Don't pay the fee until you have been assigned an appointment date. Follow the instructions EXACTLY found at the end of this K1 interview letter http://photos.state....ppt_letter.pdf. (bookmark or print that)

If you go in the wrong order, you can't recover and will end up making an appointment for a student or tourist visa or scheduling the courier and can't get back to the paying section. The appointments that are self-scheduled on the website ARE NOT K1 appointments, so don't think you found a lucky shortcut. You have to wait for London to assign it and send a letter.

This is incredibly helpful! Thank you so much because I was wondering about sorting it all out before coming over. I haven't heard of the first one. Second one, I already had the shot years ago so don't know if it needs a top up? Third one, I have had chicken pox when I was a kid so I guess I don't need it and fourth one I will go get.

The first one covers the diseases of tetanus, diptheria, and pertussis (whooping cough) the letters T, D, and P in various orders and strengths. Capital letter is a stronger dose. Lower case letter is a weaker dose. The weaker doses were developed for teens and adults for d and p because they showed some side effects to the full baby strength. My husband's GP only had the baby version DTP, so he got that and had no problems. Some NHS doctors will give them free, but they don't have to because it's for immigration. Some won't give flu shots except to older people. You can get a flu shot at Boots, Tesco, or wherever and take written proof to the visa exam.

You do not need immunizations to get a K1 visa. You need immunizations to get a greencard. But if you get every requirement met and documented at your visa medical on the immunization form DS-3025, that will suffice as proof for your AOS process. Otherwise you will have to pay a civil surgeon in the US to complete a new immunization form. That can be a huge hassle. I want you to read these two threads someone who did not get it done in advance and see their frustrations. It happens all the time when dealing with civil surgeons.

Do it before the visa and save the additional expense and frustration.

Heres the shots needed for 19 through 59 years of age: 
Td or Tdap - or  get DT, DTP or DtaP and it will be accepted for AOS also
MMR (if born in 1957 or later) Get a second shot 4 wks later if you have time before your medical.  It's two doses in your life, but if you get the first,  and 4 weeks haven't passed by your medical, they will waive the second dose for "insufficient time interval".
Varicella Not routinely given in the UK ;  a history of having chickenpox excuses you from the shot. They take your word for it at the visa medical exam. 
Influenza - During flu season only, October 1 through March 31. This was a new recommendation dated November 2010 for all ages over 6 months.  Older lists will say flu shots for over age 50. It changed.

For Australia, flu season will be different dates...winter, right? So The visa doctor there could mark the waiver "not flu season" (it's on the form) and you don't have to get a flu shot.

It's taken us 5 and a half months to get to this point, so i do have one more question
 
I've just been reading up on what the Consulate will need
One of the items states is 2 2insx2ins photos that were taken within 6 months of the interview date, so it now seems that my original photos that were submitted with our application will be invalid.
If i send them different photos to the originals, will they question that?




The first photos were for the petition. The second set are for the visa. It's two processes with two separate government agencies. The first aren't "invalid" really, they were part of a different application (I-129F). Now you will need 2 more for the visa and 1 for the medical. Then you will need 6 more when you do the adjustment of status applications. Also they are not "sent" (mailed) to the embassy. They go in hand to the interview in London. Each consulate does it differently so make sure you learn the London plan.

To summarize your earlier question. The case will go to NVC, then London. If you can't get the visa accomplished by the 4 month expiration of the petition, you will provide a notarized letter of intent from the US fiancé at your interview in London to revalidate the petition.

I'm flying into Newark Airport November 19th, i know from previous experiences that normal POE is as easy as pie there... regarding the I-94, i can't remember if I was given one before on the plane or not, I'm pretty sure it was a green one they gave me cause I entered on the visa waiver program, but this time I'll be travelling on my K-1 Visa, so will I have to request the white I-94, or will they already know and have one on hand? Orrrrrr would I have to fill one out before I go? :)


White form I-94s went automated during the summer. You fill out only a customs form on the plane. The I-94 info will be created from your passport scan, not by filling out a card. . You retrieve a copy online after your arrival to use for getting a SSN and for AOS purposes. The link to get your form was given by Janice&Micah.

Quick question, do K1 applicants need to fill out a DS 260?


The answer for London (which could be different from Manila)-- It depends on when you did your application which of three options you go by.

