Honestly all this varies from state to state, county to county. I know for where I am (and i've just recently checked into these questions) that for our marriage license all he has to produce is his passport. No SSN required. For his Driver's License... he will need to show his passport (to verify who he is with a pic) and his SSN # (which by the time we are ready to get his license he will have. He will also have to pass the driving and vision tests. Your best bet is to contact the county in which you will be residing.. explain to them your situation and status and they will be able to advise accordingly.

I'm actually surprised at how easy what we need to do will be to get done.... but that's a good thing!

The TB skin test is well known to give a lot of false positives so a positive skin test is always followed up by a chest x-ray. So if you are one of those that tends to get false positives, don't worry.

The overall processing time for us from filing to visa in hand took 1 year. Once you file there is a long bumpy road ahead of you, but eventually you will both get through it. You just need to have faith & it will all be worth it in the end. :) Best of luck to you both! :D

Wow August until now and she already has her Green Card? So that is pretty quick right?

Well no, my fiance is not previously married and has no children. The only problem I forsee is that she's been raising her little sister for the past 5 years. But she never legally adopted her... So now, that is what we're planning to do. My fiance will try to adopt her sister legally then we will begin our K1 process. But we just want to make sure we have everything needed during the process, so as to get it all right the first time.

Oh I'm not in Minnesota, I'm in Texas. So you took a filipina to Minnesota!! Wow... How is THAT going? I know my fiance is cold if the temperature goes below 70! Haha....

I know she will need an Birth Certificate, a Passport and some extra Passport photos - but what else? I heard she may need some police records and college transcripts? It's so hard finding a comprehensive list of the things she needs to have at some point soon...

If you've been through this process, in the Philippines, would you please list the items you remember needing to have? Just a quick list, nothing fancy... If I just knew everything she needed, I could search online for some addresses or phone numbers so she can call and work on getting those things.

Pleeeeeease help me! I love this woman, and I don't want anything tying up our paperwork. I would really appreciate your help.

Thats correct. If you dont have your passport you will need to include all of the pages in your passport. I would also start your petition as soon as possible. It will take about 3 to 4 months for it to get approved and once approved your package is valid for 4 months.

You dont need to wait 2 years to file a petition but you need to have proof of meeting with your fiancee in person within the last two years. Its a long and time consuming process but hang in there..

I also took a video of my petition package before I sent it to the USCIS. Click the link to my blog in my signature to get an idea. The most important thing is to make sure you complete all of the forms correctly.


When you say the package is valid for 4 months, what does that mean? Do you mean I only have 4 months to complete the whole process, up through medical and Interviiew? Or does it mean she has to be here within 4 months from approval, otherwise start over?

in the birth certificate issue, i would suggest that let you fiance go to the municipal birth registry and make an affidavit that the person appeared in the wrong birth certificate is the same person and ask in the municipal registry what other requirements to correct the error in the birth certificate. in regards to the passport,,you can get it within two weeks,,through expedite,,if you would not like to expedite it, it takes only a month.


She don't need to fix her Birth Certificate . I had error on my Birth certificate ,The middle name was wrong but all i had to do is get an affidavit from the lawyer.Alsoto get a Philippine Passport only takes a couple of weeks not months.Identification cards or any documents like Voter's Id, school Id, government id If wud help. Like i said i had the same issue but i sent copies of my different Id's with the correct name on it ad i was approved with no Problem.



Hi RoseTX and happywifemom... So, I asked my fiancee last night to take her other IDs and get an Affidavit, and then go with the Affidavit and her BC (incorrect middle name) to try to get her passport. Unfortunately they would not let her. Here is a text message from her I got this morning (let me know if I need to translate her texting). The background is she is just as lost as I am, so she is asking some "agency" for help - which supposedly helps Filipinos get the requirements they need to go abroad. She took a day off to go to Dumaguete ("dgte", Southern city in Negros Oriental) to ask around about the Affidavit thing.

