So since you filed in February, their actual processing times are at least ten months? You have to wonder why they don't just put that up for a processing time instead of this phony 6-month business. (Maybe they will when the new times come out this week, but I doubt it.)

Maybe we should wait and see if any of these things pan out? From what I've seen, the service requests don't lead anywhere (except maybe Frustration City). Has anyone who has called, and has been told that TSC will contact them in 30 days, actually gotten any info then from TSC, and did it say anything other than "we'll let you know" or something like that?

I'm going to be at 6 months from NOA1 a week from tomorrow. I don't know what this business is about waiting an extra 30 days in case they have sent you something by mail (presumably either a notification that card production has been ordered or an RFE) because such things would be reflected on the online case status and you could find it out immediately.

Anybody remember that old Jack Lemmon film "The Out of Towners" from the early 70s, the one where he and his wife are abused and set-upon tourists in NYC? I'm going to be like him and start taking names.

If you sent in your I-751 in December 2006, though, your window to apply for citizenship opened up last month. Have you applied? That will force adjudication of the I-751, assuming it's still not adjudicated by the time the citizenship interview comes up.

Reminds me of my local Chinese restaurant from many years back when I was living in NYC. I would call and place an order for delivery and would ask how long it would take.

"10-15 minute," I was invariably told.

Sometimes it did take 10 or 15 minutes. But sometimes it took a half-hour or more. Yet no matter what the order was, what time of day, or what day of the week, I was always told, "10-15 minute."

Your waiting for nothing. I am way past the 7 month mark and when I inquired about my wife's 751, I was told the same thing as everyone else (who was not past 7 months).

Basically they said see you in a year (per the extension letter)!


I'm going to inquire next month when our 7 months are up. Basically, I figure we have nothing to lose. And I can get my dudgeon up with these clowns.

My wife would beat me up if I really tried to make her learn a new word every day. I'm just there for her if she has questions about usage and vocabulary. Although she went to a bilingual secondary school in Colombia, unlike her sisters she did not go to college in the US but instead pursued her law degree in Colombia. So she has this fluent but funny English.

Actually, I haven't given it much thought yet. There are a ton of resources around here given the huge immigrant population, so I don't imagine it will be a problem. At least finding the resources, that is.

Gathering from the experiences of VJers, they just dead stopped issuing approvals at the end of June -- just about when they started transferring new I-751s to CSC. (Coincidence? I THINK NOT!) They had been running a bit over five months from NOA1 to approval at that time.

Now they're at eight months and counting, so if it stays like this until January, your attorney will be right.

Me, I'm looking at the N-400 instructions to make sure we're ready to file for naturalization in April. My wife has to do a bit of work for this one. Nothing like overpreparation, so her word for the day is "perspicacity" and her U.S. history lesson is Shay's Rebellion.

Re: naturalization -- as long as one has the requisite three years of permanent residency and is still married, one can go ahead and file for naturalization regardless of whether the I-751 has been approved. The officer that conducts the naturalization interview will then adjudicate the I-751 prior to the interview (assuming it still remains unadjudicated). That is how it is supposed to work in theory according to USCIS, but in practice I have no idea . . . .

Well, I say "theory" but it is USCIS policy -- they put out a policy memo a couple of years ago stating that this was the procedure. I think I've read reports where it has played out like the policy envisions -- your I-751 gets adjudicated before the interview (or even at the interview) and that's that. But there's no doubt that even if your I-751 has not been adjudicated, you can go right ahead and apply for citizenship 90 days before your third anniversary (i.e., a year after you were allowed to petition to have the conditions removed).

Hey Jay, I had seen you were one of us on the timelines and had been wondering if you would show up here to report in.

Looks like we're all here, almost a dozen. The TSC filers who had the great misfortune to file after TSC slowed down to a stop but before I-751s sent to TSC were transferred to CSC. We are the Losers Left Behind.

I've made our own list in our own honor (please add last-touched dates).

I dunno, I figure this would not be that high a priority since no one is being kept apart or is in danger of being deported. We're just stuck in a bureaucratic bungle that creates inconveniences for things like getting DLs and jobs.

Hindsight being 20-20, if I knew then what I know now, I would not have filed the week after our 90-day window opened. Instead, I would have waited until ten days before the GC expired so we would have been transferred to CSC. There would only have been a week or two after expiration without a valid GC, but we would have probably gotten the permanent card by now.

No, I'm not worried. What's there to be worried about? I'm together with my wife, who can travel and work with her NOA1 (and get a stamp if this takes longer than a year). We will still be applying for citizenship in April. In short, we're unworried Losers and proud of it.

A year? Who knows. Nobody knows what happened at TSC in June that apparently caused them to stop issuing I-751 approvals. All we know is that they just started shipping new ones to CSC as of July 1.

As far as the interview goes, I do not believe there is a new policy because they haven't changed the rule that gives the service center the discretion (exercised in the vast majority of cases) to waive the interview.

That sounds like a rumor. Although the statute ostensibly requires an interview, the pertinent administrative rule provides:
The director of the regional service center shall review the Form I–751 filed by the alien and the alien's spouse to determine whether to waive the interview required by the Act. If satisfied that the marriage was not for the purpose of evading the immigration laws, the regional service center director may waive the interview and approve the petition.
8 C.F.R. § 216.4(b)(1).

I find it hard to believe that USCIS now thinks it is impossible for a service center director (really, one of the adjudicators) to be satisfied that any petition was not for the purpose of evading the immigration laws. In fact, I believe USCIS would probably have to go through rulemaking to amend this rule if it wanted to eliminate the service center's discretion to waive interviews.

Yeah I know. Been there, done that! It was 3 years ago, but the USCIS hasn't changed a bit since then I see. tongue_ss.gif The "response after 45 days" thing has always been standard procedure. I'm not hoping for a quick approval or anything, I know better than that. I'm just doing what the USCIS website says, and letting them know my case has been pending for more than 7 months (6 months estimated time + 30 days). As long as they approve me before April it's alright with me! wink.gif


I wouldn't wait until April to do anything -- if I were you, and I haven't heard by the end of January, I would go ahead and file for naturalization. Then if your I-751 still isn't approved 7-8 months after that, my understanding is they will in almost all cases adjudicate the I-751 petition right at the naturalization interview.

Make that end of January: NOA1 on 1/31, biometrics appointment on 3/3, case last touched on 3/11 ~ nothing since! I just called Customer Service and was told an interview is now required for all I-751's (yeah, right...) and all they could do for now was file a service request, but the system was down so I should call back in an hour. I guess I'll give it another try tomorrow. Seeing everyone is on the same boat is comforting, but I'm still a tad nervous about it since they managed to mess up my K1 petition big time back in the days... Gotta love the TSC! mad.gif

You have to wonder what's going on at TSC. How can another service center (CSC) take on additional I-751s from both TSC and NSC and then approve them in as little as six weeks, while still handling its own caseload?

I have a feeling TSC suffered a meltdown in June. People with January NOA1s had gotten June approvals, then all of sudden they started transferring I-751s to CSC at the beginning of July. And nobody (at least around VJ) still at TSC from February on has been approved since.
