K-1 Fiance(e) Visa Process & ProceduresUnemployed filing I-134
Good news on top of bad. My fiance's NAO2 came through this week. kicking.gif I was recently laid off, I am currently looking for a job. If I find one how will I properly file my I-134 Affidavit of support. this is what I know so far from other's here that I'll need. 1. 3 years of tax returns, 2. 1 year history from my bank, 3. I-134 form, 4. letter from my new job showing I'm employed.

What else should I include. Perhaps a letter from old job, and pay-stubs showing year to date laid off from them?? Any help on this would be greatly appreciaited.

Thank you in advance,

K-1 Fiance(e) Visa Process & ProceduresImmigration process after NAO2 received
If anyone has recently gone through the Visa process with a Filipina doing the paperwork themselves
Do you know if after the NAO2 is received, is there anything else you do here in America other than
collect all your information for the I-134 Affidavit of support ?

This is the confusing part due to conflicting stories by other's, and different requirements for different
people so the flow chart is just a general description not written in stone for all applicants.

1. Do we get a packet # 3 to do or not.

2. Do we mail off our I-134 Affidavit of support to someone in America, or is that only used at the interview.

3. Does she get documents in her mail to fill out to send in now.

Thank you for any help I can get at this stage in the game.

Hey does someone what to comment i heard from a Customer Service Worker at the USCIS.

She said "The USCIS has a system that works! Trust them it works and they have many Happy Customers".

I cant believe they say that because it is large government corporation of 17,000 people that have wasted money without updating there processes to make the process of immigration FASTER. Everyone knows that your User Fees it used to fund the USCIS. Your User Fees that have increased dramatically the past years will be used to update the system that other people with benefit from in the future.

I personally cant fathom a HAPPY CUSTOMER of the USCIS. Maybe a relieve customer that is glad the IMMIGRATION POLICE is finally stop dragging there feet and allowed them to bring there fiance to the US. GIVE ME A BREAK USCIS. I think an appropriate think for the USCIS to do is remove the S from the title of this department since SERVICE is not what they do!

Please comment.

I personally believe that the system is slow for a reason, if cases were approved overnight than everyone and there dog would do it. The length of time makes people really think about if this is what they want before they invest lots of time and money into the process.

If the USCIS actually had time managment problems then the processing times would increase over the years as the backlog became bigger and bigger (ie. fewer applications being processed daily than received). Instead the processing time holds steady which tells me the goverment wants it to take that long.

I absolutly agree that the though the system is slow it does allow time to reflect on your decision to marry thie alien fiance(e) Bringing a foreigner into this country is a big deal and should not be taken lightly. It pains me to have wait to be wish my fiancee but, but like the increased security at the airports, that wait may be a good idea to allow for reflection and enhance security. This allows us all an opportunity to also protect our fine country and way of life.

1) "Make the check or money order payable to U.S. Department of Homeland Security," http://www.uscis.gov...I-129Finstr.pdf

3) Question 18 does not need to be a novel, just the facts, in our case "Met on line Date, met in person Date, engaged Date."

4) 1 FOUR page G-235A form from Petitioner and 1 FOUR page G-325A from beneficiary, NOT 4 copies of page one of the form. You fill in page one of the PDF and print out all 4 pages of the form, each page is different from the others.

Look in the bottom of the page, each one of the 4 pages says to who it belongs. They all require the same data, but each is going to a different place.

Ok everyone. I think no one want to bring a "terrorist wife" or "terrorist husband" to the United States. In am grateful for the government protecting me, Well that is the primary job of the government to protect its citizens foreign and domestic from harm of anther country or enemy of the state.

I am not one to bash the government but the department of immigration has been under a lot of scrutiny lately by the Government itself. I love the the United States and would die to save the lives of my family and country men. I have served my country and proud to be an American. We have many enemies i know because i sat across enemy lines waiting for something to happen many nights to protect the freedom of the citizens of the United States. There is no better country to live in. With this said no bashing the government just the USCIS.

The USCIS have some wall of secrecy and does not processes petitions not in the order they say which is the "ORDER WE RECEIVE THEM IN". They cannot tell you where they are at on the screening of petitions and where you are at in that process. Visajourney has a system that will estimated time that your k1, K3 or other related from will be adjudicated. If Visajourney.com can supply this information, why couldn't the USCIS do something like this?

