Hi guys,
I just realised today that my fiancé has filled out the wrong affidavit of support.
My interview is on Monday next week and I have in my hands the I-864.
He was meant to fill out the I-134 right?
Will the Embassy accept I-864 or do we need to hurry and get form I-134 done asap?
Can he send it to me through email?





With London, I have known them to accept an email version for someone with the same issue. They could make the exception for you. Calling or emailing the embassy is a waste of time for this. But to be sure you have it, expensive mail service is the safest bet.

Yes, if she can show it with a document saying how much, how often and for how long. Or even show some bank statements showing it goes into her account each month by direct deposit. If she gets checks in the mail, then start photocopying them before she goes to the bank. Just use your common sense to think through "I have to show this total stranger my money. What can I use to prove it to him?" You will be the one presenting it at the interview in London, so understand it yourself in case asked to explain.

well it isn't my pay checks it is my fiances she has just started her job and dosn't have an annual salary so we assumed we would have to wait till she got some thing telling her how much she earned over the year... or are we totally wrong ? just what we have been reading is that she must earn at least $20,000 a year to be able to sponsor me for the visa.
 
 
 



Let's assume she gets paid once a month. She reports her current income as 12 x [one paycheck]. If it's not the same each month, then figure out what she will earn at her current average paycheck multiplied out to be a year's worth. You don't have to collect a year's worth. It is current income projected forward.

Paid every other week [avg paycheck] x 26 = ?

Then prove it with at least 3 months of paychecks or a letter from her employer saying full time or state how many hours a week and what her expected yearly income will be.

You do not get to pick your interview date in London. It is assigned to you. You do not need a year's worth of pay checks either. You don't even have to have a tax return for London if you have other good proofs. When the NOA2 is received is a good time to finalize ithe I-134 with the supporting documents and get it in the mail.

I haven't booked my flights yet and will wait until a month before, most likely, but wanted to know what to do if I'm requested to attend an interview at a time when I'll already be over there.

London will not schedule you for an interview until you notify them you are ready by submitting form DS2001 and having a medical exam. You can take your trip and control your interview by not getting the medical (also in London) or mailing DS-2001 until you return to the UK.

You aren't going to submit your income information until time for the interview in London so you are looking at next year. Also, what is required in London is different than what was reported about Italy. The link to the I864 affidavit of support you were given is the one for after the marriage when applying for the greencard.

The form for the visa interview in London is the I-134. Because you are self-employed now, you will not have an employer letter or pay stubs or a W2 as proof of income. Your 2013 tax return will need to reflect enough income as the best proof since you are self-employed. Keep in mind, the income is after the deductions you take for any business expenses on Schedule C --profit or loss from business.

You will generally be expected to show an income for a household of 4 on the poverty guidelines listed on the form I-864P if you are looking for a figure to aim for. Child support can count but doesn't that generally end when the kids reach a certain age?

Well i guess if so many people are asking the question, then just like me they have read it somewhere that it is needed, Some say it is needed as i also read somewhere and some say that it is not needed as they have gone through the process without doing it.

  

It is the London Embassy letter of instruction (packet 3 in old language) that tells you IF your petition approval that expires after 4 months has indeed expired before you apply for the visa by sending in your DS-xxxx forms,, then London will need another letter of intent from the USC that is notarized to extend the petition date. If get on with applying ASAP, then it won't be necessary. If you get your letter from London and ignore it for 4 months, yes a new notarized letter from the USC. The beneficiary does not need a new letter of intent. Their intent is restated in the oath in the DS-156 and signed at the embassy and witnessed by the officer.


I agree with Jay Kay.
1. It doesn't matter what addess to put on the letters with the I-129F. It is a letter writing formal touch and nicety that is not being graded. What is important is that you are signing a statement. Just put "To: United States Customs and Immigration Services" and no address.

2. Things used to be notarized for this process, but that was dropped 5-7 years ago by the USCIS. If your embassy gives a specific statement, as does London for an expired petition, then follow you embassy. In general there is nothing to be notarized. We've been from K1 to citizenship without a notary.