1) Before Sept 1, it was DS-230, DS-156, DS-156K, DS-157
2) In Sept, they switched to online submission of DS-260 (but that was short lived)
3) about 2 weeks ago, they switched to online DS-160

Any of the above are acceptable during the transition. Don't send two or three of them "just in case" and end up applying more than once. As of now, new K1s do I-160 going forward.

What I was telling you is despite what the I-134 states, it is London's normal procedure to accept any good proof of income. Other consulates may insist on a tax return, for example, or three proofs. I have read hundreds of London K1 experiences and people who bring four proofs are often handed most back and are told "this one is enough". People have been approved in London with--
- only one tax return
-only an employer letter
-only pay stubs
-no I-134 at all if the beneficiary brings proof that he/she has enough assets to self-sponsor
-no I-134 from the unemployed fiancé, but one from another sponsor instead.

It is quite flexible in London and the interviewer will probably not even mention the affidavit of support if he glances at it and sees it is adequate.

I have completed my I-134 and received the letter from my employer today and my income does not match. The letter rec'd from my employer only has my base salary. I asked them to write another letter with my salary to include the guaranteed overtime and bonuses (of which I've already been paid) on it and they said no. There is a HUGE discrepancy between what they said I make and what I actually make. Even with said discrepancy, I am well above the 125% poverty, but I'm concerned with the numbers being all over the place. I have check stubs as well as my tax transcripts that reflect my correct annual salary. Will this be any kind of issue? 


Skip the employer letter if you think it isn't reflective of your true income. . London will approve with your tax return only. Pay stubs are your backup. They don't require multiple proofs in London or any one specific kind of proof.

Do it now and get it in the mail to him so he has it in plenty of time. Then you won't be one of those who have to spend a fortune on overnight delivery because they waited around. That is all that the petitioner contributes to the London process.... I-134 + proof of income.

He has to use the K1 visa to enter the US by Feb 15. When he enters, the Customs and Border Patrol will give him a 90 day entry. He must marry or leave by 90 days. If he marriees, he can stay past 90 days and apply for adjustment of status.

I think you are still mixing countries. His overstay in the UK isn't really a US embassy issue. He isn't in violation of any US law. They don't enforce UK laws. A risk would be being honest with the UK Border Agency telling them you plan to overstay because of an important appointment two weeks after the student visa expires and asking if that's okay with them.

He overstayed with his student visa in the UK when it had expired; he is not from the UK he is from Morocco. He was thinking he would have an issue at the airport when leaving the UK and they would not let him leave or give him trouble...

I wanted to comment that his UK student visa is between him and the UK government. The US embassy didn't give him "permission" to stay in the UK. They can't. They are the US government and have nothing to do with his UK student visa. They interviewed him because he was still present in the country to attend.

Also a comment on this--

His visa to leave the UK was approved on Oct 18th and it expires on Feb 15th also we are thinking for that same reason; we thought normal time would be 6 months. 

He didn't get issued a visa to "leave" the UK. It is a visa to enter the US by Feb 15. It is shorter than the six months you expected because the six months starts from the day of his medical exam.

His US visa good until Feb 15 does not have any privilege with the UK government and the fact that he no longer has permission to be in the UK. If they decided to find him and make him leave their country today, they could. But it is unlikely they are that efficient.

Keep in mind that a contractor will open the mail and reassemble it in a USCIS folder, maybe different to the order you used. So the person who eventually evaluates your case, won't see your efforts at tidy assembly. With that in mind, don't spend a lot of money on an Acco punch and whole box of fasteners you will use once. If you work in an office that has one, go for it.

I actually used (borrowed) ACCO the first go round. Then bulldog clips. And by the time we got to citizenship, which should have been the biggest deal, just jammed it all in a mailer without even having a cover letter. It doesn't really matter, as long as you complete the forms accurately and submit proper evidence.

All of the above makes sense and I know my consulate in Johannesburg requires form DS160, but when I go online to CEAC and login in with my case number and NVC invoice ID, the only application available to me to complete is DS260, not DS160.  Should I just ignore that and complete the DS160?  I was so happy when they switched from the 156, 157 and 230 to just the DS 160 becasue it is so much easier to complete.  Those other forms seemed so daunting- who remembers all the places they've lived since they're 16?!  And my fiance was in the military, so how do we even decide what address to put during that time...DS260 is all those forms rolled into one and feels overwhelming to me, but if that's what we have to fill out, then so be it.  Can anyone give me some insight to why my only option when I log in to CEAC is DS260?

