Just being in the Military? I have been in the Marine Corps,,, But, why the expedite? There is tens of thousands of
Military that will never be deployed,,, they are basically civilian jobs without the civilian pay.

Now if he has deployment orders,,, that is a valid reason. If that is the case, fax a copy of the orders along with the
military Id.

Note: If the expedite is approved. You need to request expediting at the NVC again,,, From what I have read here at VJ.

Yes, Chicago POE... It is a pretty good POE... I never spend more then 30 mins getting through... Even adding in the immigration paperwork.
She should be good to go. Have her call you when she gets to her departure gate... Someone will definitely let her use their cell phone

In regards to your comments above, this isnt a political site so i will spare you my views on social style goverments. however that being stated, the system in place in the USA isnt the best for sure, but i would still take it over an entitlement style society anytime..... Nothing in life is free, and No one is entitled to free health care or unemployment that never ends. where is the incentive to suceed if someone else gives you everything you need. in closing i would just say that i can understand how for some its hard to understand the culture in the USA, but our society has never and most likely never will be a socilaist one. it goes against the morals under which the country was founded. I.E. 1776 decleration of independence from the British Crown.......just food for thought.... :yes:

Been almost 3 years since I got married in the Philippines,,, so, please keep that in mind.

But, it will tke a couple of weeks to get married in the Philippines... From what I recall we
had to post our intention to marry for 10 days at the locl register before we could actually
get married. In addition, as far as filing for a CR1 visa (DCF) in the Philippines. I recall there
being a significant amont of presense in the Philippines before you can file that route. Maybe,
6 months or more.

All you need for the I130 is to prove you ARE married...

So minimal.

Marriage Certificate (Copy is ok)
Picture of you two together (I sent in 6 Pics -- Signing the marriage certificate would be good)

Optional:

Affidavit by a friend or relative that is knowledgeable of the relationship and marriage(I sent in one affidavit)

They will be looking for bonifide evidence of an ONGOING relationship at the interview... There
it will be important to have the emails, chat, phone records etc,,,

Actually filing single vs married,,, the IRS could probably care less.... As you will be taxed at the higher single rate.

As far as immigration,,, I don't expect it would cause a denial,,, IF they even knew about it... As your explanation
makes some sense... No ssn,,, how to file married...

That given,,, I do like some commments by others,,,, once you get your ssn,, file an ammended return,, and get an
additional tax refund,, for the lower married filing jointly,,, tax rate.

I don't need or want to make it a faster process. We WANT to get married in the Philippines with family there. However, I've been told too many things. I've heard if we do, it could take years (?) for her to finally to be able to move here (USA). We would have the marriage forms from the government, affadavits, pics, etc, honeymoon, etc etc, to prove we were married there. I also was told "just do the 1-129f".....thats not what we want. It might be quite a while before we'd return there, so we'd like to marry in May 2012.
So baring any problems, which we have none; Does using the I-130 visa application take a longer? A little longer is ok, 3-5 years....no! thanks for any replies; If you've used the 130, can you reply and tell me about the length of time it took. I just looked at the processing times today, and it said 187 days....thats fine with us, or are we missing something? John and Ann


6 to 9 months is probably average... We married 3/21/2009 and she was here on 8/24/2009.

Note: The visa and INS paperwork will be changed to reflect the name of the passport submitted to St Lukes. As the passport they received
is delivered to the consulate,,, and if you pass the interview,,, the Visa is placed in that passport.

FYI,,, With the I130 process,,, you will need to submit a copy of your current (unexpired) passport during the NVC process.
If you are planning to change passport name,,, make sure you make a copy of the current passport incase you need
to submit a copy to the NVC and you have not received your new one yet.


Note: In our experience our I130 name always reflected the latest name they had.

1. I130 submission married name
2. NVC (gave them maiden name passport copy) I130 changed to maiden name
3. St Lukes (gave them married name passport) I130 changed to married name
4. Visa issued in married name

I am not sure what the level of scutiny there is for Chinese immigrants... However, all is that is REQUIRED for the I130 initial submission
is to prove you and the immigrant meet the requirements for approval.

1. You are US citizen
2. proof you met and are married
3. All previous marriages terminated properly
4. bio data correct

maybe a couple of more things,,,

During the interview at the consulate you will need to prove,,, an ongoing relationship. Basically, what did you do AFTER you were married
and can prove,,, that demonstrates an ONGOING RELAIONSHIP.

I130 NOA2... Just states you and the spouse are eligible to receive a visa
NVC Collects and Validates all Official Documentation (Ie. official copy of marriage cert, etc) has been received
Consulate Decides whether or not you receive the visa based upon the documents submitted, addition proof presented, results of the
interview,,, and the all too subjective gut feeling whether or not fraud is involved.

When you file for the I130. They just need proof you qualify for the I130. Bio data for both, citizenship for you, you met and got married. A few PICs and a copy of marriage cert will satisfy that... During the interview you will need to prove that the relationship is bonifide and ongoing.

Here is what was in our I130 Package. I think better to send a simple I130... In my opinion easier for the government employee to review and approve.

Tough to say... Looks like you are pretty much through the NVC process... And you might not be asked additional
employment/financial questions during the consulate interview. However, it appears he will exceed the level
required for this year (unemployment + possible employment). It is a bit of a gamble. I suspect you would
be approved.

However, To have a joint-sponser to only be presented at the interview,,, if absolutely needed would not
be a bad idea.

