I have a question about proof of ongoing relationship for K-1 interview.

Here is what I have

1. Google chats
2. Skype logs
3. Calling Cards - I am using calling cards to call my fiancee, and talk to her at least twice a day. Unfortunately calling cards don't track the number you call as there is no billing nothing. Is just reciepts will suffice? Or what should I do?

Any other suggestions please.

I agree that calling cards are Too expensive. We use a StarTech service and there's really no good proof of how much we talk per day. I have a couple of suggestions:
1.Use a long distance service once or twice a week for the records just for a short period of time.
2. Use old fashioned post cards and letters.
I didn't see anyone else offering a suggestion.

About 4 years ago, I got burned so bad by an American woman that I will never trust what anyone tells me until I thoroughly know them and they are worthy of it. I am sure that Whyus0heartless has learned this and will likely end up with a much, much better woman next time. That is what happened in my case anyway.
My finance told me that many women in the Philippines just want the Fiance to send them money and they have a boyfriend on the side. They really don't want to leave.

IN JUNE OF THIS YEAR
While on Filipinocupid.com I had a scammer take me for $ 150 and I put her story, name and picture on dragonladies.com. I almost forgot I did that and last week a guy contacted me about a girl of the same name. He said he was shocked to find her name on dragonladies.com and he told me he had drained his bank account and sent her over $ 20,000 this year. I told him I was positive the woman was a scammer but he still believes she is not and is planning on meeting her in December. He has only seen her on cam once but talks to her everyday. I am positive it is a scam but I can't convince him because he is in love :bonk:

My ex fiancee did not show up for her interview on september, and did not even explain her reason for not showing up. To the point of not even answering my calls. When i did talk to her, she said she's not ready to get married. And later found out from her cousin that she cheated on me with another guy. I'm devastated right now after all the time, money, and sacrifices i went through for her. What should i do now? I have no intentions of getting back with her, but i'm concerned of a future fiancee visa petition if i do finally find the right woman in my life.. Need help! Advice! Thank you!

Times are tough there and the interview would be the point of "Put up or shut up." Speculation would be that she was unable to get a CENOMAR? My suggestion would be if you are intent on marrying a Filipina and you don't have a mutual aquaintence that knows you both (we did and I'm very happy of that as my fiance is an extremely rare individual): Before you give your heart to anyone and go to meet her or when you meet her maybe, get that CENOMAR up front, she'll have to get another that's near the interview if things work out but my guess is that's the time when the few ladies that are seperated from their spouses and don't see themselves as married, would tend to back out. Sorry for this happening but the reality is that you're very lucky you didn't get her here then find out that she's capable of deception. Good luck to you!!

You don't need it to file the I129F in the U.S. she will take it with her for her interview in Manila which is much later.

When you file your paperwork make certain that you send clear copies of ALL pages of ALL your divorce decrees(if more than one), every page of each and make certain the stamp and names are visible.

My wife began her Master's program 5 days after her arrival and 3 days BEFORE we got married.

The K-1 does not restrict education in any way. She is free to attaend ANY school or university. The school will probably ask for proof of "legal presence" and some states have restrictions on her being classified as a "resident" for the purpose of reduced tuition, others waive the restriction if she shows she moved here for other than education purposes.

Alla started a Master's program 5 days after arrival with a 50% private scholarship. Everything was arranged before she arrived, she only had to show up, show proof of legal presence and give a SSN. She applied for her SSN 16 hours after her arrival and had the number the next day.

Our son, a K-2, began 8th grade the second day after arrival

Even if it were a 3 or 10 year ban, they may qualify for a I-601 waiver. If it was only a catch and release she wouldnt have documentation would she? So long as it was a catch and release it should be fine. If it were a formal removal then I would have the documents - request them via FOIA.

Good luck! My fiance was told 2-weeks for visa delivery after she passed her interview. That was on August 4th, and she has not heard anything - 2GO was supposed to text her when they're going to deliver. So I called the 214 number to try to find out what is going on. All they could tell me is that her passport is still there in the Embassy, that "the two weeks is just an estimate", and read some blah-blah I already knew off of the screen. They don't know anything except that it is still IN the Embassy. They cant tell me what stage of processing, nada. They refused to transfer me to anyone with a brain. And when I told them I had already purchased tickets because they told her 2-weeks, it was just "oh I'm sorry sir, we strongly advise people not to but flight tickets until after they get their visa". Encouraging me after the fact!?!? Well, I only got them because someone there told her she'd have it in two weeks! It all fell on deaf ears... I hope I'm not screwed with these tickets I bought.

So here is a question about this letter...In the example letter, it asks you for the Service Centre address...but I cant find it anywhere. It will be California. Does it have to be this address or the Texas drop box address?

OK well me & my fiancee got approved but before we got the approval we applied for her tourist visa because we were going to withdraw the K1 Petition since we were thinking about having a wedding in Egypt. so now the issue is they sent her packet#3 and she is working on it BUT she also has a tourist visa appointment scheduled on October the 10th. What should we do? i called USCIS and they said you can continue in both visa but most likely the embassy will catch it and only issue 1. which is totally fine by me. i just don't want to cancel 1 and then the one we resume gets denied then i regret cancelling one of them.

Yes, as long as you can prove you were physically in each other's presence after the date on the marriage certificate. You'll have to explain that the initial marriage was by proxy since you won't have any documents to prove you were together when the marriage occurred.

It would be substantially less complicated to just get married in person and get a proper marriage certificate.



