K-1 Fiance(e) Visa Process & Proceduresk-1 visa, I-134 question
Side note to the above. Is there a recommended amount of copies of the tax returns (ie 3 years worth) that they want to see? I couldn't find this anywhere.

K-1 Fiance(e) Visa Process & ProceduresQuestion of Evidence
I kind of planned on covering all bases and include how we met initially (ie over the net etc) and our first face to face meeting. Would rather be safe than sorry. Oh and i'm sending the actual parts of the passport as well as copies of his BC.

K-1 Fiance(e) Visa Process & ProceduresQuestion of Evidence
Thanks again for the wealth of info everyone. I think at this point I'll print what i can (its his passport i don't have one yet) as well as the copies of his boarding pass, plane ticket etc as well as the letter that states how we met initially and our face to face time spent together. I pray its enough and will hope that no RFEs come along LOL

K-1 Fiance(e) Visa Process & ProceduresQuestion of Evidence
I am curious though. Do they want to see the entire copy of the passport to include blank pages???

K-1 Fiance(e) Visa Process & ProceduresQuestion of Evidence
We have two letters explaining how we met and when and where our first meeting occurred so that shouldn't be a problem. Just wanting to make sure we cover any and all contingencies to avoid an RFE LOL

K-1 Fiance(e) Visa Process & ProceduresQuestion of Evidence
Spoke with my huney last night (early his time) before he went to work and he did send his boarding passes and he is emailing me a full copy of his passport. So all of that will go in the package. He didn't think the passport copies were needed at the beginning so he didnt mail them. Thank god for email!! biggrin.gif

So what i'm planning to include with the I-295f will be copies of his boarding pass, print out of his itinerary, 2 photos of us together and copies of his passport with dates stamped and location. Now is it advisable to also send copies of email correspondence and/or phone records just in case to help support the primary evidence? I'm of a mind to do so just to cover any and all bases.
Robyn-n-KrisFemaleUnited Kingdom2008-02-07 08:48:00
K-1 Fiance(e) Visa Process & ProceduresQuestion of Evidence
Not really. I mean I am going to hopefully go over there and visit this summer but we want it filed now so things can begin. I know we have 2 pics and he's very good at keeping all documentation so I'm sure he is sending everything he can to me to provide. We want to start our life together as quickly as possible. I guess i'll ask him more about what he sent when he calls me later tonight before he goes to work. (btw i so hate the blasted time zone difference!!!)

So then by showing copies of his passport and boarding pass that will be good enough showing he was here last fall??

K-1 Fiance(e) Visa Process & ProceduresQuestion of Evidence
Ok, just read through all the pages regarding RFE and i'm now concerned. We are getting ready to file shortly (he's sent his documents from the UK to me to file) and i'm worried about the evidence that needs to be provided as proof of the relationship and meeting. We've known each other for awhile but only met face to face once and that was last year when he was here for 6 weeks and stayed with me. There was no hotel and we didn't really go out and spend money on anything specifc. We are both camera shy so only have 1 or 2 pics of us together. I know he is sending copies of his entire passport as well as any itinerary and boarding passes he might still retain. We are also going to provide copies of phone records of calls made to each other as well as correspondences back and forth over the last year. I'm worried that this will not be considered enough evidence along side the letter of intent we are both providing and that we are going to run into road blocks.

Is there anything else that can be done or do you all think we will run into issues?

It sounds like they were sending the package back to your fiance. Has he received it back yet? If not, he will want to do a follow up with his congressman and see if they can track down when and where the package was mailed back. In the package it will say the exact reason why it was rejected. It could be something so simple as failing to sign the applications in the right places, or not including a number of documents that it was easier to reject rather than send send RFEs. Or, did your fiance include a US address at that time? You mentioned you were living together up until June when the application was submitted. Was he out of the US at the time? If he didn't have a US address that could also be a reason for its rejection.

So, the important thing is - has your fiance received back the rejected application form? If he has, what does it say is the reason for rejection. If not, has he moved or has the return address changed?

Yes,my fiance was out of country for a past year..He was currently stationed in South Korea and by June 2007 he had to go back to the states and report in Fort Hood,TX.
No,he didnt get a package yet..Tomorrow will check his mail-room again..
Also,Senator sent him email and ask him to contact his office, tomorrow my fiance will do that..

P.S.I dont think that here's issues about still being married..
I dont think that if a man still married he will anyway file the petition for fiancee, pay for that,etc..

Is it possible for uscis accept the petition, give a case number and lately find out that they need correct fees and reject it?

P.S.S.I appreciate all answers and thank everybody who's willing to help!