That's what I thought, it's just strange as I've seen a more generic response from the USCIS for citizenship and it too mentions all the forms of proof, rather than birth certificate. It's odd they singled that out...
 
My fiancee is sure she sent a complete photocopy. The only issues we could think they might have had is if perhaps they attempted to use the wrong passport (she attached incomplete photocopies of another passport she renewed this year for the travel stamps as proof of relationship) or if somehow her forgetting to photocopy the back blue page of her passport would mean they would not accept it - but it seems unlikely.


Why don't you write a cover letter explaining the birth in Canada, the parent naturalization, etc to clear things up with them in case they don't get it. Then say she is again submitting a photocopy of her US passport to serve as proof of her US citizenship, as well as her birth certificate which does not prove American citizenship, but was requested in the RFE. Maybe that will connect the dots for them.

Yes. London isn't that picky to even need 6-7 months. I just called the benefit dept and asked them to send me a letter stating how much and that is forever. If it's a big company, they may even have a retiree website with a "click here for a benefit letter". I noticed that after the fact. You will need all this again for QB's greencard. I dont get monthly paystubs is why I used the letter. They only send a paystubs if the tax laws change and the tax withholding changes so you know why the amount is different.

My fiance has asked me to query what to put on Question 7 of the form I-134.
 
It says " I am employed as or engaged in the business of _______________________ with ____________".
 
Our co-sponsor who will be filling this out is his retired mom who gets social security and a pension. She is a widower and when her husband was alive, he was the money earner and she was a house wife. What would be the correct answer to put for this? The pension is the pension from her late husband.
 




I am exactly the person your fiance's mom is. Sometimes you have to be creative when the one-size-fits-all form doesn't fit.

I put "I am employed as or engaged in the business of pension: surviving spouse of retiree with XYZ Corp at Benefits Center, XYZ Corp, PO Box 1, Bigtown , MI."

I gave the dept and address of the place that administers benefits. I got a benefit statement from them stating I get $xxxx per month for the rest of my life, and I used that like an employee letter. It was fine with London and no mention of the Affidavit of Support was made by the interviewer.

She will also have a social security benefit letter that comes in December each year stating what her payments will be for 2013. A photocopy of that will be like an employer letter, also.

1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). 2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.

So do I really need this?






All you need is what is on the London list and your visa payment receipt email. You need zero from the I129F package.

I would start preparing the documents. A call to the Dept of State might give you an update. They know what the embassies have done. They would know if London had logged in your case. Also ask them if your case number remains a Madrid number. I think so because it is the NVC that generates the numbers and it's not going back to the US and the NVC. DOS 202-663-1225

Book the medical exam. They will ask your LND case number and you may have to explain why yours doesn't start with LND.

NVC and DOS do not charge to answer the phone. They are in the US, so the petitioner may want to do the calling unless the beneficiary has a cheap way to call. London embassy charges £1.23/minute (last I checked) from within the UK or a flat rate $16 for calls from the US.

You need your police certificate to attend the medical, so get that ordered if you don't have it. The NVC will send a letter to the petitioner with the new Dept of State case number LNDxxxxxxxx after they assign it. You can also ring them. Don't call the embassy. It costs per minute and they aren't very helpful for what you pay.

Okay that helps a lot .. still questions popping up in my head but slowly crossing those bridges when they come..but nice to know I have something stable in the future for AOS as a sponsor lol :)

One more thing. You mentioned "start my new job and be the only sponsor". For London, if you don't make enough, then Mom will be the only sponsor. They won't even need forms or documents from you. It's time to get an affidavit of support done and mailed to your fiancé if you are in a hurry to push the visa through, so that's why I said go with Mom's stuff to be ready ASAP.. But if you get an employer letter after starting your new job, then fill out an I -134 for yourself and send your stuff over just before the interview. He can use yours instead, but still has Mom's in case yours is held up.

Come to the UK forum for London interview related info and questions. It's different....like that bit about one sponsor. You do not have to do an I-134 if you don't make enough.

