I don't think you're allowed to bring a camera into the building. Does anyone take a picture at the oath ceremony? It would seem they would be allowed at such a meaningful event.

Yes, you'll have to do it again. Our attorney said they are only good for six months, but I can't find any documentation to support that. My wife had 11 months between appointments.

Should I submit the same joint evidence (with updated information too, for example, pregnancy notes from now and a birth certificate in July)? Or should I should I submit something else for joint evidence? Is there something else that I'm missing to submit for Citizenship? What else do I need to submit? Is there something I don't need to submit for the N-400?

2) If I don't have my 10yr Green Card in time (gosh knows how much longer they are taking at the VSC for the I-751 cases, even though I've been waiting 6 months already), should I still file for Citizenship anyways, as long as I've met the 3-3-3 requirements?

3) How long does it currently take for Citizenship (specifically, if I'm filing at the VSC and my local office is Buffalo, NY)? If I need to postpone an interview and/or an oath date, can this be done? And if so, when can I expect for another rescheduled date?

4) Are children (especially young babies) allowed to be present during Citizenship oath ceremonies?

5) Can I take the passport photos now (6 months ahead of time) for the N-400? Or would I have to wait later to take the photographs? How early/far in advance can I have my photographs done? Besides the photo size and colour specifications, is there anything else I should be aware of when taking these photos and submitting them?

6) Should I declare trips and explain out of the country that is less than 24 hours? As a Canadian and a Permanent Resident in the USA, over the last 2+ years I've made 10-20 trips back to Canada by land (lol..I live so close to the border, go figure) that are less than 24 hours, so do I need to declare these and explain about them, especially more so that there is no written documented evidence of such trips? I have no passport stamps or other evidence of these day trips, so it would be hard to prove otherwise on my end. So will they look into that and question me about it, even though I don't have a written record of such trips?

7) Anything else I should be aware of and/or take note of too?

Any thoughts, ideas, suggestions, comments, etc. would be greatly appreciated. Thank you.

1. All we submitted was a joint tax return, joint credit card statement, and joint bank account statement. It totaled 5 pages.

3) It looks like it's taking 3-4 months for most people right now, depending on the local office. Yes, you can postpone the interview or oath ceremony. It will tell you how when you receive the letters giving you the appointment dates.

4. Yes, there were a set of crying twins at my wife's ceremony last week.

5. The photo requirements are on page 33 of the Guide to Naturalization.

7. If you suspect ANY problems during this process, contact your local U.S. Representative's or Senator's office. They fixed a few issues during my wife's journey.

Yes you should sign your full name per the instructions. That name would match what you put in Part 1.
Adding the short signature next to it could possibly raise questions. You never want to give USCIS reason to ask questions.

I heard from my Senator's office today. She requested that the National Benefits Center expedite my wife's case. They told her it was a local USCIS office decision now which is encouraging since my Senator's office is in the same building as my local USCIS office. Might find something out tomorrow.

Are you applying for an expedited passport?

My wife had biometrics today. We were the only people there this afternoon and only the 2nd biometrics appointment of the day. Hopefully that's a good sign that the interview will be soon. We sat and chatted with the security guard for about 20 minutes. He was extremely helpful in explaining what the interview will be like to calm my wife's nerves. It was nice to finally have a positive experience and see a friendly face in this process.

Hi there...I came from Bangkok, and I got my police report last Jan paying a 150 baht...100 for the fee since I'm foreigner there, and 50 for mailing...It's free for Thai Nationals... :)



but it took 3 weeks to get it, I never heard a 1,500 fee for speeding up the process since I know couple of friends who got their clearances with the same fee with mine...

You may need to have the USC submit the story here to be certian the info given is correctly stated.
If the 221 says what you say it does the problem could be in the documents submitted as part of the support info. Meaning they dont want " the IRS for 2011 and 12. What does that mean? What they want are his lastest tax transcripts. These are proof of his income and that his taxes are current. The problem doesnt seem to be with the income amount. Its the method used to indicate it.
The next actions you take need to be carefully thought thru so they dont result in an actual denial. Right now they simply want the current and correct info required to grant the visa. They have requested you submit that with your passport so they can issue the visa.
Make sure the USC understands exactly what to do. If not try plan B as you say which should be to marry in Thailand so you can get a CR 1 type visa.

He's never been married...
I have one thing in mind upon saying that The consul couldn't find commitment frm him...We have a 15 yrs age gap and both were never been married...I just don't know what's up with him...sighs...ty though for the suggestion :)

Well for family of 4 the guideline is $28,812.

