Telling someone those things aren't needed for London is 1) ridiculous, and 2) VERY irresponsible. While it's true, they probably won't look at them, why wouldn't you have them with you, when it clearly states they may ask to see them?

So sick of people making blanket statements like that. I mean, some poor person might read that, actually NOT bring any evidence of relationship to the interview. Imagine their surprise if they get asked for it!

So no offense, but if you have nothing useful at all to add, please don't add stupid things like that. Seriously.


London provides a list of things to bring to the interview on their embassy website. If they wanted relationship documentation, that would be on the list. It is not. Perhaps it's because our countries share a language and our people can hop a plane to visit back and forth easily on VWP. Most don't get engaged on the same trip where they meet in person for the first time. There are not loads of websites where British women post their photo to find an American husband who will be expected to send money back to the family abroad. We have a similar economy and lifestyle so maybe the fraud level is extremely low.

I'm a person who tells people no evidence of relationship is needed in London. I do it because not only have I been to a K1 interview, I have studied London experiences daily for about 1550 days now. I've kept up with four years of small procedural changes at the embassy. I've seen all the little hiccups people do have, but never have known even one, out of many hundreds, who was asked to provide relationship evidence. So I don't really consider myself irresponsible or stupid when I share my London knowledge.

My fiance is coming form England but his 2 college age kids are staying there and won't be moving to the US with him. My question is will he still need to get copies of their birth certificates to take to the K-1 interview in London?

Been there, done that. The answer is no. Nor is his first marriage certificate needed. Only his divorce decree. I remember puzzling over the same question because of the way some things were worded to cover all kinds of visas and situations.

My fiance received his packet for his medical exam and to schedule his interview back in December, but we had to ask for an extension because he got really sick and ended up in the hospital for twelve days with 2 ops on his knee. Does anyone know how that works? I was told it would more or less just sit there until we were ready to continue or is there some point when it just expires? If we withdraw it and try to reapply later when he gets his health back, will that look bad for us and make it harder? Thanks in advance for any advice!


Your I129F petition has an expiration printed on the approval notice. Looks like yours was probably around last Christmas. You should contact the embassy. Insist on an email code so you can email for your status and get a response from an immigration officer rather than the person that answers the phone who has no authority or much access to your case file. Give your case number, both names, when the petition was approved by USCIS, etc. Ask if your petition can be extended or if your case has been closed due to abandonment. That's the only way to know for sure how to proceed. Get it in writing straight from the embassy and not guesses from a forum. They may let you continue or you may have to start all over at USCIS with a new everything including fees and a long wait.

Her fiancé would need an income of £18,600 which is about $28,300 in US dollars. Sounds like he just made it to the lower US mark. It will take 5 years for the American spouse to gain permanent residence with income having to be proven twice more in that time. They get to live there but it's not permanent until they've done paperwork and financials a total of 3 times in the 5 years....beginning, middle, end. No co-sponsors are allowed

As I am a little confused, you say K1 is a fiance visa. Does this mean that you must get married within 90 days and then apply for citizenship?

You'll be applying for a greencard which allows you live and work in the US. They mean that...live and work in the US, not just pop in for a visit and spending most of your time in the UK. Citizenship will be available to you three more years after the greencard is issued if you remain married ,to the same US citizen. So count on around four years total to be a citizen after you are admitted on a fiancé visa, allowing processing time to get the GC and more waiting to become a citizen after you are eligible to apply.

Edit: Forgot to add, interviews along the way will be to determine if your marriage based visa is legitimate or if it's a scam to get in the US because you couldn't come up with a good way to move here and start your business in the US. You already stated in another thread that was your main reason to want a visa to the US.

Because he will be the sponsor is he the one to fill out the I-134? If so would he just put N/A for the US citizen specific questions, and just put his UK address when they ask for the US address? Or would he fill out a whole different sponsor form?

Because of the type of work he does he doesn't have to be 'working' to make money. He just makes the app once and sales continue to happen after he is done, and since he already has apps out he could be on vacation for example and still be making money, is that still not allowed? (obviously he wouldn't be allowed to make more apps until he was authorized but does the income form sales form apps he completed before still count as an income while he's waiting to be authorized?)

