Do you have every document in hand already? Your police certificate, the I -134 from your fiancé with proof of income, name changes, court records for any arrests/cautions, etc? If so, you are free to mail it. If not, then wait until you have all documents on the London interview list. The purpose of the form is to say, I can come interview today if you call me because I have everything I need. My undocumented personal opinion is this order is London's game plan and works best.

I called the DOS on Friday to check whether the London Embassy had received our case and they have. I have a few questions. I have my medical booked for 8th March. Obviously i haven't received the packet 3 info from the embassy yet as they only got the case on Friday.

I don't have to wait for the Embassy to mail me packet 3 link,right? As long as they have my file i can go ahead and send all my forms?

I have DS-230 Part 1 filled out. Part 2 is blank.

DS-156 & DS-157. Two Copies of each.

Do i send the DS2001 and cover letter at the same time as all the other forms? :wacko:

Hi All,

We are still waiting patiently for our NOA2 and in the meantime trying to figure out potential logistics issues. I have two kids coming with me to the US. But they will need to leave the US to spend time with their Dad over the summer. Could they enter the US on the VWP with a K2 in their passport then leave to visit their Dad and re-enter until AOS on their K2?

Anyone know? Anyone done this with their K1?


It's going to be summer before you get your visas so if the kids can fly unaccompanied, they can wait to enter the US after time with Dad if you want to leave earlier. The kids are also derivatives and can follow to join up to a year after your visa is issued. They can interview and get their visa after you if the timing isn't right for them to immigrate at the same time.

Hi.
I'll give a brief rundown of my current situation.
I'm a student from Huddersfield. My fiance lives in Texas. We filed for the K1 visa and recently received our NOA2. I am now preparing for themedical and the interview but I have some questions.

Question 1)
I'm currently going through the step by step guide of things I need for the interview.
On the required documents page it says:

'Applications processed by the Embassy in London - You are required to obtain the original documents or certified copies, and one photocopy (with the exception of your passport and photographs) for yourself and each family member applying for a visa. All documents are required even if they were previously submitted to the USCIS with your petition. From January 22, 2013, the Immigrant Visa Unit will begin charging $1.00 per item if they are required to photocopy original documents. Therefore, please ensure that you bring photocopies of all of the original documents with the exeption of your passport and photographs.'

Does this mean my fiance needs to call up the visa processors in the US and ask them to send copies of our original forms? Or will they have been forwarded to the London embassy?


Everything you sent with the petition will be in London. The documents they are talking about are your documents that you present at the interview. They have a list. There is nothing from the USC but the affidavit of support and proof of income taken to the interview. If you want a copy of your document back, take along a photocopy...like you probably want your certified birth certificate back. Otherwise they will charge $1 to make a copy. If you don't need a copy back, like the affidavit of support is probably saved on fiance's computer, then you don't need to take a photocopy of it. After they look at original documents, they file the photocopy and hand back your original documents.

Question 2)
It says that I need to schedule for the medical exam, attend the medical exam in London, return home, then attend the interview after the embassy has received the receipt of my medical exam.
Is there any way the medical exam and interview could be scheduled on the same day? Or, at least, the interview be scheduled the day after the medical? I ask only because my parents will be taking me to both the medical exam and interview due to anxiety issues and travelling from Huddersfield to London twice in such a short time will be expensive and will require them getting the time off work.

Ask further questions in that thread, but if you read through it you will find almost every possible question has been asked and discussed. You want answers for London, not other another embassy where the procedure may be different.

Hello,

We have just started out with putting the I-129F and G-325A forms together and we're a little confused regarding the permanent/current/residence addresses.

As we are both relatively recent graduates we both have the intention of putting our parent's addresses as our 'permanent' address for all mail correspondence to be send to. Further confusion comes though as we are currently living together in Spain as we don't want things to be send here with the bad postal service. On the G-325A you have to list your residence addresses over the last 5 years, am I likely to have difficulties where my current address is in Spain and on the I-129F my address is a UK one. On top of that, as I'm sure many people have found, whilst a Student you end up with many different addresses for short periods of time. Do we need to list each and every short term address or can we just use our 'permanent' (aka parents) address?

