I'm currently filling a K-1 visa and it asks for a departure/arrival record number. I've visited the us on a ESTA and i'm confused at what to enter in this section. Any help would be great cheers.

That goes with the question above it about IF you the beneficiary are currently in the US. Before ESTA you would have had an I-94W that you filled out on the plane. They gave you a part of it at entry and your turned it it at departure. If you didn't say yes to the previous question, then nothing is needed there. If you are currently in the US, then maybe wait to file after you're gone??? I would say pretend you aren't in the US, but that is misrepresenting if they wanted to look you up. Kind of an odd question in my opinion that doesn't really fit the electronic records of ESTA.

And to help you with terminology since you're new---your US fiancé is currently filing a petition for you. When that gets approved, you, the Brit, will apply for the visa by filling out forms and sending to London.

I have received my (packet 3) letter from the U.S London Embassy. It says on there that the $240 visa fee needs to be paid prior to the  interview. Can i go ahead and pay it now? (I am currently in the process of sending for my UK police certificate which takes 10 days. Before i can book a date for my medical) 

Wait until you have an appointment or at least have your other things sent in. It does not have any effect on getting an interview date by paying early.

I made up a wedding date a month earlier than what I hoped for. If you say your wedding is next May, they will put off your interview in favor of those with sooner weddings in an effort to get them to the church on time. That's a theory.


My newest theory is send the DS-2001 to arrive just after your medical has arrived there. Then your dates and readiness is fresh at hand. They say "well everything is here now" and crank out the interview. I'm starting to wonder if your readiness get's buried with the application forms and instead of speeding things up, you are sorta forgotten about. They may put the readiness form in Step 3 for a reason---because getting that last is more efficient for them. A random theory....

My thoughts are do they really follow up with the signer? I have never read anybody UK say they did. Say "manager" and don't qualify with "shift" or "duty" or "team leader". Or go get your shots and have your GP sign off your photos while there.

Hi there,
 
I recently got my NOA2 and am trying to get my fiance's as well as our cosponsor's forms together for the affidavit of support (forms I-134 and I-864), I'm slightly confused about the whole barcode thing..
 
When my fiance looks up the forms on his phone there is a barcode, but if I try to open the forms on my macbook, even with adobe reader, the barcodes aren't there.
 
Anybody got any idea what we're supposed to do about this? I'm confused :/





I also can't see the I-864 barcodes on the iPad. USCIS forms seem to work best with Internet Explorer. Good news is you don't need the I-864 until he/she applies for AOS so you have some time to sort it or borrow a PC. The I-134 for the interview doesn't have barcodes.

He is living in Northern Ireland. The case number starts with DBL which I am guessing it means "Dublin." We are hoping they will accept it. Has anyone applying for the K1 visa with the English passport interviewed in the Dublin Embassy?

i don't know. If you actually resided in Ireland, then you could process there with any passport ...British, French, Brazilian...

Also a phone call or email to the embassy in Dublin might help. Ask if you do not currently reside in Ireland, will they process a K1 visa there. If no, then ask how to get the file that is being sent there transferred to London.

The thing I wonder about is each place has their set-up for various parts. Like London has a specific contracted courier to deliver the passport back . Would they go to Germany, just because a German resident chose London? Would the embassy mail letters of instruction and appointments to Spain because a Spaniard chose London. I don't know the answer, I was only questioning if you had checked the facts before diverting from standard protocol.

If I remember correctly, member Speedwell is from NI and their case got sent to Dublin by mistake on the part of NVC. They had put London on the petition. She could tell you how they got the file to London and how long it took, if it turns out Dublin is the wrong place.

I just called NVC and was not even expecting it but just got my case number!!!
Does this mean we can call and make an appt with the US embassy in Dublin, Ireland? Does anyone have any info on the Dublin embassy. My fiance is an UK and Irish citizen but lives in Northern Ireland and we decided to put the Dublin Embassy for his interview.

The Dublin website says you have to wait on a letter from the embassy. Have you confirmed that they will process the case for persons not actually currently living in the country and they will mail all correspondence to NI?

