A ridiculous question, but I am ever the perfectionist. Does anyone know if we can staple documents to supporting documents (ex: G-325A with supplemental page AND a small baggie holding the passport photo--staple or paper clip?)

As far as the passport photos ---I stapled a baggie part way down a full size piece of paper and put the page behind each G-325a like it was another piece of the application. I think I wrote "passport photos of petitioner Mary Smith" in the blank area below the baggie.

London is not picky. Follow household of 2 poverty guidelines. They issue new guidelines usually in February so check for those numbers when they come out.

It is your gross income so forget about after taxes. They won't ask about any debt you have or if he will have health insurance. If you have some proper documentation with the I-134 showing your income the interviewer will likely glance at it and never ask you anything about it. He may ask your fiancé what you are studying or teaching, but that would be to find out if your fiancé knows anything about you. No pile of proofs of your relationship. Really that easy in London. A little conversation and done.

If you look at the blue menu bar and click the word "POE" you can choose various POE airports and see what people wrote about your layover airport choices. That might give you some clues. It depends on how busy the airport is, and how many other immigrants happened to land at the same time as you. So generally the variables are--

How many people queued up in general international arrival area
How many queued in secondary area where immigration papers are done
How long to retrieve luggage and get through customs
How long to re-check luggage for next leg
How long to get to next gate. Is it close or in another terminal?

It really depends on the airport on the day/time you arrive. If you have made the same layover going to Dallas in the past, then you might have an idea about the luggage and gate changing times. The extra processing time to allow for CBP might only need to be 30 minutes from what you have done in the past. It's kind of a guess.

They will accept your joint sponsor.  You obviously don't qualify.  As a matter of fact when you present the affidavit of support in London at the interview, if you can't meet the requirements then they don't really care if you supply an I-134.  They will take one from another sponsor. They will also let the beneficiary self-sponsor if he has enough savings or liquiid assets.

For a K1 in London, they don't do all that math really for a fiance's i-134 Affidavit of Support. And there are no exact numbers written into the Foreign Affairs Manual. You are quoting rules laid out for the I-864 Affidavit of Support. If you can convince the London officer with some good income and assets then they approve. A $10k salary isn't encouraging but some hefty savings on your part could convince them. It is actually a subjective decision in London. If her income met the 100%, and a bit of savings on top you would have a better chance. But trying to scrape together everything to barely reach a total in the 100% range may or may not be convincing. London will consider your savings.

The bigger issue is after your marriage when you apply for adjustment of status (greencard). Ideally you want to do that quickly so you can get a job and driver license. She will do the I-864 with stricter rules and the 125% requirement. Your savings will again count because you are married and your money becomes part of the pot. But your savings will get eaten up by the cost of required fees as well as transportation to London twice plus flight to the US.

K1 London route = $1680 + £280

$340  (USCIS) I-129F petition
£45  (ACPO) Police certificate just before petition approval
£235 (Knightsbridge Doctors) medical exam. Pay at exam.
$240 (Embassy)  Visa fee prior to interview. Online pay.

If you forgot something big, like paying or signing your petition, they might mail the whole thing back and say fix it and mail back the whole thing to us. Or if something small is not quite proven or clear, then they would send a list of what you forgot to send. Either way, it is all fixable so no worries.

Probably not. Even if they fell on the floor out of the packet they could probably figure out the female was Maria. If you were named Morgan and Leslie, it might be harder to figure out which gender went with which photo. It's not a critical mistake, just a little extra layer of organization ...kinda like writing your account number on the check when you pay a bill to avoid mix-ups.

Thank you.  Currently spending hours editing down thousands of pages of our Facebook chat log so its a little more manageable and offers a sample.  Laborious work but necessary I think since we don't have any phone records (its 2014 - who uses phones anymore?!).