They have no technology (ie online submitted form) that would eliminate or help eliminate making mistakes. Actually the forms on the website that are downloaded could not be filled out without the aid of Visajourney.com examples. I could not find adequate instructions of one form (I-325). Thank God for Visajourney.com

I am not angry at the USCIS but I feel that since they are the only way to immigrate to the US they feel they do not have to REPORT to anyone. I think the word DISAPPOINTED is more appropriate. Understand they call us customers. If im a customer and had to wait 6 or 8 months for a simple form to be reviewed I WOULD WANT MY MONEY BACK but they have no competition and only report to the US Department of Homeland Security.

I hope since the President was a son of an immigrant to the US that he would mandate changes to help families that want to come together using the immigration process do so in a more EFFICIENT and OPEN manner. Bring down that wall of secrecy and let us see where we are in the process and estimate how long we have to wait and show us that the USCIS is working for its so call CUSTOMERS. I would love to see the USCIS be a well managed organization that works for the citizens of the United States.

GOD BLESS THE USA!

Hey this is good because i want to hear good and bad comments.

I agree with the comment about the time line being the same throughout the years. I also think the government want to take so time to completely make a decision but we should also have the accelerated or preferred charge like business have when filling the I129 for an employee. Actually now the time line seems to be less after the large 2007 influx.

I am truly happy for the happy customers but being the United States has automated its IRS system and social security system, i feel they should do more to reduce the paperwork in the immigration process and have on-line application processing and at least payment by Credit card.

Now i still think there i much to be said about the process and basically no technology except a web page that really shows no changes until someone actually looks at your case.

Keep Commenting or vent

K-1 Fiance(e) Visa Process & ProceduresNSF handling for K-1 Petition
QUOTE (jawi876 @ Feb 12 2009, 05:51 PM) <{POST_SNAPBACK}>
Hi everyone!

I posted a few weeks ago about my K-1 fee being returned by my bank as NSF (long story about my job not paying me for Short term disability). Well, I was waiting for the case to be returned. Instead, I got an email update that stated that my petition had been placed in a suspended status, and a letter with detailed information was mailed on Feb 12th. I called USCIS, and spoke to a Customer Service rep that told me how to resolve the issue before the letter arrived.

I called the Burlington Finance Center (BFC) at 866-233-1915, and the rep took a credit card payment for a total of $485 (I-129f $455 fee and NSF fee $30). This center does not have case status info, and cannot correct an error of sending the wrong amount for the fee. Nor will they process a refund request. They only resolve things such as NSFs or payments that will not clear for whatever reason.

All this to say, that the days of old when they rejected the entire petition for NSF are no longer. You also have 14 days from the date of the invoice to remit the payment. If you cannot resolve it in that timeframe, they will send the entire petition back and void any case status info.

I hope this helps someone.

glad it wasn't a hassle jawi and thanks for the info..

K-1 Fiance(e) Visa Process & ProceduresEmail vs Mail for NOA1/NOA2
I see many people posting that they received an email notification when NOA2 was approved. Does anyone get email notifications of NOA1?

If not, then I'll quit checking my email every 5 minutes and just check my bank account for the check image.

Regarding the NOA2, do you automatically get an email if you put down your email address? Or is there something extra you need to do?

If he has a digital camera, I recommend him having a friend take his pic against a white/off-white background & emailing it to you.

You can use http://www.portraitbooth.com/ to upload the photo and crop it to fit the requirements. I did this for my SO's passport photos, and also for my aunt who just renewed her passport. It worked well since you can print 6 of these on one 4x6 photo at a drugstore for about 20 cents, instead of paying $7.99 for TWO passport photos. I feel that is the biggest rip off out there, but anyway...

I've twice taken photos with a digital camera for people and they tried to submit them for their passports. One went through fine. For the other, they said the background looked too gray. K-1 Fiance(e) Visa Process & ProceduresMarriage-based Green Cards
Hmm. Some of you seemed to take away something different from the article than I did (which is natural, of course).

I didn't find the author to focus on how great America is. Nor did he even say that most people are itching to come here. He even stated that he knows several couples personally (family/friends) who've married people from other countries.