Thank you for your help! I was looking around Visa Journey and at the example forms but I'm still not sure if he is allowed to fill out I-134 because hes not a USC. Just trying to clarify. :)

It is a subjective number and there is no guideline. Few people come back and actually update what happened at the embassy. I recall one that said they were approved with $40,000. You have to convince the interviewing officer that he will not become a public charge. The number could actually be much less but it's up to the officer to decide. He needs to prove his cash funds with bank statements. Perhaps his business information and evidence of how much he has earned with his apps would make a favorable impression.

I've seen you asking about tax returns. No UK tax returns are ever needed at the embassy. A person self sponsoring would show his a$$et$ with bank statements. What he earned in the UK the last few years generally does not count in any way. He does not fill out an I-134. He shows up and says "I've got this much money in the bank. Is it enough to get a visa?"

The tax returns mentioned are US returns when there is a US sponsor providing an I-134. The answer is-- one tax return is sufficient. An I-134 by a US sponsor can be approved with zero tax returns if the income is proven in a different way.


2. Can a co-sponsor be retired?

Yes, it they have pension or social security income that meets the threshhold OR a lot of money in the bank.


3. I've never paid taxes because I've never reached the yearly income required to do so, do I need send off for some sort of paper to prove that?


No for the interview in LONDON. If you don't have any money, then don't even do an I-134. Get someone else. There is no requirement for you to do an I-134 or even sponsor for the visa. London just wants a sponsor. It can be you, friends, family, or the immigrant.

Your bigger problem is when he gets to the US. He can't work before you marry and file for AOS ($1070) and then wait 60-90 days for work authorization. There is a much stricter Affidavit of Support (I-864) that must go with the application. You will have to do that even with no income. You will need a joint sponsor from the US to also do one. You will have to explain why you did not file taxes in a statement saying your exact income for each of the previous 3 years. You can't just say "I didn't earn enough". You need to state what your earned and the filing threshold cut off for that year. Each year may have a different threshhold.

I did not file an income tax return in 2011 because I earned $125.32 and that was below the minimum requirement of $9500 income for a single taxpayer.
I did not file an income tax return in 2010 because I earned $_____ and that was below the minimum requirement of $_____ income for a single taxpayer.
I did not file an income tax return in 2009 because I earned $______and that was below the minimum requirement of $_______ income for a single taxpayer.



The answers I've given you are LONDON SPECIFIC FOR THE I-134. Many people are giving you how it works in other countries. Others are telling you I-864 requirements which are stricter. He just has to convince one person at the interview that he's not going to be a public charge. It's pretty much the officer's opinion. Maybe you hanging out in the UK for 6 months instead of finding a job in the US might shadow his general opinion. He might want more to convince him since you have not really earned a living for at least 3 years you've said. He will look at everything a make a judgement call on the self sponsoring thing.

Nobody knows when you will get there. Visa journey puts up a guess based on everybody's timeline. It's an average of a small sample of people that use Visa Journey, not every petition sent to USCIS. So VJ is guessing your petition should be approved very soon. Keep in mind what an "average" is--some are faster and some are slower so the average is somewhere in the middle between the fastest and slowest. USCIS will usually report some of their slowest dates and not say when the faster ones processed.

Thanks! That's what I figured. Now if I could only figure out why the website won't accept my information *sighs* I've tried every combination of home and business information, SSN/TIN and it just won't take any of them. I can't remember where I put last year's return and am still trying to get this year's from my tax lady so I can see exactly how she's entered it (my fault, forgot to pick it up after it was e-filed).

Have you moved? Calling the transcript automated hotline or online ( I think) will only do a return to the same address you used when filing. You can call and speak to a person and get it faxed to you. Or you can fax in the Form 4506-T and it will be mailed. The fax numbers are on the second page based on your state. I've ordered all those ways.

I made my fiance call USCIS today. They told her to mail in a letter explaining why the previous marriage was not declared on the I-129F, and copies of the paperwork for the current annulment process. They will then call her to verify the information that she mailed is correct, and rectify the application. They said that we called at the right time to make any changes that needed to be made, because if we had waited until receiving the NOA2 and then declared the annulment at the visa interview, then we would have major problems because the annulment wasn't finalised before the I-129F was filed. So they have mailed in the information that USCIS has requested, and it looks like they may just be treating it the same way they would an RFE. I guess we were very lucky with this! I'm not holding my breath until they send the NOA2 though, now the information they requested has been sent! If it doesn't work out, then we have decided that she will move to the UK instead, and then we'll work it out from there once we're married :)

I hope it works out for you. Do you know about the new stricter immigration procedures that went into effect this week for her moving to the UK?