My fiance and I just got our NOA2 as the 20th of June(yay!) and we're getting things together for when he gets his packet but I had a question..Right now I do not make enough money for being a sponsor so I am going to ask my mother to be our co sponsor(which she doesn't mind) but today I got offered a new job which makes me well over the income requirements(woohoo!) But I don't start till the 17th of August. Should I just continue to ask my mom for help or wait till I start my new job and be the only sponsor? Because I haven't started yet and when he gets his packet I guess is what this all boils down to. Sorry my question is all over the place :P


Plan on your mother doing the I-134. But by the time he has an interview, it will likely be September and you could provide one also with a letter from your new employer stating your salary rate. I don't suppose you could show me where the rules specific to London cases are? To my knowledge, I have to send: DS-230-Part 1, Form DS-156, DS-157, DS-156K, Notification of Readiness and the Affidavit of Support. This comes from https://london.usemb....gov/iv_15.html. I was told to go here in a letter from the embassy.

 
On the instruction page you gave the link for, see Step Two. The words "Assemble all of the documents required in support of your application" is a link to the documents you bring to the interview. Basically to get an interview, they want:
1) The 4 application forms (some are mentioned to be sent in duplicate.)
2) Medical results
3) Readiness for Interview (Form DS-2001) along with the cover letter information they request when you have gathered the documents requested and have them in hand so you are prepared to interview. You may send your application forms immediately upon receipt of their letter, and meanwhile gather your documents and affidavit of support. Once you are ready, inform them with the DS-2001.

If you will read your letter from the embassy again, it says "do not send documents to this office". They prefer you bring them to the interview. The letter you received also says they only need a new letter of intent from the petitioner if you let your NOA2 expire (four months after approval) to revalidate an expired petition. The beneficiary does not do a new letter of intent.



 

We are the same way and I was worried about this as well. I'll be interested in what they have to say!

I can't speak to what Canadian consulates require. Each embassy has their own procedures. Ask in the Canadian regional forum.

Hi there,
 
Approaching the end, finally. I have my medical appointment booked for July 3rd, so now I just have to fill out and send off a few more forms to the embassy.
 
They're all quite straightforward, but form Form DS-156-K says that I have to attach proof of engagement in order to apply. I don't have a ring, though, and it's all just verbal. We're minimalist people and won't be worrying about a ring (yet!) as our priority is saving as much money as possible so that we can start our life together in the best way (an expensive ring will not help us with this one bit).
 
So, what can I send them? In the very first forms we sent we had the signed declarations of love/proposal etc, is that not enough?

Nothing gets sent with that form despite what it says. Any evidence or documents are taken to the interview for people going through London. So no "attaching" per se. And London does not care about engagement rings or proof of your relationship. Just follow the London instructions for what documents they need.

I was told we could and it would speed up the process. Any clue as to if we should wait or can we mail it in? His medical is scheduled for July 2nd, so its not that early.....


Send the four application forms now. When he has all his documents in hand including the Affidavit of support from you, then he can send the DS-2001 form to say he is ready to interview. It requires a cover letter giving date of medical, date of wedding (if known) and email address.

Same with Texas. The license is signed/dated by the officiant, then returned to the courthouse to be recorded and filed in the county records. The photocopy endorsed by the county becomes the "certificate"....meaning the county certifies it is a copy from the county marriage records.

Call the county clerks office and ask if you aren't sure.

Has this ever happened to anyone else? Our petition expires on July 7th and my fiance's interview date is July 8th!! He called the embassy and they said for him to just send a notarized letter of intent from me, and gave him an address. But I'm just worried.


The (packet 3) instruction letter from London says a notarized letter of intent is required to revalidate an expired petition. Ask your fiancé to get out the letter and read it again. They give a date at the bottom by which the visa must be done or else you are asked to get a new letter. I too would have said no problem but a recent interviewee was told they couldn't be approved until it was submitted. They were actually a few days short of expiration, so I don't know if there were other factors that made the officer suspicious of this couple so they were making them jump through more hoops or not. I haven't heard of that in London before, so It does make me wonder. Anyway...just passing on the London info to you.

