 9 months.
and shave a month off that for a K3.

You need to prove a bonafide marriage,, For me I was only married for 2 weeks when I filed for the I-130. So. 6 PICs from the
wedding and one affidavit from a familiy member that knew about the marriage.

Now when she goes in for the interview... The timeline will be longer and proof of a continued bonafide marriage will require more
documetation.

The I-130 form I used the address we spent together in the PI... Was for only a few days....
My G-325 I put N/A...

Normally you do not want to leave items blank. Use N/A, None. And if the space is not enough
make an addendum sheet and put the information there.

Example:

G-325a Completed by USC - Addendum

This form is submitted in connection with an application for:
I-130/K3 PETITION FOR ALIEN RELATIVE

Yes, either is fine. I used B/C. However,,, when in doubt always give more documetation then asked for. Never want an RFE
for lack of paperwork.

Not sure where you are getting the 3 month state residency requirement. I have not seen that one... However, leaving for vacation for 2 months does
not end or suspend your resident status. That is certainly acceptable by the immigration process. You will only have issues with immigration if you
exceed 6 months.

You need to provide a little more about your situation. If your daughter got derivative status from your immigration she will obtain
her citizenship when you get yours. You can submit a copy of your naturalization paper (once you get it) with her US passport application
and she will get a US passport... or you can file for a N600... Personally just getting a US passport is better and cheaper.

We filed N400 5/25 "Dallas" just got notification "On July 26, 2012, your N400, APPLICATION FOR NATURALIZATION was placed in line for interview scheduling."

So,,, we will see. However, keep in mind. You can reschedule any portion of the process, fingerprints, interview and oath ceremony. So,,, if the
pregnancy becomes an issue for any date, you have options.

Also,,, if you search VJ for "N400 May 2012" people are tracking their status by filing location. This might give you an idea as to how it might apply
to your situation.

Assuming you are a US citizen. Your wife is able to apply for citizenship 90 days before her 3 year anniversary of arrival. Example. My wife arrive 8/24/09 applied for citizenship N400 5/25/12 and received her citizenship on 9/25/12. She applied for her US passport on 9/25/12 (using her cert of citizenship).

Side note. you do not have to apply for an N-600 for the stepson if you do not want... You can just apply for a passport for him using the Wifes Cert of citizenship papers. The US passport will
then become proof of citizenship for him... Cheaper and quicker.

Personally,, I would not waste the money on "Certificate of citizenship or N600"... Just apply for a US Passport... That is better then
any naturalization document. You should never need the Naturalization document again,, after the Passport is issued.

First, the 1099 does not show when she worked just the year and the employer. Second, if they ask specifically about the dates of the work (which I doubt they will do) just be honest about it. If you use a tax transcript I am not so sure the income even shows who earned it.

I don't think anyone can comfort your nerves on this one,,, The government is not good about sharing information with other agencies and I think they will focus on the relationship bonafides,,, not, your employment. Just a thought...

Stop giving her money,,, If she leaves on her own and/or files for divorce... Better for you.

A court will be more likely to give her the short end of the deal if she files... Also, put a
freeze on your credit reports,,, to keep her from applying for additional credit in your name.

Someone from California that has been through the divorce process might be able to shed additional
light on protecting yourself.

However, the employer has a copy of the required I9 documents. I don't think most employers review
the expiration dates on your id related documents.

Hello Chrissie!
The 90 day window is calculated based on the expiration date on your green card (not wedding anniversary)
USCIS calls it "anniversary" but they mean anniversary for becoming a permanent resident.
They like to confuse :P

Use the calculator in this link and just enter your GC expiration date.

It will give you the EARLIST date you are allowed to file.
be careful not to file too early or too late!

And yes, you only need the i-751 form.
But you also need to send evidence of bonafide marriage as the previous poster listed.

of 10/7/2010.


If you file earlier it will not be accepted... Not sure about the money. I suppose it would be forfeited.

Then,,, if that fails,,, well when they are out on there own,,, then now you are 20+ years down the road, The USA is now mostly YOUR home,,, It is definately your childrens home, Now comes the grand children. Time to make your choice. Live in the Philippines,,, or be accessible to your children and grand-children. I recommend,, listen to what she is asking,,, cause,, as time goes by her vision of the future will most likely change to match new realities.

Easiest way,, in my always humble opinion. Have her get the PICs taken on a digital camera (most of the PI passport places use digital cameras) and email you the JPGs. You can take to Target or? and use the Kodak PIC system. Cost me like $0.35 for 6 Passport Photos.

Just make sure the camera will do 2 Megapixals. I did this for her PICs at NVC and also, for mine when renewing my passport.

I don't think it would hurt to apply for a visa,, However, unless she is wealthy, has a great job she is taking leave from,, owns a business, (basically, as unrefuteable reasons for returning) they will most likely deny the visa.

True story, Had a relative apply,,, she was a business woman wanting to attend her sisters wedding. Reason for denial.. The interviewer said, "You are too good looking,, you will just find someone to marry you".

Remember, you are not in Kansas Toto.

The custom folks can pretty much do anything they want,,, I have done 15 international trips in the last year.

