When we did this in 2006, we decided to get 3 copies. Never know what you may need them for in the future. So since we were in Brazil, we got 3 certified copies. In reality, you probably need only 1 certified copy. In most cases, you send a copy of the certified copy and that will suffice. We have never been asked to produce anything other than the copy.

Why don't you have a simple wedding in the winter with your chosen US priest. You could bring a couple of friends for witnesses. Then you could do a vow renewal ceremony later on with your friends and family. If you plan to do that outside of the US, it'll have to be the first spring after you've completed adjusting status (or gotten an advanced parole document).

My husband really wanted to be married in Bermuda since visiting me there was a source of comfort during a turbulent time of his life. I really wanted to be able to stay with him after marriage rather than go back to Bermuda for a year. We compromised by getting the K-1, having a courthouse wedding in the US then having a vow renewal in Bermuda once I was able to travel. Regardless of what anyone else thinks about our choices, it made us happy. That's really all that's important here.

Ignore all this talk of "real" verses "fake" weddings. Do what makes you happiest within the confines of US immigration law.

The trick is to get them to escalate you to an immigration officer. I told them that a friend of mine's paperwork had gotten lost and I was worried that mine was lost too. Then I'd ask to get escalated to someone who had access to the most recent status on my case. It worked for me but I only tried it that one time.

Gary is correct. I know many Canadians and Bermudians who own vacation homes in the US. Putting her on your lease would not be breaking any rules.

Heck, Phil added me to his bank accounts and we got our marriage license while just on a visit. Those things didn't affect my visa application at all.

My husband and I went the K-1 visa route as it was the shortest legal way for me to be with him. I just wanted to let you know that it's totally possible for you to visit him while the K-1 is being processed. As a Canadian, you can visit for six months if you like.

As Krikit says, if you go with the K-1, you'll be required to stay in the US from when you activate the visa until you get an Advanced Parole document or your green card.

Also, come has out in the Canadian forum below to get some specific advice on moving from Canada to the US.

It'd be a shame to go through the expense of the visa and then the plane ticket, only to be refused at the entry point.

It is not possible for me to explain how we know we are right for each other in a way you'll understand, you can only trust me on that. Although I'm kinda surprised you didn't know you were going to marry your girl during all of your communications, until after you met in person. You really didn't know? And BTW, if she were actually a different person than her pictures, phone calls to me, emails, and forthcoming videos reveal, then I wouldn't marry her, plain and simple. Dont feel bad though..i think any one of us would want to be with our loved one sooner if there was a way to do it without stepping outside the law. You didnt know and thats why you asked. K 1 actually seems to be the quickest route [ from what i know of others cases ] for example, i know a guy the married a girl while he was working in Costa Rica. They had a child [ born there with dual citizenship/ US passport ] and they still got denied for the K-3. He finally got her here on a B-2 and they are adjusting her status. Another guy married his girl while she was here visiting [ like what you were asking about ] and she had to go back after her visitor visa expired...they have been apart a year now. Do your research and find the best way for you. Good Luck
BTW -it is a good idea to go meet her- pictures, phone calls and emails are one thing but there is no substitute for looking into someone's eyes

Things like airline boarding passes and stamped visas in your passport are good primary evidence, but they aren't enough. They only show you've been to your fiance's country. Pictures aren't the only kind of evidence to show you've physically met, but they do help a lot. Other kinds of evidence that might work in lieu of photos is any kind of document that has both of your names on it, such as a hotel receipt. You and your fiance need to dig through everything you've got and try to come up with something that is compelling. Put yourself in the position of a USCIS adjudicator - what would convince YOU? Remember that USCIS adjudicators see fake evidence all the time, so your evidence should be pretty persuasive.

Video generally cannot be recovered once it's recorded over, and security camera video is almost never clear enough to use as this sort of evidence. You'd also have to get a hardcopy print from the video because USCIS doesn't accept any electronic media. I don't think the security camera video is going to be a viable option for you.

EDIT: As I'm writing this, I saw your other post that you haven't been to his country. No prob! His boarding passes, visa stamps, letter of good conduct, and ID card are all good primary evidence. Now you just need secondary evidence to prove you actually met while he was here.

If he didn't overstay his K1, and surrendered his I-94 on departure, and can demonstrate strong ties to his country, then his chances are as good as anyone elses. His brother "sponsoring" him, as you suggested, is pointless. He has to demonstrate that NOT returning at the end of his visit would be a major problem for him. Having a good job, owning property, having responsibilities he can't easily walk away from, etc.