The actual requirements to be documented are
Petitioner is a US citizen- her birth certificate
Both are free to marry- requires divorce decrees if previously married
Intend to marry - letters from each saying free to marry and intend to marry within 90 days of beneficiary's entry.
You have met in person within the last two years- passport stamps, boarding passes, credit card purchases in each other's town/country, etc
(plus all the required forms and the fee)

Some photos together and with family members or friends are nice secondary evidence, but you don't need to over stuff the petition with Facebook, etc. They won't watch your DVD. Prove the requirements and you will be approved. And when you go to the interview in London, they don't want any of that extra fluff so don't knock yourself out preparing things to show you are in love and Facebook and Skype daily. That's a London thing...they won't ask for additional proofs. They might be amused by your proposal story, so do tell them what you did.

She already has called NVC and they told her our case has been sent to Paris. He said because she gave my incorrect date of birth(which they messed up, she did tell them the correct date)  he can't give us our case number and said to email them requesting my birth date to be changed. She hasn't received a letter saying it has been sent to Paris though. Is it standard too receive that? Thanks!       


I guess I don't follow what you are saying. If they can say the case went to Paris, then there must be a case number they can also see. Or is the "case went to Paris" a hypothetical answer because she asked where cases with French addresses go? You actually don't know if the case went to NVC or left NVC? Normally a call to NVC can tell you when the case arrived, departed, and the new case number. So maybe you are saying they can't pull up anything on you and there is no specific information where your actual file went to Paris. Yes, the NVC notifies the petitioner with a letter. It takes a while to be issued so that's why eager beavers call to find out in advance of the letter.

super! thanks a lot! No we tried but have had some complications with getting our case number. My fiance has emailed NVC about the issue so we should hopefully get it soon. I lived with her a a couple of months but went back to England in that time as well. Is it 6 months you have to live somewhere to get a police check for that county? Thanks again!  


Call the NVC (have fiancé call) and ask what is our case number. If the case is gone, there is nothing they can fix for you so just ask for the case number. Then you can track it on CEAC. If it says "ready", it is in Paris.
But how do you know it went to Paris? Did your fiancé get a letter from NVC saying so? The letter would have the case number.

The transfer protocol is for your desired consulate London to make the request to Paris to have the case released to them. London uses a contact form. Give them your new Paris case number...did you get it from NVC yet?

Oh no! That sucks sad.png my I-129F was wet ink/original signature...but they may send the whole thing back sad.png Did they already cash your check/did you have to re-pay the $340? And, if you don't mind my asking, how long before you got the notification of the rejection? Did you have to wait a couple months for an RFE type thing like everyone else or was it pretty much immediate? Thanks :/

If something is blatantly wrong with the submission (like wrong payment amount, check made out to wrong name, no G-325A form, no signature on a form) ...instead of giving a NOA1, the contractors will send it all back including the check and tell you to fix it. So you sign the form or write a new check or whatever, and it's like you are starting over on a new filing date. Then you get NOA1. If your check was correct, you just put it back in the package.

If it is something an actual USCIS officer evaluates about your case, that will come later and they don't send the whole thing back. They send a list of what evidence they are requesting.

So...if you get a NOA1, it is accepted. If an officer notices the scanned form looks dodgy, he could ask for another later down the line.

An RFE is more likely on a document not signed than on Photos which are secondary evidence anyway. Don't beat yourself up. It's done. If you get an RFE, then submit what they say you need and your case carries on. You won't know until an RFE letter comes in the mail. Meanwhile get the form and letter you suspect might be needed so you can be ready to submit it when/if a letter comes.

You have a lot more immigration forms ahead of you in the next few years, so keep in mind a rule of thumb---
Forms and Letters (of intent or employment) are signed in ink
Documents mailed can be photocopies, but originals of them will normally be taken to interviews to be seen in person.

By the way, I never stated nor do the instructions of the I-134 state that an employer letter as being mandatory. It's evidence that the adjudicator considers; the more evidence the better. Further, I completed a previous K1 in 2005, all the way through ten-year green card so I've been through all this before. Yes, I am doing it a second time.