I took the following messages from the article:

  • USCIS doesn't have the resources to perform thorough investigations.
  • Local offices that can interview both parties would be better equipped to spot fraudulent relationships.
  • It is the fraudulent relationships that cause the long wait times for real relationships.
  • Almost anyone, including terrorists, who wants to move to the USA via a marriage-based visa can find a way.
  • There are several different methods people can use to get over here via a marriage-based visa, with examples of each method.

NatPatBenFemaleJamaica2009-02-19 14:08:00
K-1 Fiance(e) Visa Process & ProceduresMarriage-based Green Cards
I ran across this article about marriage-based visas and thought you might like it!

"Hello, I Love You, Won’t You Tell Me Your Name: Inside the Green Card Marriage Phenomenon"

http://www.ilw.com/a...8-seminara.shtm

I won't post the entire article here, but here are the key points:

* Marriage to an American citizen remains the most common path to U.S. residency and/or citizenship for foreign nationals, with more than 2.3 million foreign nationals gaining lawful permanent resident (LPR) status in this manner between 1998 and 2007.

* More than 25 percent of all green cards issued in 2007 were to the spouses of American citizens. In 2006 and 2007 there were nearly twice as many green cards issued to the spouses of American citizens than were issued for all employment-based immigration categories combined. The number of foreign nationals obtaining green cards based on marriage to an American has more than doubled since 1985, and has quintupled since 1970.

* Despite these statistics, marriage fraud for the purpose of immigration gets very little notice or debate in the public arena and the State Department and Department of Homeland Security have nowhere near the resources needed to combat the problem. Attention to fraud is not just for the integrity of the legal immigration system, but also for security reasons. If small-time con artists and Third-World gold-diggers can obtain green cards with so little resistance, then surely terrorists can do (and have done) the same.

* An overwhelming percentage of all petitions to bring foreign spouses or fiancés to the United States illegally (or to help them adjust visa status if they are already in the United States on non-immigrant visas) are approved — even in cases where the couple may only have met over the Internet, and may not even share a common language.

* Marriage to an American is the clearest pathway to citizenship for an illegal alien. A substantial number of illegal aliens ordered removed (many of whom have criminal records) later resurface as marriage-based green card applicants. Waivers granted to those marrying U.S. citizens can eliminate ineligibilities for green cards, including the 3/10-year bar on entry for those with long periods of illegal presence.

Now would be a good time, or next week after you file your 2008 taxes.

Do I understand that Affidavit of support does not need to be sent with the filing of the Fiance Visa I 129F?
Thanks!

You do not file I-134 with the I-129F. You give it to your Fiancee in advance of the Interview. Your Fiancee will take it to the Interview. Do not sign it until you're in front of a Notary. The signature should be notarized. However, you will hear of others here that did not have it notarized. I notarized mine and Fernanda had no problems at the Consulate.

I should have been concerned earlier as other people were getting my mail they sent me, like christmas cards, as undeliverable return to sender. why? who the hell knows! i have an idiot for a postman!! i have called the USPS and as you might guess they were worthless.

un*******believeable.

so where does this leave me? i could have the USCIS do a search to see if they had it returned to them as well. it would take 30 days and who knows if anything would turn up. sounds like a total waste of time to me. putting the package back together is no big deal, except for the original signatures from cathy. UGHHHHHHHHHHHHHH talk about a downer. she is going to be bummed. IDIOTS!!!!!

again i am reminded that 90% of people who say they know what they are doing dont or market themselves as experts arent. mediocrity is excellence for the mediocre.

Hi
Well you forgot to sign the check
we mailed the check with an amount that USCIS gave us through the phone
it was wrong $10 to much
they returned the whole package stating wrong amount
we had to do it all over again and lost 1 month
to top it off
after this our NOA1 never got to us, no one knows where it be
so we lost 3 months before we where able to get a NOA1 for our 129F
eventually we got them to issue us a copy, not an original
oh yeah we lost 3 months here because every time we called you case could still be in process, call in 1 month after we waithe 1 month for a NOA1 approval

GOOD LUCK WELCOME TO THE USCIS

When cases are updated or approved, it take a while for it to show on USCIS or for you to receive an e-mail update. We barely received an e-mail on January 22nd about our case for something that was done on January 15th. It takes about a week to show up on USCIS or on your e-mail. In our case, we received notification on e-mail & it posted on USCIS on the same day which was a week after they had originally sent everything. Just be patient. Your approval will come. wink.gif
