Hey thanks for all the positive feedback on my last post. My fiancee lives in the Philippines and she is in the process of getting her passport. The only problem is that her family name is misspelled by a single letter on her Birth certificate. What is the fastest way for her to get her passport. She actually lives in Butuan City. Any advice will be appreciated. Thanks for all your help.

Hey boys and girls...Its me again...The crazy Texan with mucho problems....Anyways here is whats going on. My fiance is having problems getting her passort in time for her interview in Manila. Well according to NVC here in the US, I received the letter on 11/07/07 that they forward my case to the Manila embassy. So I guess, people with similar timelines have there interviews as early as the first week of December. The problem is that my fiance is now in the process of getting her Birth Certificate corrected (because of a misspelling)through the NSO. She said that she should get her Birth Certificate on the third week of December. After that she has to travel to Cebu to get her CFO certificate then get her passport. So I am thinking she probably wont get her passport maybe at the end of December or even early January.....My question is that can we delay the medical and interview because of the situation with the passport...What can we do...Please any response will be greatly appreciated.

My wife passed her interview in September 2007 and now wants to bring her 18 year old daughter to the US. I have read most of the material which says that her daughter has 1 year to come to the US from the date my wife’s Visa was issued. Her daughter’s name was on all the paperwork with the status that she would travel later (follow-to-join) at a later time.

Q1. How do I initiate the action to bring her daughter to the US?
a. I-824 form along with $340 filing fee?
From the State Department website I read that (http://travel.state....types_2994.html) “A separate petition is not required if the children accompany or follow the alien fiancé(e) within one year from the date of issuance of the K-1 visa”.
b. Write the consular section at the consulate where the Visa was issued (Guangzhou) and ??????

How do I initiate the action?

This is a good place to come for advice, help, and encouragement. Not everyone here has a success story, but most of them are still encouraged and fighting (or waiting) for what they want. It's not an easy process, but it's not necessarily a hopeless process either. Everyone here is in the same boat. There is a ton of help and encouragement to be found here, but the only magic formula for obtaining an approval is meeting the requirements. We don't make the rules, we just follow them. If you sincerely want your SO to come here and marry you, then you must concentrate on meeting the income requirements. And I must again add that meeting those income requirements is only the beginning. It can become very expensive and before it is all said and done, you will have spent a few thousand dollars (at the very least). Don't take all of this as discouragement. Take it as 'now you know what you need' and go get it. In my personal situation, I meet the income requirements. But it's all of the other things that are draining me finacially. I'm trying to prepare for our trip to the consulate which will be expensive as well as getting our documents prepared and then the AOS fees that will come shortly afterward. I'm pinching pennies now to make sure I have them for later. You can do it. All of us here are doing it. It's just a matter of 'how badly do you want it?'. Keep you head up. It's a long hard road and it will definately try your relationship with your SO again and again. No one here is going to tell you that it is easy, but we will tell you that it is possible. I agree that you should seek a second job and with the money that you earn there (since you are already used to living on less) you should put into savings. The visa process is not cheap and it is going to get more expensive. By the time you calculate all the fees (which are going up), notarizations, fedex of documents, airfare for his arrival, etc., you are going to have to spend a bundle. Don't be discouraged. Be motivated! If you are truly in love, you will make a way for the two of you to be together. Best of luck to you!

I need my fiance too, I really do. Why can't they expedite all of us? Work with a sense of urgency. My fiance and I have a business together, for over 2 years now. I really need him cause I need a dang day off.
Besides, there is a box, on a really really high shelf i can't reach. And a light bulb that needs changing. I also need a back rub.

You know I am only kidding, but I do think they should work a bit quicker, and probably it is not even that. It is probably that they are under staffed, and they work very hard and long.

I live on the Texas/Mexico border. I have been using a notary to do my translations. (Everyone who lives in these border towns are bilingual) She translated the document and stated that she is bilingual (in different terms I think) and then notarized it. I think she had a stamp also (other than the notary stamp). She does translations frequently. Being a border town, people are always needing documents translated for official use. (I heard of her by word of mouth. They also do notaries and tax services and stuff like that.) She has only charged me $3 per translation to-date. Maybe there is a notary in your fiance(e)'s home country that is bilingual and will offer this same service?

this is a wonderful site for us with lots of great info. we followed every step metioned here to apply our k1 visa and now its approved. so i m waiting for my package to arrive.

just one question. Is it ok to get married while waiting for the k1 process. we both went back to our country and got married in a traditional way. its mainly for our parents and to enjoy the company there. My fiance who lives in US is not a citizen by birth. He is not registering our traditional marriage in US so that we could get married again there.

