K-1 Fiance(e) Visa Process & ProceduresReal Relationship Evidence with I-129f
For our I-295F we sent 2 pics of us together in the last 2 years.. our letters of intent and copies of his plane tickets, boarding passes and passport with stamps. This was it. Mind you he's only been here once yet this was enough since they approved ours with just that info. Now for his interview he will be bringing more evidence to prove we have an ongoing relationship but for the initial petition you only need to prove you've met within the last 2 years.

Pretty much what everyone else said. My divorce was final and we filed in Feb. Long as it's legal it's fine.

K-1 Fiance(e) Visa Process & ProceduresHow to go through customs at JFK if coming from Canada?
So long as you wait maybe 2 weeks and then apply you should be fine. Its making sure you are in their database is the thing.

K-1 Fiance(e) Visa Process & ProceduresHow to go through customs at JFK if coming from Canada?
This is something Kris is going to do. My understanding thus far is that he can get the temp EAD stamp... and then we plan to wed within a few days of his arrival and apply immediately for the AOS/AP/EAD. Also I'm under the impression that you can apply for the SSN but they suggest waiting 2 weeks to make sure you are in the database. As stated above.. there is no 'temp' SSN.. and no cost involved either.

K-1 Fiance(e) Visa Process & ProceduresRumor about marriage Time
QUOTE (YuAndDan @ Apr 1 2008, 08:59 PM) <{POST_SNAPBACK}>
Can you please tell us where you got that misinformation?

K-1 is valid 6 months to enter the USA, and after entry to the USA they get an I-94 card good for 90 days, they have to marry within the 90 days of the I-94 card.

FYI, it is not hard to enter the USA and marry with a few days of entry, in our case my fiancee entered and we married all within the month of march last year, we did a legal marriage in a courthouse, and then has a large marriage party months later.

If our plans work out we will be similiar. Kris is hoping to fly in late on a thursday night we will go pick up the license the next day and get married that monday or tuesday (in Tx you have to wait 72hrs before getting married once you get the license)Then on our year anniversary we are going to have a formal ceremony.

I have looked all over, but I can't find a list of what to submit to start the K1 process. I have the I129 and g325a, but in the "tips" section it mentions an "employer letter", "asset/loan documents", and "all of it".
Can someone list the documents required for submission, and tell me what they are or what they need to say? The sample forms don't have these forms.

ThanK you,
Erik

Can a K1 visa holder enter the US after 4 months from the date he got the visa?

Hi ..Yep,usually the US visa is 6months..so as long as the visa is valid he/she can go to US. There are some circumstances that the visa holder can't leave that's why the Immigration gives enough time for a holder.

Hope this can help..God Bless..

Hi Everyone,
My fiance is Filipino. I am a US citizen. She has no immediate family here in the USA. What are her chances of getting a tourist visa to come here and visit me. Even with me submitting an afidavit of support I think the chances are slim. What are your thoughts? Thanks....
Stephen

How come the chances are slim? if you have relative who can help you to sponsor for affidavit of support for your fiance that would help you to bring her in the US. US embassy Manila is getting strict now with tourist visa.

K-1 Fiance(e) Visa Process & Procedureswhats the fastest way for K1 visa?
QUOTE (Omar G. @ Aug 22 2008, 07:47 PM) <{POST_SNAPBACK}>
hello everyone, i hope someone can give me some help regarding what the fastest way to process the K1 visa. (i imagine that everyone wants the fastest time with the least headache, but i just have to ask)

ok, i leave here in the states (philadelphia) and my fiance lives in Colombia (maybe not the best country for fast visa approvals). but i want to know how long it would take to do that whole K1 visa process and have her here with me in the USA. I've heard different things, so im kinda confused.....

1.....that it takes a year......

2.....that it could take about 6 months.....

3.....with a lawyer it could be less time....

4.....with X lawyer (recomended by my cousin) would take only 3 months.....

So what am i really looking at? if it takes only 3 months with X lawyer, i think its the best way, but i really dont know, i havnt talked to my cousin much and dont know where the lawyer is located....obviously its an extra charge but im willing to pay it....

i know its kinda a pain in the neck to do the processing yourself, which i know with the help here on visajourney and the step by step guidelines it would be easy, but i kinda want some help so i dont have to suffer from those headaches and filling everything out.....so i am willing to get a lawyer to help me out and do the processing and best of all if he knows a way to get the forms in faster and faster approvals for interniew and everything.....

Please what is my best option and what should i expect? What should i prepare for?

thanks in advance for the help guys......

I guess, you don't need a lawyer to solve your case..you are in the right place (VISa Journey) this site is really very informative..just take the advises of members and read a lot of information and experience and you will be fine with your journey.

save your money for lawyer for future expenses..

Hello again everybody!

So I'm sending a copy of my birth certificate in the 129F package and it just occurred to me-- it's highly likely that I won't be back in the States before my fiancee's interview in Mexico City. Do I need to take my original birth certificate back with me to Mexico? I'd really rather leave it here safe and sound but does anyone think he might need my original when he goes to the interview?

Thanks very much!

Based on my experience I'd say better to take it. When I had interview, they asked for the original document for my husband (it was my fiancee, and he was there with me that day). It was painful because he didn't have it that time, so we have to wait someone here to send it to Indonesia. The visa was delay few days, but I got the visa after they receive the original document. Good Luck.

I don't think she can re enter US with K-1 visa, but after you got married, you can apply I-485 (Application to register permanent residence). While they processing this application, you can apply travel document (I-131) for your wife (it's cost $305.00) for re enter US. Good Luck.

I don't think would be a problem as far as you have marriage certificate.

K-1 Fiance(e) Visa Process & Proceduresspanish double last names
QUOTE (jrayl3 @ Jul 8 2008, 11:30 AM) <{POST_SNAPBACK}>
Hey everybody--

I saw the answer to this somewhere in the forum already but I can't find it now-- what do you do with the double Spanish last names? I'm looking through our documents and I feel like we've been a bit inconsistent. My fiancee's "first" last name-- the paternal one-- is the one he chooses when he has to choose just one. However, he does sometimes state his full name with the two last names and his signature always includes the two. Should I just be putting "Gustavo Ruiz" on each document instead of "Gustavo Ruiz Palacios" and not worry that his signature includes the two? I believe the posting I found (and lost) said something about attaching a letter of explanation in the 129-F package?

Thank you!

To me it's look like he has last name (Palacios) and middle name (Ruiz), but I'm not sure if both are the last name.

K1 Guide:
http://www.visajourn...mp;page=k1guide

Example Forms:
http://www.visajourn...p;page=examples

Are you being payed as an employee and then contracted out(W2)? Or are you being payed for each contract individually(1099)?

If you are being payed for each contract completed you probably fit the desciption of an "independant" contractor even though you work in an unionized field. You would need to send a copy of your income tax return rather than just a letter from your employer since your tax return would better represent your total income.
Instead of tax return, it is better to get simple IRS transcripts, less paperwork to provide.

Worry about I-134 affidavit of support closer to visa interview, it is not needed when you file the I-129F.

http://www.irs.gov/faqs/faq1-6.html

All true but perhaps he's asking what to put down as the name of his employer.

To the OP, it is an I-129F you're dealing with, not an I-129. One is for a worker and one for fiance. Do start with the guides, but you'll also have questions later. We're here for you but the guides do the "walk through".