It's the phone that is rubbish. My iPad always kicks in the mobile version of the London website and it does not show all the links and proper sidebars. I can't find things that I know exactly where they are. You will miss a lot on the mobile version. I have to manually switch to "full site" every time I am trying to give a link to somebody. No way I could have done it on a phone.

The teacher in me wants to tell you (and others) where to find it because people need to realize there are important links not to be overlooked on London's webpages. They tell you on the K1 instruction page to click "medical" in the left hand navigation bar. Once on the medical page, on the right it says:

Yes you can do both. You may be asked to pay international student fees, which can be much higher, so check that part out with the place where you want to study.

What do you guys suggest? Should I apply for it as soon as I can so I can work in the months leading up to my wedding, or should I just wait until I'm married to save hassle? Is it really a waste of money? Is there another filing fee for this?


Don't do it. You pay $380 to file if not with the I-485. Example of timeline.

Arrive US - July 1
Apply - July 2 $380
Approved - Sept 19 (but wait for card to arrive)
Go to work - Sept 25
I-94 expires - Sept 29
Must quit job - Sept 29

Even if it was approved in 60 days, it's still September before you can work so you may only get 2-3 weeks. If any hold-ups, it may arrive after your 90 days. Not much return on your $380 investment.

Better to marry first week and apply for everything first week in the US. Then you could be approved as quickly, but not have to quit when the I-94 expires because it's based on a pending I-485, not K1 visa entry. My husband had his one-year EAD approved 72 days after stepping off the plane. (hahaha--then it was 3 years before he actually started working. But that's another story.)

My medical was Friday (28th), so I'll call them first thing tomorrow morning. I was worried it'd cause a delay in my results getting to the embassy, causing a delay in an interview date being scheduled (hoping for a mid-August interview). But thinking about it, it can't take that long for the results to make it just around the corner! 
 
I wasn't looking forward to making that call to the embassy, as I'd heard before that the only way to contact them was via that premium rate number. So if I leave the misspelling for now, and just mention it at the interview, it won't be an issue? Surely they'll realise an error was made since it's definitely spelled correctly on the rest of our paperwork. Honestly, all this panic because someone left the "e" off the end of Jane! Haha.
 
 I'll get Bob to call up USCIS as soon as he can though, regarding the NOA2.

Concerning being an issue. I would rather discuss it face to face with the person holding my folder and the last person who will touch my file before it goes to visa printing, over discussing it with a contractor in Scotland. The issue is getting the visa in the correct name.

Concerning the medical delay. There is a built in delay of around 3-4 days waiting on lab results. Once it is dispatched to the embassy, they can't change it. Call Monday morning.

On the letter I received from the embassy after our NOA2, my middle name is spelled wrong (my fiance told me earlier that it's misspelled on the NOA2 as well). Also, on the vaccination form the doctors gave me after my medical, they made a typo and made me 254 instead of 25! (Which I stupidly only noticed after driving all the way back home from London). oops8rh.gif So I'm going to contact the embassy and the doctors on Monday morning to let them know.... but my question is, will calling them up and asking them to rectify it cause a delay in getting our interview date?

When was your medical? It takes a few days for them to get the blood tests back from the lab. If they still have your medical file, they can correct it before sending to the embassy, as well as mail you a corrected copy.

For the embassy, if you applied in your correct name on the DS- forms, it will likely be fine. You will be there with your birth certificate and passport in hand to show the correct spelling. Much better than calling the embassy line, which is in Scotland, and can't actually see most of your info or make changes. Meanwhile they charge £1.23/minute for the privilege of getting no help from them. You can check on it at the interview to make sure your visa will be issued with the correct spelling. A clue will be what name is on your interview letter.

The mistake was made by USCIS, unless the actual petition had a typo. Do you have a copy? Your fiancé can call the USCIS, insist on a Tier 2 person, and ask that a correction be made in the records and that they send a corrected NOA2 since it will be part of your adjustment of status documentation to send in. The embassy is part of the Dept of State and barely a kissing cousin to USCIS, so go back to USCIS to check on where the error started. The Dept of State/embassy generally won't be able to fix things at USCIS.