She said everything in our package was sent, so either she's not telling the truth or CSC lost something. I've attached a copy of the RFE so you guys can see what it says. I'm going to resubmit all of the evidence plus full copies of my passport and his, the boarding passes that I found last night, and credit card statements from my visits there. Rob only carries cash, so he's not going to have any credit card statements. The RFE says we didn't submit the identification page- we did, but I guess it could have gotten lost. I should have this puppy in the mail by tomorrow.

I think after reading the RFE, it sounds like they saw passport stamps but maybe not the biographic page with your name and photo to indicate it was your passport. I certainly didn't send every blank page but I did have a statement on every photocopy page "I certify this is a true copy of my US passport". And I signed/dated every photocopied page.

It's all a little nit-picky in some ways, isn't it?

Nich-Nick: see for the MMR .. if I had measles vaccination at the age of 5 and clinically had mumps and rubella (plus a vaccination when I was 11) - do I need to get the shot anyway? And if I have and get it done at the medical, will I be given the waiver for the dose 2?

Thanks for your reply Nich-Nick. I can't get my second shot of MMR not due to time restrictions but health restrictions (can't have live vaccines with my current medication). I am hoping with a doctor's note explaining that, and my first shot in childhood that it will be enough. I had titers done and it showed I was immune to mumps and rubella, but not measles (It showed I had the shot but not enough antibodies). I'm hoping he will give me a medical waiver the day of, and then I won't have to worry about getting the 2nd shot while filing for AOS. I will be bookmarking your reply about those forms to make sure I get things done right the day of the exam. Thanks again for your reply!


To both of you--your cases are a bit different than run of the mill people who just go get a shot. It will be the doctor's decision. Take documentation with you proving disease or contraindications due to medication.

Sara, it sounds like you had dose 1 as a child. The dose two may be required. Seems like I read somewhere clinical diagnosis of Measles and rubella isnt reliable because there are so many spotty diseases. I can't speak for the doctor on how he will evaluate your situation. Keep in mind ZERO shots are required for the visa, but if you get it all documented as I explain, you get to skip the civil surgeon hassle in the US. I would just get a MMR shot at my GP before the medical and be done.

Vee-- Anything not medically appropriate is excuse for a waiver. It up to the doctor to decide if that qualifies in his mind to mark your sheet "not medically appropriate." if he marks it, USCIS will give you a waiver.

It's not a straightforward answer.

IF everything was complete at the medical exam and all shots were current at the time, and the form was filled out properly then USCIS will accept that DS-3025 as meeting vaccination requirements. Going to a civil surgeon in the US or further shots are not necessary. The DS-3025 would be marked "insufficient time interval" by MMR, and results marked "Incomplete" and "may be eligible for blanket waiver." The waiver would be given for the shot (2nd MMR) not appropriate the day the DS-3025 was filled out and signed. You don't have to get it later if you get the DS-3025 right.

BUT IF there was anything not marked on the DS-3025 you got later, then.... Let me use an example. Varicella isn't available in the UK. So if somebody didn't say at the medical exam they had chickenpox, there would be no waiver excuse by the varicella shot. Their DS-3025 would not be complete. So they must get the varicella shot once in the US and have a civil surgeon sign off on Form I-693. So while the CS is evaluating, he looks at the MMR that couldn't be given on the date of the exam abroad. By now the 4 week interval between MMR shots is long passed and it's perfectly safe to have that 2nd MMR. There is no longer an excuse so it would be needed. The old DS-3025 is not going to work because the I-693 has replaced it as the vaccination shot record.

I hope that makes sense. If it's perfect on the DS-3025 then USCIS accepts it. If for any reason something is not complete (like even if the doctor forgot to sign it), a civil surgeon will have to do an I-693. A new form on a new date may mean the time interval excuse is over.

I've a question regarding vaccination records. While we haven't yet received our NoA2, we're trying to prepare. My fiance (England) is trying to get his history of vaccination records as a child, but keeps running into a dead end. They keep telling him they simply can't find them. Is this going to be a problem when it comes to his medical exam at Knightsbridge? Thank you for any advice you can offer.

My advice--just get the needed shots for adults.