That is the same page London has posted on the K1 instruction page. It is worldwide for K1s it seems since you start by picking your location.

Maybe you are using the place where those getting true immigrant visas like spouse visas fill in a DS-260. What makes this all disjointed is a K visa is a non-immigrant visa. But is is always processed by the Immigrant Visa Unit. Instructions are always under immigrant visas and not where the non-immigrant info is found (tourist, student, clergy, etc). So now they switch K1s to 160s, yet leave things on the DOS pages that say K visa applicants do not do a DS-160. Well as of 4 weeks ago, yeah they do.

Another problem K1s in London have found is the online payment system says immigrant or non-immigrant at the start. If they pick Non-immigrant, then they get on a path to a student or B1/B2 appointment and can't back out. They have to create a new account with a different email address to start again choosing immigrant as the path. It's as poorly constructed as the Obamacare website.

K1 visas are the step-child of immigration. They don't quite fit the masses who are clearly either immigrant or non-immigrant. So they get forms and instructions that don't really work for them.

Thanks for your quick replies Guys, just reading through them and a couple of questions for you.  Firstly, Thank you  Rjmazur for your help and quick response. My question is,   Is it really my fiance who fills in the form?  I am the beneficiary he is the petitioner.  My fiance decided to contact a lawyer because we were going to get married in Miami when I was on holiday there in April. I wasn't sure if that was legal or not and so my fiance rang an lawyer for advice and she told us not to go ahead because if we did it could mean a life time ban.  When preparing the first stage of the form she asked  me to fill in a ds156 only to tell me I didn't need to do that. My fiance and I have been in a heated discussion tonight about our lawyer, He really doesn't like to see me confused or stressed.  Right now, I could  just cry!n I also don't know much about NVC. I am not sure when to contact them for our number or if I can trace it onlline. , I just feel like I am on that journey right now, elated one minute and stressed and lost the next! Thank you Nich Nick, you have come to my rescue once before  with words of wisdom and thank you Makulit 909 everything helps and everything is appreciated and it has to be the DS-160 for me as I don't as of yet have an interview lined up.

Just a FYI: You could have married in April. Then you would have returned to the UK and done the process for a spouse visa. It's cheaper and a better visa. But that is water under the bridge now.


I am not new to this. I know London embassy procedures. What you need to understand is once your case gets to the embassy, each has their own method of doing things. You need to ask all your questions in the UK forum for the best answers. You don't want to be confused by procedures for Manila, Juarez, Paris, etc. Helpful K1s from other countries may think you do it just like they do. Nope. Your petition is approved. NVC is the file handoff place from USCIS to the Dept of State (called DOS in the forum). The embassy and NVC are under DOS. For a fiancé visa, NVC is a short pit stop to get assigned a new DOS case number and to have the full petition file sent off to London. Your new case number will start with LND (London). My case was in London 10 days after NOA2. It could be delayed by you service center not forwarding to NVC in a timely manner. It should leave NVC the third day after arriving. Some have hit a snag getting out of NVC, so a quick dispatch isn't 100%. It takes about four days to arrive in London.

Do you need to do anything with NVC? No. They will notify the petitioner that they have sent the file to London and provide the new case number. Why do people call them? Because they can. They can't wait to be notified. They try to track their case every inch of the way. They want to make their medical appointment in London early and need the LND number to do so. But the truth is, you can get a visa without calling NVC ever. So don't get yourself in a dither about NVC unless you want to.

The case will arrive in London, but they aren't going to jump on it the first day or week. When they have your file all set up and are ready for you (beneficiary) to apply for the visa, they will send you a letter inviting you to proceed. It will provide a link for their web based instructions. This is the link so you can read their exact desired procedures and get familiar in advance. Don't read only that page. Explore the entire sight. Where it say gather these documents, click the link to see the list. When it say "click here for more information", click and read all the info. In the left column, click the links for medical exam, visa fees, etc. Read everything. You've got time to let it sink in while your case works it's way there.

Unlike what you may have heard for other consulates, you do NOT schedule an appointment with London. You (beneficiary) submit the application (DS-160), gather you documents for the interview, book a medical, then notify them when you have completed all that by submitting an online Readiness for Interview form. (It's on the instruction page link I just posted) Then when all that is done, wait 4-5 weeks (currently) for them to assign you an interview date. You are notified of your date by letter. They pick the date, not you. After you get a date, you pay for the visa online and make arrangements for the courier to get your passport and visa back after it is issued. The visa/passport is delivered usually 5-10 days after your interview. All of that info can be found on the website.