I usually have some prescription narcotics with me,,, and no prescription. Just the label. I have never had them take a second look. And, I suspect that with BC pills,, they are not really a highly controlled substance. That given, get a prescription for peace of mind.

As far as your luggage, You should be fine there. The chances of the TSA agents actually checking your bags is unlikely. And, if they do,,, you will be right there with them.

You could have a ceremonial marriage,,, If you wanted to have something that is more for the family and friends. Just make sure that would
not be considered a legal and binding marriage according to local law.

Rules on liquids for carry on. Must be 100ml or less containers. These containers must be able to fit in a one quart (.9 Liters?) clear plastic zip lock type bag. You are allowed to carry on one of these bags.

There is exceptions for baby formula and medications with prescription.

Looks to me that the most often discarded liquids at security check points are expensive
cometics, bottles of lotion, bottles of sunscreen and of course bottles of water and soft drinks.

As far as food,,, You may bring almost anything you want for consumption on the airplane. However, keep in mind that only processed food
will be allowed through the point of entry in to the USA. Nothing fresh and no seeds or plants. Even Dried Fis is ok.... Although,,, I think checked
luggage is better for that one.

Note: lotions, cosmetics, etc may be in checked luggage at any quantity as long as it is not flammable,,,

A few other exceptions apply but, this should cover the bulk of the flyers.

I travel internationally for business all over the world... I find the best way to get cash,, Is the use of ATMs.

For my wife, I set up an extra checking accouint (in my name) with ETrade bank.
Just use a bank that doesn't kill you on ATM fees and exchange rates.

With ETrade I get the international bank to bank rate and no fees.

I just transfer the money online into her account from mine. She can get the money in 2 minutes.

Note: I put the ATM card in between a couple of pieces of thin card board and wrote on the outside, Pictures please don't bend.

If you have the time and looking for a bit of nature...A drive north up the coastal highway (Highway 1) with a return trip
through the highway of the Giants (Giant Redwood Forest) is a nice day trip.

Another,,, good trip if crossing the GoldenGate is to spend part of the day in Sausalito. It is just across the bridge on the right.

Of course,,, Food, Food, Food... China Town, Little Italy, and of course getting a little homesick Daly City is home to lots of Filipinos
including the presense of a Goldilocks.

Also, keep in mind. Depending on where you plan to spend your time... It is very expensive to park around SF and usually quicker and
easier to use public transportation. When traveling on business there we usually rent a car during the weekends when we do the day trips.
And use the subway/trolley/taxi during the week around the Warf and Downtown areas.

but marriage licenses, i think (not sure), must be obtained from where one resides... so that when the marriage ban is put up the locality will be informed.

once you have your marriage license, you can marry anywhere within the Philippine Territory.

JUST ONE ADVICE: Do not skip the marriage ban (10 days) for obtaining the license. You would get tons of grief for this later on.


Yeah I think that is the case. The marriage license request is posted publically for 10 days (As was in our case),,,
Then after that a licence was issued. There was no restriction on where the marriage could occur.

Her family does not have any more financial worries. It is as if they won the lottery. Meanwhile, back here in the U.S., we are living paycheck to paycheck and working overtime to make ends meet.

We got into an argument one day because of money. I sold one of our cars because it was going to cost a lot of money to repair. I was gonna use the money to buy things we need for the house, and those things that we've been wanting to get the whole year, but couldn't afford to. I found out later that she has sent some of that cash to her family. I told her "didn't you already send money this month?" She replied, "I sent it for my neice because she called and she needs to attend a christmas party for school." We then got into a big argument.

Because of that argument, she is now very cautious (as far as amount) in sending money to her family, although she still sends money monthly. Unfortunately, my wife has quit her job, but still sends the same amount of money. We sure could use that money for a new car. "


There is a cultural responsibilities to help their parents and siblings... I think most of us understand that...

You took her out of the chain of financial support for the family.

But,,, Unless you are independently wealthy and are willing to just give them mass amounts of cash. i think a reasonable approach is to limit
the cash to "What you can afford" with a maximum limit set to about amount of money your wife could of added to the household income...
Assuming 1. They send her to a good school, 2. She got a good job and 3. she gave the family most of her income.

For example a nurse with a good job might make $200 or $300 in a small town.. Maybe $400 or so in Manila...

I let my wife know,,, that my main responsibility is to help my immediate family, But, since I love her,,, I will help her with one of her
responsibilites.

At the end of the day,,, if she is sending all of that money abroad and not assisting in her primary responsibility which is to help her children
and husband... Her parents will live in the best house in the neighborhood, all of the relatives will be going to the good schools,,, And, you
will be living below average in the USA and your kids are going to the community college. We always need to strike a balance.

Takes one day,,, there is more information around here on it.. Bascially,,, I think it is a seminar,, for fiancees and spouses to know what their rights
are and who to contact in the event of abuse...

With your return on the 22nd... The question still remains,,, are you planning to request same day visa? Or,,, are you planning to do a embassy pickup? Or just going to use Air21 with the assumption that the visa will arrive in time for the return trip?

As for Filemarie and I,,, we will try a same day visa pickup or embassy pickup,, instead of Air21 delivery.

Please let me know your thoughts,,,
