We are having the same experience (I wouldn't call it a problem). The only thing you will have to worry is TIME. There are many factors that will affect your visa process. You might run out of time and your baby might have to be delivered there then after he/she is born you will have to get passport for your baby but your visa should be the same except that you will have to get an extension for your visa. I don't remember the exact details but you can delay your visa interview for 4 months and if you have your visa already and you can't travel because your pregnancy or because the baby is too small you can wait up to six months to use your visa. You will have to verify the exact times this is just what I can remember from reading here in VJ.

Thanks everyone. Here is the decision we came up with:

My arrival to Egypt is scheduled on 09/22
the wedding is on 09/23
honeymoon is already reserved also


1st: We thought about me sending a specified power of attorney intended for "marriage purpose only" to someone like a relative or a friend, we are trying to convince her brother to do it. and if agrees then i will mail her the power of attorney and they get the marriage certificate done. then i cancel the K1 visa and get the new documents for CR1 ready and file as soon as i receive the translated/certified Egyptian marriage certificate. its an attempt to buy some time instead of waiting until i file after i come back to the US from the wedding in Egypt & Honeymoon.

or

2nd: If we cant find a way to get a marriage done via power of attorney. then we will just get married according to plan and i will have all the documents ready to be mailed except for the marriage certificate and i will just mail it to USCIS from Egypt while in honeymoon :(

I know USCIS investigates and microscope and the whole thing. They would not find anything NOW because we are not married yet. And we were planning to get married again after entering the US. we thought each government would have a wedding date and that they would never conflict. how would each government find out about the other date?...USCIS asks the Egyptian government for criminal history as far as i know, lets say they check on martial status as well..lets say they ask her martial status when she applies for citizenship years from now, would the Egyptian government give the wedding date they have!!

p.s. i m starting to feel where you are coming from. if i do cancel the K1 visa...its going to be wait time from hell...oh god...i know you guys would say wait now and have a piece of mind vs take the chance and risk getting her deported years later

Possible out, as I don't know the rules of marriage in your country, could you have a ceremony there that is not registered with the government but only qualifies as a religious marriage.



Thanks Belinda, well unfortunately. we do not have "for show" ceremony in Egypt. really the whole point is for her family to see and witness a religious marriage and feel that they handed her to me under god...etc.
so I'm stuck now??!!..me & her like all of you guys can not wait to be with each other. we don't mind the wait for the visa but we wanted to "be" married as soon as possible ASAP. not just because we love each other but because of many other issues that are rising that are trying to part us apart,...i don't want to get into details.

Ya i was intending to reply on a thread and may be i started one by mistake. wasn't intentional.

Relax guys, we have not gotten married yet. i was just asking how would they be able to find out if lets say we get married in Egypt "AFTER" she gets the visa. like even 1 day before she travels to the US...just to make her family satisfied. Which means after the background checks are done and she has the visa. And we still get married in the US again few days after.

and please...no one needs to get defensive here. im just asking for your opinion not your "conscience" .. lol with all do respect to all of course

I am in the same BOATTTTT...and i need an Advice guys

We applied for K1 visa. we are Muslims and she lives in an Egypt. so as you all probably know that my fiancee's family will never allow her to leave to the US unless we get married in Egypt.

so i know you are going to ask why we did not apply for CR1. well simply because i can not travel to Egypt often due to work & financial reasons. because we thought we can apply for K1 and start the process and i get married to her after the interview and after she get her visa!!! and not mention that we did get married when she arrives to the US. and we get married again (civil marriage) in the US and apply for AOS using the US marriage certificate not the Egyptian one, right??!! i mean how would USCIS know about it.

Ideally, he should stay out of the US at least as long as he's been inside, so 3 months. That doesn't mean he'll definitely be denied if he comes back after a week, but chances are greater. He can still visit during the K1 process, and even if he does end up getting denied at the border, it won;t have a negative effect on the K1 unless he lies (like, says he doesn't have a fiancee or something).



I have read on here that there is a certain time he shouldnt visit... is that after the NOA2? Up until then he is okay to visit?

Basically... I'd love to know what are the exact things to NOT do so we can just follow those rules. It seems so iffy and confusing. I've been researching this stuff for 2 years now and I still feel scared to go forth with filing in fear of him being denied entry after going through the entire process.

First and foremost, thank you in advance for taking the time to help me.

