K-1 Fiance(e) Visa Process & Procedures2 NOA1s?
QUOTE (rsn @ Mar 23 2009, 10:43 PM) <{POST_SNAPBACK}>
Due to some unfortunate circumstances that led to the post office returning my initial NOA1 to USCIS, they mailed me out a replacement notice. Then, about a week later, for some reason, they mailed me out yet another replacement notice. The "notice date" on the top is different for each of those. It looks like we are expected to use that date as the receipt date in our timeline. So two questions:

  1. Why do the 2 receipts have different dates? (According to VJ, this is supposed to be the date when they enter your petition into the system and begin processing, so why would this happen twice?)
  2. Which date do I use on my timeline?

I recommend registering at USCIS & seeing what date is on their website.

Based on timeline data, your I129f may be adjudicated between June 25, 2009 and July 16, 2009*.

Perhaps the OP was going by the times he saw other people getting approved. I also believe (hope, pray) that I'll be approved a 4-6 weeks ahead of the VJ estimate.

3. rofl.gif Wow! I wish I could forget all that! Can you come close? I was reading somewhere that it can be helpful to have a letter from your family members supporting and acknowledging your relationship.

Is there perhaps a sample letter for this? If not, what specific information should such a letter include?

Thanks in advance for any information or ideas.

I had both my parents write a letter of intent as well. My friend who is also an immigration attorney thought it would be a good idea because of 2 reasons. 1st I have known my fiance for less than 1 year and 2nd because we have no idea when we will receive the visa we don't have any concrete wedding plans yet. The letters were very simple. They stated their knowledge of our future marriage. We had them notarized as well. I would say to go ahead and do it because it wouldn't hurt.
Good luck.

An immigration attorney recommended this to someone I know, so I had a friend and a family member write letters indicating that they have witnessed our relationship. In retrospect, I'd have saved them for the interview instead of sending them with the I-129F...

Then we have 90 days to file for AOS so she can get her 2 year GC, correct? What if I do not do this within 90 days? It seems people can do this after 90 days and there is no penalty

Then how long do we have to wait to remove conditions so she can get her 10 year GC?

From what I understand, you want to file for AOS right after getting married, before the first 90 days is up.

He can go to his doctor and get his medical records and get any of these that he hasnt done yet. then bring his medical records to his medical exam in Naples. This is what my fiance did and she didnt require anymore vaccinations when she got there.

Good luck to you and your fiance...in bocca al lupo...

My fiance also got his vaccines in advance. That way, when he has the medical (in another city), it can go quicker as he'll already have the vaccinations required. Also, it's often cheaper to get them on your own than at the approved medical places for the official medical exam.

As you can see on Igor's list, there is a gap around January 14, and another one around January 22. My guess is that people who file around the same date end up in one box, and that these two boxes each are on an adjudicator's desk who is a bit behind in his or her work, maybe working on other stuff, who knows. I won't get worried until the other January 14 filers get approved and we aren't. As long as most others with the same NOA1 date aren't approved, I will assume we just have to wait for our box to be processed... Just a theory, though.

We have the same theory for some late December filers... that we're all in the same, abandoned, box.

Someone correct me if I am wrong, but I think if anything, your top secret clearance is going to make this process longer? Because your name will already be in the systems? I could be wrong though!

When I applied for the CIA several years ago, having a wife that was a non-US citizen was a deal-breaker. I had the background - Military Service, Speak 4 Languages fluently, & International MBA from Duke. They were ecstatic about my application until the moment they found out about my wife. They dropped me like a penny off the Empire State Building.

I don't know for which agency you are working. However, my guess is that once they find out about it, you are likely to run into a truckload of bureaucratic chicken S*%& on this one.

Just last year they passed a new regulation stating that you can get a waiver for foreign national spouse for clearances. Spouse no longer has to be a USC. So you might want to check into that and see if you can get a waiver this time. :-)

K1's usually go faster than a K3/CR1. Also, since you just met, I think doing the K1 would be the better option because then you have the option of changing your mind in case it doesn't work out between now and then. I think K1 is your best option. Lately K3 is not any quicker than the CR1 and it just causes more paperwork and headache, so if you get married first, don't bother with the K3 unless you have other reasons use it. Read the guides and they will explain everything. :-)