Also, with regard to background checks. Will I be required to have a Spanish police check as I've currently been here for 6 months and will probably be here for another 3 months?

Any information/help would be much appreciated.

Basically they want to know where you've been for security checks and police certificate purposes. Fine to put a permanent address for mail purposes, but you can't ignore reporting being in Spain. If you have too many addresses, write "see attached" on the form and add a page where you list all addresses. Make the best, most logical list you can. If you spent 5 days with a friend between apartments, was that really your residence where you got mail and paid bill? Not really. They aren't going to go to every address and check if you were there on those exact dates so give the most accurate list you can.

London website tells you when you require a police certificate:

Police Certificates:  Required for all countries where you have lived for more than 12 months since the age of 16.  Present and former residents of the United States should NOT obtain any police certificates covering their residence in the U.S.

Calling the embassy is a waste of money. They charge per minute. The quote given you from the London website is correct, except "no trace" means it's clear and there is nothing to discuss about it. "No live trace" means you have a police record on the books. You only need one certificate. It will never be used again after the interview, but make a copy for your files. All police certificates come from ACPO, not the local station since about Jan 2008. They come quickly so no need to pay for expdited service. Your interview could be in early July, at which time your daughter will not have lived in the UK for 6 months past her 16th birthday. But if you feel better ordering one for her, call ACPO and ask if they provide them for under 16 years old.

Thanks to my future Father-in-law I don't think we would got this far. He's been in contact with Congressman Wolfs Office nearly everyday and they have been on the case everyday for us and contacting him letting us know the current situation and by the sounds of it I maybe there literally in time for the wedding!

But If not The idea of still having the wedding but not making it 'official' does sound like a good idea, so my fiancee visa will still be valid and then when it finally arrives we could go for a simple Official wedding :) I will have a talk with my Fiance about this.....thank you everyone for that idea....I do really appreciated all of your help :thumbs:

A comment on expedite with USCIS-- if they are sending RFEs, it probably means approval is very soon...as soon as they review the response. A USCIS expedite doesn't mean the Dept of State/London Embaassy is going to expedite. Different government agency. So if they got NOA2 tomorrow, it would most probably be early June before getting a visa in London, even if you had all your ducks perfectly in a row. If you aren't super prepared with all the tips and tricks for London, then it could easily exceed 3 months after NOA2. And the petition hasn't been approved yet, so the clock can't even start on that part yet.

I wonder if all this pulling of the file to do the congressional reply, or if an expedite was requested, would actually slow down a petition that is on an adjudicators desk just waiting for the RFE response.

It will take a miracle to have a visa in time for the wedding. If you marry before the visa, you're done with getting a K1 because fiancé visa won't work for a married guy. A spouse visa will be starting over from where you were last July 2.

No point in paying for a medical exam in London or a visa fee if you are going to need a spouse visa instead.

hello all

i know i just posted, but now i have another question. we filed in december for our k-1 visa and are hoping to get NOA2 by this summer. what we are worried about is if my fiance makes enough for the affidavit of support so that she doesn't need a co-sponsor. she currently makes just under the limit for a 2 person household with her job alone. what i am wondering is if a structured settlement could count as income? she said she asked her parents and a couple other people, and they said it couldn't be counted as an asset because she can't access it all at once? she currently gets monthly payments, plus large sums every few years. i think she's going to be getting the monthly payments until she is 30? or some age like that. just curious if this could be counted as an income, as we would really like to avoid having to get a co-sponsor. thanks! :)

OH btw, she does not pay taxes on that. that is a big reason we wondered if it would count, as she does not pay taxes for it?


There is a difference between income and assets. Assets can be used to make up where one falls short in income. Assets can be a savings account, stocks, bonds, real estate, certificates of deposit...things like that. In general to use an asset it must be easily convertible to cash within one year. Her entire settlement balance is not immediately available to her as cash so she can't claim the whole settlement as an asset for this purpose.

