By the way...we have a question about the affidavit of support, form I-134, in section 7.
At the bottom of section 7, it asks about "Mortgage or other encumbrance amounting to"
We are wondering that since I don't have a mortgage, but am renting, do I need to put in the amount of rent per month and state that I am renting? Or should I just leave it blank?

I got a reply from the embassy it says.....Thank you for your inquiry. As of December 2, 2008, the IV Unit of the U.S. Embassy in Bangkok has not yet received the case BNKxxxxxxxxxx from NVC. If NVC has already transferred your case to Bangkok please allows some weeks for the case to be transferred to us in both physical and electronic files. Once we have the case in the system, we will notify the applicant by mail regarding further steps of visa application process.

How long it would take to transfer the case from NVC to the embassy?

Despite his assurances, reporters saw a small buildup of forces near the airport. About 200 police, carrying riot gear and shields, were seen outside airport offices about 400 yards (meters) from the terminal where the protesters are camped out.

Dozens more police armed with assault rifles were deployed on the main road to the airport. Police set up barricades and at least one black police truck and several fire trucks were parked in the area.

Good point. While we're at it, let's bring back Thaksin and make him PM again. Then he can sell what ever is left to Singapore and make billions of THB in the process. I think Myanmar would be a good place for him. He would fit in well with those dictators.


Except that Thaksin was elected -- twice. In Myanmar, the military refused to allow the elected government to take office. Seeing as how the PAD is trying to overthrow an elected government and has openly encouraged a coup, it seems it has more in common with the Myanmar junta. As for Thaksin's private business dealings, the only thing that's ever been questioned was whether or not he paid taxes on the Shincorp deal. It was his company and not a public utility after all, so who he chose to sell to was his concern and not the Thai government's.

Married2Pisita - No, I haven't done the CRBA yet. One of the requirements is for me to prove I've lived in the States for at least 3 years since the age of 14. Being I've lived outside the U.S. for over a decade, this isn't easy. But, I have some paperwork coming from the States, and when that arrives I'll make the appointment for the CRBA (hopefully December or January). Thank you for your input!

Ummm...that might be a problem.

I worked in Iraq (U.S. Department of State contractor), then in Afghanistan (U.S. Department of Defense contractor) since 2005, with a short break between those two jobs. So, for the past few years I used my parents address as my home of record (it's on my tax returns, driver's license, etc). Can I just use their address for this visa process?

Thanks for the tip about having the paperwork sent to someone in the U.S. and then have them forward the information to me in Thailand.

Thanks again Ryan. I guess while filing directly is faster, filing via the Chicago lockbox would be faster in my case because of the 5-month wait before being able to direct file. However, if it takes some time to get the packet together, what should my cut-off time be? In other words, if it takes me 2 months to get everything needed, would it be best to wait another 3 months and file directly? Another way of asking that is how much faster is the direct file route?

While I've been traveling to Thailand for a long time with extended stays on tourist visas each time, I've only recently begun living here on a non-immigrant O visa. Based on what you wrote, I will have to wait 6 months from the start of my non-immigrant O visa start-date to be able to direct file with the consulate in Bangkok, correct?

Why would my wife being granted a tourist visa be "next to nil?" Not saying you're wrong...just curious why the government would deny a simple tourist visa to a spouse of a citizen.

I gather my best option is to direct file as soon as I'm eligible to do so and just wait, correct? Or should I forego the 5-month wait that would entail and file in the U.S., but while living here?

I'm a U.S. citizen living in Thailand with my Thai wife and our son, who's 3-weeks old. I'd like to return to the U.S. on October 1, 2012 with my wife and son. I don't work (am a full-time college student and will graduate in about 10 months), and I will have a co-petitioner for my wife's CR-1 visa in order to meet the monetary requirements.

I have a few questions I'm hoping some of you all with more experience in these matters can assist me with.
1. Is there enough time between now and October 1st to secure a CR-1 visa for my wife?
2. Is there any reason why a CR-1 visa would not be issued to my wife?
3. If the answer to #1 is "no," how long would it take to secure her a tourist visa so I can at least take her and my son back to the States so my family could meet them?
4. If the answer to #1 is "yes," is it possible for me to file for the visa being that I am not a resident of the United States? In other words, would I have to move back to the States before I can file for a CR-1 visa for my wife?

I'm sure I'll have more questions throughout my visa journey, but getting answers to the above questions would provide me with a place to start.