I agree with what he said [ good input ] you may need to bite the bullet and go visit him- you need photos of you and he together. plain and simple - all the other stuff is good [ boarding passes, passport stamps, hotel bills ] but photos of you two together or you and his family, show more about the relationship. if you read examples of what they look for, you will see that. good luck

Well here i am again waiting. We made it thru various stages-NOA2, NVC etc and now we already did the packet 3- returned it the next day. Im wondering if anyone can give me some insight cuz i am getting different answers when i call the embassy in Trinidad. 1st of all, we have everything ready- all the documents are in order- we are just waiting for the medical exam and her interview. Well, i called the embassy there today and asked when we might get packet 4 and about the medical appt. I was told that packet 4 is generated only once a month, on the 25th and we luckily returned packet 3 on the 25th of June so there is nothing we can do but wait til after July25th, as that is when packet 4 would be done. if we had returned if just a day later we would have had to wait til Aug 25th because it wouldnt go into the system until July 25th. i asked if we could proceed with the medical while we wait and was told no, we had to wait til July 25th to do that. the info regarding the medical exam was supposed to be in packet 3 and it wasnt. now its in packet 4. i get the feeling they are flying by the seat of their pants so to speak. there are times i call , speak to different people and get different answers. i hate being at the mercy of people that act [ over the phone ] like they dont really know what they are doing. at this rate, we will not get our interview until Aug or Sept. i just didnt think it took that long after the case got to the consulate. anyone have experience with this emabssy or another that they would like to share?

Not to deny anything that has been said by others so far, which is all essentially correct information.

I did just think it worth pointing out one fact that may be of relevance here.

JimVaPhuong put it very aptly that your legal status in the US is under your I-94, valid for 90 days from entry. And that you must leave when those 90 days are up.
However, the requirement from the US perspective is that you leave the United States. Not necessarily that you "go home". There may be a difference,
and it may be relevant to you.

The flag on your profile is Australia. I don't know if that's "home" for you, but on the likely assumption that it is, and you are an Australian citizen, then you can leave the United States by going to another country rather than returning immediately to Australia. For example, you could travel to Canada, thereby legally complying with the need to exit the US within 90 days. Bearing an Australian passport, Canada should admit you legally as a tourist. After spending some time there (as little or as long as you like, subject to your Canadian admission - potentially a day or two , even an hour would suffice, or more), you could then legally re-enter the United States as a tourist on your Australian passport. You don't require a visa to do this.

Does this buy you anything? Perhaps, perhaps not.

You wrote that you want to "stay in the states". If you mean permanently - then no, this won't help.
However, if you mean "temporarily", like to take care of some unfinished tasks, or other reasons, then you could potentially do this legally as a way to extend your stay in the US a bit longer. Your US re-entry would be on a VWP (as an Australian) and likely valid for an additional 90 days. You cannot work during that time, but you would be in the country legally.

I did 2 k-1's. the first time i used a lawyer cuz i just didnt want to tackle all the paperwork alone and thought i couldnt do it by myself. it wasnt any quicker- in fact, it was expensive and i hated having to wait to hear back from the attorney. remember- you are not their only case. the next time [this time] im doing it on my own and and it seems quicker- you gotta wait no matter what, so get ready for that. its cheaper and i dont have to wait to hear from someone that doesnt have a personal/emotional interest/stake in getting my case done. just get all the paperwork and instructions and read everything SEVERAL times before filling them out. Check everything SEVERAL times before sending the case off and you should be fine. Good Luck!

been where u are my friend and the best thing i can tell you to do is to stay busy. concentrate on making money or preparing gifts or a surprise welcome party for your honey. anything to keep your mind off the waiting. my whole process took about the whole 6 months they said it would [ our interview appointment is in a week ] i thought i would go insane during the wait - especially for teh NOA2-but my girl told me we shud both stop worrying about it and the very next day the thing was in my mailbox! i admit i did do my share of griping- i contacted my senator and tried to find other ways behind the curtain of USCIS...all to no avail. things did move faster once the foreign consulate got the case but i think that depends on the country.... you have to wait...its just how you handle the wait that counts. stay busy and good luck!

we got the approved visa, i know we have 90 days to marry after she gets here and after we marry
we have to adjust her status, but what happens after that? i know i want to do whatever it takes so she can travel outside the USA [ delayed honeymoon ] and she will become a perm. resident with a green card. but im not clear on what happens after that. what do we file and when? how long before she can apply to be a citizen? [ i think we have to be married and living together for 3 to 5 years- again , not sure ] can anyone give me the skinny- quick info on what to file, when, etc etc. Thanks in advance.

