Hi all,


Friday I meet with local USCIS office. I was advised to meet with local office when calling in to followup on expedite request and why no answer. The expedite inquiry was sent with this letter:

Your request for expedited processing has been received. After careful review and consideration, it has been determined that the request does not meet the expedite guidelines established by U.S. Citizenship and Immigration Services. As such, the case will be adjudicated in date receipt order.

Again calling, was advised to meet with local office instead of placing another query into the CSC. Stated the forms are not adjudicated there for I-129F. Was told by call center to go into local office anyway.

wonder what is up??? anyone got any ideas? Just wondering what may happen on Friday.



According to your signature, you JUST got your NOA1 on 3/10/2011 - that's just one month ago...

USCIS states that normal processing time is 5 months; and when you call them, they say "well that is just an estimate". If you're lucky enough to get into CSC, it seems 5 months is a pretty close guess-timate. For some of us, however, our case is held hostage for 6+ months by VSC! These are just their "normal processing times". And then, from other posts I've read here, you can't really successfully get an expedite until your case has gone AT LEAST 30 or 60 days (not sure which one) beyond "normal processing time". Or at least that is what people report their Congressmen/Senators were told when they got them involved.

Again, it has been just over a month since you got your NOA1. I am wondering on what grounds you are using to justify your expedite request? Surely they will be asking you why YOU should not have to endure the same wait everyone else is... May I ask what is your reason for the expedite request after one month? I'd love to know, especially if it works!

Hey everyone. 1st of all i would like to say that i am glad i found such a great community. when i was in the process of getting my citizenship back in 07/08 i was a part of a different website. But i like it here a lot more. so here we go.

I was married to an American woman (Hispanic) for 6.5 years. we separated August 2008 and divorce was final June 2009.

I visited my family in Egypt in June/July 2009. and in September 2010.

In the 1st visit i met this girl and we fell in love. In the 2nd visit we got engaged and we had a small party with both our families and we took lots of pictures together during my stay in September 2010.

I decided to apply for the K1 visa and i submitted it was accepted/received on May 4th 2011, as you can see below in my timeline.

i did my homework just like how i did when i applied my green card in 2002 and my citizenship in 2008.

My question is, i have a solid package..everything that they might ask for i have photos, taxes, birth certificates, etc ...i am not worried at all when it comes to that and we are only 6 years apart (im older) so that another good thing. i am just a little concerned that i only met her couple of times in 2 years. can that affect my chances of approval? im planning to be there for the interview.

I got NOA on May 20th and called the NVC last night. They told me to email them and attach my approval letter so I did and I got a response today saying they:

Dear Sir/Madam:

Please be advised that the National Visa Center (NVC) has received your
inquiry and the attached I-797 Notice of Action - Approval Notice.
Unfortunately, we do not have record of receiving your approved petition
from U.S. Citizenship and Immigration Services. The NVC will contact
USCIS on your behalf for information on the location of this petition.

Never had a psychological exam, only a regular medical. Not sure if it is Philippine specific? I haven't seen anyone else post about psychological exams either tho.


Its a process here in Philippines to have a Psychological exam if the beneficiary is annulled :) and the reason is In cap :P

We're just now starting to put together the paperwork for the petition. However my fiancee has the opportunity to apply for a B1 through her company to come here for a company meeting and spend a week of vacation as well. Her interview is scheduled for September and she would be visiting in December. It would be nice if she could come here and meet my family beforehand. (So she can know what she's getting into ;) )

If we send in the petition paperwork in August would this impact her ability to get her B1 visa in any way? I was under the impression it would be about 5 months before it even goes to China. (She's in Beijing).

Your fiance will be denied the visa at the interview and at that point will be (hopefully if things haven't changed) able to submit the I601. YES, have it prepared. I don't understand when they say 10 year ban. The people that I know have been here in the US illegally for more than 8 or so years and they get married here and file for their papers and then go to the interview in Ciudad Juarez and are denied and they have to go back to their home and wait for another interview within 2 or 3 months and then they get the visa and come back to the US and then they file for their papers. Was it more the 180 days but less than 365? Then it is a 3 year ban from the US. You will need to diclose the illegal presence (because chances are they already know and lying about it will cause heaps more problems)

Yes, you'll need an I-601 to show how you'll suffer extreme hardship if he does not come to the US with you.

