After receiving the package3 are there any other documents that my fiancée needs to send to the embassy, along with the checklist?
This is the list of the documents that we think we need to start gathering, but we don’t know which ones to send to the embassy. Or if we should keep all these documents for the interview takes place
We think that the documents we need to send right away as soon we receive Package 3 are:
The DS – 2001 FORM (CHECKLIST)
And the OF – 230 Part I and Part II, where can I get these forms? Should we replace them for the DS – 230 Part I and Part II instead?
Pictures: 2 x 2 inches
And keep these documents for the Interview:
- OF – 167
- Birth Certificate
- Medical exam
- DSL – 1083 // Police Certificates:
Certificado de Antecedentes Policiales – emitido por la Policía Nacional del Perú
Certificado de Antecedentes Penales – emitido por el Poder Judicial
Certificado de Antecedentes Judiciales a Nivel Nacional – emitido por la INPE
- Evidence of Support of Petitioner (Form I – 134) Where can I get the OF – 167 form from? Is it required to send it along with the Affidavit of Support form? Does the I – 134 needs to be notarized as the I – 864?
- I forgot about the Bank Statements!!
- 3 years of Income Tax Reports (needed according to Embassy)
- Divorce Decree
- DS – 156 and DS – 156K (unsigned)
What if one of the parts never got married? Is it required to look up for a Certificate of Freedom?
Do the civil beneficiary docs will be in Spanish need to be translated to English? Even though the Embassy is located where the official language is Spanish?
Also, is it true that the DS – 160 form is replacing the DS – 156 AND DS – 156K forms? So is the first one that we need to fill up instead?
Can we get an interview date before sending the checklist from package 3, I read on some cases where they had their interview date set before receiving package 3?
Everything seems pretty confusing from link to link. Is there anything else that we are missing? Anyone who had their interview at the US embassy in Peru? Please any advice helps.

You won't fill out the I-864 until you apply for adjustment of status for the beneficiary.

Maybe I am way over thinking this...but none of the options on part 1, question 1 of the I-864 seem to be fit for me. I am the petitioner, but i have not filled a I-130. Me and my fiance are going the I-129F route and we are at the step where they sent him a piece of paper with links online with checklists (package #3). One of the things they asked for was this, to have the petitioner (me, US citizen) fill it out. Here are the options they give:

  • Check box "a" if you are the petitioner who is filing or who has already filed Form I-130, Petition for Alien Relative;Form I-600, Petition to Classify Orphan as an Immediate Relative; or Form I-600A, Application for Advance Processing of Orphan Petition. If you are the petitioner, you must sponsor each intending immigrant.
    I am the petitioner, we are using the I-129F Finance visa. :blink:

  • Check box "b" if you are filing or have filed Form I-140,Immigrant Petition for Alien Worker, for your husband, wife,father, mother, child, adult son or daughter, brother, or sister.
    This doesnt apply to us either. We arent married, nor have we filed a I-140.

  • Check box "c" if you have an ownership interest of at least five percent in a business, corporation or other entity that filedor is filing a Form I-140 for your husband, wife, father,mother, child, adult son or daughter, brother, or sister.
    This does not apply to us.

  • Check box "d" if you are the only joint sponsor or box "e" if you are either of two joint sponsors. A joint sponsor must be a person, and may not be a corporation, organization, or other entity. A joint sponsor does not have to be related to the intending immigrant. Indicate whether you are the only joint sponsor or one of two joint sponsors. Check with the petitioning sponsor or the intending immigrant if you are not certain.
    I am the ONLY sponsor. We arent using joint, or co-sponsors. This doesnt apply to us either.

  • Check box "f" if you are the substitute sponsor. A substitute sponsor is a sponsor who is completing a Form I-864 on behalf of an intending immigrant whose original Form I-130petitioner has died after the Form I-130 was approved, but before the intending immigrant obtained permanent residence. The substitute sponsor must be related to the intending immigrant in one of the following ways: spouse,parent, mother-in-law, father-in-law, sibling, child (at least 18years of age), son, daughter, son-in-law, daughter-in-law,brother-in-law, sister-in-law, grandparent, grandchild or legal guardian. The substitute sponsor must also be a U.S. citizenor lawful permanent resident. If you are a substitute sponsor,you must sponsor each intending immigrant.
    I am the ONLY sponsor. We dont have a substitute. This doesnt apply to us either.

I had saved photos on my computer. I arranged the pictures in PowerPoint with the date and place underneath as a caption and printed them on photo paper. It looked nice and was really easy to do. I did 4 pictures all the same size to a page. Worked out fine. :star:

They will tell you then and there after they ask you all the questions and deal with your paperwork whether you are approved or not. They will then tell you that your passport will be mailed to you (if you passed), or either tell you that further information will be needed.

I agree. During our K-1 process I used my mom's home address, but I was staying there at the time. However after the K-1 was completed we will use the new address on the other forms for AOS. So just put his mothers address and it should be fine. And like you said, at least someone will be home to get the mail and give it to your fiance.

I don't get how there's a grey area here. If you have a ceremony and have it registered, you are married - and by that definition, a K1 visa is no longer an option for you.

Furthermore the OP will have to submit a marriage certificate with the AOS package. I dont think all the dates will jive if he chooses to get married before the K1 is approved. So even if they dont checked initially; it will be an issued later on. It is best NOT to let emotions get the better of you....