Is it possible to hold both a K1 Visa and a L1B visa at the same time?
 
If we keep the K1 visa on track and get that in my fiancé passport, could we then get him to apply for L1B visa fast tracked using Premium Processing and is it ok to have both visas?
 
We are not comfortable relying solely on the L1B visa especially if the K1 has to be cancelled. If he got both could he enter on the L1B continue working and the K1 would become redunent? then file for AOS after the wedding?
 
And if the L1B ends up not happening then he could just enter on the K1 and suck up not being allowed to work until after AOS.






I would go with the sure thing K1. Marry the week he arrives and get the AOS/EAD/AP in the mail. Start filli ng out the papers while you are waiting on the Interview. Learn the process. Do you know where to get a marriage license, etc. Have it all lined out BEFORE he comes. After filing, apply for an expedited EAD approval based on him having a job offer in the US. Another thing to prepare in advance. A letter confirming his US job.

If missing some income is your concern, then he should continue working, even after he has the visa, until you have all the ducks in a row for marriage, filing the applications, and a letter confirming his US job.

Yes, if  you define "right away" as enough time for the mail to arrive, be delivered to the correct adjudicator, and him to put down his other cases and go back to yours to review again with new evidence.  It won't be the day after you mail it, but it could be 2-3 weeks. If faster, then lucky you.

Is it possible to get two RFEs? I've only gotten one but I'm wondering if it's possible to get another.


Since people are being approved around your same timeline, your RFE means your case made it to the top of the pile and an adjudicator has it on his desk. If it had all be correct, you would have been approved Thursday. But there is something he still needs to see before he can approve. The RFE will list anything needed. It could be one thing or five things. Once that is cleared, he can approve you. It would be unlikely that he would look it over again and mail a second letter for something he missed when he was adjudicating your case. If you don't reply to the RFE correctly or on time, then you might be lucky enough to get a second chance with another RFE or he could just deny because he didn't receive what was needed in order to approve.

Shouldn't you change your timeline to say Service Center: CSC? Right now it says Texas. What letters start your case number? WAC? Just curious.

Defintely go with a lawyer!!! It saves sooo much stress!! I happened to find a really good one. He does all the paperwork for my fiance and I, sends it in, will prepare my fiance for his interview and medical etc. Nothing is slowed down. I just received my NOA1 in the mail in my mailbox yesterday.
 

Your lawyer should be fixing the RFE or give you a refund because you seem to be doing an awful lot of work after paying someone who is supposed to know all the details you keep asking on VJ.

Me again with another question about a small issue that's causing me to stress out (unnecessarily I'm guessing):

For the section on the Biographical Information form which deals with your parents' details what do I write for my father's 'City and Country of Residence', considering he's deceased?

At the moment I've just put down the place he was living prior to his death. Should I leave this as it is or do I need to state that he is deceased?

If the last employment abroad is shown in your other list, then "if not shown" means only write something in that line if it wasn't already given elsewhere. You already listed it, so that question is blank. If you don't want to leave it blank then put--previously shown.

For the last address abroad, there is no "if" so list it again on the form.

We replied last week to our RFE and I was wondering whether it was common to receive several RFEs or whether the adjudicators usually check the whole petition and list everything that is missing in the first RFE?
I try to manage my expectations; our RFE was weird (they asked for a legible copy of a Divorce Decree, which we had already sent and it was legible) so I get paranoid.

Curious whether it was an England divorce decree or a US decree. They sometimes have a problem with the English one because they aren't signed and just have a red stamp from the court.

London doesn't even require a transcript (or tax return) for a K1 if you provide other proof.

It says it expired Dec. 31st, there's no newer version right now.



That date means a required review by the OMB in compliance with the Paperwork Reduction Act. They allow public comment and make a final decision. It could result in a changed form or keeping the same.
