I have no clue how long the transfer will take. Not many transfer and they never come back and report when they do. Hoping you will bookmark this thread and update it. Okay? Thinking in terms of waiting on London to reply to you, London getting around to asking for your case, then Montreal getting around to sending it...well you know how that can go...s-l-o-w-l-y. But one can always hope.

You may get some special instructions from London, but I think a new DS-160 would be correct since you start it by picking a consulate. That way you know it goes to London instead of depending on it getting retrieved. And the address where they will mail your interview will be there in the new document. Less chance for something falling through the cracks. I would do it even if they say you don't have to.

Phoning DOES NOT WORK because you won't get to the right department. You will get the run around or crazy wrong info like reapply because you called the tourist visa people who don't get it.

Give all your details plus the story..names of both parties, birthdates, A-number, petition approval date (don't call it NOA2),...whatever will identify your case plus New UK address, email. Then when they reply, you can always ask further questions by replying to their email.

Nothing. Your job doesn't really matter. Listing it on your biographical info might help distinguish you from Mikeypants the terrorist who worked in Liverpool and Berlin when they do security checks. But changing jobs at this point doesn't need to be submitted to anybody in my opinion.

We wouldn't really want to be separated after getting married so hopefully we can work round that. We were speaking this morning and I think we can budge on the big ceremony being tied in which really is a lot of hassle with save-the-dates and shipping the family over etc. 
 
Our 2 options seem to be:
1) Start applying for the KS1 path now and she goes back in January and I wait for it to come back, however long that will be before going over and marrying her.
2) We get legally married while she is over in the UK and we then go straight for the CR1. Can I then go straight over there while waiting for that to be processed?

You can VISIT on VWP until you are issued either visa (as long as the CBP lets you in). Go too often, for too long and you can get turned around and sent back home. There is no MOVING over to the US until you get a visa...either spouse or fiancé.

Just look at how the graphs go up and down. You might get a fast petition processing center and it all suddenly changes by your time.

London is averaging around 65 days from when they get the case, but it was 100 days in the spring. You don't know what it will be when you get to that step. A swing of a month or three on any given step (petition, NVC, London) could ruin a planned wedding is why people say to wait on setting a date. The most often asked question on here is probably "how long" and it is impossible to pinpoint accurately.

We'd love to be able to give dates for people in advance otherwise if we wait till it's processed then get married then, it would be too difficult getting many people over there for the wedding. Also working out things like jobs and being apart for longer would be tough.

To be frank, you're dreaming. Marry somebody from your country if you want to set a date now, not be apart, and set up a job right now.

Not being able to set a wedding date
Not being allowed to work or get a driver license for several months after entering the US. 3-4 at best.

OP, you will likely have to cancel your trip to take care of the actual Visa application, process, & requirements. You can do nothing you need to get done in America.

Not really. He can easily stall the process in London. He won't get the visa as early as if he pushed on through, but that's his choice. He has a few weeks to get his documents lined up...like police certificate, shot record, birth certificate. Get on that TOMORROW, Capt British.

The London process requires 3 things to get assigned an interview.
1. Online application DS-160
2. Online form indicating readiness for interview.
3. Medical results received by Embassy.

He can do #1 and #2 from anywhere in the world. He can call from the US and book his medical for January once London gets his case. He will know when that is by using the CEAC status check. He can get his new case number (to check his CEAC status) by phoning NVC. When he returns, he goes to the medical in London then waits a few weeks to be assigned an interview.

It doesn't happen that fast, ie interview in one month. More like 2.5-3 month (London specific) if you are efficient with your paperwork and actually in the UK, not on holiday.

If you get "no trace" then the US government will never know about it and you don't have to "confess" to a maybe crime/violation/citation/whatever. No trace-you are clean.

A UK police caution is an admission of guilt and settled without going to court. It counts with US immigration folks. If yours was a caution of that nature, it would show up on your police certificate as "no live trace". Get something that shows the charge and fine, settlement, etc. (Yes I know you said there was none, but get it in writing). You can order a Subject Access Report if your police certificate says anything but "no trace".

I said in your other thread you could wait until NOA2 to order the police certificate. With a possible charge, order soon so you can order the SAR if needed. it takes longer.

People get visas with worse than what you described.

London is not picky. Two things at most is all you need. One would do it. If you have an employer letter, they often take that as the only proof. They don't even require a tax return for the I-134, but if you have one, it is a good proof too. Forget the bank.

You don't really need the letter itself. It does tell you that if your petition has expired (four months after NOA2) then bring a new letter of intent from the petitioner to the interview. So we we're approved on the 15th and I received the hard copy of the NOA2 and I just wanted to confirm from people's past experiences that the Valid from/to box is the time frame the beneficiary has to initially enter the country? Also if that is the case is there any way to file for an extension or would it require restarting the entire process? I just want to make sure I have all the options on table to make the best moves possible I guess.

