I have not posted on this forum in a long while. Well my baby is here with me now and very happy . We already got married before the 90 day deadline. We have slight problem. My wife is pregnant and for some reason she as to do another medical. We have the vaccination report from St Lukes and for some reason she did not get a Tetanus shot and a Veracilla shot ( I could be wrong on the spelling) Two of the vaccination shot will be harmful for our baby since she is still in her first trimester of pregnancy. I am so worried because our deadline to submit the paperwork to the USCIS is September 12th. I don't know what to do. Will my wife get deported back to her country. Any suggestions will be appreciated. Thanks

I am looking at flights for for my fiancee to come over now that she has recieved her visa. Does any one know how much time she will need to clear immigration at the port of entry? I ask because we want to make sure we have enough layover time between flights.

Well, thank you for the thoughts... I have already filed both my I-130's, and I-129F K-3/K-4. There is nothing I can do about it today. I said my peace in my filing of those petitions. It is my complete understanding that I will not be affected by IMBRA, 2 K visas in 2 years rule. I am not worried really, I just was curious what you would think. One of the nice things about my attitude going into this marriage is, if my petition is delayed for any reason, and or the consulate in GUZ denies my wife and step son their visas to the USA, I will be moving to China Jan 2008. I have already been offered 2 jobs there in her city.

Thanks again for the Touch process on how that works. Also the paper work flow was nice to understand better. Oh, the "how do I send my paperwork binded" was a good one too. I used the same as you did. The big black clip binders. I did not send a good size door stop, but I bet someone's box is really heavy about right now. Also maybe I get the double points deal on this filing. I have K-3 and K-4.

I have filed a K-1 in 2000. That marriage ended in divorce in 2003.
I filed a I-130 in 2004, but that ended in divorce 2006.

I just flat made some bad choices in women.

I wrote an explanation to both marriages, and divorces with my I-130 I just filed.Under IMBRA, I dont need a wavier based on I did not file 2 K visas in the 2 year period. I hope that is correct anyway.

What I am really curious about is what a adjudicator thinks about someone that files more than 2 visa petitions.

First, thank you for your kudo's about helpful insight. I try.

Next - Boy, you sure throw the hard questions out there don't you... Look, I'm not going to answer this as a former adjudicator but a a person who has been to the otherside (divorce) and back gain. You may not like what I have to say, but you asked my opinion.

My situation was that I was the recipient of an unwanted surprise divorce back in '04 after 13 years of marriage (my 1st). I speak/know from personal experience that I was not emotionally capable of giving my heart away to someone else for quite a long time afterwards, as is usually the case. Devastated, I used that time for "me" time, meaning that I took a very long, hard and sometimes painful look at myself and embarked on a journey of self-discovery and personal growth for which I am very glad I did. It allowed me to heal from a very deep wound that I had received and become an even better and more self-enlightened person than I was at the time. So, in that regard I am glad I had to endure the divorce because I came out better on the otherside, even though I would never wish anything like that upon my worst enemies.

That having been said, I would say to you that maybe instead of wondering what an adjudicator would say to you regarding having just filed for yet another bride, my thoughts to you would be I think you need to take a hard look at yourself and the choices you are making in life and why you are making them. From what you tell me, you are engaged in some sort of a behaviour pattern here. The reasons why are known only to you and it's none of my business as to the "why" part of the question. But you even admitted that you made some "bad choices in women". Why? Why did you make bad choices? What made them bad choices? What have you learned from your bad choices and how are you going to keep from making bad choices in the future? This is all about you my friend. You don't know yourself. And until you take the time that is neccessary to "know" yourself and why you do things, you'll continue to make "bad choices". and whats to say that in 2009 or 2010 you'll be posting again about the next unfortunate event in your life.

So, I know I am being blunt and it is not my intention to pass judgement on you. Bad things happen to good people sometimes. But, I feel that until you sort things out in yourself, you may continue this pattern of unsuccesful relationships be it with a USC or a foreigner. I would encourage you that in order to be fair to any woman that you decide to get close to, that you need to get to the bottom of why you are doing these behaviours. Do this is to avoid hurting not only yourself more, but worse - the woman you love.

