My SO does not speak much English. I typed up his statement of intent to marry and then explained to him what it said. He took it to a notary to sign. He explained to the notary that he understood what it said and then they notarized it. The notary stamp is in Spanish. We were approved just fine.
I can't see that the language barrier will be an issue until you get to the AOS stage and have to interview. (Unless Ncaragua allows USC's to accompany fiancees at the consulate interview and you intend to be there). At the AOS interview you will both definately be there. The CO may wonder how you communicate with each other. I would take this time to work on your Spanish now and be better prepared. You won't need to speak on an educated level, but you will need to show that you two can communicate.
I think the documents being in Spanish at the Consulate level would probably be ok, but I would check to make sure. Any documents that you send to USCIS or that you use with AOS interview will need to be in English.

I'm sure they would still receive some sort of receipt and still receive the NOA1 in the mail. To me, it would be worth it to hand deliver if possible to avoid paying a lot more money. If they send the packet now, it should be fine, but they may not have it ready yet. No?

I-129F: I would put whatever her name was when you divorced so that it will match your divorce decree (don't forget to send a copy of that also)

G-325A: I would list all employment for last 5 years. Since you've had your primary job for 15 years, you'll have plenty of room to list everything.

Evidence: I wouldn't tape the tickets to anything. Put them in some ziplock bags or something and attach the bag to a piece of paper or something. You can list what the evidence is on the paper or attach a label or sticky note or something to it. If you have pictures, place them in a baggy too and on the back of them, write who is in the pics, date, place, etc.

I didn't write on the back of mine because I sent it off before finding VJ. I was approved with no problems. However, looking back, I should have written on the back just for clarity. The pictures that I'm sending with my SO for his interview have writing on the back. I only wrote who was in the pictures though since some of them are of him and different members of my family.As far as your variety of pictures goes, I think that fine. In fact, I think it is good. Not only do you have 'going out'pics, you have pics of a normal couple sitting at home in a normal situation and not posing formally for a camera. Good luck! Your journey begins.

It is unlikely that she would be given a tourist visa unless she can prove strong ties in Mexico and prove that she is not obtaining the tourist visa with intentions of immigrating to the US. This will be difficult for her to proves since you already have a K-1 petition in progress. My opinion would be to forget about the tourist visa and save your time and money. When they see that a K-1 visa petition exists, they will deny her the tourist visa.

1. You do not have to send proof af being able to support her at this stage, but you will at the consulate interview stage.

2. Yes, it is recommended that you type in the information for these forms then print and sign. G-325A will print 4 copies. Sign and send all 4 copies for each of you.

Absolutely. If the evidence shows the petitioner visited you four times in the past two years, or even once, it won't matter if you ever came to the US.

If there was only one visit, yours, and you failed to give the primary evidence, then you would either get an RFE or denial but that's not the case here.

Yes, if you get an RFE, you should receive notice via email and case status online. However, some people never receive notices. If you are fortunate enough to receive notice, it will not tell you what the RFE is for though. You will need to wait for the notice in the mail.

If they can not cash the money order, they will send the packet back to you. That's what I've heard as far as sending a check for the wrong amount anyhow. At that point, you may want to consider sending a personal check so that you will have your number before receiving the paper NOA1. You can go to Western Union and get your money back. Good luck!

Well I guess this is a goodbye from me to all of you.

On Tuesday my fiancee sent me an email with a letter attachment telling me she can't marry me because she no longer loves me.

We have been together for almost two years, been through so much ####### together and just when everything was starting to fall into place she does this completely out of the blue.

Everything I have done in my life for the last 14 months has been geared towards finally being with her and now she has flipped my world upside down and left me nothing but a shell of a man with no idea what to do next.

Question from petition 11, I-129F:"Have you ever filed for this or any other alien fiance(?) or husband/wife before?"

My question is, should or shouldn’t we show that my fiancé already filled the K1 before and brought a bride to USA, that afterwards left before 90 days were over?

The two different lawyers that we asked about that matter, each gave us different information:

The first one suggested: we should definitely show, and on top of that, we should show the proof that she did leave USA.

The second one said: since the marriage did not happen, and the 90 day law was not broken, and mainly- no documents were filled in order to get the Green Card, so it will just delay our case for several more months.

I personally think that we should show that, because I’m concerned that the officers will see that he filled for another K1 in past anyway, write it or not.
My fiancé thou, thinks that I am not familiar with the American system and if no rules were broken with the last K1, we shouldn’t refer to it.


USCIS will know that your Fiance applied for and that he (actually his fiancee) was awarded a VISA in a previous petition. If you answer "No", it would be an obvious lie. And it will not just "slip" past USCIS. Interesting that your Fiance thinks he is smarter than the "American system". Wow, that speaks volumes! Do the right thing today and you won't have to pay for it when USCIS starts the investigation.