So now that you have a summary, calmly start reading and soaking it in. It's a lot to take in at once, so go over it several times reading all the links on the London website. Make bookmarks, print pages, highlight important things, and make lists or notes. It's like studying. If you want to stop being confused and stressing, then do your homework.

A comment on the biometrics appointment mentioned above in a Federal building. I notice you will be in The Woodlands. Your biometric appointment will be in Houston on Hwy 290. They do nothing but biometrics there so you don't need an infopass appointment to get in the door. You walk in with your biometric letter and they will take you before the day on your appointment letter. We did that three times with no problems at all at that location. Go after lunch when they aren't busy.

It is the Advance Parole that allows you back in the country. If you leave without it, you are abandoning your greencard application. So even if you used a different passport and you left, they can/will deny your greencard. I wouldn't risk it.

It takes 60-90 days to get the Advance Parole and work authorization. The clock doesn't start until you mail in the applications. Yes, request expedite. Once you have done biometrics, you could try to go in person to again ask for expedite. That would be at the big USCIS Houston office near Beltway 8 and the Hardy Toll Road and would require making an Infopass appointment To see an officer.

Unfortunately the K1 visa has downtime when you can't do anything. Had you married first and gotten a spouse visa, you could work and travel out of the US from day 1 of your US entry.

Another tip: Keep a log of every date you enter and leave the US. When (if) you apply for US citizenship, you will have to supply those exact dates as part of the application. Might be hard to reconstruct those dates over several years if you don't log it as it happens.

They were speaking to all the people there for non-immigrant visas like tourist and student visas. It used to disturb a few K1s who thought they has missed a form because they had mailed in paper forms. They still got checked off the list.

Then underneath it says:

On other instructional websites, even this one, all it says is to fill out the DS-230. However when I look at descriptions of these, the DS-230 is an app for an Immigrant visa, whereas the DS-160 is for a non-immigrant visa, which my understanding is that the Fiance K-1 visa is considered 'non-immigrant' visa (which is what im filing)
 
So my question is... what do I do? Do I fill out both? Only one? Which one!?!

His visa was cancelled because he didn't do what he was required to keep it. So yes, he did something wrong, correct?He withdrew his entry attempt so that isn't part of cancelled with prejudice. They just happened to have him and the visa at that moment so stamped it so he wouldn't use it again.

So did he accrue overstay in the US by staying on a visa he no longer qualified for? How many days between selling the business and leaving the US?

That is correct. London wants a singular sponsor so Dad will be fine.

Also, it is not all about the tax return. If you currently have a job and earn above the poverty level, then you can sponsor without a tax return on the I-134 in London. Prove the current income with an employer letter and some pay stubs and that will be acceptable.

Agree on if using a tax return as proof, it is for example
[TurboTax printout + W2 or 1099] or [transcript from IRS].


When your do the next Affidavit of Support (I-864) for the greencard, then all said in post 2 does apply to that form. It has specific and stricter requirements.

 Thanks for that. It doesn't really specify what happens if they were discharged in a bad way, you know what I mean? I know that to become a citizen, if he was discharged in the last 5 years he has to provide reference letters from employers and co-workers ect that hes in good moral standing or what have you.

How do you know what you stated is required to become a citizen? I've never seen that in the USCIS Guide to Naturalization, the application, the Checklist, etc.

You said no charges were filed and no fine or sentence. He didn't commit a war crime that would exclude him. Are you confusing maybe with foreigners who gain US citizenship by serving in the US military? If they were dishonorably discharged before serving five years, then their citizenship status could be revoked. But your husband will not need to join the US military to become a citizen. He can become one based on having been a permanent resident for 3 years if married to a you, or being a PR for 5 years if he doesn't remain married to you.

So I recently found out my Fiance (like a complete idiot) got dishonorably discharged from the British Army for getting into a fist fight with his commander. No charges were pressed, he didn't go to court, he was just discharged.

Jenni-- you are on the wrong page. This is what happens in a London case

1) USCIS approves and passes your case off to the Dept of State, which is the "parent" of NVC and the embassy. At that point USCIS is done. Your case will go to NVC first.

