...hmmm... I wonder if they will process the applications first whose extension letter is on about to expire. Mine is still good till May... Junglee's expires in March... so they will have to get active now to make the mark..... and big surprise... his case just got touched.
Anyone know whose extension will expire first? Is Junglee the first of the few of us?


I don't know if they would necessarily sort the petitions by the date the one year extension is to expire. That would require a bit more effort than sorting them by NOA1 date (i.e., they would have to check the green card expiration date). But who knows . . . .

Huh! I didn't get one of those, or at least not yet. Maybe they're going through the pile in order of NOA1s. Anyway, this must be the "received at VSC" touch -- the one on Feb. 4 being the janitor taking the files out of his closet in the TSC basement men's room to load them up on a 35 mph mail truck for the 8-day drive up to VSC.

I know it's stock language, but I hope the "we" in "We process cases in the order we receive them" is USCIS and not VSC.

Today I received the I-797C transfer notice. It is interesting to see the line: Case Type CRI89 "Approved Removal of Conditions (I89)". It says that in order to speed up processing, they have transferred to the Vermont Center. I wish I knew how to "decode" these messages... wondering if they meant that the case was approved, and Vermont will speed up processing by ordering the card. My envelope was postmarked 2/5/2008. - vivira.



A lot of us received letters with the exact same wording. We're all waiting to see what it means. smile.gif


I'm probably repeating myself, but I think if TSC adjudicators had actually had "approved" all of our petitions, they would have just ordered card production, not shipped all of the petitions off to VSC. More likely, they just took all petitions that had not yet hit an adjudicators desk -- roughly, those with NOA1s of late February and later -- and shipped 'em off. Although I still don't understand why some late June NOA1s are apparently still there (e.g., muergana, and also apparently Reinhard/Mr. Big Dog, who still hasn't checked in here).

C'mon, don't pull any punches -- it's fact. TSC was processing February 2007 petitions when they shipped them out, not April 2007. And VSC is (or was) processing August 2007 petitions, not March 2007. Now VSC presumably really is processing March 2007 petitions -- from TSC.

I think any "preliminary processing" was merely the receipt of biometrics info for the case. If an adjudicator in TSC had a file on his or her desk, he or she would have gone on and finished adjudicating it, not packed it up and sent it to VSC. Thus, the cases sent to VSC are no "further along" then a non-transferred VSC case for which biometrics was just done a week ago. The only difference is that the transferred cases are (presumably) at the head of the queue.

Also, note the last official processing time posted for VSC -- it was March 1. That more or less corresponds with the oldest TSC cases (most of the February NOA1s were either approved or got RFEs). VSC actual processing time was much shorter, by a good 4 or even 5 months. So by taking on all of these older cases, the posted VSC processing time is now accurate.

Anyway, that's my theory and I'm sticking with it. At least until after lunch.

And I do not think any of us are approved. And yes, since we have a receipt date of March 23, 2007, we will have to wait as Vermont indicates March 1, 2007.

Also, I think "ihateemo" said she called the Hotline and the lady on the other line said she was approved. I think that is wishful thinking, because when I called the Hotline on Jan 18. 2008, the lady also said "approved" but it was in the same sentence as "CRI89 Approved Removal of Conditions". So I asked for clarfication of "approved" and it turns out that this is simply how the USCIS "classifies" pending petitions for our category. This is really cruel as it is misleading, but this is the wording they have chosen to assign our category.

You're right, of course, but I just love process, that's all. My wife could give a flying farfugnugen about this b/c with two kids, it's not like there is much of a chance of our petition being denied. (I will blow a gasket, however, if we get an RFE for more financial info or something like that.)

I hear you James, I try not to get too excited seeing the word approved, it seems like a cruel joke in the light of the processing time paragraph. I have already resigned myself that I will be one of the last Losers to be approved!


There are a good month of transferred Losers after you, Cassie, so you definitely won't be alone. Although it is curious why they didn't transfer everyone up through the end of June. I'm basing that assumption on the fact muergana wasn't transferred, and that Reinhard/Mr. Big Dog has not stopped in. He is around over in Off Topic, but I suspect he would show up here if he had been transferred, if only to say, "WHEW! Glad I'm out of Texas!"

No, the "no service request for you" was directed at Tweety, who had put in a service request months ago when the posted TSC processing date finally passed her March NOA1 date (you can't put in for a service request until your NOA1 date is earlier than the posted processing date). Now that she is at VSC, which has a posted processing date of March 1, 2007, she is back within the posted processing time and suddenly ineligible for service requests. (Not that they do any good.)

From what I've seen here on the main list, VSC has (or had) been consistently approving I-751s just about 6 months from the NOA1 date, despite the posted processing time. So if you filed at VSC in September, you probably could count on being approved in March. But I have no idea what affect this bulk transfer from TSC will have (and let's not forget the transfers from TSC of all new petitions being filed there, which has been going on since December.)

The problem with guessing where VSC is at right now is that the VSC filers on the master list who would have been approved or are up for approval -- ForYou and gwsmith01 -- haven't been around in ages.

I thought we would have gotten the notice about the transfer in the mail by now (by yesterday's mail, actually -- five days from them sending the notice out the day after the date on the notice). It probably doesn't say anything different than the online case status message, but I'm curious. Anyone get theirs yet?