But if she gets a monthly payment, that payment is income. It doesn't matter if it's taxable income or not. She would have to prove that she is to receive that amount each month with a statement of some sort from whoever distributes her monthly payment. Much like an employer letter states a person is employed full-time at "ABC Company" making $2000/month, she needs something official in writing stating her monthly distribution from "XYZ Bank and Trust" is $xxx.xx/month. She can further back that up with bank statements showing $xxx.xx being direct deposited each month or even photocopies of checks if she receives money in the mail by check. While it may not show up on her tax return, it's not the tax return amount that gets you through. It is painting a clear picture of her current monthly or yearly income to the officer making the decision.

My husband attached and just got a confused/mean look from the short lady at window 1 when she asked for his photos. She's still there and kinda looks gruff sometimes. I think it's easier for them to scan a loose one. It will be fine.

It doesn't say "do not attach" anywhere in their instructions. They normally attach at the document window.
I guess their logic is when they say mail in XYZ forms and bring ABC to the interview, you're supposed to know they mean literally only the forms.

Yes, send only photocopies. No, they won't want to look at all your emails, plane tickets, Facebook status, or love letters at the interview in London. Each consulate has a different vibe and procedures so when you get past the petition, learn the London stuff in the UK forum.

Finances: presented at the interview in London. 8-10 months from when you file. 100% of the poverty guidelines for visa. 125% later for the greencard. Your job doesn't count, but your cash savings will. If she has steady income from an inheritance, get documentation to prove it and that will do if it meets the level required. . What I find odd is that two people from the same country might have completely different NOA1>NOA2 periods. Shirley they are stacked on the overflowing shelves of CSC in incoming data sequence and they get pulled off the shelf in order.

There must be some logic to the system ?


Here's some stats to amuse you while you ponder the logic. We filed the exact same date as another British couple from Cambridge. We started a jovial "race" and kept up only when the next hurdle was jumped. Oxford vs Cambridge.

Our paths were identical--VSC, London, AOS transferred (no interview). We were both pretty savvy to filing...no RFEs, etc. Somehow they were always in the fast lane, or maybe it was the fast box. :P

Our race: Cambridge / Oxford
NOA2: 36 days/59 days
Interview: 63 days/88 days
EAD: 23 days/59 days
Greencard: 192 days/196 days
Removing conditions: 142 days/171 days
Citizenship: 137 days (tie)

Because of different variables along the way, we ended our journey from mailing that first packet to US Citizenship only 26 days apart.

Best advice in hindsight of the entire process is just let it happen and quit checking USCIS constantly. It consumes you and disappoints you too often. Go have a pint. Cheers!

I would say no to change of address with USCIS. Your petition has been approved. You have your NOA2. USCIS shipped you off to NVC. That part is done and you have no active business with USCIS at this time.

Now you are active with the Dept of State. Your fiancé can give the officer your new address or take updated DS- forms to the embassy and offer them , saying an address has changed. You could do another I-134 with the new address if you want it all tidy or let him tell them you have moved since you signed the form. Basically everything was true when you each submitted forms. The interview is a good time to tell them something has changed.

I see nobody has answered you. There is a Dept of State web page that tells how to get documents from various countries and if they are available.. This is Dominican Republic:

Available. Certified copies of marriage, adoption, divorce and death certificates may be obtained by visiting the Civil Registry Office (Oficialía del Estado Civil) having jurisdiction over the area in which the marriage, divorce, adoption or death took place. Alternatively, such certificates may be obtained by writing directly to the General Directorate of Civil Registry Offices of the Republic (Dirección General de las Oficialías del Estado Civil de la República) in Santo Domingo. The address of the General Directorate is Calle Paul Harris esq. Horacio Vicioso.

Domincan civil documents used for visa purposes must be legalized at the Oficina Central del Estado Civil, the main civil registry office in Santo Domingo.