i just happened upon this thread and wanted to throw in my two cents. this process is a mother %$#@@*&! when you love someone and want to be with that person pronto, it is the most frustrating thing to have to wait because of what someone else decides. To a certain degree-someone else is in control of your lovelife! the paperwork can be handled without a lawyer if you do your research and triple check it all before sending it in. i know becuz i've been thru the process twice- once with an attorney and the last time , i did it myself-thru research, past experience and the help of this site [ VJ ]. we got approved last month and it feels great. You can do it. But Dont expect to speak to anyone at USCIS though- you wont get much help there. the waiting is very VERY frustrating, so be ready for that. Now about the age thing- when i was 19 i was with someone and no one could tell me i wasnt going to spend the rest of my life with that person-then. today i know she lives in Vegas and thats about all i know. i say this to say, i [ and most on here ] are not judging your age or relationship- most of us have been there. But this [ K-1 ] process is a lesson in patience and waiting and thru time if your relationship is meant to be- it will be. Work on it becuz, believe me, you will have the time. [ if you are lucky a k-1 takes 6 months ] on the other hand, most relationships are tested over that period and if its not meant to be- you will have dodged a bullet. Bottom line- since you cant get a straight answer about filing age, just wait until you are 18 and then file and dont risk having to re-file if you are too young. and having enough income is a real issue. check the guidelines of being above the poverty line. You have to make enough to support him in the government's eyes.....Good Luck

I called the NVC and have gotten my case number, said they just recieved it on 8-10-2009. They say it takes 2-4 weeks to process? How much time does it really take to process usually?

Ok.. now that I have the case number what can I do?

Ok, What now? We have our noa2, I have all the copies of everything together ready to send my babeh.. I have the I-134, and all supporting docs... also everything she will require at the interview together to send. All I need is the NOA 2 in the mail and ill make a copy add it to my papers here, and package it together to send my babeh.

The steps to me right now are:

1. Prepare papers make copies of everything I have currently for my fiancee.
2. Recieve NOA 2 in mail, copy.. add to package and send off package.
3.
(ok thats all I got, I think its call NVC, get case number.. then call embassy every once in a while until they say they have it, then scedule interview, and then get the medical appointment, medical-interview-Visa.. and then she had to take some sort of seminar?? then she can come here?.... whew.. is that it.. lay it out for me.. please....

Oh and generally how long is it from this point until shes here in my arms? 2 months?

If the petitioner (My fiance) doesn't meet those requirements what is likely to happen? If she just falls short perhaps can she go through a co-sponser (Her parents etc)?

As for joint everything, well that was intended after the marriage bit. Like when you are living together after marriage etc. Its not expected to have joint things before marriage. Basically acting like married couples do who wanna share everything. If I'm not mistaken, there is a way to open bank accounts in US overseas, you could look into that for joint bank accounts, or simply just open one up there. Either way, I'm not well versed on stuff like that since I'm only engaged at this point.

Keep all the proof of a valid relationship as well. Also if I'm not mistaken, people applying for AOS (adjustment of status form K1/K3 for green card) have also used affidavits from people they know stating the genuine nature of the relationship etc. Things married couples use can range from joint tenancy leases, joint bank accounts, insurance, joint memberships, joint bills but in your case, since you're planning to relocate back to stateside, it will be abit tough and redundant to opne all those there.

My suggestion is contact embassy on requirements for DCF to expand your knowledge on the option and then try searching these boards for DCF topics, maybe some others can shed some light into it. As I know, it is the easiest(less paperwork) and fastest way to get to go stateside with you.

Hello! Thanks for the reply! I've been living in Japan for 10 months or so, so that shouldn't be a problem. When you say "resident" does that mean citizen? Because Japan does not allow dual-citizenship. I have a work visa that is valid for up to 3 years and an alien registration card that shows I can legally live in Japan for up to 5 years. Would that count as enough?

Also, if we get married here, I don't think 4 months or so is going to be enough time to set up joint bank accounts and such. I live alone and she still lives at home with her parents, so no living together as of now. I understand my situation is time pressing, so thank you for the replies.

Also, I've read through the guides and they're quite helpful.

Hello everyone, I currently am living in Japan and am employed by a Japanese company. I met a wonderful woman here who I am wanting to take back to the States with me. My contract at my present company expires in December.

I have a few concerns however. We both have plenty of documentation and proof that we have met and have every intention to marry once back in the States. But since I live abroad, how exactly can I pay the petitioners fee by check/money order? I still have a permanent residence in the US, and an open US Bank Account, so will I have to pay through that or is there some other method in which I can pay from Japan? I live close to Tokyo so getting to the US Embassy shouldn't be a problem.

Also, will living in the same country and city as my fiancee be beneficial in expediting our visa process? Since Japan is an industrialized country, there shouldn't be a need for any vaccinations I believe. I didn't have to get any when moving here.

The payment method is the only snag so far, but another concern arises in that I still don't have a job lined up for me when I return to the States. I have a good chance of acquiring one and I have plenty of assets I've saved while working in Japan. I have more than enough for several months of support.

Any help would be much appreciated, thank you!

We sent in the packet 3 on March 2nd, so they should have received it the next day. The page says it reflects only appointments scheduled by March 5th, so maybe they hadn't opened the packet yet (as her case number wasn't on the list).