HELLO I GOT A LETTER YESTARDAY FROM THE NVC STATING THAT AN APPROVAL WAS SENT TO THEM FROM USCIS AND THAT THEY WILL FORWARD MY THINGS TO NIGERIA CONSULATE IN ONE WEEK AND THE NIGERA EMBASSY WILL SCHEDULE MY INTERVIEW. I APPLIED FOR 129F ON APRIL 12, 2010 IN THE VSC. I HAVE BEEN CHECKING THE USCIC WEB SITE ALL WEEK AND NO CHANGE IN THE USCIS. THE USCIS SITE STILL STATE IT RECEIVED MY APPLICATION AND IT IS IN THE REVIEWING PART. IT DOES NOT SAY ANYTHING ABOUT BEING APPROVED OR ANY CHANGE FROM APRIL 16 2010. SHOULD I TAKE THIS AS APPROVAL. IF SO HOW DO I START GETTING READY FOR THE INTERVIEW? WILL THE EMBASSY SEND ME AN EMAIL OR PACKAGE. OR SHOULD I JUST GATHER EVERYTHING I WILL NEED AND AWAIT FOR THEM TO TELL ME THE INTERVIEW DAY. However his service might be completed by the time you get to the interview stage. Either way a document that says "when" he will complete his service or a document that says he "has" completed it would be something useful to add.

I will try to phrase this delicately. You are asking if he can lie and get away with it. He has 3 children which are dependent on him and for which he supports or pays support. His family size, with you, is 5. Just because someone is not claimed on a tax return due to a court order or separation agreement and the tax code does not make them "not dependent". Claiming them on a tax return makes it impossible not to claim them on an I-134. He SHOULD claim all the children on the I-134, to do otherwise is fraudulent and falsifying material facts. That is all there is to it. You know it, I know it and he knows it. Being found to be falsifying material facts at any point makes you subject to visa denial or AOS denial, deportation and permanent ban from the US...plus possible criminal charges for your fiance. They do not deport US citizens, the put them in prison. The USCIS and the consulates are not the IRS and visa applications are not tax returns. It is a mistake to think that because something is listed one way on a tax return it would be listed the same for a visa application...it may be, but it also may not be. He is prevented from claiming them on his tax return because the IRS only allows ONE single person to claim an individual as dependent. That is tax code. Immigration rules require you disclose ALL people dependent on you.

That said, he CAN claim the child support he receives as income provided he has a court order and proof of payments, even though child support is not shown on his tax return.

Regarding your question on how someone could plan a wedding within that 90 day window, without knowing in advance when that 90 day window: I'd suggest getting married via justice of the peace during those 90 days, and planning your dream wedding.

We're getting married by a justice of the peace within the 90 days, then having a small reception for family/close friends. But a year later we're having the BIG celebration [in Jamaica]. That way, I have plenty of time to plan without worrying about that 90 days.

One piece of advice I'll add is to go to the regional forum and find out if there are any tips to expedite the time from when the embassy receives your case to when you have the interview.

For example, in my regional area, we've posted the forms in the packet you get from the embassy, so one can get started on those early, as some documents can take a while to obtain in Jamaica. We also found that since mail delivery is slow/unreliable, some of us have had luck by emailing the embassy a scanned copy of a signed DS-230pt1 before mailing them a hard copy, saving weeks in getting an interview date.

We prepared the letter of intent, but since I was there, I guess that was enough proof for them. They didn't ask for that letter (or for pictures). Of course, each embassy is different, but if you're at the interview, that's definitely evidence of intent.

I did a bit more research and found that this might vary by embassy. It is a requirement for the embassy in Jamaica. They won't even schedule your interview until you return the DS-230 pt1 signed.

Unless something changed during the past few months, a K1 applicant also completes the DS-230 pt1 and brings it to the interview (unless embassy requests in advance).

The embassy sends the letter after receiving your case from NVC.

Here are the tips I used months ago to track my packet from NVC to the embassy (which isn't necessary, but gives you something to do while waiting):

1) 2 days after NOA2, starting calling NVC: 603-334-0700 press 1 then 5.
2) Once NVC has your case, they assign a new case #. Ask them what date they sent your file to the embassy & also for the NVC case #.
3) Once you know the date NVC sent off the file, track it at DHL's website: http://track.dhl-usa...?nav=TrackByRef For the reference code, enter EXP 10 JUL 2009A (adjust using dates just before the date NVC told you), with a shipping range of that day to a few days later (July 13 - July 14 worked for the example above). Look for shipments to your beneficiary's embassy.
4) To find out if the embassy processed the packet, call the Dept of State before 5pm: 202-663-1225 press 1 then 0
5) You can also call the DoS to find out your interview date once you believe the embassy has scheduled it.

True. For the immigrating fiance, taking them locally could save some headache. I've gone the do-it-yourself route for all of my (USC) passport photos for this process, as well as for family members about to get a passport, with no issues. But if other countries don't rip you off for passport photos, as they do in the USA, then that's a safer route.

May I suggest, if you're into saving money, taking a digital photo on a white background & using some online FREE service to print them as passport photos. I used www.portraitbooth.com and got 6 passport photos (on a 4x6 page) from the site. It was $0.19 to print at Walgreens, double the price if you want 12 photos.

During the 3rd quarter 2009, 12,929 fiance visa cases were completed & 26,850 cases were pending.

However, USCIS calculates that only 4,754 cases were gross backlogged, since those were the ones outside of their current normal processing time. By doing this, they can report a much smaller # of backlogged cases.

What exactly they contain & tell you to do varies by embassy.

In Jamaica, the p3 says to send in your DS-230pt1 to have an interview scheduled. Meanwhile, it says, gather the other documents.

P4 in Jamaica contains the interview letter.

Also, you may want to go to the regional thread & ask others if there are any tips/shortcuts regarding those two packages.

For most people, it will be a very good estimate, but you never know if you will be in that number.

VJ estimated that my I-129F would be approved between April 20 & April 30 for much of the time. Almost everyone else who filed when I did DID get their approvals on or before April 30. However, I (and a few others) didn't get approved until July.

Chances are, it'll be accurate, but as Gary & Alla posted, don't make plans on it.
