Hi Guys,
 
As you know I had my visa approved on the 6th of October. I heard that the CEAC status was supposed to change from 'Ready' to 'Administrative Processing' once it has been approved however mine is stuck on ready. Should I have any cause for concern?

The interview was only two days ago. It doesn't process that quickly in London. Maybe on Thursday something will happen. Perfectly normal at this point.

We received our approval two weeks ago and since then haven't heard anything, so presumably it's at least on its way to the NVC. In that time I've sorted out my police certificates and filled out the DS-160, is there anything else I can do now? I am in the United Kingdom if that makes a difference.

Thank you.  I was aware they could be downloaded, but wasn't sure if there is any stage at which an 'actual' copy may be required. Is the downloaded version sufficient for the purposes of AOS/EAD/ROC applications? 


You won't need it for ROC. A copy of your greencard will be used for that.
You will use the online printout for the AP application as well as application for a Social Security number.

Did you experience any hiccups not having an income large enough to owe taxes on?

If you were below the filing limits, you DO NOT have to file. Not for the IRS and not for immigration.
2013 Single- gross income $10,000
2012 Single- gross income $9,750
2011 Single- gross income $9,500

Gross income is salary, investments, rental income...all things considered income.

You will need a joint sponsor if you do not have a job with enough income by the time of interview in London.

You will need a joint sponsor if you still do not have a job by the time your new spouse applies to adjust status.

Question 2) I know we're not there just yet, but the financial requirements. I just finished grad school. I am unemployed. I am searching for a job, and will hopefully have one by the time the affidavit of support is needed. I also have a lot of savings and my parents have agreed to be a joint sponsor. The affidavit of support shouldn't be a problem.
 
Problem: I haven't paid taxes in the US since 2007. I was working in Japan 2007-2012. I only filed for 2009. My income was under the limit, so I didn't owe anything. I was unemployed 2012-present  and have not claimed any benefits, so I haven't been required to file for the past 2 years. Now, I can file the forms for the years I missed in Japan, but I still haven't paid any taxes (because I didn't owe any). Will our request get denied because I haven't paid any taxes even though I have enough money to support us? Also, how soon after I file the missing years can I request the transcripts or whatever we need for the application?

Insight for a LONDON fiancé interview:

They don't require a tax return in London if you have other proof of current income. So when you find that job, get a letter from your employer to take to the interview. One of your parents can also be the sponsor if you have no job. Or the fiancé can even self sponsor with a lot of cash in the bank or a house to sell.


Later when your fiancé (spouse) adjusts status to get a greencard, the I -864 Affidavit of Support is a little stricter. The most recent tax return must be sent in. However if you read the Instructions for the I-864, it says if you were not required to file a tax return, then submit a signed statement stating why. Be specific--
"In tax year 2014, I was an unemployed graduate student and earned $0.00, so was not required to file.
In tax year 2013, I earned $3,210.12 and fell below the filing threshold for a single person, so was not required to file." Etc for the three tax years appropriate to time you prepare the I-864.

You would also submit good documentation of that new job you will have by then---employer letter, six months pay stubs. Or one of your parents can be a joint sponsor and provide a complete I-864 in addition to the one you will submit.

Yes. The expiration date is the date by which it must be reviewed by the OMB. All government forms go through required periodic reviews and are either continued or revised. Use it until the review process is complete. If a new version comes out, it will be posted as the latest version.

If you require a police certificate from Australia, then you need fingerprints. It says that in your instructions on the London website.

I know for sure others who didn't get the fingerprint version of the Aussie police certificate, were not approved for their visa at the interview. They had to get the correct version and submit it along with their passport later. I am going to PM somebody I think got the Australian certificate and ask him to help with this topic.

I think for the purpose of a visa, you lived there. Others in the same situation have gotten one. It takes some time for you to get the proper police certificate from Australia and it requires you to have your fingerprints captured. Hi guys, my first post here.  My fiance is having alot of issues at work, enough to the point she wants to quit the job.  How would this effect our immigration?  She is also my sponser.  We are led to believe that she needs to maintain solid employment, but surely there has to be some form of allowence to change jobs??  Its getting real old, real quick seeing her in tears because of work.  So if anyone can shed some light on this we would greatly appreciate it.  Probably asking a bit much, but if you anwser, would you be so kind as to post a link or something to where this sort of information is.  Thanks in advance guys.
 