Not a problem. You can monitor your case online at USCIS website. When you receive your first "touch" you will know they really have your info and are working your case. You may want to double check that your address is correct. Look atthe copies of the I-129F that you sent to them. It could have gotten lost in the mail, or maybe USCIS is just a bit behind with yours. Your case number, as you have found, is on the back of your cancelled check. You are OK!

This is my first time posting on here, and I'm kind of at my wits end...

I received an email receipt on Jan 23 (the actual NOA "received" date is Jan 12) for my I-129F. It's now February 23 and I have yet to hear anything else. I know everyone goes through this paranoia, thinking "What if they lost mine? What if I'm supposed to be doing something??" and this is basically where I'm at right now.

I am working with an immigration attorney who only answers me in 1-word responses via email, which makes me feel like I'm bothering him. I have tried to contact someone- ANYONE- at the USCIS customer service number and it seems like I get caught up in an automated-hell. Does anyone know how to get a hold of an actual person??

Is this normal to not hear anything besides my NOA1?? I saw that some people received an NOA in the mail- I never got one of these.

Also, my fiance and I are planning our wedding at the end of August. With a received date of Jan 12, does this seem like enough time for the full process to be completed?

This experience isn't nearly as funny or kitschy as the movie Green Card... <_<

AOS is Adjustment of Status. After you are married, there are another series of forms that you need to file with USCIS. This enables the beneficiary to stay here on a conditional basis, to work and eventually get a green card.

The beneficiary has the option to have an interview in English if they speak english. Otherwise, it will be in portuguese. Fernanda speaks no english. Her interview was in portuguese.

Hi. I think I understand this portion of the Fiance Visa instructions application but I just wanted to ask to make certain. In the translation instructions it states the following:

"All documents neither in English nor in Portuguese must be accompanied by certified English translations done by a Sworn Public Translator."
The translation must include a statement signed by the translator that states that the:
• Translation is accurate, and
• Translator is competent to translate.


Does this mean that translations are only required for languages other than English or Portuguese? For example if our emails were in Chinese then we would need to get the translations to either English or Portuguese? But since our emails are in either Portuguese or English then we will NOT need to translate all the Portuguese emails to English. Is this correct? Thanks.


No, you don't need to translate emails. Translations are only required for languages other than English or Portuguese. The Consular doing your Interview speaks english. Since the native language of Brazil is Portuguese and the interview is in Brazil, nothing needs to be translated.

It means that YOU must have all your information to the Consulate BEFORE 9/14/2007. The Consulate can schedule your interview anytime before or after the 9/14/2007 date. But you need to make certain that all your packet 3 docs are at the Consulate BEFORE this date.

If your interview is after this date and was scheduled by the Consulate, no problem. You don't need to reschedule anything. In fact in many cases it is almost certain the interview will happen after the NOA2 expiration date. But again, YOU only need to ensure that your documents are at the Consulate BEFORE this date. The Consulate will take it from there.

I noticed that most people here are filing the K-1 Visa without an attorney. Or, I should say no one mentions using an a lawyer. Has anyone been successful in filing this way. Next...can one of the senior members detail a list of lingo used in the timelines? For instance, what is NOIA? I see that a lot. It would be helpful because I am preparing my K-1 application for my Ghanaian fiance. Oh one more question...I just got back from Ghana and cannot bear going and leaving my fiance again. It was really tough. But, do you think we will have a better chance if I visited again?

When mailing in the 129-F, did anyone include evidence of marriage plans other than the statement of intent to marry? Me and my fiancee really don't have evidence of any of this...some e-mails but nothing like concrete plans. We were just planning on doing something really simple now, so there are no invitations or guest lists or anything of that nature. We mainly discuss this on the phone.


They want proof that you met in person in the past 24 months. They don't want any proof of wedding plans.

4:00am this morning my fiance called to say interveiw went perfectly and he will have his visa in a week!!!!! My honey is coming home! What an incredible, heart wrenching ride this all has been. But in the end worth every tear shed, every minute spent missing your fiance. For all of you waiting months and months god bless you. Our visa was approved start to finish in just under 2 months (and thats with the holidays). I guess we were EXTREMLY lucky with the right service center and consulate. I'd suggest doing it yourself. It is not difficult. We did it! The answers for all your questions can be answered here at VJ 24/7. The Guides are great assistance and the example forms give clear advice as to what you need to do. Unless there are some serious legal things happening in your or the beneficiary's life, I would not think a Lawyer is necessary. Other than filing paper and waiting, the Lawyer does the same thing you'd be doing. An attorney cannot make the process go any faster. Save yourself some money. But in the end, you do what makes you comfortable.
