The questions i posted here are different and regards K1. First i wanted to know if we can cancel K1 and start CR1, Secondly if we will have any issues having her enter if we CANCEL K1 ( my other posts didn't take into consideration canceling K1).

Thanks for all your help.

K-1 Fiance(e) Visa Process & Procedureshep in scenarios !

1.. shouldn't be.. circumstances change all the time, just be honest and never lie on forms..
2.. are you trying to get her into the country and she stays? would you tell the OFFICERS at the POE that she is your wife, entering USA on Tourist visa.. BUT she will be going home..

hmmmmmmm very interesting..

to answer your questions on the second scenario -No she would not stay. She would enter to visit then when her allowed time is over she would go back to Jordan to wait it out. At airport , if she's asked who are you visiting, i think she would have to be honest and say visiting brother and husband ( should she say only brother? which is partially true)

I did have another scenario for everyone:

3rd scenario: If we continue to process on K1 , would it be possible to have a church ceremony and party ? its just a ceremony w/o signing any contracts at church before my fiance leaves to be married in the States.

Thanks

K-1 Fiance(e) Visa Process & Procedureshep in scenarios !
Hello VJ friends !
I need your help and opinions with the various scenarios i have for my fiance and I. I recently got engaged to my fiance who's from Jordan and we have some questions. Keep in mind, she is currently holding a tourist visa that she got a year ago that may come into play.

First Scenario : IF we start our K1 visa and then decide to get married, is there any consequences to back off K1 and start spouse visa? I know i'll lose the application fee but wanted to see if there are any implications

Second Scenario - If we back off K1 visa in the first scenario , got married and she attempts to enter the US on her tourist visa. Would she have a problem entering the US? She obtained the visa a year ago before we got engaged and i wasn't in the picture. She has a brother in California and got the visa to visit him. I know in this kind of scenario you would have to have proof to argue your case to have ties back to your home country and she will have a return ticket, letter form her work that she has a job, bank accounts, and car registration. My question is if we cancel K1 , got married then attempted to have her visit would she have issues as the officers at airport will have the info that she applied for K1 ( i am assuming can someone confirm? )

I may have more questions but those are the ones i need some help on at this moment.
Thanks all !

K-1 Fiance(e) Visa Process & ProceduresHELP!
The family is all fine. The younger boys left a candle lite and fell asleep. No one was injured during the fire, but I am sure there Daddy has beat their behinds since then ;) We are finding that the problem is everything is already closed for the Holidays, so we will not be able to get anything replaced until next week or the week after. The birth certificate and medicals are my main worry. I am just wanting to cover all bases since it is better he get everything needed from there then try to get it once he is here.

K-1 Fiance(e) Visa Process & ProceduresHELP!
My Honeys Uncles house burnt down last night, thankfully everyone is ok. HOWEVER, our WHOLE visa package was in the house. EVERYTHING but his passport. Praise God for that part! SO, my question is what exactly does he need to get so he can enter. I know he has to get his birth certificate & his medical. What else will we need to replace immediately for the entry and then AOS? Please help!

Thank you all for the info. I am to the point that if he has to have another physical, so be it. All of this running around and going state to state to get verification for verification is getting tiresome. I am just ready to be done and have him here!

K-1 Fiance(e) Visa Process & ProceduresThe Do Not Open Packet
I have told him a million times DO NOT OPEN, lol. Poor guy. I just read the instructions for the I-485 again and from my understanding we will not need the police certificate again, but he will need a copy of his medicals to submit. Is that correct? Since we aren't a special class and he has no criminal history. He just has 1 ay to replace his birth certificate and medicals, so we want to make sure we are in the clear and he doesn't need to get a new police certificate as well.

K-1 Fiance(e) Visa Process & ProceduresThe Do Not Open Packet
Ok good deal. BUT are you sure they will give him all the information back at POE? I am fairly sure we will need that to file the AOS? Thanks :)

K-1 Fiance(e) Visa Process & ProceduresThe Do Not Open Packet
As I posted before my Honeys house burnt down and we lost all of our paperwork. He got the visa and packet today (THANK GOD), but I want to make sure everything he needs to enter is in the packet. I am particularly worried about the medical and police report. He is going to get a new medical in the am, which will not include all of his shots as some were done in another state. He will re-take those before we file AOS. Do we need the police report to file AOS? Also, do they return the packet after they review it at POE? Thanks as always!

K-1 Fiance(e) Visa Process & ProceduresManila Hotels - Pay by credit card from USA for Fiancee

Regarding the medical in Manila, anybody have any trouble booking a room and paying for it in advance by using a credit card from the USA so your Fiance can just show her I.D. and they will give her the room ? I know this can cause some troubles. Do you have any experiences in this ? Which hotel ? What procedures ?

Does she have to have a copy of my credit card with her ? Did you use Agoda.com or call directly. Help me ?

I had to go round and round with Marriot Manila to get approval for her to arrive before I do with just her I.D.

