WHO DO I MAKE THE CHECK OUT TO? It doesn't say, just everywhere it says send in a check for 340 dollars.

I assume USCIS, but I don't know for sure.

I'm Ann and I'm a K1 Visa applicant from Manila. My fiance(e) and I received our NOA1 on Feb 28, 2011. I would like to reach out to all of you especially those who are K1 Visa Applicants who are currently waiting for their NOA2 and those who recently got their approvals.

First, to know about the processing timeline; just keep checking Igor's List. You'll soon become addicted like the rest of us.

I was Vermont, and for a long time Vermont was much slower than California. Now they both seem to be going at a decent pace. It took about 5 1/2 for my NOA2; California has been a little quicker than that.

As for coping with the wait; it's difficult. Here's what I found. At first, it wasn't too bad, we had just started and it was exciting. After about 3 months, it got difficult, we talk on Skype all the time and there were days when one of us would just have to say, "I'm just sad today". There were days when you'll be sad for no reason except the wait is getting to you. Just let each other know when you're feeling that way and lean on each other for support. Around 4 1/2 months the wait got easier because I knew ours couldn't be too far away. But then, right before we got approved, I was really anxious again. I saw people from around my date being approved and I really wanted our approval to hurry up and get here. And finally it did.

The key to coping with the wait is just keeping in touch with your fiance; talk to each other, let each other know how you feel. Always be as positive as you can and support each other when you're feeling down. :thumbs:

I just got approved but I remember exactly how you're feeling. It's like you know you are so close and now every day you're anticipating a possible approval and each day it's disappointment.

I wish I had an answer for you but all I can do is try and encourage you to hang in there. You're time is coming soon. You can try contacting your congressman and senators. It might or might not help, but it's worth trying.

Good day everyone, hope all is well with you.

I have a concern and would just like to share it with you. I just want to know if anyone out there is experiencing or have experienced the same thing and can provide helpful information. :)

My Fiance received NOA2 last May 6 stating that our application for the petition for K1 visa was approved and forwarded to the Manila Consulate.
We called NVC several times and the Manila Consulate just last week and both offices don't have a record of our application yet. It's been almost a month now since we received the NOA2, is this normal?
My fiance called USCIS last Friday, but the lady who answered just directed him to the website state.gov and informed him that USCIS just approve applications which basically means she doesn't know where our application is!
I sent out an email inquiry yesterday to both USCIS and the Manila Consulate inquiring about our application, I'm really hoping to get a response from them soon.
Is there a step that me and my fiance are missing to get that MNL case number?:(

I was able to get my MNL number by emailing the NVC. NVCInquiry@state.gov

You'll need to tell them your USCIS receipt number, the petitioner's name and date of birth, the beneficiary's name and date of birth. They should be able to tell you the MNL number after that.

According to your signature, you JUST got your NOA1 on 3/10/2011 - that's just one month ago...

USCIS states that normal processing time is 5 months; and when you call them, they say "well that is just an estimate". If you're lucky enough to get into CSC, it seems 5 months is a pretty close guess-timate. For some of us, however, our case is held hostage for 6+ months by VSC! These are just their "normal processing times". And then, from other posts I've read here, you can't really successfully get an expedite until your case has gone AT LEAST 30 or 60 days (not sure which one) beyond "normal processing time". Or at least that is what people report their Congressmen/Senators were told when they got them involved.

Again, it has been just over a month since you got your NOA1. I am wondering on what grounds you are using to justify your expedite request? Surely they will be asking you why YOU should not have to endure the same wait everyone else is... May I ask what is your reason for the expedite request after one month? I'd love to know, especially if it works! :lol:

There are certain reasons that USCIS will expedite a petition. This is different than the request because of the length of time that the petition has been waiting.

Expedite Criteria

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

Severe financial loss to company or individual
Extreme emergent situation
Humanitarian situation
Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
USCIS error
Compelling interest of USCIS

The issue of age difference can be a red flag at certain consulates more than at others. For example, it seems quite routine in Manila (Phillipines) for the male petitioner to be significantly older than the female beneficiary and these petitions are approved quite easily, it seems. The reason for this is that consuls also have the discretion to judge petitions from a cultural standpoint and, because of this, it is not an uncommon practice to see these big age differences in the Phillipines because the culture allows these relationships. On the other hand, at Casablanca there is higher scrutiny for being a high fraud consulate and female petitioners who are older than their male counterparts face an added challenge because it is against the cultural norm for the female to be older -particularly if the age difference is big.
In your case, however, your age difference is not many years, but just a few. Equally important is the fact that you are still both of child-bearing age, an issue which is important in the eyes of many consuls. You can get more specific advice on the consulate experience by consulting with other VJ members who have interviewed at Juarez. Click on the link at the top of the page that reads "Portals."

Agree with the other responses. Although I haven't got that far yet, from what I've read when you get to the embassy, you'll fill out a form for the courier letting them know where to deliver your visa. That will probably take care of your problem.

I am so nervous, my interview is in 8 hours! I am so excited but so nervous to! Can I have other thoughts from people from Manila who had fiancé interview? How long does it take for them to mail visa if I am in Manila? Oh I have so many butterflies in my stomach!! Wish me luck!! If God is for me, who could be against me right!!