Soooooo, maybe that only works for some people? They wont let her do anything w/o her corrected birth certificate, and they told her 6 months on that, so it will probably take 8 months.

You should get started on your I-129 packet. She can collect everything she needs in the Philippines while your I-129 packet is processing at the USCIS.

The only document you need from her right away, so that you can include it in your I-129 packet, is her "Letter of Intent to Marry."

Later on, she will need a passport which does not expire for at least six months after her interview at the USEM. She will also need a CENOMAR, her birth certificate, an NBI clearance, and at least a dozen official passport photos. Make copies of everything...just in case.

Thanks for this info. I can't file the I-129f until she decides definitively what she is going to do about her sister. If she manages to get her adopted, then I can put her name as the adopted "child" of beneficiary. So I'll give her more time on that, but she understands our time constraints. Anyway, about that "letter of intent to marry", can it be handwritten? Or does it need to be typed? Can she email me a letter that I then print off? Does it need specific wedding plans/dates?

Hi everyone. First, thank you for all of your replies. I seem to have confused you with a bit of my information. I did not intend to wait for two years to file the I-129f petition. When I visited her in May 2009, we were only friends (pen-pals) and had been since ages 18/19. During my visit, we realized that our feelings ran much deeper. I told her how I felt, but then it was time for me to return home. In December (6 months later), I finally proposed and she accepted.

As I mentioned before, I didn't foresee such a complex process... Since I proposed, it's been issue after issue; the two biggest being her sister and her Birth Certificate. Even though she is already raising her little sister, and has been for 6 of her 12 years (mom died, "high blood"), this apparently does not qualify her to be included in the petition. So I just suggested to her to try to legally adopt her sister. She has been scurrying around since January trying to do that (I thought this would be easy, as she's already raising her - I was wrong). So I told her I would give her until January to have her sis adopted, so we can include her as a "child of beneficiary". In January, I would still have 5 months left on that 2-year maximum of "having met in the past two years". The other issue is her Birth Certificate error, which you guys say is a nonissue. I just worry, If I submit my petition soon, and it gets approved before her Birth Certificate error is resolved, what then? Because once she has her Birth Certificate, is the Passport going to take another 6 months?

I think most of you guys had the benefit of knowing you were going to propose/marry BEFORE you went to visit, right? So you probably knew about the process before, and maybe you had been gatherig requirements previosly. For me and my fiancee, everything is happening 6-months after I visited, with the above complications - all while she's still working full-time as a Teacher.

You do not need the birth certificate of the Alien Beneficiary for the I-129F petition. However, you do need the certified birth certificate of the US Citizen. In lieu of a birth certificate you could use your passport but your fiance(e) will need her birth certificate and your birth certificate by the time she has her interview at the Embassy. So you should go ahead and order a birth certificate now.

Hello. I am posting this message to seek help/assistance from anyone in North Texas (preferably Dallas/Ft. Worth area), who has successfully gone through this K1 process with a Philippine fiancee. As of the end of May, it has been one year since I visited her there in Cebu. If I understand it correctly, that means we have one more year to get an I-129f approved.

We need help on both ends... Over there, she is getting the run-around trying to have an error on her birth certificate corrected (apparently this takes 6 months). And if she can ever get that, I need to know what to tell her to acquire next. It seems everything needs a correct birth certificate there though. Here, I don't think I have ever even seen my Birth Certificate - Hmm, do I need to order one for this process too? Anyway, I need help with the steps I need to tell her, plus maybe some contacts to get that birth certificate error fixed quicker.

On my end, I'm just confused. I had no idea it would require so much time and effort when I proposed - but I want more than anything to go through with this. I plan to submit my I-129f on January 2nd, 2011 and I want to get it right the first time. I think I can figure out all my documents I need to include, but what does she need to send to me to include in the petition? I'm hoping I can find a couple (Philippine + American) who can review my packet a few times through December and make sure I am not missing anything.