How did he fill out his I-134 did he put adjusted income or what?
Was there someone else he included on taxes he doesn't have to know like ex-wife?

He needs to write a letter like they said and submit his bank statements seems they are thinking something here.

he's not...i got it frm the the Office of Federal Register... yup, it was stated that 23,550k...for that 4, i'll be included with his two sons...and his Income Tax shows, 32 K for 2011, and 33K for 2012...and for the co-sponsor, its not accepted for K1 visa here...He's from California too...

If u dnt mind me asking, is he in the military? And wat state is he in? I live in california and i need to have atleast 19k income for the fiance and its just the two of us. I think u got ur info wrong( sorry). U need 125% of the poverty line and upon researching the website u posted is not the uscis. Andcorrect me if am wrong $23,550 for 4 people.

Am so sorry about this, i think your fiance should write a letter as a the CO suggested... stating he is willing to support you also probably to the tune of how much, like a monthly allowance or something. He should attach his bank statements and also request a cover letter from the bank, stating why he is requesting the bank statement.

I believe the CO needs your fiance to prove he is willing and ready to support you if he can only show evidence that he is capable. I hope this helps

Thanks for the reply...I sent our intent of letter to marry upon filing of the petition, and sent another copy from his side during the interview, I also submitted the IRS of 2011 and 2012...the comment was "Petitioner failed to demonstrate sufficient income to sponsor an immigrant."... how could this be?coz no matter how I check the 2013 Poverty guideline, it only requires 24K USD for the 4 of us...and his IRS for 2011 was 32K and for 2012 was 33K...is this denial or we can still waive it by submitting what the consul was asking?

Sorry this is happening to you. What exactly did the 221g say? Out of curiosity did the both of you send in signed letters saying you will marry each other within 90 days of getting married in the intial petition and then send an updated copy for the interview? Also did you submit any IRS tax transcripts?

It's raining cats and dogs so as my experience at Bangkok Embassy... I cam so early and never had a problem on the process of application, been aware of the requirements specially the affidavit of support...to my dismay, after 15 mins of interview, the Strict Consul told me that " I'm so sorry, I'm refusing the issuance of your visa because your fiancee is not showing any commitment to you because he is not capable of supporting you, so I'm going to give you a 221 form, you tell your fiancee to write a letter to the embassy that he's willing to commit and support you all the way, and send a copy of his bank statement...

I was so surprised knowing that he's had 33,000 USD for 2011 and 2012, he's living with his two kids ( a 17 yr old who is working part-time & an 11 yr old)...and his been working at the same company for 10 yrs now...I'll attached here a copy of Poverty Guideline for 2013...and I strongly believed that the consul is so unfair to give that judgement.... Can anyone advised me what to do and share some experience like this? He even told me to provide the documents then send them together with my passport...We're confused and doubting if we still have hope to get the visa or is this total denial...

It's not really a refusal if they gave you 221g. They just want more info. Give them that, and you should be fine.

I think the K-1 will end up working out for you. You really don't want to start all over with the marraige visa if you can avoid it. The police certificate is only good for 6 months anyway, and you wont need a certificate of no marriage for a marriage visa. They should give you your birth certificate back if you get the visa or not.

I see, might be the reason why your lack of docs were easily resolved and visa was issued in just few days because it was spousal visa...mine is just K1...were just giving our best shot now, if this won't work, we'll get married here...am just crossing my fingers that this issue won't take much of our time...and I paid for the postage at the embassy, another thing...i just dont know if I can still get all my original docs like birth certificate, and certificate of no marriage, and police clearance...coz the embassy didn't give it to me, the lady told me that they'll keep it for verification...

K-1s are a little different than CR-1/IR-1. We were IR-1, so we didn't have to pay anything at the interview. We had already paid NVC $400 for the visa fee here in the U.S.

Am not sure, but I guess, everything now should be sent by post, coz after submission of the documents, we were told to pay at the thai postal service booth outside, you should do this before having the interview....

We submeitted our evidence in person and they told us right then to give them the passport. We picked up her passport with the visa in it the next day. You can read our experience here:

Thanks for the reply Karee...The CO told me after the interview to mail it with my passport, so I sent it thru EMS last Tuesday, and was received by USEM on Thursday, and my status at ceac was updated on Friday...Am anxious for the possible result...how about your experience?were you told to submit the additional docs in person?and how long did you wait for the result to come up?