Medical exam and timing. You make your own appointment by calling. Attend after London has your file and notifies you they are ready for you to apply for a visa. You don't plan "how far before the interview" because you will never get an interview until the embassy has your medical results.

I'm putting in the applications for my fiance's K1 visa tomorrow or the next day.  I think I've got everything in order, but I have one question - should I include a copy of my divorce decree (a/k/a decree absolute)?


It sounds like you may not be quite ready to send off the forms. One of the requirements is that each of you are free to marry. Divorce decrees are the proof they want to see. If you were divorced three times, then they want all three decrees...the whole thing and signed by the judge. Do go over the guides again to see if you missed anything else.

We're you divorced in the UK? I ask because you called it decree absolute. But you are the US citizen if you are applying for your fiancé, so I was curious.

London will accept the father as the sponsor. Your fiance's I-134 will not even be needed. Dad will do the I-134 and submit his proof of income.

Thank you so much for this info. By cash assets, does that mean my savings? I have a car but would I need to sell it before I can use its value in my assets total? I'm sorry if these questions are silly but I just need to make sure I fully understand.

Anything that could be liquidated easily can be counted. Use an estimate of it's value. Read the form I-134 and instructions to see what counts. It's not stated what London will consider enough. One person on VJ has said they had 40,000 (pounds/dollars??) and were approved. It doesn't mean less wouldn't be. Can't really advise you because "a decent amount of savings" to one person may mean $1000 and to another may mean $200,000. You said you had decent savings and inheritance but not how much and you don't have to on a forum. It is a specific $ amount on the I-864 for the greencard, but not for the I-134/K1 in London. If the officer thinks you've got enough to support yourself for the months it will take until you get work authorization and a job, then he will say OK. I would think proof that your fiance has some income plus you have savings would help.


Also, if the embassy in London allows self-sponsorship, at which stage do I make it clear that I will do this? We have not yet sent off the initial petition, so do I need to state it in there or does it only become relevant at a later stage? Basically, if the initial petition is sent off with just our employment information on the biographic information forms, am I still likely to get to the interview stage, or could it be denied earlier on this financial basis?

You make it clear at your interview. If it's not enough, they say get a sponsor who will help and send us that info. They won't just deny you.

The initial petition to USCIS is to see if the petitioner qualifies to "import" a fiance by showing
  • he's a US citizen
  • he and you are legally free to marry
  • he and you intend to marry within 90 days
  • He has met you in the flesh within the last two years
That's about it. It doesn't say you have to be madly in love, Skype 18 hours a day, send each other valentines, or be employed.

Next part is you apply for a visa at the embassy in London (Dept of State. No longer at USCIS). Then it's about your qualifications, medical results, criminal history, and proving you will not go on welfare in the US because you have a sponsor (or enough money to self-sponsor.)

The Embassy in London allows self-sponsorship if you've got cash assets. There's no figure given but provide proof at your interview and discuss it. However to get your greencard you may need a joint sponsor who meets the income requirement.

For the 2 of you your husband would need $18,912 in income. If he is short that, then multiply the difference by 3 to see what you would need in assets to make up the difference. Like if he was 5,000 under the minimum, then $15,00 cash would cover the difference.

The I-134 is not submitted with the petition. It goes in her hand to her interview in London. Not even going to answer those questions because they are many months away.

In general, you should list the address where you actually live on forms. It seems kind of sneaky or misrepresentational to pretend to live in the US to gain an immigration benefit. That's my opinion only, nothing written in the law.

How did you meet means ...came face to face in the last two years because it's a requirement. You don't have to say when you got engaged. When in the last two years did you go to the UK, he to the US, or you met up in Bermuda. Just let them know when and how you were together in person during the last two years. You seem to be over thinking this and that story about when USCIS considers you engaged. They don't really care if you were "engaged". They want you free to marry before you file a petition.