Thank you all for your advice. I think my take away from your responses is that I can write the dates on the pictures and that will be fine. I think my biggest worry now is that I don't have the boarding passes anymore. I re-printed the itinerary from my email, but I think I may have left the boarding passes on the plane a year or so ago... But hopefully, I've got GOLD in a hotel receipt with both our names as the guests, among other receipts that place me there during the dates on my itinerary. I do have the receipt from my boarding pass that my travel agent sent. And the passport stamp, and pictures, and letters - I pray I've got enough evidence.

And someone recommended making additional trips. Well, I cant really afford that - I work, but with the economy and trying to put aside for her arrival, who can afford that? It amazes me how expensive it is to travel to the Philippines when few people in that country have any money at all. may go back, like you suggested, for her interviews.

I have a question about this requirement: "Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photos."

I need to know does the date displayed need to be displayed by the camera on the front of the picture? Or can it be written on the back? My fiancee is saying she cannot get a date to be displayed on the pictures when she emails them to me or prints them from her camera. I've asked her to go to one of those picture printing places in tbe mall to see if they can make her camera show the date the pictures were taken. But if she tells me they cant, can we just write the dates on the pictures?

I have some of these things, but not all of them. And how exactly do they show that we have met each other in the past 2 years? Don't they only show that I have been there? I traveled there, so I do have my flight receipt from Cathay Pacific and passport stamps - but actual boarding pass? Long disappeared. We stayed with family mostly, so few hotel receipts. When we did stay at hotels, it's just my name on the receipts. What itineraries?

- I have very few chat logs because the distance she has to travel to the nearest Internet cafe is quite inconvenient. We text every week, but I use something called Chikka to text her, so there are no phone bills. I do however have every receipt I've ever gotten for sending loads to her phone. Would those count?

- Also, she doesn't ask for much - actually, she never asked me for money until the economy turned, her father lost his job, and she became her family's "breadwinner" on her teaching "salary". I have a few Western Union receipts... Are those helpful for anything, like showing that I'm helping the woman I love to survive?

You know, since everything will be in one packet addressed to one of the addresses above. In the sample letter, it shows that we need to put a "Service Center Address". Well, I have been going in circles on the USCIS website trying to find the TEXAS Service Center address - can't find it. And my fiancee already sent me her letter - it's a beautiful letter, but addressed to some PO Box in Mesqite, TX. Will this be an issue and they send it back, OR will it not matter as long as we say we intend to marry within 90 days?

When I went to get my US photos, they are 2in. by 2in. and have a white background.

So I went and looked at the "passport size" photos of her that my fiance sent me from the Philippines. They are a little smaller, obviously rectangular, and have a blue background. You can see her face perfectly though, and I think her face is probably the right size - there is just less background.

Is this going to be a problem? Do I have to make her treck alllll the way back to the city to take photos that are 2in. by 2in. and on a white background??

I did not include a boarding pass in my petition. When I went over there, I was just visiting a friend who I wanted to meet and who had been asking me to visit her for 10 years. Almost a year after my trip is when I proposed, so I never thought to save any boarding passes - I didn't know I might eventually need it until I found this site. What I DID send was:

- Certified copy of Birth Certificate
- Copy of every page of my Passport
- Copy of receipt sent from travel agency ON boarding pass-like paper - includes itenerary in right quadrant
- Dated Itenerary emailed to me from the Travel agency
- Copies of ATM, Restaurant and Hotel Receipts
- Copies of pictures of us together during my trip, and of me with her family and friends - with names of people and loations written beneath each photo (14 photos)
- Copy of a letter FROM my travel agent, TO ME, AT the hotel in Cebu, asking me how I liked Cebu and how things were going with LIEZL (along with envelope)
- Chikka receipts from every time we chatted in the past 3 years - no logs, because Chikka doesn't save chats and I never thought to save them off (but I am now)
- Copies of 9 years worth of written correspondence - I lost a years worth when moving out of a dorm 10 years ago

Will I get a RFE for not having the actual boarding pass (which is probably rotting away somewhere in a Cathay Pacific seat-back pocket)? Or, based on the above, do you think I will get my NOA2 when they get to my case?

