hi!  we apply k1 visa last July 2012 it was granted and expires sept 15, 2012 it's just due to my fiance's work contract in afghanistan which ends Dec.11,2012 :( the day in my interview my fiance made a letter to the consulate to ask for extention til my fiances end of contract but since there is no extention unfortunately we weren't able to use the visa so We reapply k1 and next week is my interview but my concern is i still have the old packet in hand my question is should i just bring the old packet on the day of my interview? i don't know.. :(

we try to send an email to the embassy regarding the packet but didn't recieve any reply yet.

visa was granted last 2012 but unfortunately we didn't able to use it due to my fiance's contract of work in Afghanistan (he works for military) we are re-applying for a K1 visa now.

 

i already submitted a police certificate in my interview last 2012. since we are re-applying, do i have to submit a new one? im kind a worried now coz my interview will be next week and i didn't get a new one.

hi guys...sorry if you get mad at me for posting in the wrong area..i'm sooo new to this but im about ready to pull my hair out and cry. my boyfriend and i have been dating for..2 years feb.24th but we've known each other longer. I'm moving there to the United States in Oregon (I'm a Canadian citizen he's American) I'm also 19, hes turning 21. please no comments about age . anyways how long estimate should this take? Just an estimation i would really love, from reading everyone's stories here my guess was about 5 months for everything to be done? does that seem right. anyways he's visited here twice once for two weeks, and again for 3 weeks. and being apart is just too hard (we've been apart for about 7 months) I was calm about all this before, but then reading things is really stressing me out. Anyways so my questions are.

1. what happens during the medical exam
2. estimate time of how long it takes

those questions are pretty different from each other but..those are just the little things i have to ask before i start hyperventilating lol.

Hi Everyone,

Is it possible to change consulates? My fiancee's I129F was recently approved. I called NVC to get case # and asked if we could have our petition sent to Moscow instead of having the interview if Poland (fiancee is from Belarus)and the lady I spoke with said she didn't think it was possible. I was under the impression that it was possible since the approval notice states a petition can be forwarded. Thanks in advance!

We're a bit confused as it says the interview cannot be scheduled until the fee has been paid in Poland and one obtains a receipt#. She is very worried about this but my lawyer told me that they usually do not try and find a reason to deny you. I am not able to make the trip to Russia to be with her on the interview but she has her engagement ring and all of our photos.

The only thing that we do not have or are worried about is the misspelling of the fathers name and also the dates were wrong on her work history.

She worked in Egypt off and on for four years. But we also have a letter stating she has never been in jail or trouble in Egypt. So you think we should not worry about this?

It was recently brought to my attention that I need to have spent a minimum amount of time directly visiting my fiance. My time spent with her was only 4 days. Is there a minimum?

Once you send it to Dallas, they will send it to either Vermont or California.

There's not a minimum amount of time you need to have spent with your fiancee; just that you have met in the last two years. Later, when she's going for her interview, you'll want to be able to show that you have an ongoing relationship. But that's once you're through with this awful wait.

Hang in there, it's worth it. :thumbs:

Do you get an RFE if you fail to submit one? And does the service center put the petition on hold until you submit the letter? thanks so much :)

It is not primary or secondary evidence of a relationship. It is a statement to USCIS indicating your intentions when a Visa is granted. Will you get an RFE if it is not submitted? It is highly likely, depends on the person working your case. After all, it is required and it is in the instructions for the I-129F from USCIS. There's really no reason to skip this. It is very simple to scribble a sentence or two. There's even an example here in the guides. Whjatever you do, don't start inventing your own rules unless you want to get an RFE!

If he has been issue the visa and you have already contacted USCIS then they are tracking that the visa has to be cancelled for fraud on his part. Now unless you keep in touch with him, not sure how you will even know he came into the country. Either way they will track him by your address and if you do not marry within 90 day of his arrival which in your case you will not they will want an update through AOS at some point otherwise he will be here out of status. If he is tracked through biometrics I hope this is caught throught that confirmation number at the Port of Entry and he is returned to his country.

Completely understand the discomfort, however; the only way you will get him out of the country is to keep in touch with him. I do not in any form suggest you allow him to see you or come to your home just keep in touch through email or through his friends and family to keep a pulse on his location this is the only way ICE will be able to process with deportation.

Good luck on this case, I previously did a cancellation but my ex had never been issued his visa so the embassy just closed out the case and even that took over four months before USCIS sent me a letter stating the case was closed out.

I agree you still need the none custodial parent's help to get passports. I had the same issue, my ex-husband and I were both military and regardless of what the divorce decree read when it came down to getting passports or getting the children out of the country I was always asked for a notarized letter from him authorizing issuance of passport or travel.