The approved petition is valid for 4 months. You need to only have your visa interview by expiration . If you can't have it by then LONDON asks for you to bring a new letter of intent from the US person to the interview. Not a problem at all. People are going to reply that it gets extended automatically. Maybe true at some embassies, but London does tell you to bring a new letter to revalidate the petition. Follow what London says.

Your visa will be valid for 6 months from the date of your medical exam. You have to enter the US before the visa expires.

It is not as strict as you imagine. Why something on the back? In case they fall on the floor, USCIS will know which file they fell out of. You won't fail if you put name, birthdate, SSN, all of the above, some of the above, or none of the above.

Pick what seems most logical and efficient to you and you won't be graded off. Or read the instructions.

And some advice-- When somebody (A&B) provides you with a link and page number for an official source, they are trying to help you get the answer, rather than spoon feeding you.

My fiancé has got a letter from his bank for the I-134 form but it doesn't have the "total amount deposited for the last year" on it and the bank told him it was a standard letter so was not an option to put this on there.  Can he just send copies of his bank statements to me showing the balance of accounts and amount deposited for each month as proof of this?
 
Also - in the USCIS instructions for I-134 there is no mention of including copies of recent tax returns, is this not necessary?

You do not need a bank letter for a London interview. You would only need statements if you didn't have enough income and needed to show savings that would make up for lack of salary.

London will approve your I-134 with just about anything that shows income. It can be a letter from an employer, OR a tax return, OR pay stubs. You don't have to have all of those things.

London does not require a tax return if there is other good proof of income, but transcripts are about the easiest proof to get.

Your letter from the embassy will go to the petition address so you won't be getting it. NVC isn't a good option to change a K1 address. So much easier if you stay at the same address and avoid hiccups or delays.

You do not do that until London receives your case and issues you a letter that your case is there. That includes waiting on doing DS-160 and medical exam. You will not pick your London interview appointment. It gets assigned and you wait on it for what seems like an eternity. There is no notifiation of arrival at NVC. NVC will eventually notify the petitioner that the file has been sent to the consulate as well as giving the new Dept of State case number. By the time that letter is received, the file will already be in London. With the new case number, you can check status on CEAC. So the system is set up where calling is not a requirement. However, people who can't stand waiting for a letter, call NVC and ask for the new case number.

Another notification by mail goes to the beneficiary from London when the case is received, logged in, and ready for action. No need to call and ask if London is ready. A letter is sent. Again, people don't like to wait on letters. Also the CEAC status will say ready when the case gets to London. Useful if you moved since the petition was filed because you won't receive the letter.

I am hesitant to give up my home and job and be left with nothing if something falls through.

If the voice in your head is telling you to wait, then listen to it. It is not going to be easy starting out with a husband making only $16k per year. K1s have a struggle when they arrive and being below the poverty level will suck even more. You won't be able to work, get a driver's license, OR leave the US for months. Yes, it only takes three months after applying, but factor in how long it will take to marry, get the marriage certificate back, and get the applications sent off before that 3month timeline can start. And consider if you have enough saved to cover the costs. These are minimum required but there is also two trips to London, passport photos, moving/shipping, wedding, etc.

K1 London route = $1705 + £290

$340 (USCIS) I-129F petition
£45 (ACPO) Police certificate just before petition approval
£245 (Knightsbridge Doctors) medical exam. Pay at exam.
$265 (Embassy) Visa fee prior to interview. Online pay.

I have looked around but can't really find a solid answer anywhere so was wondering if anybody can help me. The US Embassy London has now received my medical results. I contacted them via the online form requesting to know what my interview date is.

My worry is that as I put my planned wedding date as the 8th of November if they decide to honour it and get me an interview in time for that date I may not actually receive the letter before my actual interview date. I have also heard horror stories of London being very slow to send letters or not sending them at all.
 
As such I was wondering if there is a specific way to get my interview date before receiving the letter.

The letters have been arriving just fine lately. That seemed to be a short lived problem I haven't hear any complaints about in months. If they happen to give out a short notice appointment, they email or telephone, ie "can you be here tomorrow?" Or a recent person got a 2 day notice via email.

He actually just called the medical center and they told him to wait because if they send the medical results before the embassy has received it, "it will cause chaos." It's a long enough process, I don't want them to lose our paperwork so I think we'll just wait until we've heard from the embassy. Thanks!
 


I think that is the sensible plan. The embassy has a system where they work most efficiently. When people get in a rush to try to jump the queue, it can slow it down for everyone because things are arriving before London is even aware the fiancé exists.