2) NVC assigns a new Dept of State case number. Yours will start with LND for London. Then they package up your file and any others going to London and send it off with DHL With luck it is only at NVC for 3 days. Transit takes about 4 days.

3) The DHL box arrives in London. They don't open it the first day. Yes it does go from the delivery site to the Immigrant Visa Unit. When they get around to it (could be 2 weeks) they will notify the beneficiary by mail that they have received the approved petition and invite you to apply for the visa. That letter is the further instruction promised you. They don't send you forms or write out much instruction, but getting the letter means you may begin the next part because they have your file set up. The letter tells you to get your K1 instructions and forms here. http://london.usembassy.gov/iv_15.html. Don't use a phone or tablet because it automatically gives you the mobile version. It's not very good. I know the website extremely well and I can't navigate it or find things on my iPad. Looks like what you copied above might be mobile version.


Nobody is bullsh1tting you. You were told you would get further instruction. YOU WILL. You have to allow time to receive that letter of instruction. It doesn't happen instantly. There's a lot of people waiting to be served. I told you how to contact NVC so you know if it has made the pit stop there yet.

The process you found above is for immigrant visas like spouse visas. You don't do a DS-260 and you don't submit anything until London says so by sending a letter. But you can start learning the K1 process by reading the London K1 instructions. You will submit two online forms and have a medical.

4) Once your two online forms and medical results are received by the embassy, prepare to wait up to 6 weeks before they mail a letter saying what date to come to an Interview. That's how it rolls in London.

Getting angry is wasted energy. Immigration is a slow process.

I can't ring NVC as I am in England and only have a mobile phone from which i cannot ring abroad, but i'll get Peter to ring them. As there;s no reference to NVC on the letter, I don't suppose you have their number, do you?
I have my original birth certificate, and a certified copy of my youngest daughter's birth certificate as she is only 19. USCIS have Peter's certified copy , so hopefully i won't be the first person ever to be asked for this lol

Have you called NVC directly and asked if your file was received? I know by the time NVC got around to notifying me that the file had been sent to Lomdon, it had been in London a while. Ask NVC when the file arrived and when it left for London. If they say they never got it, then try to chase it down with USCIS. I know others have had that problem and the K1 forum would be the place to ask that because it's not a London topic and you will get more USCIS to NVC experiences over in K1.

Your other questions from personal experience--
The website and previous paper packet have pretty much said that same thing. My husband has kids not immigrating and a previous marriage. He did not have to provide his kids' birth certificates, his previous marriage certificate, or my (the US fiancé) birth certificate. Other people have verified they didn't either whenever somebody asks. So that's about five years of history where I have never heard anybody say differently. I have no clue why it says that.

My Fiance and I had an email on 30th Oct from USCIS saying our application had been approved, and then two days later he rec'd a letter saying that our application had been forwarded to the Consulate
 
This has confused me slightly. Are we missing a letter?
Isn't that the letter the NVC are supposed to send? If so, we've not rec'd a hard copy of our NOA2 (I did think this was the hard copy of our NOA2, hence a date on my timeline)
 
There's nothing about the NVC on the letter, it just says that our case has been forwarded to the listed Consulate and to contact them if we have any queries
 
Is this normal?
I have seen a couple of other timelines where the NVC dates have been left blank. Is this the reason why?
 
 











It's normal and confusing. I think they mean "we're done with you at USCIS and are sending you on to the consulate part". But it will go to NVC. Then the NVC will notify your fiancé of the new case number and when they send it to London. You aren't required to call NVC. The blank timelines are probably people who didn't call NVC to ask when their case arrived.

Hi Everyone,
 
We received our NOA2 notice on 10/29/13.  I just called the NVC and they have not received our case yet - they said to allow 8 weeks.  Does this sound normal???  I've noticed on others timelines they have received case #'s in 2/3 weeks.
 
Our Approval notice expires on 2/28/13 Just want to make sure we have enough time to get everything done.
 
My fiances interview will be at the London Embassy - I have my affidavit of support ready for him.  Can we do the DS-160 now before we have our case #?
 
Just want to get as much as we can get done now.  Any advise - tips would be GREATLY appreciated!!!
 
My fiance and his daughter will be coming to stay for Christmas and new years so we can work on getting things done together when he is here.

There is a procedure in place you are expected to follow. London will send a letter to the UK fiancé when they are ready for him to begin the next part. That will be when they have the case and have logged it in. Right now London is not ready to receive his visa application. They haven't received an approved petition with his name on it.