Thanks for your quick reply. Yes it is more than 365 days. I have filled out the I-129F and it asks if your fiance has ever been in the US? I checked yes. I have no intentions of lying. So then should I already have the I-601 ready? When should I send it in or should he take it with him to his interview? When does that form come in to play?

Hello, I am wondering if anyone is or has been engaged to someone that was here in the United States illegally for more than the 180 days and went back to Mexico and then you filed a I-129F Fiance Visa? If so what are the steps to take? Did you have to file a Application for Waiver of Grounds of Inadmissibility I-601 for them being here in the US illegally? Please help me with this because I am getting ready to file the I-129F for my fiance. He has since went back to Mexico on his own. He was not deported or anything. He has been in Mexico for 2 years and 3 months now. We still have a relationship. I go back and forth to see him, but it is very tiring. So I thought that I would try and get him a visa so he could come and get married. If anyone has been in this situation and has gotten a visa please let me know what the steps were. Ok I see you're talking about Part B Question 15. When they talk about abroad just list her current italian address there. They just mean abroad as in, not in the US.


What if she doesn't have the Italian Residency Cerificate? The address in Italy is where she is currently staying, so that will still be her address even if her home is in Romania?

Her home is in Romania, but she is just living and working in Italy.

So on the i129f, put her Italian address, and on the g325a state her Romanian home address...

1. I am an active duty soldier stationed in Italy. My fiance is a Romanian citizen residing in Italy. We live in the same city, and see each other every day. I am petitioning for her K1 visa. Can we go to Napoli to get the medical exams and do her interview, since it is closest to where she resides, or does we need to go to Bucarest?

2. On which form, and to which address will USCIS be sending me my receipt? I put my APO address in PART C, Question #1, of form I-129F, and my home address in the states in Part A, Question #2. At which address will USCIS be corresponding with me? To which address will they be corresponding with her? She doesn't have a mailing address in Italy, but receives packages through my APO address.

3. Does anyone have any experience with this?

Is a Sentri Pass the same as a Tourist Visa? I guess it would depend upon why it was taken away. Did they give her a reason? Unless she has had illegal entries, I wouldn't think it would affect it. Did she mention to them that she had a K-1 visa pending? If so, they would probably take her tourist visa.

I brought all that, but the interviewer didn't ask to see any of it. I offered and she said "no need." I think my presence there was enough proof (or the fact that the initial petition contained pictures). I had pictures of our families together, phone logs for every other month from filing to interview (9 months), copy of all pages of my passport to show the 10 stamps to Jamaica, and updated letters of intent. The lady didn't need to see any of it though.

But as it is better to be safe than sorry, you may want to bring whatever you think is necessary.

Also, go to Embassy Info and read reviews of peoples' interviews in Kingston. That gave me invaluable information.

With that being said, the fact that he suddenly doesn't want to visit throws up a big red flag to me. Without getting more information from you, it's hard to guess what is going through his head, but to me, it sounds like you two really need to sit down and discuss whether or not you're on the same page. If you're not on the same page, you should see if the timeline for your plans needs to change, or if you can work out your differences.


It did for me, too.

I'd echo the advice someone mentioned about going to the regional forum section for advice from others who filed for fiances from Pakistan. I can't even tell you how invaluable the advice I got from the regional forum for the Caribbean was (and still is).

I understand your frustration. My k1 took 6.5 months to be approved, with no touches for 6 straight months. At the time, it was taking most people 4 months to get approved & standard processing time was listed as 6 months.

I engaged my senators/congressman, but am not sure that helped. I also had an Infopass appointment while waiting, but I don't know if that helped either. Based on the fact that there were several us of who filed and were not approved in the 4-4.5 months of the rest of our month's filers, and all of us got approved within about a week (2 months after the rest of the filers), I think they lost the box with our files for a while. :: shrug :: It happens.

On the bright side, it eventually got approved & my then fiance came over. Now we've been married a couple of months & those extra 2 months of waiting isn't that big of a deal. It did add to the costs, as I made a couple of trips to visit him that I didn't expect to make, while waiting.

I hope the fact that you aren't the only one to wait extra time offers you some comfort.

If your fiance has a digital camera, you might could get the passport photos easier (and cheaper).

Have someone take a picture against a white/off-white background.
Upload it at http://www.portraitbooth.com/ (free!!!)
Format it at the site to fit the US passport guidelines
Save the image generated by the site (which gives you 6 passport pictures, 2x2, if printed on 4x6 photo paper).
Have your fiance email you the image.
Print the image at Walgreens for 19cents. You might even print 2 or 3 copies, to get 12 or 18 passport photos.