Even if VSC approvals do back up because of all of the new transfers, it'd probably only be another three months, so you'd still get approved by June. Plus, who knows, maybe with the fee increase, whatever new workers they hired have finally gone "online" at VSC and there won't be any additional backlog. Unlikely, but who knows.

But you're right -- the fee increase was a clown move by USCIS. They raised the fees so they could clear whatever backlogs they had, and ended up creating bigger backlogs because of the rush of people who filed before the fee increases. (Ironically, all of those people who rushed to beat the fee increase and filed at TSC and NSC were long ago approved by CSC.)

Look at it this way: there can only be a few I-751s left at TSC, all from RFEs from February. I'd bet you'll be approved before any of us if you've responded to the RFE promptly.

It can -- , from what I understand, an N-400 interview with a still-pending I-751 will usually force adjudication of the I-751 right then and there by the interviewing officer -- but unless the time for VSC approvals stretches out to a year from the current 6 to possibly 9 months, your I-751 will be approved well before you are eligible to apply for naturalization.

with all TSC cases at Vermont I don't know if they push everything back 3 months or if 3 months worth of old TSC petitions might not all get done in a shorter time. If it took 3 months for me to get approved, all VSC filers now would have an additional 3 month waiting time!


I note aussielad is getting burned up about that possibility in another thread. He's only been waiting five months . . . so he has to wait eight months total, it's still less than any of us.

You have to believe all of the transferred cases are at the top of the pile. The newest of those cases is still older than than the oldest petition that was filed directly at VSC.

Within that pile, though, you and I are probably 2 and 3 months down, respectively, because the oldest transferred petition is from mid-late February. Which means, barring some miracle, we'll probably get approved at around the one-year mark of our NOA1s.

My NOA1 was dated three days before the date my check cleared the bank. But I didn't receive the NOA1 until more than two weeks after the date on it. Make of that what you will.

Yeah, I posted in this thread when you first started it over a year ago and I'm STILL waiting for the I-751 to be approved.

The Chinese government won't renew her Chinese passport unless she actually has her U.S. 10-year card? That's very odd. Why should whatever documentation a Chinese national has to reside in a foreign country affect whether the Chinese national is entitled to renew a Chinese passport?

Lesson learned:

it's wise to include passport photos, after all they did ask for them :blush:

I left mine out of my package but waited until I'd received my NOA then sent them on with a photocopy of the NOA and a very short note reading
"this is an addition to my I-751 application"
I also wrote on the envelope my A# and that this is additional info for my I-751 application. Surprisingly it was attached to my file and all was well - great job!


Passport photos are only necessary for those who reside overseas pursuant to military or government orders -- regular folk no longer need submit such photos because USCIS is now taking photos of I-751 petitioners at the biometrics appointment.

Thay can and do put the I-551 stamp in expired passports. The passport can be expired, it still serves as valid ID, just not valid for international travel.



Kindly stop spreading misinformation. Even assuming a local office will stamp an unexpired passport, that establishes neither ID nor employment eligibility. List A of acceptable documents for the I-9 expressly requires an unexpired foreign passport with an I-551 stamp to establish ID and employment eligibility.

You will have a slew of people who will tell you, no, they are not necessary, they were approved and they did not submit any affidavits. They probably didn't submit a birth certificate of their child, either, even though birth certificates are, along with affidavits, one of the five categories listed in the instructions.

But lets forget the instructions for a second and go to the source, the pertinent USCIS rule in the Code of Federal Regulations. It provides:
Form I–751 shall be accompanied by evidence that the marriage was not entered into for the purpose of evading the immigration laws of the United States. Such evidence may include:
(i) Documentation showing joint ownership of property;
(ii) Lease showing joint tenancy of a common residence;
(iii) Documentation showing commingling of financial resources;
(iv) Birth certificates of children born to the marriage;
(v) Affidavits of third parties having knowledge of the bona fides of the marital relationship, or
(vi) Other documentation establishing that the marriage was not entered into in order to evade the immigration laws of the United States.
8 C.F.R. § 216.4(a)(5).

The I-751 instructions combine items (i) and (ii) and describe all of the above as "examples" that the documents submitted as evidence "should cover." So affidavits are really about as "optional" as any of the other items. You can be approved without them, just as you could be approved without birth certificates or without documents showing joint tenancy in or ownership of property.

Practically speaking, if you have tons of evidence in the ownership/tenancy of property and financial commingling categories (and certainly if you throw in a couple of kids' birth certificates), then perhaps affidavits could be seen as optional.

Not exactly true. The guide refers to "affidavits," as do the I-751 instructions (but then stupidly links to some example letters as an erroneous example). Affidavits are notarized, or they are not affidavits.

Lest there be any doubt (like people thinking, oh, you're just being ####### or too literal), Black's Law Dictionary defines an affidavit as follows:

"A written or printed declaration or statement of facts, made voluntarily, and confirmed by the oath or affirmation of the party making it, taken before a person having authority to administer such oath or affirmation."

Does that sound like a letter? Or something that is not notarized? A notary public has authority to administer oaths and affirmations in connection with an affidavit.