I just decided to move to New York when my dad passed away. So right now I am planning to bring my wife here in the US for us to be together. we've been together for almost 7 years and we just got married last February 16,2012. I filed her petition last march and On March 27, 2012, USCIS received my I130 IMMIGRANT PETITION for my wife. My question is, what are the chances of her visa getting approved knowing I just moved in New York a year ago,but I'm a US citizen. Does it affect my petition or not? And do you think I'll be able to be with my wife by Christmas? I'll be so glad to hear from all of you advice and suggestions. Thank you!


Yes, it is possible based upon the amount of time (almost 9 months). However, many things could delay that. Mostly, you not having all
your paperwork ready and correct. Any RFE or delay on your part... Then, there is a possibility USCIS does not generate your NOA2
within the norms...

Our I130 was done end to end in 120+ days... Review the timelines of others. It is certainly plausable.

The previous reply is correct. However, be prepared for headaches. Getting, the passport, green card, ssn, drivers license, credit cards
etc. to follow the same name convention,,, not so easy.

I think my ex-wife had 3 or 4 different uses for her name.

Ie. Using only one of her first names
Using her 2nd first name as middle name
Truncating her last name as whole name too long
Using her middle name and last name as a hyphenated last name.

We are in the same situation you are. We made a copy of her current passport for the Bio-page copy needed for the DS-230. I think they just want to make sure she has a passport. Then she applied for a new passport (needed NSO marriage certificate) to support name change. She will have her new passport on 6/18. I will submit the new bio-page then,, and use the new passport for processing in Manila. If I run into any issues,,, I will send you an EMail.

K3 is a NON-immigrant visa with a path to AOS for people married to US citizens. Upon entry, you will still have to file for AOS. Also K-3 is almost $1000 more expensive to CR-1/IR-1

Beneficiary on CR-1/IR-1 visa can start working as soon as they arrive in US, where as its not the case with K-3.

Read the guides and you should fly through CR-1. That's the best choice right now. A lot of people got delayed last year because they filed for K-3 rather than sticking with stand alone i-130.




You file the I-130 which is for an immigrant visa for a immediate relative. Depending how long you have been married... 2 years or longer the beneficiary will be issued a IR1 visa, If you have been married less then 2 years (as in my case) you will receive a CR1 visa.

Before the IR1/CR1 Immigrant Visa used to take much longer then the K3,, But, these days the processing time is
about the same.

My personal opinion is to file for both (as there is not an additional filing fee for the I-129F K3).

Because in my case.. My K3 paperwork was lost between the CSC - Califormna Service Center and the NVC - National Visa Center. But,, my IR1/CR1 is still being processed in an efficient manner.

Miight just want to wait to change the address when it gets to the NVC... First, they are easier to get ahold of,,, And second, they seem to actually have some ability to review and make changes... The CSC people.. always, seem to just read a script and provide no assistance.

My plan was to pursue which ever petition reached Manila first. If it looks like the CR1 is a better choice once it reaches the NVC you can choose which to pursue at that point.
You can always reschedule the K3 interview (from what I understand).

I may be a newbie on VJ but, certainly not on the process. I would suggest that you always pursue a K3 in conjunciton with the I-130. The reason for this,,, Is inept government workers. My case is a perfect example. the I-130 and K3 were both approved on the same date. However, the I-129f K3 has been lost somewhere between CSC and the NVC. And neither one will take responsibility for this. So,, I still have one horse in the race. For me I am glad the I-130 is moving forward at a good pace.

thank you for your advice. I am sorry to hear that the K3 application got lost, but what did you do to cancel the k3 instead? do you think it is a long process to cancel K3 then pursue the CR-1?


I will not have to cancel the K-3,,, because the K-3 will not arrive in Manila before the CR1 and the K-3 if it ever surfaces will die a natural death cause of the CR-1 visa being issued.

First,,, bad that VSC had your case (NOA#2 takes along time),,, Good now that NVC has it... Check the timelines compared to others, But, I would think you are looking at about 90 days for an Interview from now... Either, CR1 thru NVC or K3 thru Manila. Check the NVC shortcuts and flowchart so,, you know the process.

My K3 got lost in transfer between CSC and NVC,, so, I am just pursuing the CR1.

To answer your specific question. I would say Manila will get the K3 paperwork in 10 days and depending where she lives maybe another 10-15 days for the packet #3 to get to your spouse.

With baby in your lap, you didn't pay for baby to have a seat so baby can't bring checked-in bags. Each "paying" customer gets to bring 2 checked-in pieces of 50 pounds each. I don't think the OP is asking about carry-on bags.

i just read about the additional luggage,i dont know if its a check in luggage or carry on..as long as it wont exceed 7 kilos..

Normally you can take one carry on and one personal item... I travel internationally all of the time,, I always take a 22" rollerboard and a laptop backpack. Never a problem. Double check the airlline for checked allowance, You pay normally only pay excess baggage when you check in for the first flight.

Not sure what is a W-7,, but, if submitting a photocopy of a return (rather then the transcript)
instructions state including the W-2 (for you) as you are the guarantor for the AOS.

I used the AGI numbers,, and included a work/income verification letter for good measure.

As in all documentation with these petitions, the more the better. Never seen anyone get an RFE
for too much documentation.

Looking for a little information. We submitted the maiden name passport bio page with the DS-230 at the NVC, Looks like our case
should be completed tomorrow 6/26.

Note: all paperwork except the passport Bio page was submitted with the married name. Also, the NVC Benificiary name was always
the Married name until today. When I called today,, they asked if she had another possible name, The NVC name is now her
maiden name.

Now we have a new passport with the married name. Suggestions? My thoughts are to wait until an interview date is established before
attempting to correct the name in the paperwork.

Suggestions? Should we attempt to get this fixed before the interview? Or just bring the old and new passport to the interview and have
the Manila Emassy resolve at that point?

All suggestions welcome.