You are interviewing in London. Are you going to believe a post from a stranger who says 6 months or the printed instructions from London? You originally stated you lived in NZ for a year. Then you said not a year. If a year, get a police certificate.

I think the name and A-number on the back is mostly a practical matter for if the small photos slip out and fall on the floor or the bottom of a mail sack. Then they could easily know which file they belong to. It's probably nothing that would get you rejected unless your photos got separated from the application and they would have to RFE for photos.

I've seen somewhere on here that you need to make 25% above poverty guidelines to qualify. As of right now I earn an hourly wage that works out to roughly 20% above poverty for 2 people, but at the end of July I will get the anniversary of employment raise that will bump me to about 27% above poverty. Our wedding is set for November 2, so the earliest she can come and have that within 90 days would be August 4. My fiancee is in the process of filling out packet 3 right now so I need to send her the affidavit ASAP. Do you think we would be okay if I have my employer mention in the letter that I will be earning a raise in July or would I be better off just submitting what I have and getting a co-sponsor? I have someone lined up if I need to but would rather avoid it if possible.

It is a subjective decision by the officer in London, so sure, have your employer mention the raise so he feels very comfortable that you won't become a public charge.

So let me just confirm - you don't have to file for AOS before your I-94 expires? What status would the immigrant be in if AOS wasn't filed before it's expiry? We are still going to do it before it expires, just we'd thought it was a bit of a mad rush to get everything all done within 3 months, so I'm curious to know.


There is nothing in law that says a K1 must do anything but marry within 90 days to meet the terms of the visa. Thus no absolute deadline for AOS.

In practicality, A K1 gets few privileges after entry. No working. No leaving the US and re-entering on the K1. No driver license, except a few states that give a 90 day license, which is kinda pointless. Yes to a Social Security card, but without being allowed to work. After your 90 days are up, you are pretty much in overstay but not likely to be hunted down and deported. (They have bigger fish to fry.) You are accruing overstay days nonetheless, and it could come back to bite you if something went wrong with the AOS. Or an emergency could make you want to return to the UK. Then you have to start over to come back, but you also have overstay days you accumulated by not filing within 90 days.

By filing, you are protected to remain in the US while the AOS is pending. Your work authorization and permission to travel internationally and return are received in 60-90 days. You can get a driver license.

London denies a lot of B1/B2 visas for the same reasons the others were denied. I think you would be wasting the fee to apply because I have seen MANY report quick denials in London. The UK is a VWP country, so they are very strict about handing out tourist visas. I suppose they figure 90 day visits is plenty and they dig to find out why you need longer. To "live" with the fiancé while waiting on K1 isn't a good reason.

Check ESTA every few months, admitting the denied visa. Sometimes it will go through after a period of time, but 6 months may be the quickest.

I've read that even if you don't make money, since you are the one petitioning for your fiancé YOU are the primary sponsor and stil have to fill out your own, along with a co-sponsor if needed.

That is true for the I-864 which you will provide for AOS. People here often give people the same basic instructions for the I-134, then pass it forward. It is actually not as strict and has very little in actual law except that the officer must be convinced you will not become a public charge.

Some consulates may have their own local customs of what convinces the officer. I'm telling you what London accepts for the I-134. You certainly may do an I -134 too if you like. They also do not require a tax return with other good proof of income. If the British fiance has enough cash, they can prove that to self-sponsor with no I-134.

I am filling out my affidavit of support for my finances upcoming interview.
1.First of all, if my mom is being a co-sponsor, do we both have to fill out our own I-134 or does only she have to if I an unemployed?

For LONDON they want a sponsor. If you don't make money, then don't fill out an I-134. Mom will do it.


2. Next, when it asks info about my fiancé and says list any children should I leave blank, write none or N/A?

It says to list children who are coming with him and also will be supported. They don't like blank because you may have overlooked it. No children are coming, so NONE is an appropriate answer.


4. Question number 8 says list anyone who are dependent on me for support, does this mean I should listen my foreign fiancé? There is no one else who is dependent on me.

They want to know about other people besides the current immigrant. On Mom's form, she will list you and anybody else like other kids.