Send the embassy an email requesting that the visa be withdrawn. I had the same problem before except I had petitioned my fiance, I called NVC they told me email the embassy send them a memorandum for record sign it and forward with your full name and case number. The embassy will send you an email stating they confirm the cancellation and return the application with all documents to NVC, NVC return it to USCIS and then you get an letter stating the application has been cancelled it took about 4 months for me to finally get the cancellation memo but either way they did not see him during the appointment time.

I am just below the poverty guidlines if you use the adjusted gross income. I have read that I can get a co-sponsor? Is that correct & does it take longer to do it that way? @ JimVaPhuong- Thank you! We (my fiancée & I) have decided not to worry about this. We will provide all of the evidence regarding our income, our sponsors, & pray about it. I have full faith that everything will be fine, as we have a mountain of evidence that we do have a real relationship. We have $20,000 in travel expenses, $10,000 in calling, and over 1,200 emails & chats. If they deny us for this issue even with a co-sponsor who clearly qualifies then we will deal with it at that time. I don't think we truly have anything to fret about, I just had a moment of fear.

@ John & Mari- I read (somewhere here on VJ) that we are to send the original letter of intent we sent with our filing as well as an updated one. I have no idea if that is true or not but better safe then sorry. Re. the child support I totally agree, which is why I would have never thought to send in that information until JimVaPhuong said that they will deny us even with a co-sponsor because I can not show how we live without public assistance. I am going to contact the consulate on Monday to see what their rules are.

@ Alcheringa- I am hoping that I have misunderstood your post, but I do not think that I am. I would guess that you did not read through all of the posts before coming to your conclusion that I (and Nigerians) am not an honest person. First I am always 100% honest about my assets and income, I do not even cheat on my taxes like 80% of other Americans. My comments were in response to a post saying that we will not get approved even with a co-sponsor, which we have. I was upset at the prospect of someone not taking our whole situation into account and I was trying to figure out what I should send to prove that we do not need public assistance. We all face our specific hurtles when it comes to this process & we all need luck and prayer to get through it. You saying that Lagos is a particularly hard consulate to deal with because of people like me trying to play the system is judgmental and uncalled for. It would be like me saying that men just go to the Philippines to get a young submissive wife because they can not get an American woman. A bit judgmental right? Totally uncalled for right? Especially since I do not know your situation in full. By the way, I know that is not true because I have 2 friends who did marry women from there & that was not the case either time, but you get my point right?

In Texas child support is not taxable. Also, 2 of my children are disabled and receive disability which is also not taxable. The total of those things is over $30,000 a year. If you figure that in with my total income we are far above poverty guidelines & that is after almost all of our expenses are deducted because I am self employed. There has to be someway to get over this. The crazy thing is that he has his degree & works in a field that is highly needed here & will start out making over 100k a year, which of course will benefit the government as well as it will send our tax bracket up so much. Frustrating.

I actually just pulled numbers out of the sky for the income. I am self employed out of my home so much of my mortgage, utilities, etc are tax deductible for me, however I am still below the income guidelines if you look at my bottom line. My children have their own forms of income which are not taxed, therefore they don't reflect on my tax statement. Should I include that information as well? statements from social security & trusts for my kids? Because that is not MY income but theirs, however some of it goes toward living expenses. Maybe I should just write a letter regarding how we meet our monthly expenses & the fact that the income reflected on my return is all disposable income? I think our situation is a little more complicated then the norm. Now I am very worried, even though my co-sponsor makes well more then needed to support 2 people I am worried they will deny us due to what my tax returns show.

I am trying to get everything together to send to my finance. I have phone records, emails, pictures, the original packet, travel info, letter of intent. I am having a co-sponsor for the I134. I am still confused about what documentation they need. I have read the form countless times & since they are not self employed it looks like I don't need to send the tax returns. SO what exactly will they need? Also, I AM self employed so I know I will send my tax returns and bank info. Does my co-sponsor need to be able to support myself, my children, my finance, and themselves? Or do they count my income as well? I hope this is clear, I am seriously tired...
One last question, can someone tell us what other fees we have coming up? I thought we were supposed to pay the NVC but I have yet to receive a bill. I know we have the medical fee, police cert fee, and the actual visa fee. Is there a fee for the appointment? Any other fees? I want to make sure we have enough money put aside for all of this. Last minute surprises are not so fun. Thanks!!!

Our package left NVC on May 23. We still have not received anything from Lagos. I called and they won't help me. I emailed and it has been 8 days with no reply. I emailed again, still nothing. I found the list under the packet 3 info this is what it states is contained;

The links on the consulate website are broken. I can find all of the forms here but the OF-167. I think this list may be old or outdated. Does anyone know where I can find that form. I googled but no luck. Also, anything else that the packet contains? He would just go to the consulate but it is about 9 hours away. I am hoping we can put the packet together ourselves and avoid an extra trip. Thanks for your help! One more thing; does anyone know how much they charge for the police report in Lagos? Or if not what is charged, how much are you required to tip ;)

We received our packet 3 via email with our interview date. On one of the pages it states we will need to pay $131 fee. There is no other info given regarding the fee and I can not find anything else on it. Does anyone remember this part? Our interview is September 9.