My fiancee and I have planned to file in March for our fiancee visa. We were just talking the other day about him coming back to visit once more for 3 months [the maximum legal time he can stay] and THEN filing for the visa.

He is due to leave tomorrow back to England [where he is from]

He has been here for 3 months [90 days tomorrow]

My question is... how long does he have to stay out of America before being able to fly back and visit again just as a tourist for 3 more months?

ALSO...

More importantly... is this frowned upon when filing for the fiancee visa AND can it hurt him [be denied entry] when he tries to go through the port of entry AFTER obtaining said fiancee visa


We would love to see eachother for 3 more months during the summer before going through the process of filing for the fiancee visa. We have been together for 2 1/2 years already and hes been here 3 times and me to england once.

The tax-preparer usually adds business expenses/deductions that cut into the total yearly income which bring the gross amount slightly below the poverty level. I had figured that the number of applications on Igor's list are not representative of the whole I would have thought maybe it is about 1/2 of all the applications received by USCIS. But 4% ?!? Do you think it is that drastic? Did you get this % from somewhere or is it a wild guess?

4% is a pretty good estimate; it might be higher but I think it's definitely less than 10%

When I was waiting for approval, I would check the USCIS site and it would give the number of petitions waiting and I used that number along with the number we have here at VJ and figured out a percentage close to 4%.

So, yeah, we're a pretty small percentage.

I dont see how this is in short time... I have seen alot of peoples timelines and they received their NOA1 whithin a few days.
I understand i cant speed them up but I ean anything we can do to be ready for the next stage... for example having forms etc prepared so there not much extra wait time..

You're right, you can't really speed anything up. Just make skype your friend and good luck with the wait.

What I would suggest is check out the UK section in the Regional Discussions. You'll probably find people there who can let you know what the interview process is like and let you know what the embassy there expects.

hi all VJers! :)

i just recently discorvered Igors list. Im finding it very addicting but unfortuantly agitating because your seeing others approved then yourself, things not going fast enough etc... I cant help but look everyday though... I looked on there yesterday ( we are recent k-1 filers to VSC by the way waiting for our NOA2 lol :) ) and our number in line was 469..i looked this morning we were at 468, now tonight i looked and we are at 470. I can see the fact of us moving down on the scale 469,468,467,466,465..etc. but my question is WHY would we move back down i dont really understand it. we seem to be ahead of some other people in receiving our NOA1 hardcopy on there but our numbers keep fluxuating. why is that? why would we move back farther down on the list?

(maybe im just not understanding this thing at all and have it completly wrong this Igors list...please let me know!) thank you!

Here's a reason you might move down on the list: If somebody joins visa journey and fills out their timeline then they could be placed ahead of you if they received their NOA1 before you. The might have started the visa process before you but not found visajourney until later. So, they would be ahead of you in the line and that would move you further down the list.

Hi. I had my interview last September 2, 2011 and was approved for a visa. I've been checking both 2GO e-trace (MNL case number still invalid) and Manila Embassy's email since then to no avail.

The embassy emailed me September 12, 2011 stating that my visa has been issued and will take 5-10 business days. I just checked earlier today (September 14) with 2GO (branch and online) but it still isn't with them.

My flight is on the 22nd. Why is it taking them so long? I live an hour or two outside of Manila.

It's a bit frustrating since I can't schedule CFO seminar (I want to do it one time with the visa on hand since I live outside of Manila) and it seems too close to our planned flight. :(


For what it's worth, we haven't been able to track our visa online. But she called 2go and they were able to let her know where her visa is. They weren't able to find it by the MNL number but they found it for her using her name. You might want to give that a try.

I had my visa complete on 31 Mar 11, but it was too late for April's appointments. The NVC told me to call them at the close of the second week of the month, that is when the embassies close out all their appointment for the month. I called on 14 Apr and they had scheduled the interview for the end of May. They explained that the visa's are issued in the order they are received so if they are back logged you get pushed to the next month.

You can marry overseas and still apply for immigration visa you are there you are on orders from the government your home of residence in the states does not change. My soldiers did this all the time when they married third party nationals in Korea. Good luck ....and yes DEPARTMENT OF THE ARMY civilians did it as well..

Bottomline upfront provide what you think will prove you have a valid relationship, intimate conversations are not required. If anything conversations with more substance that prove you are trying to know each other will prove much more beneficial. My husband and I spoke about everything under the sun and we provided only conversations that we wanted to share. I spoke to his family on several occasions and I provided those to prove that it was not just him and I but that both my children and his family approved and accepted the relationship.