Yeah, I'm going to call USCIS tomorrow and try to speak to a person. Our relationship, I am not worried about - I sent 10 years worth of letters and other correspondence showing us moving from friends to more, as well as pictures and receipts from my visit. The sister thing, I'm a little freaked out about now... I'm going to try to explain that at the time I applied, I didn't realize the relationship between my fiancee and her sister was not valid for the petition. The instructions simply say to list all children of your fiancee. SHE raised her sister - their father has another family he's with. If you'd seen them together... That IS her child. That was about as much thought as I put into it when I typed her name in there... I was more concerned with all the "evidence" of our relationship I needed to send, that's what my mind was consumed with - trying to send them enough of everything they needed

But I caught the mistake, thanks to you guys! I'm grateful for your responses, by the way! I guess had I not come here, I'd still be just as clueless about it - I was waiting for NOA2. I just pray USCIS will understand, especially since I'm calling to notify them of the matter and not trying to hide it. I didn't "knowingly or willingly falsify" anything. First thing first, don't listen to any of us regarding this.

Go speak with an immigration lawyer, you only need a consultation with them. You will want to discuss the situation with them.

Now regarding adopting her sister, US immigration will recognize the adoption that occurs in Philippines so long as the adoption process took place over there and was completely legal. There may be some back and forth paperwork involved as them being siblings will raise flags, but I believe if you can show it was a legal adoption it will be allowed in the end.



Oh my goodness!!! I am soooooooooooooooooooooooo confused! I mean, this is awesome news, if true... It is kind of what I understood at first also. But everyone on these boards is yelling FRAUD (when it's not) and freaking me out. She is going through a legal, legitimate adoption process in the Philippines. But then I saw people arguing in another thread about "orphan" status being necessary before the US considers the adoption to be legal, and that freaked me out - I don't want to go to jail... I think I will speak to an immigration lawyer. This is KILLING me! Why do they have to make this so confusing??

Dude, you should be happy of the current result that sputum tests are negative. Did you know that TB is an infectious disease and caused by a strain of bacteria? Hence, the series of antibiotics she needs to take for months to prevent the bacteria from developing antibiotic resistance. If she stops taking the meds now (after 3 months of taking them), the bacteria could become drug resistant and it would be harder to treat it. As you said, it is mandatory to finish the medication to completely get rid of the bacteria. Please research about Tuberculosis before you make any decisions. It's your wife's life that's on the line. Plus, the US is very strict about infectious diseases like TB. If she stops medication right now, it might come back to haunt her. When she gets here, she will be required to get checked for TB.

Hi all,

So, my fiancee's interview date is coming closer and closer (October 19). I'm concerned about 1 thing. When she went into the hospital to get her vaccinations they said that Hepatitis A/B were not required. She did get shots for HPV, Tetanus and diptheria, and possibly one more, I can't remember. But I was actually in Thailand and went to the hospital with her on her second round of vaccinations. And I personally spoke to the doctor, and he said that she did not need them at her age (she is 26). I didn't know that age was a factor at all for hepatitis. I'm just concerned that we meet all of the requirements at the time of the interview. I think my concerns can't possibly be valid because I trust the doctor knew what he was doing. It was an extremely professional hospital. I can't remember the name of the hospital, but was told it was Bangkok's best.

But, I can't help but worry...

Anybody have any experience or information on this?

Hepatitus A/B is only required for certain countries. For example, I was given it but I work in Indonesia and the company wanted me to have it. The Dr. there I am sure gave her the ones that were required. Oh, one more thing, the second round is not required either just to get visa, my wife received her visa and we are going tomorrow here in the USA to finish up second rounds.