My name is Nuch. My Fiance is an American and I am Thai. Anyway, we are still waiting for Noa1 hard copy too. My fiance sent the K1 application on Nov 26,2008 and now we still don't receive the Noa 1 hard copy yet. The USCIS already cashed our check on Dec 1,2008. Otherwise, we are able to check our case online because we found the receipt number at our online bank account. If you send your personal check , you should be able to have the receipt number at your bank account and then find the 13 number which is included 3 english alphbet on front. Once we checked our case at USCIS.gov , there said they received and mail the notice on Dec1,2008. But I don't think sent it yet or it might lost somewhere.... Yesturday,My Fiance also called the USCIS to ask them to send us the hard copy , they said we have to wait for 30 days (counting from the day that receive the document) and then call them again. They said they can't do anything if it is not after 30 days. My fiance will call again on Jan 2,2009. If I have any update, I will let you know.

When The NVC received your DS 230 forms .Usually they will review your document about month .Then the NVC will send your case's document to your local consulate.For my case ..for Tranfering is so fast .Once the consulate recieved your case ..they may used about 10 - 12 weeks for scheduling your apppontment date for interview. Ao.! Once the date that they do scheduling your interview ..they will send you the packet 4 in same day.

For your question .. you get answer already .

#1.For one thing, unless you will continue working for the same employer when you return to the USA, your income earned overseas is meaningless. It's the the job you will have in the USA that will be the basis for your sponsorship. So you should have been filing US income tax returns while you were overseas unless your income was below the minimum requiring a return.

#2. I agree with your wife.. the staff at consulate dose not asking your son.. but both of you must preparing son's document carfully.

#3. It depends on whether you want to use one or both of your parents as Household Members, in which case you and they execute I-864As, or you want to use one of them as a Joint Sponsor, in which case the lucky one executes their own I-864.
( My husband ..give his parent join for Sponsor too )

#4. Mmm .. Did your wife and you processing her Visa with USCIS Thailand ? About my case my husband he did for me at USA .So when I 129 F was apporved about month after.I had got the packet 3 from Us Embassy Thailand too but we dose not send back to embassy. We waited for DS-230 part I fromNVC and sent back to the NVC, along with I-864, and it take about months .The Nvc sent my case's document to the consulate. Then the consulate will send me Packet 4 ( Apponitment letter ).
Ok.. If you send your document and checklist the consulate will set your interview date about 10 - 12 weeks.After you have getiing the interview ..foe immigrant visa ..you will get in the next office day.

I am the US citizen. There is a chance I will be unemployed at the time I send in the form and paperwork to lift conditions on my wife's green card and go from 2 to 10 year. I don't see any request to verify employment again and support as I did to get the 2 year card, but do people typically send in something proving they are still employed along with the proof of an ongoing relationship? Do they ask about this and if we are interviewed will they ask and could it jeopardize her chances to get the new green card approval?

She is a few months away from being able to apply for the 10 year green card. After she gets that what would happen if we divorced? Would she have to leave the country immediately? If they say they want evidence then they want evidence. Someone, anyone who can verify your story and that you entered this country with legitimate intentions of marriage is what you need. It sounds like without that you may be facing deportation.

Marina-Del I have a similar situation as I used my sister's home address for tax purposes but live at another address. The reason is I live in an apartment and didn't want any correspondence from the IRS to get lost because while I was looking for work we were moving around a lot.

I did get an RFE as my signature indicates but I don't think it was because of the address difference as this wasn't mentioned. I just submitted more evidence including the tax returns and didn't mention the discrepancy. I don't know if I should have or not but I have been sweating this a lot the past few days however I prefer to address this particular thing if the USCIS mentions it and not otherwise.

I did not get mine notarized it would have been very difficult to get the six different people to a notary. It was hard enough to find time to meet and get them to sign. However I am still awaiting their reply so it remains to be seen if speed of replying trumps authenticity of the documents.

I recently replied to an RFE. I have read if you are going to have an interview often an RFE is an intermediary step. At the moment I am between jobs. If I did have an interview and they asked about my job and I answered I am between jobs would this somehow invalidate the affidavit of support? I am NOT planning on lying but if it was a potential red flag and if I did get an interview I would scramble to get a job any job before the interview occurred. However if it is not a red flag I will continue my search for an optimal new job.

In my original I-751 submission I did not include affidavits as I heard they were weak evidence. In a reply to an RFE I submitted them and our case was approved. I'm not saying they can stand alone but they can tip the scales in your favor.