In our case the CO did read our conversations but when my husband went for the second interview it was not the same CO he interviewed with the first time.

Completely understand your frustration. My husband went to his interview and they put him on AP for 61 days before he got called back for a second interview. You can call DOS and find out what type of AP he is on local or at Washington, D.C. In my husband's case they kept his passport which was a good sign but I also heard of others whom they returned the passport and they still got the visa approved.

It is not a denial if it was denied the case would be on it's way back to USCIS. There is no standard on how long AP takes it could be up to 1 year or less depends on what they are researching. We were not missing anything and still got AP others were told your visa is approved but placed on AP so it all depends on the CO. Be patient and keep your spirits up, you have not been denied. You can do an inquiry with the consulate after 90 days.

I do not recomment rescheduling, have your spouse scan the documents and send to your email. You can go to a cyber cafe and print them, just have the documents they do not have to be originals. My husband did not have original copies of any of the bank statements or tax returns and they accepted all. If push comes to shove have him scan the document that shows he sent them but they have not arrived and therefore you have to provide copies and not originals but I think this is really overdoing it. Do what makes you comfortable but we used were not originals.

Proxy Marriages are still considered legal, you paid someone to stand in for you. She is married and therefore should not file for K-1. If nothing else that is why the military accepted the certificate and updated DEERS. If the Army does anything correctly is annotate who is entitled to Government benefits to include monies Soldiers get when they claim being married.

This is a advice from a 22 year Army veteran that was AG (Adjutant General Corps for 13 years).

They are claiming married for a reason, file the CR1.

They kept your passport that is a good sign, did they kept the blue slip inside the passport? If so this is also a good sign. The fact that they set a second interview date is great. My husband was in the same case they kept his passport but they took 61 days to call him back he was placed under Administrative Processing. Just be prepared for the second interview and bring pics and anything else that proves the validity of the relationship.

Bottom line up front, you can move as you please but yes you are required to update your address sooner is better than later in case USCIS needs to contact you you and I think you will want a green card mailed to you eventually. A case pending is irrelevant, if you are an immigrant the USCIS has to know where you reside especially if you have any additional processing you will do with them in the future.

If he does refile, ensure he sends it certified return receipt or express that way you can track the peice and can see exactly what department and who signed for it. I never sent anything to USCIS, NVC or the consulate that could not be tracked.

If he was approved you can hope you get a quick call back once those documents were submitted but they could take longer if they place him on AP. I have not seen too many AP cases for K-1. One good sign is that they kept his passport. Just standfast and if you don't hear anything after 14 days call the Department of State to get an update or call the consulate but I never got any positive feedback from Casa they took the time they needed to process the case.

You do need the interview letter for the medical exam to be completed. The visa forms are online and you can fill them out and scan them in pdf format and email them to him, I did that and they accepted the forms. I would recommend he goes to the embassy with the email trail from NVC stating they sent it to the consulate and wait in line outside and talk to someone at the window to see if he can get the letter from them he will have to insist he needs it for the medical exam. It beats waiting on them to mail it to him, mail service in Morocco is very bad. I would call now and set the appointment with the doctor just to get on the schedule atleast 5 days before the interview. Dr Alan (Alain) gives you the results the same day. He needs a copy of the interview letter and any pictures (3) of himself.

He will need his birth certificate, court report, police report (originals) and all translated into English there is a translator in Rabat that also does this is one day. Oh and two passport pics US size the photo places know the required size.

Bring conversations with any additional pictures.

I got the interview letter in April via email and the hardcopy got to my husband's house three weeks after the interview.

I think you will be okay you just have to move fast, first finish up the correct affidavit of support (864 with sponsor's signature), attach a letter explaining the situation (signed and notarized by you) along with any documents you have from the IRS and the chart I provided. It is still proof from the organization of her exemption, proof of the policy/regulation that the sponsor is exempt and show proof of her earnings 1099 (SSA) and Retiree Account Statement. This is more than enough proof to show that she makes enough money to sponsor him as stated by the income guidelines for sponsorship.

Good luck and God bless don't stress out now act and fast, he needs the paperwork as soon as possible so if you can afford it use some type of express service do not recommend US postal service or FEDEX they only guarantee express service to the US border. I believe DHL guarantees door delivery, look at Silverberry1331's profile she used express service as well she can give you some insight.

Just keep pushing, relax once it is all over and he has the visa in hand.