I received a rejection notice in the mail due to supposed wrong fee and I still had a valid case number just like everyone else. They sent my application back and on USCIS website it said this

"On September 6, 2007, we determined that this I129F PETITION FOR FIANCE(E) was not properly filed, rejected it, and mailed it back to you with all supporting materials along with a notice describing the reasons the case was rejected. The notice will also describe what will need to be done to properly submit the case."

I got it back and it was because of the fee. I think there is a difference between a rejection notice and a denial. And I would think that they would send you an RFE before the actual denial especially if they had questions about your divorces or meetings.

Rejection could be because you didn't sign something or application was incomplete. Again, this is all speculation but I had the same message as you did and it was because our petition was "improperly filed." Also, this was dated September 6th and I did not receive mine until September 12th or so.

Did your fiance's address change and he might have not received the package??? You might need to call USCIS and find out what the notice said, tell them you didnt receive the package or the notice.

Good luck, I hope everything works out.

Yes,you got exactly same message as we did..
I also believe if there were some issues with divorce papers, they would send RFE..
I believe there are something about fees..

P.S.Let me ask you..When you filed you petition did uscis cashed your check, gave you a case number and after sent you notice about wrong fees?
If yes,did they return your money or you just sent them 385$ check .Or they cashed your 170$ and after asked you to send them 455?

When the fees are correct and case initially accepted before an outright rejection, the most common reasons are one or more of the following.

One of you isn't divorced or submitted insufficient paperwork to prove a divorce is final.
You haven't seen each other in person during the past two years or insufficient evidence you of meeting.

Do either of those sound like possibilities?

We met in September 2006 in Korea and untill June 2007 were living together.
At the end of June we filed the petition. We know each other for a year and I didnt see my fiance just for about 4 months.

Yes,I've been married in Korea and we added my korean divorce paper to petition, but didn't add divorce paper from my home country-Uzbekistan.
We just went to Uzb.embassy in Seoul and took paper that saying that I am free and clear to get married. But later, when I got back to Uzbekistan,I sent via fedex my uzbekistan divorce degree to my fiance.

Also,I my fiance just got divorce at the end of June and we filed petition straight after that.

I don't understand. If uscis immigration officers found out that me or my fiance is still married ,they would denie petition, but not just reject it.

P.S.If we got valid case number, does it mean we have NOA1?
Is it possible for uscis accept the petition, give a case number and lately find out that they need correct fees and reject it?

you don't have a timeline, so I can't check dates properly, but if it was filed around the time of the fee increase (as the mentioned date of August 13 would seem to indicate) it may well be it was received after the July 30 cut-off, and has been rejected due to incorrect fees... do you know how much your cheque / money-order was made out for? if your petition was post-marked (or, as some have found to their cost, received) after July 30 you'd have had to pay $455, not $170 as it was before

all the best getting it sorted out quickly

He sent it on June30 to TSC and included 170$ check..
Check been cashed on 18 of July..
We didnt get NOA1 hard copy and we couldnt find out about case number(copy of cashed check wasnt clear)..

My fiance asked Senator for the help and Senator found out our case number..
Today I sing in uscis website and found about our case being rejected..
We dont even know our NOA1 date, last update in uscis wensite is 08/14/2007

P.S.If our petition been rejected because of the fees, why then they gave us a valid case number?
I thought once they cash the money, they give the case numbers..
Dunno what to think..

I just wanted to thank this site..I found good people here who always been ready to help with advice..
It's hard to realize, but my visa journey is over...

Friend of my fiance gave him a link saying that I am a scammer!!!
That I am asking money for travel, visa, etc and the date when somebody
added this information about me is 07 october 2007...

But to be honest before all of you and before God,I never were scammer,
never were looking online for man neither..Yes,when I was in Korea 2 years ago I used
koreanqupid.com site to find a friends in Seoul..
But once I found the man who I love, that was it...

I believe his friend added me in this scammer list, because Inquiry Date in this page about me is
07 october 2007 (united states) and he found out this page (like he is saying) on 09 october 2007...
And my surname in ,,Assumed Last Name,, is not that I have in passport, its my mained name on that site(and his friend knows it) ..so..how could I recieve the money from somebody if my surname in my passport is different???

My fiance lives with that guy and I believe he doesnt like us being happy. And I remember that
guy sent me message long time ago asking me to leave my fiance,I ignored him,but asked him why..he never aswered...

All what I wanted to say here is...I truely loved and love my fiance..And I wanted to be happy just like other people do...But I think, its not a right time for me yet...

I will try to find administration and find out how it could happen with me..But site says ,,Disclaimer : Entries listed below do not confirm a scammer or scam and may not be real names or fact.

I just wanted to share with my pain in here and in a same time wish to all of you luck in your journey...