Tdap - or get DT, DTP or DtaP and it will be accepted for AOS. (must be no longer than 10 years ago)
MMR (if born in 1957 or later) Get a second shot 4 wks later if you have time
Varicella – Not routinely given in the UK ; a history of having chickenpox excuses you from the shot. They take your word for it at the visa medical exam.
Influenza - During flu season only, October 1 through March 31. This was a new recommendation dated November 2010 for all ages over 6 months. Older lists will say flu shots for over age 50. It changed.

So the reality is
Tdap has to be within 10 years, so a baby shot wouldn't get you out of that one.
Varicella Just say you had chicken pox without any proof required and you get out of that.
MMR Get the first less than 4 weeks before your medical exam and you don't have to get the second. You will be given a waiver by USCIS because it was medically inappropriate to get dose 2 on the date of the medical exam, which is the date USCIS goes by.
Influenza You can avoid this shot by having you medical (date of record) before flu season begins on Oct 1.

Many NHS doctors will do those shots for free. Way easier and cheaper than paying for the titre, which involves a needle too.

Hey guys,

Very simple question, and more than likely an obvious answer, but have to check.

My fiance is coming over to the states on Thursday, entering with the K1 visa. His old visa waiver (ESTA) has expired since his last visit, but he doesn't need it anyway as he now has his K1 visa. Correct?


I noticed when we flew out of Heathrow, the line checker guy (before getting to the check-in counter) was repeating over and over to each person "Do you have your ESTA?" Tell your fiance to not let that throw him off. The answer is "No, I'm traveling on a visa." Then he will probably show the visa and get the little sticker on the back that shows he cleared the checkpoint guy.

Markie's grandparents would be most suitable as they are very (and I mean very) well off. However, they retired last year and so have no source of active income. Does the co-sponsor need an active income to be suitable even if they are extremely well off?

If retired they may receive a pension or social security, which counts. They can also show assets--savings, investment accounts, cash in the bank and thus qualify. He should ask them first to see what they have to say. It's a big responsibility and they may not agree to it.


Also, how many co-sponsors can we use? I have seen things suggestive that it is just 1 and just 2 in others :s .

You may have one joint sponsor on the I-864 in addition to your husband being the primary sponsor.
For the I-134 in London, just a sponsor. If your fiance can't sponsor, then the grandfather can be the sole sponsor.

My fiancé is a Sole Trader, he sells applications for phones, because of the nature of his business his income will continue even if he is not working, meaning sales still come in without having to do anything.


Think of good ways to prove that income will continue...meaning it's not like full-time employment where he gets a regular salary each month. Bring some documentation to show it comes in month after month over a long period of time so they will be convinced it will continue to come in.


Taxes: He won't be taxed double on the same income. There are tax treaties in place between the US and UK. He'll be taxed by one or the other. If he pays in the UK, then he reports to the IRS, but gets credit for foreign taxes already paid on the money. It'll be complicated at first with the options.

Oh yes i know that! Sorry i meant in the time after my interview that i have the k1 and in my last month of employment at the airline i will swap off us-bound flights. I wont be leaving the us for a while after that. I am hoping to fly to san diego a couple of weeks after my last day with the company. Its going to be a sad/happy few weeks :/


Then yes, you can go anywhere but the US with the K1 visa in your passport. You might even be able to talk your way through US immigration with your crew visa, explaining you are still working and not immigrating on the K1 yet. But you never know what the one guy (with the final say) on the CBP desk that day will decide, so kinda risky.

Work a month after i resign. My employer will be fine, if im going to spend a life time in the usa i can go a month without it im sure! So interview can be delayed? Could be an option. I just keep reading stories of noa2 coming from csc in like 100 days and we are at day 50 now so trying to be as ready as possible. I wasnt expecting to have tp resign till february but if things stay the same could be sooner.

I don't know if I'm following everything you have planned but---

Say your B2 and crew visa are cancelled. When you enter the US on your K1, it's also cancelled so to speak, because it's a one-time visa. At that point you have no way to get back in the US so don't head out to Lagos.

Solution:
  • Work your notice and be free of your employment travel before you enter the US.
  • Enter the US on K1, marry, apply for AOS, and Advance Parole (AP), and work authorization (EAD). The AP will take 60-90 days to arrive and allows you to re-enter the US from international travel. Once you have the greencard, you no longer will use the AP. It's a temp travel card while you wait on the greencard.