In regards to the Visa, you have to overcome the first finding. I don't recommend running off and getting married unless you are able to get some trips under your belt to Morocco. That was one of the first questions they asked my husband, how many times has she visited you and for how long each trip. We have friends that are married that were denied on those basis alone she had only visited him once and they married on that visit. In their case she has 3 children all under 18 and it is very hard for her to visit but unless she visits and shows more interaction as a married couple the embassy finds it hard to believe that a bonafide relationship/marriage can be based on a one time visit. I got to know my husband so much more converstating on an instant messenger service over 18 months, we had no choice but to talk about everything under the sun and just going through the process made us closer but the COs do not buy that for one minute their filter is set on fraud alert. Those visits make a big difference but that alone normally does not get you a no. There are many redflags they look for:

- Age differences
- Previous relationships with Americans that implied immigration.
- How soon after meeting did he show a romantic interest?
- How soon after meeting did he profess his love?
- How soon after meeting did he propose marriage?
- In conversations provided did you talk, agree or disagree about religion or money. If you spoke in a different language from English or Arabic translate all conversations they only want to see documents in English.
- How well he knows you this includes your family(in great detail), jobs, previous marriages, chidren(in detail), monies (all accounts) etc...everything and anything.
- First impressions make a difference, applicant has to dress well and be confident at the interview not soft spoken.
- Pictures ensure you include family in the pictures, I am not saying stage them but they want to see genuine acceptance into the family. I have an independent relationship with his family outside of our relationship and they could see that in our pics.

My observation has been that when they call you back for a second interview at Casa within in two weeks it is normally not good. Things I have observed as a good sign are keeping your passport, giving you a 221(g) simply to complete the application any missing documents or working with you without a straight denial (they are well versed at handing out denials), the CO tells you it is approved but placed on AP. People hate AP in Morocco but I have found that it is a good sign, they are working your case which is much better than being told we don't believe you and here is your 221(g) for denial.

I know in the haste of wanting to be with our loved ones we oversee the job the COs have to do but being a retired military officer that knows about force protection and the job we are charged to do to protect Americans and our way of life I can fully understand why they have to do what they do especially because Morocco has a very high fraud rate. So I can say be prepared for the next go round and try not to be upset at how the system is set up but rather try to work with it to meet their requirements and get your loved one home. We are here to provide the best support we can to make everyone that truly is doing everything honestly successful.

My heart goes out to ladies who really wish to go there but have no support system to help with the care of their children to visit their spouse. I wish you both the best of luck.

I turned in a memorandum from the Commander stating my standard name line (rank, name, last 4 of SSN and ETS date)and that the character of my service. It beat sending in multiple LES statements or additional documents as proof of employment. Plus for active duty Soldiers marrying a foreign national does require informing the chain of command as this stands to affect security clearances. As you well know some jobs in the Army you cannot do without a clearance.

She did not commit visa fraud, however it can affect her chances of getting the visa if you provide proof that she was scamming you all while making plans to marry him. I think you maybe a bit late if she is here and ready to marry him. The choice to report her is up to you the report will be accepted, it may or may not be taken into account. The reporting should have happened before she was issued a visa.

Sorry to hear about your situation but moving on is probably the best remedy.

You can also prove your income level with an employment letter and copies of your earning statements/pay stubs. The K-1 requirement is 100 percent of the poverty guideline not 125 percent which you will need when you adjust status after the marriage. Whoever will sponsor is normally the one to fill out the form. The only papers that need notarization are statements from family confirming the relationship.

Oh my mother-in-law did give us a notarized statement acknowledging the relationship and the exchange of funds between us. In your case you don't need to prove co-mingling of funds since you are not yet married.

I also think you should have your fiancé write a letter addressing his ex fiancé, and why they didn't go through with the interview, and the relationship. This will probably be your biggest red flag for Casa, so having him explain it up front, get his side of the story out, may help for when Casa gets the case. Good luck!!

We are really supporting you on this decision especially because you are so happy with him. When I saw this thread I worried a bit and am really hoping he cleared up the last case before you petition him. I have to agree, perhaps you can take him to the embassey while you are there and find out what the status of his previous application. I read just recently of a couple whose application was not processed because the previous petition was never cancelled. They were told they could not process the visa application until the previous request was cancelled, then they could file again. I always say an ounce of prevention is worth a pound of cure. If he kept his case number from the last time he can always call and get an update from the consulate, even to just verify that it was closed out.

I had previously submitted a a K-1 petition and cancelled one month before the interview. I personnally sent memorandums to both NVC and the consulate to let them know I was requesting the cancellation and the reason for the cancellation. I was finally notified in writing of the cancellation by USCIS after 7 months.

I could not be happier for you just want to ensure you line up your ducks in a row so you will not have any issues.

Have fun on the trip, we are planning our next trip this December.