She does not provide her financial support documents when you first file. That will be months down the road at your interview. If she has a new job, and a letter from her employer stating adequate earnings, that is all London consulate will require to approve your visa. A few pay slips would be an additional proof you could bring. If she doesn't have a job by then, someone else can be your sponsor for the visa. London is fairly lenient on this for K1s. This is not information for those in other countries but the UK. Each is different.

London is more flexible on the I-134 than many consulates. They will accept Mom's I-134 and supporting documents alone. That's been their practice. However one person who interviewed recently said they didn't have one from the fiancé and so they asked if there was a new letter of intent from the fiancé. I don't know if that was a one-off situation because kinda odd from how they normally are. So really nothing from fiancé, but maybe get another letter of intent to say he still plans to marry you within 90 days of your entry on a K1 visa.

London does not require any specific list of income proofs. No tax return is fine if there is other proof. Mom needs something stating her salary. Does her Notification of Personnel Action include salary? If so, that will do it. Is she a doctor? Maybe she doesn't get a salary like a typical employee. What can she prove her yearly income with?

Yes they accept scanned copies of evidence, but you likely have a month to receive something in the mail.

The photos on the DOS guidelines have several photos marked acceptable with people wearing jewelry and glasses.
 
In the photos I have I'm wearing jewelry.
 
There are several posts on here stressing no jewelry no glasses etc. whatsoever... even quoting it as 'coming from DOS' or uscis... Was this an old rule that has since been updated??




Often VJ is like the game where people whisper something to the next person and so on down the line. At the end, the phrase is nothing like it started out. I always called the game "Gossip" but maybe in the UK it is ""Chinese Whispers".

Anyway if you go to the source where DOS says what is acceptable and gives examples of right and wrong, you will be fine.

Keep in mind that the cover letter is probably discarded in the mail room by the contractors who reassemble all you send. A b c d may not end up together in your same order. The actual USCIS adjudicator will not see it as you submitted it.

I organized mine by trips but just laid small things out on the copier like a collage instead of scanning and resizing...boarding passes, a photo, an ATM receipt...whatever. (I like your scanning idea). I used a very light yellow highlighter to highlight my name and the dates on the various pieces. Then I wrote in red Sharpie in the margin at the bottom what that page showed. "Nich visits Nick in England Jan 2-12, 2013". "Nich and Nick visit France April 3-7, 2013". (Ferry tickets and my passport stamp). So instead of a table of contents, I was kinda in their face with red writing on each page pointing out what I wanted them to see, but kept it brief and didn't write a story. I pretty much did that for everything through citizenship and nobody complained. Just go with what suits your sense of logic and don't worry about the resizing. I had to resize my husband's UK birth certificate for a submission because it was huge.

I didn't document with evidence anything but meeting in person. Did not document the progression of talking online first or becoming facebook friends or screenshots of video chats. Still got approved easily. I wrote a short couple of paragraphs as an additional page to the I-129F saying we became acquainted like this and first met in person on [date] when I went to England. He first visited me [date]. We have made subsequent visits [long list of dates and location]. We decided in [month, year] to get married. Just a very brief summary of us. Never said "love" or "engaged". They see all kinds of submissions so pick what pleases you.

It's not as hard as you imagine when you are first starting out. They aren't like the FBI at a crime scene going over everything with a microscope.

Well back in 2008, we did have 4 identical G-325As like old fashioned carbon copies. You filled out the first online and it populated all four. Weird really. And our instructions did say use N/A or None. Some of the newer forms generate a barcode, so maybe that extra stuff clutters their design. No clue. But check each form instruction you fill out for immigration because some may still say leave no blanks if they are a little older.

Yes. They are secondary evidence of meeting within the last two years so that would be the focus for the petition approval. But if you met when you were in kindergarten and found each other again, then a photo of two tots would be amusing if not evidence. A photo of you (whenever) puts a face on otherwise names on a paper. Somebody on here dated as teens then got back together like 20 years later. Not evidence of meeting the last 2 years but an entertaining photo.