Will there be any problem during the interview or the visa process as we are married now.

Most traditional weddings in native countries are not considered official because they are not registered with the govt. Just family coming together and blessing the marriage in the native way. Young man, go ahead with ur fiancee visa and just don't mention it at your interview. Don't fret! I come from a country(not england) where traditional marriage is only recognised by your people that you are a couple but then you can't officially use the Mrs thingy yet. You still need to get married again in the U.S though to cover ur ###. Goodluck and I wish you all the best! :thumbs:

She can not leave the US after she enters until she receives her residency card. That could take around 6 months giver or take. How long will you be working overseas? Even after she becomes legal resident, she can still only be out of the country for a certain amount of time. (I don't know how much, so I will not speculate.) Is it important that you take this assignment at this time?

I would recommend to send all pages just to cover your bases and avoid a 'possible' RFE. I have two divorces also (from the same idiot...i know, i know) and I sent all pages of both. I will also be doing the same for the consulate interview. It's better to be overprepared than under.

Looks like we have approval at the same time. I have not been sent to NVC yet. Check out the 'Interview time for March filers' thread. We are all waiting, but you may be able to get a better idea about when you will actually show up at NVC. There is also a number you can call. 603-334-0700 press 1 for English and then press 5 for an operator.

Calling USCIS and the Consulate and explaining the inaccuracies would be all I can think of. However, making that information obvious would only mean for sure you need to fix it.

Your interview will still be down the road. maybe he could pick a day sometime between now and then to try to take some time off of work to get it fixed? I really do think it would be best to fix this now. Who knows? It might go by unnoticed, but I wouldn't want to chance it.

Does he have boarding passes, stamps in his passport, boarding passes or anything else that can show that he was there with you in person? This is the most important requirement for eligibility for the K-1 visa.

I would definately start making some phone calls. There may be a possibility that your case is under AR, but you need to speak with someone to verify where you are. You probably need to call DOS. 202-663-1225 You can't re-petition until there has been some sort of finalization (for lack of a better word) with your first petition.

Your dates are confusing and don't really add up. You're talking about a divorce that you went through during months that have not yet occured. I'm sure this is a typo, but please recheck your post so that we may better help you.
How long was your visit in Vietnam with your SO? When she exited Vietnam during your visit, do you exit with her? Do you have the same exit stamps in your passport?

Bill Y Bella, I'm sorry I can't offer specific help regarding your situation. And please forgive me for tagging on to your post regarding your secondary problem, but that is exactly my finance's "catch 22" also!

She has a passport. That passport has immigration arrival and departure stamps that are critical evidence for our demonstration of having met in the past 2 years. Her passport will expire about a year after we estimate (hope!) that her K1 visa will be issued.

We are concerned that it will take longer to get her AOS/LPR after she arrives here in the USA then the amount of time left on her passport before its expiration. The problem will be that then she will need to renew her passport becuase if it expires she will not be able to travel. When we go to renew the passport, once again she will loose all of the previous documentation in that passport: this time for the CFR, K1 VISA, entry stamp to USA, etc. All of which I would think we would want as documentary evidence for further immigration steps in the future .

What would be best is if she went to get a "fresh" passport just before her embassy K1 interview (actually before the medical exam where you first have to surrender your passport), so that that passport would have enough future validity time to survive and collect documentation throughout the multi-year immigration journey. But alas, the "catch 22" comes up again, because for her to do that, she would have to surrender her current passport which has the evidence we need for the K1 Embassy interview!

If anyone else has found a way around this problem, thanks in advance for sharing it here.

How long does it take to receive a passport in the Philipines? maybe she could use her passport for the interview and then get a new one before she leaves to come to the USA. Or maybe she can just make color copies of her current passport before surrendering it.