K-1 Fiance(e) Visa Process & Procedureshow to best use the 90 days prior to marriage k-1
QUOTE (Seattle2Cebu @ Oct 23 2007, 06:41 PM) <{POST_SNAPBACK}>
the rule is that a couple has to get married within 90 days. This is just a suggestion, but it
is based on experience. You could possibly save yourself a lot of grief and $$$ if you
will step out of your emotions and observe your fiance during this time. You can set the
wedding date towards the end of 90 days. Allow yourself to be a third party observer
looking in. Be alert to red flags and possible issues. Address any issues that arise. You
can end up deeply regretting it, if you choose to overlook problems and just hope
they will resolve themselves. There is a whole lot more to living as a couple than emotion
and feelings of love which can be exaggerated from a long distance relationship. Your
fiance may not express her/his concerns to you in an open direct way. The USA is a
big big dream for many immigrants and some will say anything and do anything to
be here. Dont think that you are immune to being taken advantage of. This is not to say
you live under a cloud of suspicion and doubt. Of course few people would take this
advice, because "they know" their relationship will make it. Dont be afraid to ask
hard questions and even seek pre-marital counseling prior to being married. Most of
all trust your gut. All of us have that little still voice or tug at our spirit that warns of
upcoming disaster, take a long long time to think about it before you get married.
There is nothing wrong with putting a key-logger program on your computer and monitoring
your beneficiaries email for a month. Find out what they are saying to people back home.
a little invasion of privacy is way better than having your life blown apart later, not to
mention the emotional devastation..

hopefully this will be rcvd in the spirit it is given..

thanks

Maybe you should have spent more time getting to know her before you filed for the K1 Visa! Key-loggers, pre-nups, looking for red-flags! There is no substitute for being under the same roof, sleeping in the same bed, using the same bathroom, spending money from the same account and trying to share lives that were once 2 seperate people. It brings out our best and our worst. But if you have gone through this long K1 Visa process and have impersonated loving her, yet you don't even know her well enough to trust her, that should make both of you do some serious soul searching. Talk about a red flag!

Thanks for the replies. I had already assumed I was dreaming, but figured I'd throw our ideal plan out there anyway. At the least, it should have provided a few laughs at my noobieness. I briefly read the guides and would consider myself somewhat intelligent, but I felt like my head was spinning and I couldn't figure it out what would suit us best.

One thing is most important to us, but now I wonder how possible it is and that is that we don't want to be apart after the wedding. I know that we don't want to be married on paper right now since that seems very premature. So I guess that would rule out the CR1 and K3 routes. It seems that the K1 route may be best, but that would limit us to getting married in the US.

What K-1 folks often do is have a simple courthouse wedding in the US to satisfy the terms of the K-1 visa and then have their large family wedding back home after gettind advanced parole or the conditional green card. I did this myself. My husband and I returned on Sunday from our wedding trip.

Come check out the Canada forums. There's a thread for everyone planning their formal wedding ceremonies.

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa
It's perfectly fine to have your legal marriage at the courthouse in the US and have a second ceremony for friends and family when you've had more time to plan the wedding you want. Lots of K-1 couples do that. There's no reason at all why you can't have a ceremony that is not legally binding and then come to the US and head down to the courthouse.

The trick would be finding an officiant willing to do that. They may be uncomfortable participating in what appears to be a legal marriage when the couple is not married. If the couple is legally married first, it's just a vow renewal and most officiants have no problem with that.

Remember that the CO's look at these things every day and SHOULD have a sense of what chat logs look like with and without voice and camera. So don't overly stress about it. These logs are only part of the evidence that you will be submitting. Looking at everything in total does it seem to be enough?

Chat logs, etc, aren't primary evidence, but they can be a difference maker depending on the specifics of your situation. My thoughts are/were to give them all that I could to evaluate rather than submit a smattering.

Okay, we're not at the interview stage yet, but I have a lot of things ready to show on-going proof of our relationship. I save everything. The things I have saved so far are phone bills, photos of my fiance & I, photos with friends & family, flight itineraries, flight tickets, passport stamps, letters, e-mails, cards, train tickets, movie tickets, you name it..... well anyway among all these things I have saved, I wanted to ask you about our chat logs. See, we don't really chat on-line as we use voice/video chat all the time. I went ahead & took screen shots of our call logs on Skype. It shows the dates, times, and duration of all the calls we have ever made on there. I went ahead and took multiple screen shots of the call history log. Is this enough, or do they only accept chat logs where they can see actual words that we were typing? I think this should be just fine, but I just want to make sure so we can be on the safe side. Your help would be GREATLY appreciated! smile.gif Thanks! God bless! smile.gif

If you are filing the petition then you need to send proof of having met in the past 2 years so the itenaries, tickets and photos are alright. Proof of ongoing relationship will be required at the interview stage.

That is correct. Save most if not all for later at the interview but the only way to use MSN or Yahoo logs as evidence is to print screen and paste into Word etc. This preserves the formating. Copy and pasting text cannot be distiguished from simply typing up fake logs.

You can never tell what will be "enough". We included some examples of our written conversations but neither of us speaks the language of the other fluently, so those were a necessary part of our relationship and our evidence. I also took half a dozen screen shots while were were conversing on the webcam. Most included additional family members in the shots, such as holidays or other times the conversations included others.