Does anyone know if a student loan has to be paid off before a person can emigrate? My fiance has an outstanding student loan balance to the Thai Government of approximately $5,600 (170,000 Thai baht). She currently pays about $67 (2,000 baht) a month, which will take about another 7 years to pay off at this rate. I'm going to help her pay it off eventually, but cannot come up with the total outstanding balance at this time. I know it's not part of the I129f package but does the topic of unpaid student loans come up at any time during the Visa process?

1st post here so if it's in the wrong section can someone help me move it.

I agree with the above poster. I had a lawyer, but to be honest looking back it only gave one thing that I do think was helpful. They had staff in Russia. This was nice as she could deal with them on the documents she needed to give them on her side. Also at the time of the interview, she went to their offices in Moscow and they reviewed the paperwork she had and gave her some coaching and practice on the interview. It also helped to calm her down and reassure her somewhat. Otherwise, they did not do much. They send you a list of docs you have to collect (can be found on this site) and then they fill out the forms for you. Send it back to you to confirm/sign then they send it on to the government with your money. So the gist is, if it is complicated, get a lawyer, if you want some hand holding for your fiance' in her own language in Russia, then get a lawyer that has resources/offices in Russia otherwise do it yourself and save some cash.

I did the whole change of status when she was in the USA with me, on my own using the site here and asking questions of the forum. Good luck and ask questions if your confused by any of it. If you follow the process outlined and it is a pretty straight forward case, you should be just fine.

I know it will be hard at first but some of the best times in my life is when I didn't have a pot to piss in. Sometimes you have to take a leap of faith and love always finds a way. Take it one step at a time. This is why we call it a journy because it is exciting, scary, and fun all in one. I'm sure everything will work out for you as long as you two don't give up. :) I never feel tired on reading the story of K1 couples on the beginning of their life in the U.S. It always put tears on my eyes, remembering the hardship we all have to face.

I myself left a decent job, a wealthy family, and friends in 2007 which I still miss up to now. My fiance (now husband) traveled to Asia to help me moving. We rented a 1 bedroom cheap apartment the same day as we arrived in the U.S. Nothing was in that apartment except stove, and fridge. That night, we went to Walmart and bought an airbed, two plates and two mugs and a rice cooker. That's how we start our life :) :)

Present time: I'm due for our second child on Dec 2010 and about to apply for Naturalization. I have never had the chance to work, because we decided we want to have kids and I don't want to leave my babies. Yes, we have moved from that cheap apartment and now own a 3-bedrooms house. Slowly, we try to get our life better and better.

But yes, nothing was easy. We really tried to limit our expenses in the first months - and I used to be the spoiled, rich kind of girl, but never complained anything. For me, I might be a princess of a wealthy family in my home country but I won't be happy if my hubby is not with me.

Currently we're still waiting on our NAO2, our VJ timeline suggested it would be adjudicated between the 15th of February, and the 25th.. Then it moved up to the 1st of March, then back down to the prior expectation.. It's now the 4th of March, so what I'm wondering is, should we be worried? And if so.. Should we call the USCIS?

I checked Igor's List aswell, and the prior fifteen cases which also sent their 129F at around the same time to ours have been adjudicated around this time; 3rd of March or so.. So I don't know what to think.

Any help or insight would be appreciated. Thank you.

I filed a K1 Visa Petition in Jan 2007, and it was approved. Circumstances changed, and we did not continue the process. We are in a different place, and want to try again. It has been more than 2 years, I was wondering if I answer "yes" to question #11 on the form.... or "no". It is the same Fiance.

The instructions for the form state:

"If you have filed two or more K-1 visa petitions at any time in the past or previously had a K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver. To request a waiver you must submit a written request with this petition accompanied by documentation of your claim to the waiver."

So I do not believe I have to file a WAIVER, but dont know if I should answer yes or no....