So is that the office she contacted or was it a lawyer office? I don't quite follow the post about what was sent to USCIS. Generally they want a decree signed by an official like the judge and in the full long version (in extensa) over an extract. And they want an English translation along with the Spanish version.

You ultimately have to give the best answer your logic can come up with. First off, I've never known an interviewer in London to discuss the job supervisor . Nor have I known anybody to report their employer was called. So it's not a hugely critical question if you were ranking the importance toward getting a visa.

My logic would say I was hired by XYZ agency. Somebody there places me in temp jobs. XYZ pays my salary. XYZ is responsible for my performance. If Nationwide doesn't like me, they call XYZ to say "deal with her and send me somebody else". XYZ would be the one to terminate me. If London embassy wanted to know anything about my work, salary, etc, they could get everything from XYZ.

If you want to make a long list of every assignment, you certainly can add a sheet at the back of the form and go hunt down each supervisors name.

Two ideas, no right or wrong way to do it really. Pick the one that you feel most comfortable with. The only possible discussion of work you will have at London may be (in a chatty conversation)--"so what kind of work do you do in the UK? Do you think you will look for the same kind of work in the US?

By the way, have you found the UK forum on VJ yet? It's a really good place to learn and ask about London specific procedures, which are different from other consulates.

I have searched everywhere for a answer to this, but on one thread it says one thing and another on different thread.

I am filling out DS-230 part i for myself (K1 Visa) and on question 29 it says list all children, their address etc, well my son has dual citizenship so was told on one thread this doesn't need to be filled out with his name, but another says I do, what is right?

Also do I need to fill out another ds-230 part i on behalf of my son, even if he has dual citizenship, won't he already be good to go right?

Your son does not need a visa, so no forms for him.

List all children means list them. They asked your parent's names too and they aren't immigrating with you. This is on the London Embassy website in the FAQ's http://london.usemba...proc.html#iv054

You are required to enter the details of every child under the age of 21, including a stepchild from a marriage that was entered into while the child was under the age of 18.

Anyway on to the main questions!

Our main concern is our age difference, its 9 years.
Along with that there may be legal issues because of my age and also he's a high school teacher =/
Any advice would be really helpfull.

Is he a US citizen?
Are you free to get married? (legally old enough, not already married)
Have you met in person within the last two years?
That's really all there is to it. USCIS doesn't get into morals or gossip-like distractions such as "why is he dating someone the age of his students? Shame on him"


Also if anyone know's where i can get US sized passport in Norwich UK that would be great!


You can take your own and size it using this uploader tool from the Dept of State. Scroll halfway down the page. http://travel.state....toreq_5333.html Save the jpg file and print at home or at a photo place. Also available at Snappy Snaps, Photo-Me booths, Jessops. Any of those near you?

PhotoMe booths are available for normal passport photos and are usually found in Asda and UK passport issuing postoffices however they also now do Visa shots at a price of £7. it isn't immediately obvious either so check the machine you are using carefully.

hey all, I attended my interview and all was successful except one little thing - a hold up from medicals - so they didn't take our passports. Medical issue was all cleared up and the couriers came and got our passports last Monday, the 25th of march, it's now the 3rd of April and no sign of visas yet and courier service says embassy still has them - have you guys got any idea of time frames regarding this?

I've been around the UK forum a long time (that's where you should be asking this question) and sometime they get right on processing your visa. Other times it might sit in a pile 3 weeks because they are busy with other cases and daily interviews. Also remember there were US holidays and UK bank holidays, both of which the embassy takes. They could have been closed Friday and Monday. Not sure. I didn't check.

Thanks for the help i know i won t get my visa till then but i am hoping we can be accepted within the next 5-6 months as it was january we sent the forms off do you think that sounds logical me and my fiance are prepared to wait as long as it takes as she will visit me here in england whilst waiting im not taking the risk going there and not being allowed in before my visa is hand

If you will make a timeline, a predicted date of petition approval will get generated. Then you will have about 10-12 more weeks beyond that to do the London part becore you get the visa. Click on "timeline" under your name then read #2. Right now California Serive Center is working on approvals of peritions sent in August.