London is different from Egypt in how they handle the visa part. London gives instructions for your fiancé. They only want her to mail in the forms, despite what the DS-156 says about attaching documents. She will bring all her documents and your I-134 to the interview. They will "attach" them together in the file. She does not need the NOA2 until she files for AOS in the US after marriage. Nobody haas ever shown an engagement ring receipt to my knowledge. Many dont even have engagement rings. Their website says a new letter of intent is only needed if the petition approval has expired before she sends in her forms. Any original document that she wants back from the embassy should have a photocopy with it. They will verify the original, file the photocopy, and return her originals. They provide a detailed list of what is brought to the interview. The UK forrum would be a good place for you to start reading and asking questions to get the London specific answers .

So here's my question -- is there any reason to wait to receive the letter from the embassy before sending in the forms for "Packet 3", or can we jump the gun and send them in as soon as we have them ready and have confirmed that the embassy has received our petition? We already have our case number from NVC...

Curious if anyone's had any personal experience doing this, especially in London.

Yes, people have done this for years. A call to DOS can confirm London indeed has your case. I think it's jumping the gun when people want to send the forms when their petition is not yet approved, or it hasn't made it to the NVC , or out of the NVC. There is a list if things that can be prepared prior to petition approval in the first post of London 2012- K1s from NOA2 to interview thread Let's organize the info/questions into one place. Then once the file makes it to London, you already have your ducks in a row.

Look at the 7th column. If a series of shots is complete, the column heading says to put a check or write VH If the patient has a history of varicella (aka chickenpox). A k1 is not excused because they don't give the shot in the UK. That only works for spouse visas. As a K1 you have opportunity to get the shot in the US before you apply for AOS. Look up the "technical Instructions for Civil Surgeons" and you will find it says verbal confirmation from you of having varicella is acceptable. Find it, print it, and show him his instructions.

Just a follow up on your answer, is there a form for self-sponsorship such as the I-384 or is it just a case of turning up to the interview (a lot to do and a long time to wait before that of course) with bank account statements etc as proof of assets?

For a K1, there is no published amount such as 5x poverty level. You just have to convince the interviewing officer that you won't become a public charge until you get a greencard and job. . I remember one who said they self-sponsored with $40k. I feel like its much less than people expect, but nobody comes back and reports. Some of the older members say they knew people who did it for $6-10k.

For a K1, your fiancé can be approved on salary of 100% of the poverty level, if that helps. There's no form to fill out when you self sponsor. Here's where the London embassy explains it http://london.usemba...faffidavit.html

A good rule of thumb is to remember these are forms from the AMERICAN government, so you will be going by American rules for your entire immigration process. This includes forms to the embassy in London, as well as meeting American immunization requirements, etc.

He did commit a crime that falls under grounds of inadmissability to the US. He should obtain all the details of the case, especially date, amount in grams, fine, or whatever. Here's what the Foreign Affairs Manual says about juveniles and drugs

Specifically excluded from such treatment, however, are convictions or admissions relating to drug trafficking, importing/exporting, and manufacturing

A caution in the UK isn't just a "warning" like you might experience in the US. You know when you get pulled over for a headlight out and the officer says he's not going to give you a ticket but go get the light fixed. A caution in the UK is a way to process minor cases without clogging up the courts. a person agreeing to the caution has basically pled guilty to the crime and accepts the fine or whatever without going before a judge. So don't be misled that a UK caution doesn't count, especially where drugs are concerned. Because of his age and being a small amount, and no repeat offense then the officer can approve the visa without a formal waiver, but each case is different so be prepared with case details for the interviewer to review. Then he will know for sure the age, etc rather than taking your finances word for it. He might get the grumpy interviewer who is a stickler for details.

Also keep up with all documentation because this can come back at you all the way to applying for US Citizenship.

So my NOA1 was back in early February and I visited my fiance in mid May and I gave her a new letter of intent to marry and the i-134 with all supporting documents. The problem is that we didn't get our NOA2 until the end of July. I was planning on just emailing her a pdfs of my last few pay statements to update the i-134 supporting documentation. Does anyone think I need to send her another i-134 and letter of intent dated nearer to the current date or am I probably ok. Thank you!

The I-134 doesn't actually count up household members by adding up numbers. It is somewhat more informal than the I-864 for adjustment of status. If you look at it, the form asks the sponsor to name people who depend on them for support...full or partial. Your parents can decide if they support her enough to list her.