This has saved us tons of money since we've needed so many passport photos during this journey.

I sent our packet off on Friday (Oct. 29). I think assembling that packet is the most intimidating process ever. I don't recall ever being so nervous and afraid of doing something wrong. And now the waiting begins.

I did have one humorous moment. As I'm filling out the I-129f, I was referring back to the example on here. And when I finished, I printed out the example instead of my actual form. I didn't even notice until at the end when I was making sure I had signatures on everything. At least that's one potential mistake caught ahead of time.

By the way, I want to thank everyone who has ever posted on here; either asking questions or giving answers. The information I found on here is the only way I was confident enough to do this without paying money for a lawyer. You've already been such an enormous help. Thanks to all.

I am sorry for starting this thread and offending so many people. That was not my intention. I was angry with VSC (what else is new?) and since that anger is inversely proportional to the amount of activity at VSC and there was ZERO activity for the 5th consecutive day, that anger was totally out of control.

But I was wrong to take that anger out on this board, as it is my problem and not any of yours. Again, I am sorry.

I thought long and hard as to whether to post here any more, as there were the usual assortment of mockery posts, but when I saw the ever increasing firestorm by people I consider as good members, I simply had to try to put out the firestorm I wrongly started.

My intention, which seems to have been lost in the haze of my anger, was to dramatize the point that almost any country could make a credible claim for humanitarian expedite status, so it is arbitrary and short sighted to single one country out for that status and hang the rest of them out to dry.

Please do not tell me to not be angry any more. I know I need to not be angry, but that is about as helpful as telling a clinically depressed person, who knows he should not be depressed, to simply snap out of it and not be depressed any longer.

I do not harbor a belief that I am the only one being cheated by the government. I believe that all of us are being cheated. I do my best to encourage others here to stand up for their rights, but I can't help seeing this race to visa land as a competition. All of my life, everything was a competition and everything I have is as a result of winning that competition. So can you see why I feel driven endlessly to compete against everyone else for that elusive visa?

I will control my own anger from now on by refraining from posting my opinion anywhere on this board. I will limit myself to the facts.

And for those of you who don't know this, trying to explain to an angry person that he is wrong will solve nothing, as it will only cause him to dig in his heels and defend his position even harder than he has already done. Just ignore such a person.

So with everyone all upset about the 'service' from USCIS, I have to say... Yes, the wait sucks. But in those walls, there are some people that actually care about the petitioners and their lives. (Otherwise they would have just thrown my packet out since it was not in response to an RFE.)

You know, I think that's a good thing to remember. There's really not a lot of good things to say about the wait and the whole process; but you're right that those are regular people working there. They're doing a job that I'm sure can get pretty monotonous, but I'm sure they have no bad intent for any of us.

Now I wish those nice people would read this and move my petition to the front of the line. :lol:

Same thing just happened to us. We had the AOS interview (from a K3), they lost the medical exam, we submitted another medical and heard nothing back. We filed a service request to find out what is going on and we get the same letter you did, that they have no record of our application/petition! How can that get lost in the system when we have gone so far as the AOS interview??

Try following these steps.

Go to DHL Worldwide Express website http://www.dhl.com
Select "USA" - A new page will open
At the top highlight tracking and click on "TRACK BY REFERENCE"
In the Reference field type "CORRESPONDENCE"
For the Shipment date you should select a day before and after the date NVC said they sent your file.
Leave the "Customer number" blank
Origin Postal code should be "03801"
Then Click "Track"

"YuAndDan" gave me this info in 2006 after I asked the same question. You will have to call NVC first and speak to a human. The automated menu cannot give you any info about whether your pkg has been sent or not.

I' m curious. :blink: While checking out the plane tickets I realized the return / roundtrip ones are way cheaper than the one - way ones. As I wanna save money on it ( and on some one can save up to 500 euros :blink: ) I was wondering if this can cause any problems at POE. People entering USA on a K1 visa shouldn' t have a roundtrip ticket anyway so do the officers there even ask or are we all supposed to say something ? Or it doesn' t really matter what kind of a plane ticket one has ? :blink:

It does not matter to Immigration. Buy whatever ticket is most cost beneficial to you. It is not an issue with Immigration as long as the Beneficiary has the correct documents when they return to the US.

Your credit or credit scores are not an issue. Having sufficient income to put you 125% above the Poverty level is the requirement with regards to money. Who you owe, how you pay aren't factors.