Finally got our NOA2 waited 2 weeks and called NVC. They gave us our case number and said that our packet had been mailed to London the week before. My question is do we have to wait for the embassy to receive our packet before scheduling our medical, or since we have our case number can we go ahead and schedule the medical.

You can schedule your medical if you want to, but do get your immunizations including flu jab done first. Make sure you can get in with your GP nurse to get a copy of your shot records or actual shots needed. It will save you time and money to take care of that BEFORE your appointment at Knightsbridge. Then you are clear sailing for your adjustment of status without seeing another doctor in the US. The shots are listed in this K1 London Guide http://www.visajourn...complete-guide/

Keep in mind that your visa will be valid for 6 months from the medical date, so if by chance you weren't planning to move ASAP, don't rush to the medical.

And recently a few people that called for appointments with their LND case number were asked if they had received their Letter from the embassy. You will have to answer "yes, I have" to get scheduled (if they ask).

And you do know that not everybody needs a civil surgeon? It depends on if her shots were properly complete and documented at her visa medical. Were there shots she didn't get?

Your use of AOS in your post is a little confusing and it seems like (from other threads) you maybe haven't decided for sure which visa. So--

AOS- in a K1 fiancé discussion tends to be Adjustment of Status, ie applying for your greencard once in the US with the visa. So your post reads to me like you are planning ahead for after the visa since you are in the K1 forum. And the moderator has just moved you to the adjustment of status forum because of that.

AOS- in a CR1 spouse visa discussion tends to mean Affidavit of Support which may be what you actually meant when you said AOS. Can you clarify what you meant?

So back to answers--

If you will read the instructions to the I-864 Affidavit of Support (used for spouse visas and adjustment of status for K1s), it explains the tax return requirements. It is always best to get your info straight from the source.
Briefly it says
send in the most recent tax return
Two before that are optional
If you weren't required to file, submit a statement why not required.


Why would somebody not be required to file a tax return?
They were unemployed and earned zero income. It is call INCOME tax. No income, no tax.
They didn't work all year so their total income fell below the filing threshold...maybe they earned only $2000 in the year, so IRS says no need to file.

What reasons are not acceptable?
I lived in another country so the money earned abroad doesn't count.
I have been too busy to file.


On a K1 visa going through London, it is Form I-134 affidavit of support that is taken to the interview for a fiancé visa. London does not require seeing any tax returns if the sponsor can show other proofs of income.

It is fine. If he had been working 3 months at that income and could prove it with an employer letter then he meets the qualifications, especially with a London interview. It is not as difficult to get a visa as you have dreamed up in you head. The biggest worry would be if you have ever committed a crime (even a caution) or admit to having used or even tried drugs at your medical exam. That is the big reason people in the UK forum panic most over. And you do understand this financial stuff is months down the road. He will have worked another half a year by then.

You can have it delivered anywhere...work, family, neighbor. You pick the delivery location (or pickup) when you make the courier arrangements. The person receiving is supposed to have some form of ID from you, but there are MANY instances where they didn't actually ask for ID.

Follow this link http://photos.state....accinechart.pdf it will take you to a list of jabs required relative to age, it is from Knightsbridge Doctors which do the medical etc.
I took a copy to my GP surgery and asked them what i needed, got jabs for no charge.

Thanks for the speedy response .... another question, what would happen to my UK passport - if it expires within the time period of waiting for AOS, I would have no UK residency to renew or replace ?
 
 


The UK passport is now renewed only in the UK, not at any British embassy. You mail the forms, proofs, photo along with your current passport to the UK and pay an extra fee for courier delivery back.

You will need that passport for the AOS biometric appointment, for a Social Security card application, and for an AOS interview. Mailing it off to the UK during that time period would take some careful planning...maybe after biometrics. Then if you should get an AOS interview before your new passport arrives, you could request a reschedule. It is supposed to take only 6 weeks and costs £102.

Keep in mind that the London instructions for your K1 interview say you need 8 months on your passport when you interview.

Passport: A Passport must be valid for travel to the United States and must have at least eight months validity beyond the issuance date of the visa. Children may be included on a parent's passport, but if over the age of 16, they must have their photographs attached to the passport.

I'm sorry, Need clear help lol. I've got medical booked for Monday in London and wondered how to book interview. I'm finding conflicting information. Do I need to pay visa fees now? What readiness forms do I submit? Thank you.

The conflicting information may be coming from reading in the K1 forum and hearing what happens in other countries. The method at each embassy is not the same.

Hi Guys,
 
As you know I had my visa approved on the 6th of October. I heard that the CEAC status was supposed to change from 'Ready' to 'Administrative Processing' once it has been approved however mine is stuck on ready. Should I have any cause for concern?

The interview was only two days ago. It doesn't process that quickly in London. Maybe on Thursday something will happen. Perfectly normal at this point.