Thank you - Len was approved! I'm still thanking God. His appointment was at 11:45, and he called me at 1:15pm, after his interview to give me the good news. The representative at Airpak told him that his wait for the visa to arrive could be anywhere from 4 days to a week. I've read on here that it took some VJ's longer to get the visa in hand. I hope it comes soon.

Good luck with your upcoming interview. Words of advice that Len stated was take your time with the CO, don't let the CO rush you, be honest, and have all your supporting evidence, pictures, and documents in order. The CO really love organization.

The K1 visa fee is $100, usually to be paid in the equivalent local currency. However, that's the non-immigrant visa fee. If you asked somebody about the "immigrant visa fee" that would explain the different answer. They are not the same.

Can you explain to me the difference between the non-immigrant visa and the immigrant visa? I've read the Kingston website and USCIS website and I really don't understand the difference? I'm sorry if this question has been posted and answered before - I searched and didn't find. Thanks again!

Hello there. Welcome to VJ. Well the (K1) visa which you are applying for is a non-immigrant visa. basically its like a visitor visa with an option to get a permanent one. A permanent visa is an immigrant visa (CR1/IR1). Those are for married individuals and their familes who are looking to come to the us "permanently" and become a permanent resident. That means they are an immigrant within the US.

Thanks for clearing that up for me. For some reason - all of Len's co-workers try to give him advice. They've never done the process, but they have their two cents to give him. This causes confusion for him - and frustration for me. Only 6 more days until the interview. Whew - Thank God!

Congrats! I know the feeling about input from everyone and their brothers, uncles, friends, whomever. It is so funny because no one that gives advice have been through the process. I just try to read as much as possible.

Again Be Blessed on your interview.

Teena

Good afternoon,

Hello, My name is Pam and I am a newbie to VJ. I have been reading all the different posts and I have gotten alot of questions answered. My fiance interview is December 11, 2007, and we need to know what fee will he need to pay. We filed for the K1 visa - I have been told that it's $100 US. He has gotten different amounts. I called the NVC and the representative told me its $100, I believe her - Len is confused because many locals have told him differently. I told him to go with the information from the representative from NVC.

Can anyone tell me the process and the amount they paid and where they paid the fee?

Thanks for your help

Hi pam, your fiance's interview is actually one week before mine. The visa fee is US$100, or JM$7100 payable at any PAYMASTER. He MUST take the receipt with him on the 11th. good luck with the interview.

Thanks and good luck as well. This process has been long, but has been worth it.

K-1 Fiance(e) Visa Process & ProceduresQuestion about Wedding process...
Thanks malego77.

My ma-in-law said that for marriage we may need SSN number.
Did they ask you for SSN number when u got married?
What should we tell them if we want to get married at the earliest even before getting my SSN?

K-1 Fiance(e) Visa Process & ProceduresQuestion about Wedding process...
Hi Everybody,

Sorry I posted this in a different forum hence posting it again under K1 Forum.

My interview is on 20th Feb and all excited getting closer to being my Fiance soon.
We have started planning our marriage date and have a question regarding the wedding process.

Our Situation

1) Me and my fiance are Hindu.
2) His family doesnt bother much about auspicious dates however they would prefer any Thursday (Saibaba day).
3) My parents want us to tie knot on a auspicious date.
4) And We both want to be together as soon as possible.
5) However my parents have asked me to stay with my sister in Missourri untill we get married. Because our culture does not allow live-in untill married.

Our Wedding Plan

Keeping above in mind, we were planning to get married within 3-5 days as soon as I land in US.
Since my interview is on Feb 20, I am planning to be with my Fiance by first week of March.

Our Issue

After googling around I found couple of auspicious dates. Though I have asked my Dad to find out some more dates from our PunditJi).

Auspicious wedding dates :
March 2008 - 1 Mar, 4 Mar, 11 Mar, 26 Mar.
After that till April 14 there are no auspicious dates (as heard).

Our Question

1) Considering the above dates, when should we get the marriage certificate?
2) Someone said marriage certificate validity is of 30 days which means getting married within 30 days of marriage certificate purchase.
3) Also heard that we may need to purchase marriage certificate 30 days in advance of marriage date.
4) Am confused now and would like to know process of getting marriage certificate and getting married? We will get married in Texas.
5) How much time should we count?

We have to plan my flight accordingly because I do not want to stay at my sister's place away from my Fiance for long. This process has tested our patience too much and when we are almost through we just cant be away from each other for any xyz reason. cray5ol.gif Help!!!

Thanks,
Manya

K-1 Fiance(e) Visa Process & ProceduresHow to use Passport as evidence.
Just like Zee said the only thing you need is the I-134 notarized. I sunt my fiance copies of everything else and they was not notarized. They granted his visa and he pick up his visa today.