5. Question 11 asks what contributions you will make for the person, and I will get a job shortly after we are married so I will be able to support him but I'm worried my fiance will get questioned as to how I'm going to support him while I'm unemployed if I'm not making any money. I also don't own a home (we will live with my mom until my finances AOS and employment authorization comes through then we are moving to Florida) but I don't want to leave that blank as I am the primary sponsor. What should I put?

You aren't doing a form.
If someone other than the fiance is being the sponsor, then I think "intend" is appropriate because the immigrant isn't going to be the sponsor's spouse. Sponsor can list how they will help like "provide room board, and any financial assistance needed."

Sorry to add on to this topic but is there any way I could use my tax return from Turbo Tax? (yes yes which page should I print out?)

Yes you can use a complete tax return printed off TurboTax. To be complete, it must be the tax return forms and schedules, AND the W2 statement from the employer stating the total income for that tax year. Or the income may be shown on a form 1099 if it is not from an employer. Examples of people who get 1099s are contractors, pensioners, social security recipients to name a few common ones. A copy of the tax return without the wage statement is not complete. Reason? I could go fill out tax forms right now, make up a big salary, and sign it. The wage statement is needed to backsup the income you report on the return.

In the print function of TurboTax choose "only forms required for filing". Otherwise you will get masses of paper depending on the return. The pages to include will be called Form xxxx or Schedule xx. If it says at the top "Summary" or "Worksheet" or "thank you for choosing TurboTax" then it's extra rubbish not needed. My return has Form 1040, Schedule B, C, D, SE, and maybe others. A simple return might have only form 1040 or 1040A. The schedules come in if you earn interest or dividends, itemize deductions, are self-employed, farm, have rental property, sell things like stock, etc. Everybody's will be different.

The beauty of a tax transcript is that you don't have to send forms, schedules, W2 wage statements, etc. it's all summarized and verified by the IRS in a tidy few pages.

You can also call 1-800-908-9946 the transcript line to order over the automated phone system. If you no longer live at the address that was on the tax return, I don't believe the automated systems will work. They only send those out to the address as written on the return. You would have to fill out the Form 4506T and mail or fax it in http://www.irs.gov/p...-pdf/f4506t.pdf

It's a transcript of your tax return.

They won't cancel you or deny you. If you hadn't sent anything in at all, they would even contact you again to ask what are you waiting for? Have you confirmed with DOS that all your things are received and they aren't waiting to get anything from you? What dates did you--

Your letter would have a date at the bottom they call the Priority date. I'm not sure if it is the same as the NOA2 date or a date when they send out their instruction letter. Reply and tell us if it is the same.

No need to write for an extension.

Hello all! First, I'm sorry if I'm posting questions that have been answered before on other topics. I've read through several pages, and although I've found a LOT of useful information, I haven't quite been able to find the specific answers I'm looking for. 
 
My fiance and I received our NOA2 on April 25th, after six months of waiting. Now, it's been nearly three weeks and we haven't heard anything from the NVC. I've called a handful of times, but they keep saying that it hasn't been received and that I should wait to call back until it has been 14-15 business days after the date on my NOA2, as anything before then is normal processing time. 
 
My question is, what exactly are we waiting on from them? Another letter? Package 3 (whatever that is)? (By the way, if anyone knows what package 3 is, please share, as I have no idea.)
 
Also, will they schedule the medical and interview, or is there some way we should be doing that now?

The file goes to NVC for only a few days. This is the hand-off to the Dept of State. Gets a new case number LNDxxxxx and is sent to London. USC petitioner gets a letter from the NVC telling new case number and it's gone to London. You have to get to the NVC or your case won't get to London for the rest of the process. It sounds like it is still with your service center or NVC has misplaced it or put a typo for your case number in their records and can't find it on the computer.

London takes a couple of weeks maybe, but eventually logs in your case and sends a paper letter to the UK person with instructions on how to apply for the visa.