As we say here in Nebraska, "There is a time to get back up on the horse and ride after being bucked off and then there is a time to learn how to become a better rider before even getting back on a horse". Take the time to become a better rider, your new bride will thank you for it and you'll be happier in the long run.

That is a fair assessment for what little I wrote and told.

I know several people that are their 3rd petitions. I know this looks bad myself. I would think the same thing you just wrote. Falling off that horse must have damaged my head the first time, cause why am I on the 3rd petition now.

Let me tell you I wrote my reasons with my I-129F K-3 petition because I feared the adjudicator would think I am crazy that I can pick a 3rd woman and succeed.

My case of K-1 that ended in divorce, the girl developed a medical condition and wanted to return to china. At that point she then requested I file for divorce from her. Nothing I can do about it really, she is in Beijing, and I am in the USA, and she plainly tells me that she is not coming back the USA to be with me.

2nd case was a Chinese girl that was already in the USA, but only on a F-1 visa ( student visa ). She had a F-1 visa that was good to 2007 for a PHD program. So it is not like she married me to stay in the USA, and her sister is a USC also anyway. The girl was just to much to put up with in my life of simple, and she was extremely difficult to put up with. I also would not have a child with her, and that was my fault for the age difference.

So, I am not frugal in marriage, but made a bad decision to marry the PHD girl.

Just to let you know. The girl I have married now is just the best person I have ever met in my life. She is not only my wife today, but finally my best friend. I have went to china 3 times before I even filed the I-130. I have stayed 72 days total in China with her.

I documented all this with the I-130, and the K-3 petitions I filed in the last 4 weeks.

Hi there,

My fiance is from South Africa, and finally he's here!! kicking.gif It seemed like it took forever, but basically from the time our petition was mailed off, til the time he entered the US, was about 6 months. We had an attorney, which I think helped to speed things along. Hang in there! I know EXACTLY what you are going through. We are now about to enter the AOS process, but at least he's here and we can tackle that one as a team together.

Hi there,

Yes, he will need the unabridged version. It will show both of his parents names on it as well as his. Apparently the other one doesn't have enough information on it. I'm not sure if he has obtained a police clearance certificate yet, but he might want to go ahead and get that out of the way too. My husband (from the Johannesburg area) had to do it twice because one got lost.

Hi there, and welcome! Wow, I remember mailing off our I-129...seems like ages ago, even though it really wasn't. I know how tough it is being away from each other...hang in there! Nothing in life worth having ever comes easy. We sent ours off January of this year, he got his interview July 1st, which he was approved that day, and arrived here in the US July 31st. So, all in all, from the filing time, until he actually arrived was about 6 months. You may run into a couple of delays with the holidays and all, so, I would plan on 6-8 months. It seems like an eternity, but it's definitely worth the wait.

I believe so. I got an RFE during this phase of the process and I returned the original along with the corrected information. You don't want them to have to think too much and figure something out. They are Government employees. Be gentle!

I disagree... the credit card statement does exactly what he needs it to do and that it puts him exactly in a certain place on a certain date. If he compliments that with similiar evidence putting his fiancee in the same place at the same time then he accomplishes exactly what the requirement of the USCIS is.

BTW, dated photos can be faked.


USCIS is not going to willingly put together a puzzle of different events and dates to determine if 2 people were together or not! Anything can be faked, but a picture speaks a thousand words. Photos together have worked for all of us here!

BLACK is what they ask you to use. So I used a Black pen. A good Black pen will never look like the signature/info is from a copy. It'll have a "shine" to it that a copy will not produce.

The K1 visa is a once entry visa, if you leave the usa before you recieve your advance parole you will not be allowed to enter again.


You can leave when you want. There is no time limit to be here before you can leave the US. Form I-131 has conditions that can get Advanced Parole to you even if you are already out of the country when you apply for it. Look at the I-131 and it should clear things up for you.

USCIS does not put that much thought into what a ring looks like! As long as you have met in the past 2 years and can prove it and both of you are free to marry, all is good. Wether you have a ring or not, be it a band or a rock, it is not important to USCIS at all.

