Or longer. I have seen people who filed for Naturalization in 1996 and were still waiting for the background checks to complete. From INS to CIS and yet Immigration was still aware of their cases and when requested would send updates indicating it was still pending.

At this point the only thing that is going to take care of this - which amounts to a backlog - is for an overhaul of the system. Which all current indications point at happening, the earliest, in 2010.

Mind you, mohamod, mohammed, muhamad, etc . . . are not the only names with problems. Ali, Imran, Saaed, and many other popular, male, Islamic names can be indefinitely detained.

For what it is worth - I have also seen someone with a perfectly American name - with all family members with English names - have the same problem. So it is not limited to Islamic and Arabic names - they just happen to be the most common.

Hello everyone,

I've read here under the K1 visa chart, that some port of entries will stamp your passport with a termporary work permit if you ask them.
It mentioned JFK and NY airports. Does anyone know if these are the only POE that will issue this, or are there any others. I fiance would be coming from Central America so most likely the POE would be Miami or Houston. Has anyone entered any of these and received this work permit.

Would appreciate any insights. Thank you,

Are there possibly problems with the Cruise liner going in to international waters, a Caribbean island that is not a US territory, etc?

So I received a letter from the vermont service center last week, saying that our petition was approved blah blah and was sent to the listed consulate. I was a bit confused by this because I thought it was supposed to go to the NVC center. Then I got another letter the next day from the NVC saying that they had forwarded the petition to "the appropriate visa-issuing post" where the interview will take place. They listed the consulate where they sent it ....Montreal but thats not the one we listed. Just wondering why they would send it there?

Anyways, im really confused here, am I supposed to receive some documents or something for NVC? I thought they sent the same letters to everyone, but apparently they are tailored made, because I've noticed that some people have commented that their letters say different things. Can anyone clarify ?> lol

We had the same problem during the K1 process. It is not grounds for expedite. So I organazied what they wanted. I used my cover sheet to describe each document and assign a number to it. Then I numbered each document. They were happy after that.

K1-Matt,
The items you mention would be needed at the Interview. You would get a letter from your employer (Manager,Supervisor) on company letterhead stating title, start date, salary, full or part time. You'd need your most recent tax return. I gave Fernanda 4 mths of pay stubs, just as a nice to have.

USCIS wants to know that you and/or a Sponsor can afford to care for the Beneficiary. Whether you are new on the job or not is not as much of an issue as not meeting the income qualifications for support. The Consulate is expecting you to show that you have enough financial stability to provide care.

As the others have stated, take a look at the Guides. Go slow and it'll make sense. If I was successful with this process, anybody can do it. And all I had at my disposal was VJ! Can't beat that.

G-325A is not interested where you visited. They want to know where you lived, held a permanent residence, where the light bill was delivered, so to speak!

Email would be only 1 part of you proving a relationship. In order to prove there's a bonafide relationship, 1 email every 5-6 weeks may not convince the Consulate. The Interview is the Consulate's opportunity to evaluate whether a true relationship exists. It's on you to prove it. I know that we would not have made it if we only communicated every 6 weeks. Do you have telephone records? Do either of you write letters? These would help your situation.

Fernanda and I wrote letters about once each month. I kept all the ATT long distance bills. We did not even include our sporatic emails as evidence. Along with proof of multiple visits, hotel receipts with both our names and many photos together or with friends/family, and her wearing the engagement ring to the Interview, her Consulate interview for the K-1 was approved in about 4 minutes.

Be prepared to have more evidence at Interview time.

It's been 23 days. Not anything to worry about. Took us about 26 days. Has the check been cashed? If so, you should be able to see the case number assigned stamped on the back. The simple fact that the check was cashed would mean that your case passed the inital review for completeness and was accepted by USCIS. You should be receiving an NOA1 any time now.

You really need to read the K-1 guide on this site FIRST. It will show you the entire process and answer many of your questions. There are examples of everything, even a flowchard showing yo uthe steps in the process. Are you the Beneficiary or the US Citizen?

1) Only the USC may apply. Receiving a K1 Visa does not get you a SS#. After marriage, some folk before, the beneficiary must apply for the SS card. It is not just given because the beneficiary arrived.

2) The beneficiary is not free to work until they receive an EAD or Green Card. The USC can do what they want.

3) The 90 days is the number of days that you have to get married after the beneficiary sets foot in the US. The K-1 Visa is good for 6 months, but after you arrive here, you have 90 days to marry. Until you are married, the Green Card or EAD is not an option for you.

You are officially on your way! A cashed check means they have accepted your package as "complete". All that means is at first look, it appears that all the required documents are there. Once your case is assigned, an Agent will look at it in more detail. If he/she sees something they want more information on or they think something is not included, they will let you know via an "RFE" - Request for Evidence. So for now, you passed step #1. Get them to accept the package, assign a case number and cash that check!

It is automated, but only to a point! You need to speak to a human to get info on a K-1 Visa case. Be patient, you'll get through. In fact, you can email them too. They normally respond in a couple days.

7-10 days for a transcript. The official copy including W-2s take longer, about 3 weeks for mine to arrive. Once Tax season starts the transcripts as well as the full return copies may take much longer.

You don't need to get a transcript after you file your 2007 taxes. You can use a copy of the 2007 tax return WITH your W-2 at the interview.

You can do this K-1 thing yourself. Unless you have some very serious issues in your background, you do not need to pay a Lawyer. Save the money and upgrade her engagement ring or something!

You can email the Consulate and ask the question if you can attend. At least you'll have that answer as a hard fact. Regarding flying back to the US with her, I think that's a good idea. I did that with Fernanda and we both enjoyed it. I was more relaxed because I knew she was OK. She was more relaxed because I was with her. It's a good way to start life together! Then again, if your money says that you cannot or should not make the trip, then don't.

Does he need you there? Probably not. The process is pretty simple. Fernanda had no problems at all. She spoke no english then, so they couldn't ask her anything! She went into a room at the airport with an Immigration Officer, they entered her K-1 and Passport info and within 5 minutes, we were on our way.