It has nothing to do with being "bad". Until you have a legal wedding you don't have a petitionable relationship. It's really that simple.

From the USCIS Adjudicator's Field Manual, chapter 21.3:

(A) Proxy Marriages .

Section 101(a)(35) of the Act provides that the term "spouse", "wife", or "husband" does not include a spouse, wife, or husband by reason of any marriage ceremony where the contracting parties thereto are not physically present in the presence of each other, unless the marriage has been consummated. (Note: Consummation of a marriage can only occur after the ceremony, there is no such thing as “pre-consummation” of a marriage.)

the problem will be that at the time of FILING the wedding needs to be legal. Seeing you're not going to consummate until after your actual wedding then you may as well file based on your "in person" wedding instead of proxy wedding.



Ok ... please answer this final 2 questions.

1- If they do the marriage certificate via proxy (power of attorney) in the next few days, for the purpose of getting it issued and translated & certified. and ready for me by the time i get there >>>>>>>>>>>> Is it OKAY to file/mail out the CR1 on the DAY OF THE WEDDING CEREMONY which is 09/23 ?????? (and yes i will include boarding pass, hotel reservations, and me & her are working on trying to get joint bills and bank accounts so we can include it as well).

2- My Fiancee is very mad right now, she wants to know what is so bad about filing before the ceremony if it is already set that i am going there next month and i have the ticket booked already. Isn't that proof enough that the marriage WILL BE consummated?!!!!!!

This is incorrect. If you search threads you will find lots of stories of denials with proxy marriages. Even with consummation later it can be very tricky. Without consummation it is not valid for USCIS at all. Please see here on the I-130 instructions themselves.

Under "Who May NOT File I-130" you will see

"4. A husband or wife, if you or your spouse were not both physically present at the marriage, and the marriage was not consummated."

You cannot file for I-130 until you meet her in person after the proxy marriage. You cannot file it directly after the proxy marriage, because as stated, a proxy marriage is not a valid marriage for USCIS. Once it is consummated, then you can file a petition based on your proxy marriage and subsequent meeting in person. You have to have a petitionable marriage at the time you mail in the petition, not only at the time the visa is approved. If you read the instructions for the I-130, it very clearly says that you cannot petition for a husband or wife if you were not both present at the marriage and you have not since then consummated the marriage. You can file the I-130 when you arrive in Egypt, but not before.

Please understand this: If you file a I-130 after the proxy marriage and before you see her in person your petition will be denied.

Edit: Sorry, after reading again it seems you plan to file "from Egypt to the US" which is good, but then you say "So any day now they will receive the power of attorney via FedEx and they will get the marriage certificate made and translated etc and mail it back to me asap. so i can file for CR1 and waste any more time." so I am not sure which plan you are doing.

Hey everyone...i am the OP :)

1st of all i like to thank each one for every advice or suggestion, i couldn't believe the amount of effort you guys put in this post to help with my case. (we who about to die "aka wait forever for a visa", salute you)

ok here is whats going on so far.

1- Talked with her family, they do not approve of her traveling without being married with a K1 visa (which is what was expected by me and everyone here that is Muslim or know how things work in a Muslim family). it does not look good on her and the family to travel with a non-family member.

2- Talked with her family, they do no approve of us getting a Nikah (which is a religious traditional deal that does not get legalized or documented with the government at all). However, Nikah does not reserve her any rights as wife what so ever in case of a divorce or something else god forbid. so that is why the family do not feel there is a good reason to put their daughter in that position.

3- Someone here suggested that we marry and divorce while on K1 so when she enters she is not married, that will not work either because a divorce is like a very shameful thing in Egypt that makes the woman and her family look very bad. plus USCIS can give us a headache later on or feel we are playing games.

So, here is what i did so far i made a power of attorney to her Uncle. i know "some" of you are against proxy marriage. But do not forget that i am still going there on September 22nd and we are having a wedding ceremony on the 23rd and a honeymoon ,,,etc.

I will include a copy of the plane ticket and the hotel reservationns when i send the CR1 packet from Egypt to USCIS in the US. The only thing that wont be included in the CR1 packet is photos of the wedding. but we have many photos for us and with family from 2009 and 2010 and from the Engagement party and many outings, phone call logs, emails.. etc

So any day now they will receive the power of attorney via FedEx and they will get the marriage certificate made and translated etc and mail it back to me asap. so i can file for CR1 and waste any more time.

What you guys think? anyone think there is something that they can deny my wife the CR1?

and once they are here they can apply for a green card through special catagories (Nonimmigrant (includes fiancée))

Before 2009. You would send it to 1 of 2 places. Now everyone sends it to 1 place Dallas and from their they sort it out to somewhere else. You cannot be sure which place you will get. So just omit the USCIS address from the top of the letter as you are not sure if it will go to VSC or CSC.

Yep the example one is out of date, it used to be correct because you sent it to 1 of 2 places but they dont do that anymore and everyone sends it to the Dallas lockbox which then sorts out the petitions between 2 places.

Just omit the address on it.

You do not need an address on the cover letter.

If you have prepared it already, I believe that it is nice to have the cover letter with any specialized detailed signed by both of you. It is true that it is the USC petitioner submitting the application and really only I had to sign off on it, but I had my fiance sign the cover letter we wrote that respectfully addressed/explained his extended full latino name and his variations of mailing address as we did not know if they would be needing spanish street addresses or english street addresses......