Here's some things to work on now--

Advance preparation for the London part of the K1 process
When your NOA2 is near, its a good time to start your preparation. 

Petitioner
  • Order your tax transcripts.  Only the most recent tax return is needed, but you can order three years at a time for free from the IRS. Tax transcripts are summaries of your whole tax return provided free by the IRS. They can't be faked because it's a copy/summary of your whole tax return picture, basically certified by the IRS because it's issued by them. That's why you don't have to include any 1040, Schedules, W2s or 1099s if you send a transcript. They are free from the IRS. Transcripts take the place of sending a complete tax return. London will actually approve without a tax return/transcript with other good proof, but they are a good way to show income. 
    If you call 1-800-908-9946 (the transcript line) , there is an automated system for ordering transcripts. You'll have to enter your Social Security number and the numbers of your street address.  It will generate an automated request to mail your transcripts.  You can also order online on the IRS website  http://www.irs.gov/i...=232168,00.html
  • Start filling out the I-134 Affidavit of Support.  It will have to be signed and mailed to the UK the slow way.  Get familiar with the form.  When the NOA2 is received is a good time to finalize it with the supporting documents and get it in the mail.
  • Don't obsess printing Skype logs, emails, photos, or Facebook status. London does not want to look at that. Really they don't.  London does not want to see a copy of your I-129F petition or NOA2. They got that in the file from NVC.
UK beneficiary:  

  • Get some passport photos taken.  You will eventually need
    2 US sized for the Embassy
    1 UK sized for the police certificate
    1 either size for the visa medical exam. 
    (and for AOS in the US, 6 more US sized photos)

    You can take your own and size it using this uploader tool from the Dept of State. Scroll halfway down the page. http://travel.state....toreq_5333.html Save the jpg file and print at home or at a photo place. Also available at Snappy Snaps, Photo-Me booths, Jessops, Gould's Pharmacy (by the embassy), near the Bond St Tube station (Oxford St) which is closest Tube to the medical exam.





  • Go to your NHS doctor and get the immunizations you will need for Adjustment of Status. You can get a K1 visa without having any shots, but you will need them before AOS. Its really wise to take care of  it before getting to the US so you can avold civil surgeon hassles and $$$.  Many NHS doctors will do them for free, but they are not obligated to do so for immigration purposes.  If you had these shots as a child, Tdap/Td  must be no longer than 10 years ago or you have to do them again.  Get the shots documented by your doctor to take to your visa medical exam. Heres the shots needed for 19 through 59 years of age: 
    Td or Tdap - or  get DT, DTP or DtaP and it will be accepted for AOS also (not longer than 10 yrs ago)
    MMR (if born in 1957 or later) Get a second shot 4 wks later if you have time before your medical.  It's two doses in your life, but if you get the first,  and 4 weeks haven't passed by your medical, they will waive the second dose for "insufficient time interval".
    Varicella Not routinely given in the UK ;  a history of having chickenpox excuses you from the shot. They take your word for it at the visa medical exam. 
    Influenza - During flu season only, October 1 through March 31. This was a new recommendation dated November 2010 for all ages over 6 months.  Older lists will say flu shots for over age 50. It changed.



  • Order your police certificate.  It takes some preparation because you need a passport photo signed off on by somebody officialish whos known you two years.  Heres the website.  Read the instructions.   • Look at your passport and make sure it will have  6 months remaining after visa issuance. If not get it renewed now. If you've damaged it or gotten it wet, or the edges are wrinkled,  it will need to be renewed. London is fussy about that.

    Make photocopies of any document you want back. They will verify the original and file the photocopy.

On a slightly different note.. I have done all my forms and my status on ceac says ready for interview. Do I need to send one of those DS-2001 forms (or anything) to say I'm ready for interview. It doesn't say anywhere on my checklist. I've just done all the DS-160 and DS-260 and got all my documents and booked my medical. That's all it says, but I've seen some people say (recently as well) that they have sent a DS-2001, so I looked up what was.

The London K1 instructions are here http://london.usemba...gov/iv_15.html. The checklist you are reading was cobbled together and is not quite giving you the K1 instructions. London has made changes recently and their website and the form you are looking at haven't been done very well.

Follow the website http://london.usembassy.gov/iv_15.html because that checklist you have is geared more for a spouse visa.