No problems if you get a new passport with new name without the K1 Visa inside. The K-1 Visa is a 1-time entry Visa. So after you are in the US, it has done its job. If your country will issue a new Passport, great. For Brasilians, the Brazilian Consulate will put a stamp in your unexpired Passport with your new married name. But you cannot replace the passport until it expires.

Military personnel have the right to have the K-1 process expedited. Contact your USCIS Service Center for details and/or search this forum on many cases just like yours. Good luck!.

When you made the "expedite request", you needed to provide specific documentation that the beneficiary's life was directly and immediately at risk. What happens in the country in general is not specific enough to your case and does not prove that any direct risk exists. This is why USCIS is asking for the documentation. Yes, they see news and they read the papers. The job of USCIS is to validate your request, put together your "package" and send it to the Consulate. That is what they are doing. But 100% of the proof is on you to provide documentation to support an expedited petition.

Just send all docs that had you planned to send them when you made the "expedite request". Send them photos of some events that has occurred near to where your beneficiary lives or works that puts her life in danger. Send them the news articles, preferably with dated entries. You'll need photos. You'll need signed statements from witnesses. The travel advisory is a not very specific, but it can be used as additional proof that a dangerous situation exists. The more you provide, the better your chances. USCIS wants "documentation", so send them something. Remember, USCIS wants doc to compile a package to support your request. But before they will "OK" an expedite case and forward your package, you have to give them a very solid reason to do so. You'll need to get creative. I wish you the best of luck.

The 4 G325A forms are different. They look almost exact, but not quite! So you will probably get an RFE for not sending all the required G325A forms. However, the additional sheet that you used to list employment is only needed once.

my fiancee just got medical check done and will have an interview soon, hopefully approve too. I'm planing to go oversea and fly together back to US once visa is approve. Here in Houston, the process took 5 minutes. My wife did not speak English when she arrived. Maybe that was a good thing!The process is not difficult. Probably more stressful for the beneficiary, but not difficult at all. The US Citizen can go to the Immigration lane for Foreigners. I did. But the IO did not process us together since we were not married yet. So I had to wait for her to finish before I could be processed. The Immigration officer looked at her documents and asked her a couple questions. She said "I don't speak English". He escorted her to a room for Immigration to enter her Passport and Visa information into the system. I was allowed to sit with her. Then they returned her passport and we went to get our luggage. No problems at all.

I've read what I could about the fees involved and i'm sure there will be misc. ones that are not listed... but i'm curious as to what some of you have spent while embarking on this wonderful journey for the K1. What i know of is the 455.00 for the I-295F, $1010.00 for the AOS. I'm also told there is another fee of around 400ish for the medical. Anything else I'm missing out on?? I'm trying to get a good grip on what will need to be saved and this is the one area i'm still unsure about.

Thanks for the input all. He's going to get originals printed for his interview and depending on how our timeline works out he should have more if it falls after June.. i'll see if i can burn the images to a CD and take it into Walgreens or something and have them printed out properly.

I'm sure it is out there but for the life of me I can't find the answer. The picture we provide of us together.. does it have to be on photo quality paper or does it matter? My fiance sent me a color print out of us together. I just want to know if i should try and d/l the pic and take it in and have it printed on different paper or if it will matter.

wow.. amazing to see others with the same situation. I got involved with my fiance while still working on going through my divorce. We actually 'met' face to face not long after i filed my initial divorce paperwork. I think so long as you can show proof of the relationship and the fact that your previous marriage is over you should be fine.

At UCSIS, you just have to meet the minimum and pass Background check.

The embassy will require the 'Hard' evidence. this is where they 'meet' your SO in person and as Judge and executioner, has your destiny of 'bliss' or 'hell' in their hands making a decision in seconds that will affect your forever.

both dont have to go to the embassy... but you do need to provide proof of the ongoing relationship at that time. unless of course you just mean they meet the beneficiary in person....

For our I-295F we sent 2 pics of us together in the last 2 years.. our letters of intent and copies of his plane tickets, boarding passes and passport with stamps. This was it. Mind you he's only been here once yet this was enough since they approved ours with just that info. Now for his interview he will be bringing more evidence to prove we have an ongoing relationship but for the initial petition you only need to prove you've met within the last 2 years.