I'm currently putting together my I-134 Affidavit of Support forms/evidence. I do not make adequate income, therefore my Mom will be co-sponsoring. I'm going to have her get a letter from her employer but do I need to get one as well? Is it necessary for me to have my boss write one up as it will only be showing that I do not make enough? I do not work a specific number of hours per week either. I will include tax returns, W2s and pay stubs..so is a letter necessary as well? I work at a retail store and have never seen company letterhead there..is there anything I could use or attach to it instead? Has anyone else here been in the same position as I am and what did you do?

London doesn't need a letter from your employer or even an I -134 from you since you don't qualify. They will be more interested in your mother's things.

Hello All!
 
I'm hoping one of the experts on this forum can answer this basic question about the G-325A Biographic Form.
 
Near the top of the form, information is requested about the mother and father. It asks for their city and country of birth, as well as their city and country of residence. For the latter question, if they are no longer alive, should this question be answered "Deceased" or answered with the last place they resided (or some other answer)??

How did you not get ur i94 upon arrival

They rolled out an automated I-94 starting April 30 for air and sea entries. It should be to all airports by this week. People that need a copy do this online submission to print their own. http://www.cbp.gov/I94

It should also have to effect of SSNs being available faster because the paper form does not have to be entered by a human into the database. It's supposed to be there immediately with the automation. Does not apply to land crossing entries.

Thanks for all your help - I'll leave out the Mamma Mia tickets even though they have his name on them we should have taken a pic outside the marquee! Oh well...in the scheme of things, that part isn't really going to matter.
 
The visit in 2011 was June 2011 so it's almost 2 years but not quite...
 
I'll label the hotel info...the bar purchase receipt just shows the last 4 of my credit card, so I just made a copy of the card I used and blocked out the first 12 numbers...
 
I do have signed letters from both of us saying that we are free to marry and intend to marry once he enters the US with the visa so we should be ok there! 
 
I just don't believe in front loading with convos and emails when the factual proof is there...did you send any of those when you originally sent your stuff?
 













I did not send emails or chats. We talked on the phone or did video conferencing. I think you have the same attitude I did. I mentioned the photo at Mama Mia because we took one outside "The Sound of Music" in London. Another proof I used was his credit card bill and my credit card bill. I highlighted with yellow that we both made transactions at Harrod's on the same date. I have always made notes on my evidence in red Sharpie what I was showing as well as using a yellow highlighter to zero in on the important part...name, date, location or in this instance, a transaction. Your credit card photocopied on the same page as the receipt is good.

]Here's a list of the items that I'll be sending along for the K-1 visa. I have a few copies of emails and Skype conversations but they are sporadic as my fiancé and I spend most of the time talking on the phone. Is it better to just include a few emails to prove that we've been in our relationship for so long? I'm more inclined to keep the packet short and simple because I don't want overkill with convos and emails, I feel like the proof is in the pudding. :)

Yes, I think you have enough to get approved. It proves you met which is the main proof they are seeking, well that and that you are a USC (birth certificate) , and both are free to marry and intend to marry (two letters of intent).

I'm wondering if anyone knows what I should do during the interview (it's not even boked yet, still waiting NOA2 but preparing of course!) 
 
I was born in Turkey but moved to the UK at a very young age and have since been Naturalized and have been a UK citizen for almost 20 years. I have the paperwork to say it, but my birth certificate is in Turkish. On the interview list it says I need to bring in the paper copy - in Turkey you get a small 3" x 6" (approx) sized laminated bit of paper which states your name, place of birth and your parent place of birth and religion. It's all in Turkish but it's also very clear what is what. It's not a paper form. 
 
 Do I need to translate it? Has anyone else had any similar issues?

For the entire immigration process until you become a US citizen (if you choose to), anytime your birth certificate is requested you will submit a photocopy of your original card AND a certified translation. If you interview, then you will take the original card and original translation for them to see in person should they request it. In the case of your London interview, you won't be mailing any documents in with the application so you will take both the originals and photocopies to the interview.

Certified translation does not equal "paid translation service". It means the translator promises or assures they did a correct translation. Anybody fluent in Turkish and English can do it. Scroll down this USCIS page to read that. http://www.uscis.gov...000ecd190aRCRD. It says:


Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate.