More than likely you wont have another interview. How did you submit the new evidence? By mail or in person? When we had 221g, we submitted the new evidence in person between 1 pm and 3 pm on Mondays or Wednesdays, and they told us when to come back and pick up the passport with the visa. There was no further interview.

Is there someone here who experienced this...I was put under 221g because of Insufficient financial capacity of petitioner though he's earning above 125% of tihe guidelines....Then the consul ask for a letter from my fiancee stating that he'll be committing himself to me and support me all the way when I get to enter to US plus a copy of his bank statement...After sending all those papers, I even added another W2 and 1040 of 2011 & 2012, My status at ceac.state.gov was changed from ADMINISTRATIVE PROCESSING TO READY for interview...and when my fiance called DoS about the status, he was told that I have to wait for few days then they will send me something....

I'm worried & confused now, I don't want to face again the same consul who handed me that 221g paper, I was so frustrated knowing that I did well during the interview and we were well armed to face the battle...That consul just told me that, he didn't find any commitment and my fiancee is not financially capable, I was stunned knowing that my petitioner has been working at the same company for 3 yrs, and his income is above the poverty guidelines...

Does the status mean that I'll be having a second interview or the actual denial? Frankly speaking, visa refusal is such a pain in the ####, knowing that you are hanging at the moment and hoping for an uncertain thing, investing time, effort, and money...For me, it's a false hope, and actual denial is a lot better, coz you already know that you didn't make it but then you can proceed immediately to plan B....

I was on AP for 3 wks...when I submitted the docs that the consul asked, my status changed...from AP to Ready then to Visa Issued...it took 2 days before the visa issuance...

Those of you check your case status on the CEAC website, do you notice the change in "Status Updated Date"? If the date changes, does it indicate the case is being worked on?
Anyone recently got out of AP, did you notice the date changes also? How often?

hi there...I had the same status last week...From AP to REady for interview...do tell your petitioner to call the Department of State and inquire...we did the same, then the week after, it was changed to Issued...so call them and ask...Goodluck!

The US State Department website says, An applicant must obtain a police certificate from the local police authority: If you...lived in a different country for more than 12 months. She wasn't in any single country for more than 12 months but was gone in total for 14 months.

You think she's still required to get a certificate from both even though she wasn't in either for 12 months?

I have a couple questions regarding the Embassy Interview and the requirements of the DS-156K Application.

My fiance will be going through Guangzhou.

What are the Police Certificate requirements? Can anyone share a link to information about specifics on what's required? She lived in Iceland for 6 months and then Norway for another 8 months before returning to China. Will she need any documentation from Iceland or Norway?

Also, with regard to Evidence of Engagement, what kind of evidence are they looking for? I was planning to wait on a ring until she is in the United States. Beyond that, what would be considered evidence? We have already signed letters as to out intent. Just curious.

lol...might be he entered a wrong case number...i havent got a problem when i was checkin my status there, i was on AP for almost 3 wks...and i found it reliable, coz it provided correct update till i got my visa...

a friend of mine status reads " issued" does that mean they issued his wife a visa :blush:

her interview date is 02.26.13

don't worry much, I've been checking my status at that site every now and then since I'm scared that it might changed, lol...it's working pretty well...so it might be some connection or technical error ....hold still...aja!

Hi there! I'll try to answer your questions based on my understanding and experiences when I did the same....

 1.) The medical exam result(sealed envelope) will be submitted to the embassy upon interview, and the hospital/clinic will give this to the "beneficiary" after the exam or in some cases, it may take few days before the beneficiary can pick-up the result personally, though I'm not sure about the procedures in your country...

 

 2.) I just secured 2 copies of each form before I went to my interview, but submitted only one copy each ...

 

 3.) You can make follow-up to the embassy about the packet 3, all the information abt police clearance, medical, and forms are included in that packet...and they will just give you a website, and you can also check the copy of packet 3 online at the USEM website, you need to know your case number to check your status online. Make sure to make copies of financial docs needed, and at least 2 yrs tax returns/W2(2011 and 2012)...some may even ask for 3 yrs, but it always depends on the Consul...

 

  4.) Just make a copy of your NOA2 and submit, but make sure you keep a copy of that because you'll be needing that for the AOS.

 

  5. The intent to marry should be sent upon filing the 129F...but you can make another copy with more details to be submitted upon interview, but this is not necessarily required...