Thanks for the update. I have asked the VJ admin. to update/correct the FAQs to reflect current practices, so that everyone may benefit.

Those things may be true for other Consulatess. I am familiar with 5 years of practice at only London. The guides are probably fine for other countries. I can't comment on them. Since the OP is flying the British flag in his profile, I wanted him to know that his consulate has different practices than those outlined. I don't think changing the guides is necessary for the whole of VJ.

She doesn't need to put anything but N/A. The stuff past the annual income is optional. If her income isn't enough and she has a lot of money in the bank, then she can make up the difference with savings, investments, etc. The main thing they want is her income or the income of another sponsor if she doesn't make enough.

The link given you above for the I-134 info is almost all not true for London. Try the UK forum for help with the I -134.

You won't have your visa in 4 months. Hope for Christmas. Seriously.

Hello,
Was wondering if anyone has any experience on joint sponsors, our nephew met a American girl who doesnt meet the income requirements and we found out that we can be a joint sponsor for him, do you think SHE still has to meet the income guidelines even though she has us doing a joint sponsor form for them?
I remember 20 years ago I came in with a joint sponsor being my ex didnt make enough, but who knows if they need the primary to make it or not nowadays.
Any feedback on this?

If she made enough on her own, then she wouldn't need to find joint sponsors. Yes you can jointly sponsor if she doesn't qualify.

My fiance' ,who is the beneficiary, is moving before we receive our NOA2. How do we go about changing his address after we get confirmation of our NOA2? :wacko:



Once you get NOA2 and your case gets sent to NVC you can contact them to ask your case number. Then contact the embassy with your case number and tell them the new address (and you can also ask that they email you the packet 3 at that time).


Why not try to change it before NOA2?

Don't call the embassy. It costs per minute and they aren't so great anyway. They aren't even at the embassy. There is no packet to receive. It's a letter saying to go to this website and follow the instructions. http://london.usembassy.gov/iv_15.html

You will know London is ready for him to send his forms (whether he gets the letter or not) by calling the Dept of State.

Fill out the forms using the new address so the appointment letter will be sent correctly. He will need that letter, but there's even ways around that too. So basically even if you don't change his address, all will be fine. Come over to the Uk forum and learn the London procedures.

We had a flight booked for Saturday but of course that didn't happen. I am curious as to London Embassy specifics for a case like this. I know that there are a number of other posts for other embassies but just trying to get some degree of expectation management.

Appreciate any feedback you may be able to provide. I will provide periodic updates as we resolve this situation for other couples who make this unfortunate mistake.

After your case gets to London, you can list him where it asks for your children on the DS-156k and the DS-230 part 1. Your previous forms were correct on the date they were signed, so not really a problem with that. Your baby won't needed to apply for a visa if you get him a US passport to travel on.

Congratulations. I hope he grows strong and comes home soon.

I know this may be a silly question but I sent my I-129F application to the lockbox in Texas but got my NAO1 from Vermont. Which is handling the case?

The Lockbox is a central processing place that opens mail, checks that you did the correct forms, deposits your check, organizes the file into a folder, then sends it off to Vermont or California. A Lockbox isn't a Service Center. Change your profile to Vermont. It says Texas.

K-1 Fiance(e) Visa Process & ProceduresShould i plan a SOON visit to the U.S.?