Website says K1 completes the DS-160. That is correct. This was new Oct 7, and followed a Sept 1 change, so you can understand how some of the procedures got garbled as they were changing rapidly. The DS-260 is for spouse visas so don't do it.

See Step 2 on the London website http://london.usemba...gov/iv_15.html. It says when you have gathered your documents, submit the notification of Applicant Readiness. They say email it, but it's actually an online form submission. And they don't really say where to find the form. They end that paragraph with leftovers from the old instructions when a paper Form DS-2001 was put in the post to the contact address they refer to. I told you they have cobbled together a mess. To find your online notification of readiness form, look in the right column, second paragraph where it says:


"The document checklist Form DS-2001 is no longer in use. Please download this list of required documents.   Once you are in possession of all of the documents required in support of your visa application, you are required to notify the Immigrant Visa Unit by email. Read more..... "


If you don't click that Read more..... ", you will not find the form to submit. So click it and go to another page with a link to the form you need at the end of the page. Submit the form so London knows you are ready to receive an interview date.

To be really simple I guess.. What can we do if her income doesn't meet the requirements? Because it doesn't.. What can we do? This can't just be game over, there has to be a way!

Separating the two issues here which are 1) K1 visa, 2) adjustment of Status

K1 in London
Fiancé does I-134 if she earns 100% of the poverty guidelines for 2 people.
--or--
Get an I 134 filled out by one of her parents who makes 125% of the poverty guidelines for 4 people. (That is assuming the fiancé is fully dependent on her parents. So Dad as sponsor would be meeting requirements for himself, Mom, his daughter plus the immigrant.) Note: your fiancé does NOT need to fill out an I-134 if she doesn't qualify as the sponsor. One form from whomever has the money. It's a LONDON thing. Positive.

Immigrant self-sponsors by bringing proof of his financial assets. A spreadsheet summarizing the source and amount is helpful if invested in various places, as well as bank statements and such for proof. There is no specific amount that qualifies. It is a judgement call by the officer interviewing. A few people have reported the amounts they were approved on. Around $40k is the lowest I recall. That doesn't mean less would be rejected. It means nobody has reported on VJ (that I can remember) a lesser amount. People don't always share those kind of details. A foreign person does not fill out an I-134.

To be honest, it doesn't look adequate to me. You are trying to convince a government official you will not become a public charge (supported on welfare by tax money). Your fiancé is supposed to be able to support you and all she has to bring to the table is a welfare check from the government? Do you see the irony in that?

And your joint sponsor...only works part time? Does not earn the poverty level?

It is a decision made by the officer so who knows for sure.

Attend the medical is not the first step.

London will accept another sponsor in lieu of your fiancé since she doesn't work. London does not insist on tax returns with other proof of income. Your fiancé has to fill out nothing. Get it all from the other sponsor. You may self-sponsor in London with enough assets or an income that will continue in the US. There is no published amount. One sponsored himself because he had a house sale pending. I've seen $40,000 Cash accepted. Another was accepted with $8000 cash and proof that he receives regular money from phone apps he created that continue to sell and generate revenue. It is a judgement call by the officer on interview day.



All you write is of a concern when you apply for adjustment of status in the US. The form I864 has stricter specific requirements like your wife and a joint sponsor each do a form. Your joint sponsors household size as a single adult is 2...himself plus you the immigrant. Your wife can submit a statement why she was not required by the IRS to file (no income) and submit that instead of a tax return. Everything mentioned in this paragraph is for later, after you are married, not for a K1 visa interview in London, and a head's up that it will be more strict to get a greencard.

thanks to you both for your input :) thats actually a good question about Skype logging the convos i was wondering that myself, it just appears to archive every conversation together into a huge feed under each contact which i guess is why it crashes so badly when trying to pull up old info, it seems stupid and i really hope there is a way to view the logs themselves and not the actual conversations, i guess its my fault in the first place for being a Mac user (boo!)

You mention application forms. What application forms. All the applications we are required to complete are done. The embassy has no way of knowing he has relocated to a new address without them being informed in some way.

He applies for a K1 visa with form DS-160. That is his application form.
(Anything you sent before to USCIS was filing a PETITION.)

So you said he did the DS-160. What address did he put on the form DS-160 when he filled it out? Old address or new address? If he put his new address on the DS-160, then he has changed his address as I explained eleven days ago.