We used Cherry Blossoms. They didn't like it but did wind up sending me several forms to sign and allowed it. The night clerk said no but the manager worked it out. It's about 1500 Php per night, walking distance from the Embassy and St. Lukes, decent accomodations, right by the mall. They have Airport pick up service but it's high (700 or 750 Php) but he's trustworthy and helpful. My wife was more at ease with the same hotel and he picked us/her up and was the last person she saw when she left. We had 3 Uneventful stays there. Cherry Blossoms

My opinion is: Beware this topic in Visajourney! Go to any outside .gov source or an attorney. When someone sends you a link to this topic and it is a Visa Journey link it's too full of opinions by non-professionals to trust. My advice is to do your own research or get an attorney. My experience has been that many people rally in support of individuals and NOT facts: This is a complex topic adressed here without data to back it up. We each have different experiences. This comment will probably get removed but that's my experience.

K-1 Fiance(e) Visa Process & ProceduresImmigration Attorney

I've been working for several months without a day off, and I am still very unsure about doing the paperwork myself for a K-1 Visa. I've decided to hire an Immigration Attorney. I did a Google search and found several at prices ringing from $995 to $2495. I'm not certain who to use or who to trust. They all promise results.

If anyone can make a recommendation for an attorney, send it in a PM or email me at Hangernaid@gmail.com. I know this site is not for commercial purposes and I don't want to have a thread deleted by violating any rules.

I appreciate the recommendations.

Jim

I paid a Visa service to do the paperwork, he did all the paperwork from I129F to I131 advance parole form, he gave us the instructions, lives in the country of origin. It worked good for me and was worth the $495 I was out, I was able to afford it.

One of my VJ friends started with a service and wasn't happy at all with the communication or service he got. It sounds like we're in the same boat, I have a full time job and a secondary business.

The guy I used is in the Philippines and won't work another country. There probably is someone on this site that has this type of service available and will help you for a fee.

K-1 Fiance(e) Visa Process & ProceduresK1- AOS Civil Surgeon
I used a Civil Surgeon here in Fort Worth, Tx. that I wouldn't reccomend to anyone else, in fact I'd advise against using him. I did however get my Health Insurance Company (United Health Care) to reimburse me the $115 for the visit. The clinic refused to code it at all. I gave my insurance company the correct information, found the insurance codes myself and just received the reimbursement.

K-1 Fiance(e) Visa Process & ProceduresHELP! COMPLETE change of personality.... :(

So... I came here to the Philippines ONLY for my fiance, i've sent the initial I-129 packet off end of Dec, got notification of NOA1 around jan 4 but sad to say i just wasted all my time, money, and effort for her.... almost EVERY DAY we're arguing and she's too damn stubborn to listen or work out or anything..... all she does is run away and she thinsk that's the solution to our probs when it just makes it 10x worse!!! She is even avoiding her own family and doesn't even sleep at home anymore.... and dont even mention to text/call her as she doesn't ever reply to anything even V-day i just stayed by myself.... i even made up a story that i got snatched and you guessed it! she didn't even care and just hungup the phone on me bec she's too damn SELFISH and SELF-CENTERED & only remembers the negative parts of our relationship... really never met a more HEARTLESS girl then her it's quite sad bec before this trip she wasn't like this AT ALL otherwise i wouldn't have invested so much into her.

Anyway...... so needless to say, she doesn't have a copy of the I-129F i made for her.... and she also doesn't have the original receipts i brought.... im THINKING of coming back here in May 10 to surprise her in time for her bday later in the month and as a last resort to fix our relationship as by that time maybe i would already receive notification of NOA2...
i need to know what i should do with her complete copy of all the i-129 papers, and also the original receipts that she should bring to interview, if ever... should i leave them with a trusted person here? or should i bring everything back home with me and play the waiting game.... :/

i even took many pics of us in our few times we hungout together as "ongoing proof of relationship" as required by the NOA2, but didn't make any copies of anything.... including the hotel receipts. I just dont wanna waste EVERYTHING which is why im trying to utilize all my options esp. while im still here.

PLEASE HELP! DONT KNOW WHAT TO DO ....

Take the advice the other guys that have married Filipinas, ask more of them, ask other Filipina ladies. If you move on it will sting for a while but the right person is there waiting for a husband that will be good to her. When you go to the PI to meet her, she won't let you out of her sight, why? Because she will want to check out what you are up to just as much as you (should) want to know what she is about. I met someone who was deceitful before I met my wife. I don't know how, but this lady is deceiving you and more will be revealed if you move forward with this situation.
That's my 2 cents worth. Off line me if you want.

K-1 Fiance(e) Visa Process & ProceduresK1 Medical Interview and AOS
I would re-enforce what everyone is telling you about the CS, whether scam or not understanding the right CS can really streamline the process. Anything done prior to coming here will make it simpler. I actually shopped for a good CS, found one, then chose the closer one and not the best, most informed one.

My insurance paid for MMR as well but also the County Medical (Free) Clinic would've done them for $15.