The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is:

Yes, thank you.  I think I know understand the financial/asset requirements (5x if applying for fiancee, 3x if applying for spouse - i.e. already married).  I am still a bit curious about the co-sponsor situation.  While my immediate family would not qualify, I have many single friends that earning $100k+, so they would meet the requirement, but I had read that non-family co-sponsors are not always considered.  Does this vary at different consular offices?


There is no 5x for a fiancé. There is no number actually written in the law. K1 is a non-immigrant visa and is a little hybrid (not quite like either non-immigrant or immigrant) It is for the officer in London doing a K1 case to decide that he feels assured that the immigrant will not go on public assistance. It's pretty flexible if you read the link I gave you for London about public charge. A fiancé can even self sponsor.

For a spouse visa, it is all written in the law precisely because that is an immigrant visa. 3x if the spouse sponsors with no additional help, and 5x if it not a spouse.

Your friends with 100k should be just fine as aponsors. The I-864 is a legally binding contract that can be enforced. It is the I-134 for a fiancé that is not legally binding so a particular consulate officer might wonder about the commitment of a casual acquaintance. Either visa you go with will have an I-864 at some point. With a fiancé visa, it won't be until she would apply for a greencard. So depending on the visa, your I-864 may be reviewed in London (spouse visa), or USCIS at NY local office (fiancé greencard interview), or the National Benefits Center (fiancé greencard decision with no interview).

As you said, I am just trying to understand what the process would be in the event that section 3 of Doma is determined to be unconstitutional, so the process should be identical to any other marriage based visa process if the court rulstrikes down section 3.

This is a bit random, but I haven't been able to find the answer in any other threads.    My UK born partner lived in the US for 18 months a work visa.  Would we need to provide police certificates from the US in addition to the UK as part of any visa application process?

This is way over my head to know how civil partnerships or same sex marriages will be treated by the USCIS.
As it applies to current legal fiance's or spouses--

Fiancé visa--kids visas are derivative K2 of the parent visa. The Affidavit of Support is the I -134. It's easier to get approved, especially at interview in London. It is a subjective decision by the officer doing the interview. Fiancé visa generally only requires 100% of the poverty level of the USC is the sponsor. Other sponsors are allowed. Marriage is in the US. Requires filing adjustment of status to permanent resident for each visa holder. That will have another Affidavit of Support, the I-864 which you have been studying.

Spouse visa-- Marriage can be anywhere. Each person is filed for separately. All the permanent resident stuff is processed at the NVC so upon admission to the US on the spouse visa, everybody is a permanent resident. In the instance of Direct Consular Filing, you skip the NVC and it is processed in London. DCF is a time shortcut you have the opportunity to choose.

The Affidavit of Support for the spouse visa is the I-864. It requires the USC sponsor to be resident (domiciled) but intent to domicile works. Here's a FAQ page from London that may add to your understanding of the I-864 as processed through London, instead of the NVC, when you do DCF. http://london.usemba.../faqs-i864.html

If you the USC can sponsor on your own, then the $16k is valid as income. You will need to make up the shortfall with assets. For the spouse it is 3 x [shortfall]. For anybody else being a joint sponsor, it is 5 x [shortfall]. If the spouse doesn't make enough money, then the joint sponsor has to make enough on their own. You don't pool the money unless the joint sponsor is an immediate relative and you and joint sponsor live under the same roof. Anybody can be a joint sponsor. The kids can have different joint sponsors if one joint sponsor didn't make enough to cover their entire household size PLUS the immigrants. For example if your friend was a joint sponsor and had a family of four. That four plus your three makes a household size of 7 for the purpose of the poverty guideline chart.

Hello,
 
I am a US citizen who has been living with my fiancee in the UK for the past 5 years.  We are hoping to move to the US with our two children (both 1) next year.   I understand that I need to provide proof that I earn 125% of the federal poverty guidelines (family of 4 - $23,550 * 125% = $29,438).  As I live/work in the UK, I understand that I can not count UK income on the I-134.  However, I earn a pension (from my deceased mother) of $16k per year in the US. 
 