Great pics by the way, make sure he has copies of pics of your family's visit to Morocco or UK not sure where they were taken but either way have them available. You have made alot of trips and it has also included your family which is always a plus but with Casa it can always be tricky. Just make sure he has all the proof of those trips. Ensure you documented your time with him over the summer. I always say you can never be too prepared for Casa, he needs to know your childhood, your boyfriends, your jobs, your school history, bestfriends, your children (if applicable) any and everything you can imagine to include financial standings. Your goals, habits, hobbies, lol I have to laugh everytime I tell the story of drilling my husband like he was going to a promotion board in the Army. In our case they asked about my ex-husband, my children and their girlfriend and boyfriend's names and their hobbies.

They gave us about a 45 day notice, NVC will notify you but the appointment is set by Casa. The first two weeks of the month is when they schedule appointments. In our case we closed out with NVC on 30 March it was to late for April's appointments we had to wait til the second week in April for a May appointment.

I have been driving cross-country all day but I did get a chance to review of the form. Item 15 is where you give your fiancé's address abroad and it is asking for the physical address so provide that as required. In the instructions it states if you need additional space to add a continuation sheet. This would be a blank paper stating, "continuation page for form I-129F, item 15, the following information is provided: add the mailing address, reason for PO Box use: blank city does not have mail courier service available. Please forward all mail correspondence to said PO Box address."

The address is an extension of the petition add the continuation page. I did this as well except for a separate item number.

The address is used not just to forward mail but to do physical checks if the applicant is placed on AP. I recommend you read the K-1 application instructions to see what is acceptable. Never met anyone that applied with a PO Box but call USCIS and ask. Also, it is up to you to explain anything that may generate an RFE or worse cause the petition to be returned or rejected. I explained everything that could be questioned in the cover letter and numbered all the attachments plus I referenced each enclosure in the cover letter.

What address is on his ID it has to match where the packet is going otherwise he will not get the notifications. I have travelled to Morocco 5 times and have yet to see small towns or villages not have a cyber cafe, western union or a post office and mail in Morocco is slow as molasses. They may also drop off a notice at any rural area and he must go to the designated post office to get the mail piece. In our case my husband was told to report to Rabat with his ID.

Lastly, I got notified about the entire process via email not courier mail.

I spoke with a representative of NVC this afternoon, and he shared that our case was received yesterday and that it's in A/P. Is that standard for a K-1 at NVC? In other words, is that just their way of saying they're running the standard background check, or should I be concerned? After all, I did get the whole line about there not being a time frame for admin processing... :help: :unsure:

I have heard that cases can be placed on AP at any stage of the process but only second time I read it from NVC. They normally start processing cases after 15 days of receipt asking for beneficiary to appoint an agent and payment for the visa fee/affidavit of support.

Now if this AP could mean no AP out of the consulate that would be great but their is no guarantee. I say call them back and ask but it sounds like the FBI AP the local background Administrative Review is done at the consulate.

Yes she need to send you awholelotta love so when USCIS opens the petition they'll be smothered with love and approved in no time :) Ahh..

Birth cert. and copy of passport isn't needed at this stage for her. Well, if she has a stamp in the passport proving you have met then it's a different matter. But save the copies, the English birth cert. is needed later on for AOS, and of course the K1 interview before then. If you're the one with all the primary evidence of having met, and you have pictures as well, then you're good to go. Right now it's more about the USC and meeting the requirements. Which country is your fiancee from? Good luck.

Edit: I'm assuming your fiancee is not the USC? Otherwise yes, the guides are worth reading.. Twice.


I have the primary evidence that we met, she's from Jordan so i just visited her over Christmas and got officially engaged. so I kept my boarding passes and will submit with passport stamps of entry/exist of all my trips ( we've met before prior to this trip but didn't really have primary evidence as we weren't 'engaged per sey).

Correct, i am the USC and my fiance is from Jordan. I've read the guide few times by now lol and been going through threads.

i do have another question for anyone on this fourm. in my situation, i've known my fiance for a long time as i grew up in Jordan and known her as i grew up there and her family. As far as primary evidence, i don't really have anything solid prior to my official engagement that took place this past Christmas/december. I do have one picture together from 2005 and i can pull some emails to have communicated but my primary evidence that i will be submitting is the boarding pass from this past trip and entry/exit stamps ( i have lots of them from this past ten years showing my trips). I was just wondering if my evidence is 'good enough' from my last trip as i went to Jordan to officially get engaged.

My fiance is getting ready to mail a package for the 129F packet that'll be sending to the Dallas loxkbox. I wanted to confirm if i am missing anything else that is needed from her.

Shes sending the following:
1- Letter of intent to marry within 90 days of entering the USA
2-G325A
3- One passport style picture

she's also going to send me an english version of her birth certificate and copy of her passport just incase.

Am i missing anything or not thinking of anything else that she needs to send me?