K-1 Fiance(e) Visa Process & ProceduresRFE divorce decree

Hello,

On the subject of RFEs and divorce decrees....

We were issued an RFE regarding our divorce decrees. I am not positive whether it was mine or my fiance's or both, but I requested another copy that looked like the same thing I originally sent in. The only difference might have been a small rubber stamp at the bottom of the first page with a box checked. In her case (China), she gave what is always given. The civil administrators in China assured her that what she was given is what all couples are given and that they were well aware of what was required for a K-1 visa to the U.S. So, in the end, she turned in the same documents. And now we wait....

I post this more as a cry into the void than anything else. I have tried my best to read up on all things related to K-1/K-3 visas, but it is still hard to sleep through the worry and waiting and uncertainty. We are using a lawyer and I hope that was a wise investment. I felt confident that using a lawyer would save us such things as the current RFE that we are awaiting second judgement on. Now I wonder...

I just wanted to say this, purge it if you will, since this seems like one of the few places where I know I am among understanding folk. I am grateful for this website and the answers and encouragement it provides. Hopefully this will be the "minor bump in the road" our lawyer assured us it would be.

Thanks for reading and thanks for being here for us. There are times when going through this process feels very lonely. Best to all of you.

Steve

Same here RFE divorce decree. I resubmitted the decree and even made a small coversheet. we had our NOA2 exactly 2 weeks later.

K-1 Fiance(e) Visa Process & ProceduresMarrying before getting SSN

Like many of us, my fiance and I would like to get legally married very soon after he enters the US with his K-1 visa (and then have the friends/family wedding ~2 months later), in order to speed up the timelines for work, travel, AOS, etc. However, when I checked the requirements to apply for a marriage license in my state (Massachusetts), it appears that the state requires a SSN from both parties in order to satisfy federal reporting requirements to do with making sure people are in the US legally. We would rather not wait the 2 weeks until being able to apply for the SSN (and I imagine that it takes even longer after the application to receive the number).

How does this work if you are in the US legally on a K-1 visa but do not yet have a SSN? People must get around this if it is possible to get married on a tourist visa and then return back to your home country for CR-1, as some people do. Does anyone have experience with this, particularly in my state?

Thanks in advance for any helpful experiences/information that anyone can contribute!

I don't know about a Federal law but my state (Texas) has an SSN requirement on their website but when I called the county clerk's office (marriage lisence office is in county clerk's office here) I discovered that we didn't have to have one.

I will also add that I put this on my timeline: That my fiance arrived on a Wednesday and we filed for her SSN on Friday. The SS office here in Texas told us it might take 2 weeks longer to get it processed since she had just arrived, but she had the SS Card in 17 days.

 Good that you're looking toward the AOS, that $1070 comes real fast after all the airline tickets, honeymoons, etc.

K-1 Fiance(e) Visa Process & Procedures...less than 30 days in total

Guys , I decided to ask the question as someone mentioned that in one of the posts today. Is there anyone here, who has been granted a K1 Visa even though you spent physically less than 30 days together?is there any rule when it comes to the time at all?

Me and my fiance met 4 times within the past year but it total it was only 25 days face to face!Could that be a problem in proving a bonafide relationship? We have full time jobs and it's not really possible for us to see each other for longer :(

We physically spent 1 week together prior to my fiance (wife) coming here.

Well, my fiancee is in the Philippines and we just went through all interview process and everything. I was not there because of work obligations at home, not to mention the money it takes to fly. I figured no big deal so I set out to find where I could get one. To my surprise I found out that the US does not have any legal document like that. I'm really not sure what to do. Has anyone else been in my situation and what did thy do? Also does anyone know how long it takes to get the visa back from the embassy? PLEASE HELP!!

K-1 Fiance(e) Visa Process & ProceduresNOA2 - Approved - I129F - K1

Hi all,

Today at 11:30AM I got a message from USCIS stating that my K1 was approved. It was five long months. I am so happy and I wanted to say thank you to all positive comments I received.

For those still waiting, keep your faith ... I know it is hard but just stay strong.

Good luck for all of you.

Now, I have to wait NVC and consulate procedures, but the worse is over.

Thanks a lot GOD. I hope that soon, my new family and I will be together.

Ciao.

K-1 Fiance(e) Visa Process & ProceduresNVC FOLLOW UP

If i call NVC what information will they ask from me to know that my case is already with them? is it my case number from USCIS?

Yes like A&B Mentioned you will need
Your WAC # or USCIS Case number,
Name and DOB of both of you
And other information like email to verify other info to confirm your identity.

Once you identity is confirmed you will ask for the Case Number so you can set your interview appointment .....
it will begin with MNL for the Philippines and your priority date (usually the date they received your documents on the original file)

Then you will have your fiance go to a BPI branch and pay the MRV VISA APPLICATION or interview fee. She will need the case number, and her passport. Then they will give her a receipt and you can set your interview about 24hrs later.
