Just like Zee said the only thing you need is the I-134 notarized. I sunt my fiance copies of everything else and they was not notarized. They granted his visa and he pick up his visa today.

K-1 Fiance(e) Visa Process & ProceduresI-129F papers mailed! It begins...
Hello all. I've been vising this website for a couple of months now gathering information for our K1 submission. Wow - what a wealth of invaluable information and reassuring documentation!

It is a little scary mailing all of these K1 documents since you never feel sure that you have done everything correctly... so I suppose it is only appropriate that I mailed them today on Halloween. wink.gif

I just wanted to say that I'm very thankful for this amazing resource... this is such a difficult time to go through (being away from your loved one, dealing with mountainous government requirements and paperwork, etc)... I would hate to think of going through it without all of this first hand knowledge and examples.

So - thank you!

And now the waiting...

...

Are we there yet??

Hi Malego,

Juarez

Gracias por todo,

K-1 Fiance(e) Visa Process & Proceduresk-1 or no K-1
My financee and I have retained a lawyer, and have also received our noa1

Now I heard from a co-worker (whose relative has done this same thing) that all I have to do is go over to his country (London) marry him, then go to the American Embassy over in London, and then be able to bring him back over here with me........

Is this true ? And if we go this route then what happens ???? (our K-1 is already sent )

Any help is appreciated...

K-1 Fiance(e) Visa Process & ProceduresQuestion ??
I have a weird question about the amount of money I need to make ... Its kind of complicated so here goes.

First of all. I made (according to my Check stubs) 23,108.00...but according to my w-2 it is 18,455.56.(this is because my retirement and my medical, dental etc is taken out BEFORE taxes ) Which is enough to bring him over....BUT not if I claim my granddaughter (which I want to do for obivious reasons)

Will the USCIS take this into consideration when going for the approval or do they just look at the W-2 ??

I have such a weird case, because right now my daughter lives with me, so I guess that could be a good thing and a bad thing.....as I am supporting her and the baby right now, but by the time he gets ready to come over.... then she might be able to co-sponser ??

Please tell me am I making any sence at all ???

And I havn't figured out how to put our timeline on here. Could somebody help me ??

Thanks

K-1 Fiance(e) Visa Process & ProceduresPulling my hair out
I have so many questions about this whole process I dont even know where to start .... I read one thing, think I have it down. Then I read something else and Im confused again.

I miss my baby so much, and Im so afraid that were gonna get turned down... The stamps on his passport are kinda faded and you can hardly read them.!! He dosnt have copies of his plane tickets to the US (where we met) or Canada (where we met up again last summer)

The only proof that I have is a Bus Ticket from Omaha NE to Toronto Canada.... But I live in Dallas (we drove to Omaha to visit family before I went to Toronto to meet up with him) ... so even that looks shady...

We do have some pictures together (4) and e-mails and phone records (which are from "Vonage" telephone service, so it looks like someone just typed them out....

Geesh. This is the hardest thing I have ever been thru !!!!! I feel like Crying every single day

Thanks for any responses

USCIS will go by your received date with regards to processing your petition. So they'll be using your July date, not the notice date. Best of luck to you!

Well, that's good to know. I still won't get my hopes up for a Christmas present, though.

It's barely within the realm of possibility, but yeah, I wouldn't get my hopes up either.

It would be an absolutely wonderful Christmas present though. At least we know they are getting nearer to our dates, and I do so wish everyone on here waiting a quick and speedy processing time.

Although I have been a lurker on the forum for some time now, and have found all of the information you all provide to be invaluable, I find myself with questions concerning the receipt date and the actual NOA1 date. I am hoping that perhaps some of you may have run into this same problem or could shed some light on the topic. Any advice would be greatly appreciated!

The received date on the NOA1 does show July 28, 2007, with a Notice date of August 21, 2007. This was due to the deluge of of applications received by the service centers at that time I am sure.
My confusion with this is that if I login to the on-line case status, which I do at least 30 times a day, it shows they received it on August 21, 2007.

Soooo, which one is VSC going by? unsure.gif

Thanks again for all of the information everyone has shared on this site!!

well i know when i call, they tell me they are going by the notice date.. so it seems that they will go by the august 21, 2007 date.. so even though they received it before july 30th, which is a good thing(lower fee), the actual date they are going by is august 21st.. they said 6 months on the website, then you should know whether or not you are approved.. sometimes, it's sooner.. that is their guesstimation date of course... i had to stop calling because it was depressing for me to hear the same date over and over again of when i got the notice sad.gif .. anyway, i hope this will help.. God bless

Thank you so much for your reply. I guess what is concerning me is that on the USCIS Application and Receipting Update site this is what is stated:
"Date Received in Mailroom – USCIS will honor the actual date that an application was received in our mailroom; this date will be indicated on the receipt (in the Received Date box) when Form I-797, Notice of Action, is mailed. You can see a sample Form I-797 under "Related Links" on this page. If your case is affected by the receipt delay, arrival of your receipt may take up to 12 weeks for adjustment-of-status applications and 15 weeks for naturalization and other applications.
Weekly updates on Receipting – Until this situation is resolved, USCIS will provide these weekly updates on progress in issuing receipt notices to our customers. Additional information is available in Frequently Asked Questions, located under "Related Links" on this page."

I have asked our attorney as well about it and he states it should be the July 28, 2007, however he stated that the August 21, 2007 is the date of notice of receipt being issued. I will need to contact him again today because I would like him to contact the service center to find out why it is not changed, and hopefully to have them change it or better yet have them take a look at our application and hopefully start working on it....

Great insight by all. Found this website which addresses all of the areas discussed:

I think there's an answer here for all of us, and it's really surprisingly affordable -- about the same price as me adding a spouse to my group coverage at work.