I was wondering what photo evidence needs to be included in the initial k1 visa application.
Do we only need to include photos from the past 2 years or from our whole relationship? I did not want to include too many photos, how many did you all send?

Maybe six in a variety of times frames would be nice. Not all from the same trip if you have multiple visits. With family members is good. London does not request any proof of relationship at the interview. But they may pull out the photos you send with the petition and ask about who is in the photo. "Who's parents are these?" "Is this your fiance's sister? What is her name?". Or they may not bother at all. I've read a couple of people (out of several hundreds) that said they were asked "Did you bring any photos for me to see"? I think that is maybe one who just likes to look at photos and if you said "no" it would be fine. Most of the time photos aren't even discussed. You also won't have to show additional trips, or Skype logs, or an engagement ring receipt....none of that....at a London interview.

Vaccine Schedule
The vaccine is readily available at your doctor's office or local health clinic. Three doses are generally required to complete the hepatitis B vaccine series, although there is an accelerated two-dose series for adolescents.

Adults do not have to "catch up" by proving they had the baby vaccines. They only need the four which are age appropriate for 19 and over.

Note that the first two cover diphtheria, tetanus, and pertussis (or just diphtheria and tetanus) but have different strengths for children vs adults. A capital letter indicates a stronger dose, while a lower case letter indicates a lesser dose. Some adults showed an adverse reaction to the higher dosage for diphtheria and pertussis, thus the lower dosage for adults was created.
DTP/DTaP/DT -pediatric formula
Td/Tdap - adolescent and adult formula

The USCIS will accept the pediatric formulary or the adult versions for an adult patient.

You know there's only four possible shots for anybody over 19 years old?

Mumps/measles/rubella combo

Diptheria/tetanus/pertussis combo (one within the last 10 years)

Varicella -excused if he had chickenpox which most in the UK have had. They take your word for having chickenpox.

Influenza- Flu jab required only if his visa medical is during flu season. That ended Monday.

So most likely he only needs two shots to be complete for AOS.

Anecdotal mostly from reading 6 years of interview discussion about London where many have been successful with only a (singular) sponsor.     A fiancé with no money is of little use to convince the officer that the beneficiary will not become a public charge.  You may also read the Foreign Affairs Manual, where you will see it does not say the petitioner must be the sponsor on an I-134. It even discusses other suitable sponsors and relationships to consider. It even suggests non-Americans may not follow through with a sponsorship but it does not expressly prohibit their consideration.  

In the end, it is a judgement call by the officer and London officers have historically accepted someone other than the fiancé, including the beneficiary, as the sole sponsor. 

9 FAM 40.41 N5.6-3 Use of Form I-134, Affidavit of Support
(CT:VISA-1995; 06-06-2013)

a. Form I-134 may be requested by you in any case in which an alien is inadmissible on public charge grounds, but where the I-864 is not required. Section 213 of the INA (not section 213A) permits the admission of any alien who is inadmissible on public charge grounds in the discretion of the Secretary of the Department of Homeland Security or the Attorney General, by the posting of a bond, or by another undertaking. The I-134 is considered to be another such undertaking.

b. Because INA 212(a)(4)© and INA 213A require the use of Form I-864 for so many classes of immigrants, the use of Form I-134, Affidavit of Support, has been reduced considerably. Nevertheless, there still are circumstances when Form I-134 will be beneficial. This affidavit, submitted by the applicant at your request, is not legally binding on the sponsor and should not be accorded the same weight as Form I-864. Form I-134 should be given consideration as one form of evidence, however, in conjunction with the other forms of evidence mentioned below.

c. If you determine that any of the following types of applicants need an Affidavit of Support to meet the public charge requirement, they may use Form I-134, as they are not authorized to use Form I-864 or I-864W:
(1) Returning resident aliens (SBs);
(2) Diversity visa applicants (DVs); and
(3) Fiancé(e)s (K1s or K3s)

d. The simple submission of Form I-134, Affidavit of Support, however, is not sufficient to establish that the beneficiary is not likely to become a public charge. Although the minimum income requirements of Form I-864, do not apply in such cases (e.g., the 125 percent minimum income amount which is only required by the I-864), you must make a thorough evaluation of other factors, such as:

(1) The sponsor's motives in submitting the affidavit;
(2) The sponsor's relationship to the applicant (e.g., relative by blood or marriage, former employer or employee, schoolmates, or business associates);
(3) The length of time the sponsor and applicant have known each other;
(4) The sponsor's financial resources; and
(5) Other responsibilities of the sponsor.
NOTE: When there are compelling or forceful ties between the applicant and the sponsor, such as a close family relationship or friendship of long standing, you may favorably consider the affidavit. On the other hand, an affidavit submitted by a casual friend or distant relative who has little or no personal knowledge of the applicant has more limited value. If the sponsor is not a U.S. citizen or lawful permanent resident (LPR), the likelihood of the sponsor's support of an immigrant visa (IV) applicant until the applicant can become self- supporting is a particularly important consideration.


Take it or leave it. You can always present something from you fiancé that shows the likelihood that you will not become a public charge. London has no absolute required documents. Just figure how how she can best prove to a stranger that she has a job and income. Or use a different sponsor instead of her.

What I told you is based on reading just about every interview tale told about London for six years. They are more flexible than other consulates. On more than several occasions people have reported--

Approval on an employment letter only.
Having excessive proofs of income handed back.
Being approved on 100% not 125% of the poverty guidelines.
Being approved with one sponsor, not the petitioner.
Being approved by the UK beneficiary bringing proof of a house sale, or money in the bank.
Little or no discussion of the I-134 by the interviewer if adequate funds documentation was turned in to the document collecting person.

Yes, bring all you want to the interview. A tax transcript is so easy to get (online, print at home) that most people use that as an easier proof. But K1s are approved in London without one so don't despair if you have those other proofs. I would bet $1000 London wouldn't send you away to get a tax return for an I-134. Out of curiosity, why don't you want to use a tax return?

The info you have read about a tax transcript and proof of citizenship applies to the I-864 Affidavit of Support which you will not fill out until Adjustment of Status. For a London K1 interview, the I-134 does NOT have any one required piece of income proof. They will take any documentation that shows your income. We suggest taking two proofs, but they have accepted only one proof on many occasions. What you have is sufficient for London. Also London only requires an I-134 from the sponsor with enough money. If the fiancé doesn't make any money, then he doesn't have to do an I-134. Another person can be the sponsor and prove their income. Or the UK beneficiary can sponsor herself by bringing proof of assets. In the case of self-sponsoring, there is no I-134 for London.

This advice from the London K1 guide, which i've read several times over and still managed to overlook the info i'm after:
 
"Call the Visa Specialist Unit at the Department of State - (202) 485-7600 when your Case Updated field on CEAC changes. This means one of two things they've either received your online Readiness form, or they've printed and sent your interview date letter. The DOS will be able to tell you when your interview date is, just in case the letter never arrives or is late. It is a good idea to check with them because some have never received their letter."
 
I'm assuming 'case updated' field does in fact mean 'status updated' (maybe it changed recently, i'm not suggesting the advice is wrong), and hence at this stage I can ring DoS to see if they have my interview date.

DOS will no longer talk to anybody about their K1 status. It's an update at the end of the London guide. Your status is going to say "ready" pretty much the whole time from arrival at the embassy until after your interview. The date normally changes if they get something like a form or medical file, answer an email, or send an interview letter. All a guessing game really. After the interview it will likely say Administrative Processing (working on paperwork, waiting in the queue to be printed) and then Issued (printed, celebrate, fret about when courier will get it and deliver). Hope that helps. The updates aren't always dependable, so don't bet the farm on them.

I read two completly different things on a forum on here and i do not understand at all!

The London guide link I posted to you hours before you started this thread tells you what to do. It just takes some time to read and let it sink in. You should not follow anybody from another country or consulate because they all have different procedures. Not all have a Readiness form. Some do medicals on the same day as interview. Some schedule their own interview. So you could be confused if you aren't reading London specific instructions.