Would I be ok submitting my tax returns as proof of the $16k per year currently earned in the US, plus savings/assets to cover the difference for 3 years ($15k *3 years = $45,000)?  Or do they really require the difference of income earned * 5 in savings/assets in order to approve.
 
My immediate family would not meet co-sponsor requirements.  I have friends who would meet the requirements, but my understanding is that generally co-sponsors who are not family would not be considered very helpful.

Your quickest route and probably the most favorable is not the K1visa. If you marry now, your "husband" can get an IR1 spouse visa. Because you live in the UK, you do not have to file the I-130 in the US and wait months for petition approval, then wait more months for the case to process at the NVC, before eventually ending in London for an interview. You file the petition at the USCIS office housed at the embassy building in London. It is called DCF (Direct Consular Filing).They are approving those quickly. Then the case is shifted over to the Immigrant Visa Unit (in the same building) to do the actual visa process and interview. You will save months of waiting, it is less expensive than a K1, and he enters the US as a permanent resident fully able to work and get a driver license. As a fiancé on K1, he enters the US later than if you do the DCF, without those privileges and has to apply for permanent residency (greencard) and wait 5-6 more months or so.

If that appeals to you, then the money thing will be different slightly so not going to answer that part now.

I think I've found the source of my confusion. I was thinking that I had to send my medical results along with my statement of readiness, but I see that this isn't so. So I guess my only question is: how will I know when to schedule the medical?
 
First I have to complete the Application for Immigrant Visa and Alien Registration, Form DS-230-Part 1. And send that off.
Then I have to compile all the documents they need, including police check, and send those off.
 
Then will they tell me to schedule the medical? And seeing as both the pysician AND the embassy want my police check, do I just take a photocopy or do I request 2 copies from the police check website?

Read your instruction page again because it lists more than just the one form you said in your post. It does not say to send off your "documents". It says send "forms". Forms and documents are not the same thing. Forms are DS-xxxx.

It also says Click on "The Medical" on the left-hand Navigation bar for further information. And once you click on "The Medical", that page has a link for even more info in the right column, including the questionnaire you fill out and take to the exam. You are going to have to click a lot of links to learn the whole process because there are pages and pages of info.

The medical people give back your police certificate, so one is enough.

I didn't change my name and immigration has not cared. I kept my former husband's name even.

Just a quick question about what to send to the embassy after getting letter of approval, i understand about what forms to print and fill in but i have read that ppl send other documents as well, for example the affidavit of support. my question is should i send these documents with the forms or not as the letter says and i quote "Do not send under any circumstances send any documents to this office until you are specifically requested to do so. A final determination concerning there acceptability can only be made at the time of the interview. This will also prevent loss of documents and your having to obtain duplicates"

Clive---you have got to quit reading things that other consulates do. Each has their own procedure. London said in a letter to you, " Do not under any circumstances send any documents to this office,". That's exactly what London means.

 
 

ok looking through the forums i found the answer i was after, Here's what i found:
 
Here's the basics of what London needs to get before they assign an interview:
 



  • Visa application forms sent in by you to get in the queue. Only forms. No passport photos or documents like birth certificate, police certificate, etc.
    • Form DS-230 Part I and Part II
    • Form DS-156 (2 copies)
    • Form DS-157 (2 copies)
    • Form DS-156-K (Do not sign it. You will sign at the interview while the officer witnesses. It's an oath)

  • Medical results. They arrive at the embassy by courier 3-4 days after your medical exam.
  • Form DS-2001 Readiness for Interview with a cover letter- This is your way of saying you have gathered every document needed for the interview including the I-134 from your fiance. They are in your hands---not on the way.

Filling in forms DS 156 & DS 230 prior to my interview  for the K1 Visa and it asks in both about how many times i have visited the United States. Since the age of 14 I've probably traveled to the US about 30 times but don't remember all of them, as i am now 40!
 
Do you have to enter or tell them every single visit?

Every one you can possibly list. Do you have an old passport? Can a relative help you remember even an approximate month/year? In the end you are filling in the form to the best of your ability so give it your best shot and then don't worry about it.