I have been waiting 7 months for the NOA2 so far, and i know this wait could be a further 3, 4 or worse still...5+ months. I hate being seperated as a family for so long. We have a 1 year old son together. He was born here in the United Kingdom. (I am the beneficiary. Last time i traveled to the U.S. with our son was December 1st for 90 days. Our son is a U.S. citizen, so obviously he traveled on his U.S. passport.)
It is very difficult stretch for us financially, however it would be worth it just to be together. It would also be very disapointing to spend so much money on return airfares for me and baby, to then find that we would have to leave a lot earlier in order to schedule appointments,.. "if" we received the NOA2 before my 90 days was up in the U.S. It wouldnt give us much time to raise the cash for our airfares back to the U.S. after my visa was issued. We have to allow for a 6 hour drive to and back from the airport to our home address in the U.S. Plus we have to stay overnight in a hotel, as it is too much travelling for baby in 1 day.
We could afford to do this, however i just dont want to end up spending all this on a visit less than 90 days because of not having that much longer for the NOA2. If it was an RFE, we could submit this while me and baby are still in the U.S with my fiance. If we get a straight approval (hopefully) would i need to return to the United Kingdom straight away? Or would i first have to wait for further instructions before needing to be present in the United Kingdom for the next step (for example, booking a medical examination)?
Really not sure what to do :unsure:

I want to give you some London information because each consulate does it differently. Once your petition is approved, it goes through NVC (National Visa Center) not VSC as reported above.

From NOA2 to interview in London is about 3 months.
You do schedule your own medical.
The embassy will assign you an interview once your forms and medical results are at the embassy.
You can delay the interview by holding off sending the readiness for interview form DS-2001 or attending the medical.

You don't need to wait for instructions. Read the thread and there is a copy of the instruction letter and links posted to your instructions.

I am new to the forum, but am so impressed by the depth of discussion, support and information. My apologies if I have posted this in the wrong place but, my question is: I am a British citizen engaged to a USC, and we are filing a K1 Visa application. I know that I will need a police clearance from China, as I lived in Guangzhou for just over 5 years and in Beijing for 3. I have my police cert from Beijing, but information about how to go about getting one from Guangzhou is utterly confusing. I mostly had F visas in the beginning and one Z. I also read that police certs are not issued for F and L visas and neither the British Consulate in Guangzhou nor the Chinese Consulate in London have provided too much practical insight. I spoke to an immigration lawyer who told me that I could attempt to get an official letter stating that the Chinese authorities do not issue such clearance documents for F visas, but again, so far, the authorities I've contacted have not given any real guidance on this. Does anyone have any practical experience of this problem? I really want to get all my documents ready in time.

It confirms police certificates aren't issued for L or Z. I would print that for the interview and perhaps a write a log of contacts you made trying to get one. I am aware of at least one other person who was allowed a visa in London without a police certificate from a country in South America because it could not be obtained.

Yes, that is normal for anybody that has any kind of condition like high blood pressure, diabetes, asthma, depression, heart disease, and any number of existing conditions that can't be assessed in a short exam. They want to know more about it from your regular doctor. Many people go with a letter/report in hand to avoid the delay. Once they hear from your GP, they will forward the medical forms on to the embassy.

I went for my medical yesterday in london for my k1 visa. All was fine appart from failing the sight test. I am reqister partially blind in tbe UK. I did not think that this would be a problem. I explained my eye condition to the doctor but was sent away. Anyone got any suggestions as to what to do. Has anybody got a similar experiencr????

What do you mean by you were sent away? Did they do the other parts of the exam? Did they ask for a report from you GP?

She didn't say anything to me about a psych exam so I guess that's a good thing. I asked her if there were any problems and if it would affect my case and she told me there weren't any problems and that it would have affected my case if I had attempted suicide in the past year but because I hadn't done that then it's fine as long as my GP confirms my mental health. I didn't even receive medication for it cause my doctor said its better to learn to deal with it naturally, and I haven't had any problems since then. I guess I'm just getting worked up over spilled milk. I don't have a history of depression or any mental illness- I just had a stress overload one day when I was a teenager and did a stupid thing.
I already gave my doctor the letter so its up to him when he acts on it. I did write that it was urgent but doctors surgeries are hopeless :P

You really need to speak with the doctor or get the nurse to for you. He needs to write the magic language "not a threat to herself or others". Make sure he knows that is a key phrase in US immigration, or so it seems at Knightsbridge. Sounds very positive to me with what she told you.