Either way, they will accept and approve it. Your fiancé is correct. The purpose is to find out how many others you might have to support financially. They want to know if you have other immigrants you have signed an Affidavit of Support for. In some cases petitioners might have brought over Mom and Dad as immigrants. Then they found a fiancé they also need to sponsor. And they have 3 kids to support. It helps the consulate know what kind of money to require. Is it just the USC and fiancé (2)? Or is it USC, fiancé, 3 kids, Mom and Dad immigrates (7)?

Yes. The manually filled out piece of a card is no longer used. The online printout is the "new" official I-94.

Our friend in the US has filled out our co-sponsor I-134 as the USC does not earn enough from her current job. I'm going to London for my interview so we can use a co sponsor before anyone says :-).
 
Q 3 of the i-134 is the details of the beneficiary and it asks for 'relationship to sponsor' ? What should our friend put in this box ??

The reason I suggested maybe putting more than "friend" is because of this discussion of the I-134 from the Foreign Affairs Manual:

(Paragraph before is saying to consider more than income and look at other factors, such as....)

(1) The sponsor's motives in submitting the affidavit;
(2) The sponsor's relationship to the applicant (e.g., relative by blood or marriage, former employer or employee, schoolmates, or business associates);
(3) The length of time the sponsor and applicant have known each other;

(4) The sponsor's financial resources; and
(5) Other responsibilities of the sponsor.
NOTE: When there are compelling or forceful ties between the applicant and the sponsor, such as a close family relationship or friendship of long standing, you may favorably consider the affidavit. On the other hand, an affidavit submitted by a casual friend or distant relative who has little or no personal knowledge of the applicant has more limited value. If the sponsor is not a U.S. citizen or lawful permanent resident (LPR), the likelihood of the sponsor's support of an immigrant visa (IV) applicant until the applicant can become self- supporting is a particularly important consideration.


I don't think London would likely care, but if you could quantify the relationship a bit, why not?

So we got an e-mail today that we have an RFE. OH, might not pick up mail for a week, and I'm concerned how long we have to return whatever evidence is needed. Anybody have any ideas on the time frame they give you?
 
The e-mail said to call them if I needed info....so I did......oh Dear I got "Agent I'm not having a good day".........who refused to tell me anything, but did say there is no extension to whatever time limit is given. If it's not sent in time, you get a denial........
 
I'm not sure I believe this, as elsewhere on the forum someone else mentioned they let USCIS know, there was a delay...and by advising them the case was kept open.

You should be given around 84 days to respond.
The call center never tells you what it is. You have to wait for the mail.

They could deny the application based on you failing to prove your case with evidence. BUT they are giving you a second chance to supply additional evidence. If you don't reply in time, they can assume you have abandoned and deny. If on your second chance (the RFE response) you still fail to give them what they need to approve the case, then they can deny because they don't have what they need to give approval. Don't count on them giving you a third chance, even though some may have been so lucky.

So get it in on time and get it right.

Any idea if I put biological or adopted parental info on the I-194 form? 

I would personally put the adoptive parents. They are by law the parents. Most adoptees don't even know their bio parents.

You can add a page to any form. Label the top wih the form name and question number. Then you can list both if you wish, for a full disclosure.

On that Guide page, it is serious over-kill for anybody interviewing in London. Here is the list revised for you.--

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):

NO 1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well).
NO 2. Send copies of the documentary proof that you submitted with the I-129F for your fiance(e) to have on hand for their interview at the embassy. Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well).
NO 3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).
4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
5. You will need several items (for the above form). Gather duplicate evidence of income and resources as appropriate:

NO (A) Statement from an officer of the bank/financial institution with your deposits, identifying the following: 1. date account opened; 2. total amount deposited for the past year; 3. present balance
Good one (B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available)
© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern
(D) List containing serial numbers and denominations of bonds and name of record owner(s).

Begin collecting these ASAP after your NOA2 arrives. See this FAQ for more tips and useful information on the Affidavit of Support Form.
NO 6. A copy of the NOA2 that you received in the mail. (backup information; the embassy will have copies of this as well)
NO 7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, online chat logs (pick several over the prior few months), etc.. from between the time you filed and present (NOA1 until date-now).

NO Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)