I've seen IMG advertised online, claiming that it will provide coverage for this specific scenario ("the ad said something like, 'want to get coverage before you're married?' on a page about K-1 visas).

Before I purchase again, I will definitely call to make sure, though! Thanks for the heads-up... Something worth looking into..

Just an update: To be sure, I called IMG and their Patriot America plan will cover the visitor, regardless of whether he/she is immigrating or not.

Excellent - exactly what I had hoped to hear. This will at least give us coverage until the "event" in April -- help fend off any potential disaster. I figure if I have insurance we won't need it, but if we don't...

Thanks for doing the research and sharing the info. That's what makes VJ such an asset.

Happy New Year.

K-1 Fiance(e) Visa Process & ProceduresMedical Benefits for Fiance(e) Upon Arrival in U.S.
Initial discussions with my company's HR folks indicate that my fiancee cannot be included in my group medical/dental coverage and would not be considered a domestic partner -- even though the intent of the entire I-129F process is to arrange for immigration to the U.S. for the purpose of marriage. Further, by completing the required I-134 Affidavit of Support form the U.S.-based partner is in fact required to certify support.

I'm hoping that there are VJers who have encountered this challenge and can offer some advice and insight. How did you provide medical insurance for your fiance(e) prior to marriage?

My (Trini) fiancée did. She actually got her B-2 visa after my I-129f was filed. We were just very honest and up front about everything, and my invitation letter explicitly said I wasn't going to marry her while she was on the B-2. There was no problems for us at all. (Every case is different, of course)

Good luck! Trinidad represent!! wink.gif

Hey, thanks for the note. Good to see more Trini couples on here! We've just decided to wait it out, though. I'm going to see her in December, so no white Christmas for me this year wink.gif

Congratulations on your approval, by the way smile.gif

K-1 Fiance(e) Visa Process & ProceduresVisit during K-1 processing

Yes, but she will need to show ties to her home country, otherwise she may be denied entry.

Hmm...that may be difficult (she would quit her job then, and has no children, but a lot of family), but I don't remember her having to show much proof on her previous visits.

How would the immigration officials at the entry checkpoints know about the K-1 application? It just seems to me that this entry would not be any different from her previous visits.

Would point-of-entry be the only potential problem?

Can my fiancee visit me in the US while her K-1 is being processed? She already has a visitor (B-1, I think it is) visa that is valid for another 3 years, and can stay for up to 6 months at a time with it.

She would go back for her interview, of course - we don't want to jeapordize anything.

K-1 Fiance(e) Visa Process & ProceduresWhat does the pack 3 contain?
Hi Charito, well my story was different because I never got the packet 3 or 4 from the embassy EVER!!!! I had to call the embassy and ask about the day of my interview!! mad.gif , anyway, I know that the packet 3 and 4 are the same, the packet 4 is just the paper where they tell you the day of your interview, and you don-t have to send any paper to them, at least I didn't send anything, I did bring with me all the documents I would need, my police records ( Antecedentes Penales, Antecedentes Judiciales, Antecedentes Policiales) pide todo para viaje al extranjero. Then also your birth certificate, as I am from Arequipa I had to go to the Reniec so they put a special stamp, but if you are from Lima I don't think you need that. The forms, if you go the web site of the embassy in Lima you will find the forms that you need, also your fiance has to send you the affidavit of support, his taxes from the last 3 years and a letter from his employeer, then 2 photos (5*5 cm) I think that's all, bring with you also many pics and letters or emails that you and your fiance have as prove of your relationship, well, hope that this help you, good luck!!! good.gif and if you need more information just ask, byeee.

K-1 Fiance(e) Visa Process & ProceduresI have a few questions.
Ok ladies and gents. I just got back from the Philippines last week and noticed that I finally received my NAO2 approval. I noticed on the letter it had an expiration date of January 17th 2008. Well I am gathering all the necessary information like my I-134 and the necessary docs to send to my babe in the Philippines. I noticed on the K1 guide on this website, it said I had to send the original I-129F to my fiancee. That might be a problem because I only have a copy, the original was sent to the USCIS back with May 2007. What am I going to do now...Well I had a few more questions to ask you experts:

1. How many years of tax returns do I have to submit with the I-134 and how many pay stubs and also W2s ( I am a W2 employee)

2. Do I have to send my fiancee a certified copy of my divorce decree for her interview.

3. Do I have to send A copy of the entire I-129f package to my fiancee.

4. Do I have to Send her an original letter affirming your desire to marry my fiancee again

5. What if we do not get everything completed before the expiration date on NAO2?? What is going to happen?

The reason why I am asking is because the immigration place that is helping me do the paper work said all I need to send my fiancee is the I-134 form and 2 paystubs, plus 1 year of tax returns. They also said I need a letter of employment and a letter from my bank talking about my account balances. So I need to know what am I suppose to send fiancee??? Help Please

Ok. Thanks for all your recent responses to my last post. Well, I received my NAO2 on September 29th. I just recently completed my I-134 Affidavit of Support form and all the necessary documents I am suppose to mail to my fiancee. Well I had a few questions:

1. I am able to buy my fiancee an airline ticket? If I can name some website where I could buy her the ticket with my credit card and send her the e-ticket information.

2. After I mail her the Affidavit package, does she have to do anything special.

3. When does my fiancee get her passport? Does she get it before her embassy interview?

All responses will be greatly appreciated.

Hey people, I already received the NOA2 approval. I was wondering if its possible for my fiancee to go to the interview in Manila without her passport. The reason why I am asking is because there is misspelling on her Birth certificate. And she is getting the run around in obtaining her passport. She lives in the Philippines. Is there anything she can do get her passport quicker. Also can she do her medical and interview without a passport? She is in panic mode now. What can we do??
