I'm pretty sure you will. They don't really RFE in London for nit-picky things on the forms because you can sort that when you get there. It's not like the petition where nobody ever meets with you before approval so it has to be corrected by mail. I can't even think of an RFE in London that I have seen in the last 5 years is why I don't think they do them. If you never sent forms, they eventually would send a letter asking if you were still planning on applying for a visa.

Ok.  :)  I just wanted to make sure that I wasn't suppose to receive anything.  I didn't get an email or anything, I just randomly saw that it was approved.  So now it's another waiting game for the NVC to receive our package, correct? 


You need the paper copy of the approval for submitting with you adjustment of status, so if you don't have it in two weeks, call USCIS and track it down.

Yes, NVC next step. Sometimes there and off to London very quickly (days). Sometimes weeks to get to NVC and weeks to leave there. It's a big waiting game at every step with no real predictable timeline for London.

Hello all!  :)  Thank you for all the advice and help!  I just had another quick question...they said that they sent the approval notice on August 28th and last time I received mail from them, it only take a day or the day after to arrive.  Should I be worried? 


NO !! You don't need the notice until AOS. Just make sure you eventually get it.

I've appreciated having this forum as a guideline and it was so nice to know that others were going thru the some worries & stress that we are.  I just checked our "receipt number" online and it said that it was approved and that they sent us a notice on August 28th so hopefuly that will arrive today.  But what is the next step??? 

You don't need to email London to receive a packet 3. They will send a letter of instruction when they are ready for you. That letter is your "packet 3". It's not a packet. London is supposedly changing some procedures tomorrow so I suggest you wait for that and see what the new K1 instructions are. Meanwhile start gathering the documents needed for the interview. The police certificate is needed to show at the medical so order it ASAP. Get the I-134 from petitioner. This is the current K1 instruction for a list of documents ts to gather (see step two). Also the post above tells you to schedule your interview. That does not happen in London. They will assign an interview to you by letter. You don't pick. You can wait 4 weeks after everything is in before they contact you with a date. Each consulate is different.

Print out a new letter on confirmation to marry your foreign fiancé? NO, unless you let four months go by before doing any of the London part.
Print out another passport style photo NO
Fill out I-134? YES and two proofs of income
Get ready to fly over for an interview??? NO unless you just really want to go and have the extra money and time to go.

Foreign fiancé's next step after petition approval:
Order a police certificate? YES. ASAP.
Get a list of vaccinations? YES and get the ones needed for AOS before your medical.
Print out a new confirmation letter NO
Print out another photo US SIZED PASSPORT PHOTOS-3 Needed
Wait for packet 3? YES

In the scheme of immigration, getting married is more important than transportation from the airport. You list NYC as the local office. There is an abundance of public transportation, cab, and airport limo services in that part of the country. You will need $1070 to file for your greencard and work permit after the marriage. That should also be a priority.

The visa will be issued for 6 months past your medical. Stay in the UK and work and save money for furniture. Once you use the visa to enter the US, your 90 day clock starts for marriage.

Start your counting when the last item arrives. For example Ejjet had a medical on 15-Aug, so start counting weeks at 19-Aug which is likely the earliest the report got there. That's 2 wk, 2 days waiting after everything was there at the embassy.

Hello all, I wondered if anyone has any expereince they might share.
 
Our I-129f was approved 6 weeks ago and sent to the london immigrant visa unit for processing. They have said via email that it takes "up to 4 weeks" for the files to arrive. They have no record of having recieved our file. My fiancee was told yesterday by a tier 2 official in the US that they would try to trace the file and that we should call again in 2 weeks.
 
Has anyone else expereinced similar? We are going round in circles between various helplines and progress seems nonexistent
 
 





Did you call NVC, which is where it goes first from the USCIS service center. Find out if NVC received it from USCIS. if so, ask when it left NVC for London. Sometimes cases don't get sent from USCIS immediately or sometimes they get hung up at NVC when that should be a brief pit stop of only 3 days. What are the NVC dates? Make a timeline so we know what you have already established.

I guess that was a subconscious thing, I will fix it. Yes I am that one, what ended up happening, was that they couldn't guarantee grad assistance for last semester as they changed their policy to not include international students, and then they changed their mind last minute. While they were messing around we decided to go this route. Everything happens for a reason, and we are happy to already be on this next stage.


So now you are going to leave school in the US, go back to the UK for 2.5-3 months (or longer if you are born in the middle east, Pakistan, India etc) to get a visa so you can enter the US with your student visa voided and no permission to work? Wow.

London has approved many on the employer letter alone. Skip the bank statements. Not needed. Pay stubs are good back up to the employer letter.

No documents from the USC are needed except your financial stuff.

You will 1000% need a complete tax return for AOS (full return+W2). Or you can submit a tax return transcript which is a stand alone document not needing a W2. This is what you are supposed to read about your appointment. It is referred to in the appointment letter but nobody seems to bother finding it and reading. http://photos.state....appt_letter.pdf. It has the exact instructions of how to pay. Follow them and don't try to have a go on your own. Many have a mess because they didn't do it right. Don't do it until you have your appointment letter no matter how many say they did it early. It won't speed up your interview to do it early. Stick with London's order.

Well fortunately, (in this case) I have a very simple family and background, no muslim or middle eastern ties, or more relevantly no IRA or protestent paramilitary family members.
 
I know I don't schedule the interview, when I said that I meant when I would be able to start the interview scheduling process. It isn't the being away for a certain time that we are concerned (too much about) it is more about the immediate need to leave before I absolutely have to. Although my classes are online, it would be handier to stay until at least the middle to end of october.


Then you've got a plan to follow and hopefully London will speed up a little. They have been so busy this summer, it has dragged out for many. And they have been making changes which has been a confusing bother. Maybe by December they will be all caught up and can pop out your interview and visa in record time.

So theoretically, if I figured out how to fill in and post packet 3 and my police certificate while still in America, I could return to the UK for my medical, for instance at the start of December and then schedule my interview without concern of my i-797 expiring?


Yes, but you do know that you don't schedule? You can have that medical and wait 4+ weeks for them to put you on the Interview schedule. And that appointment could be another month away. Then it could take 10 days to get the passport returned. Or if you have any middle east, Muslim, India, etc personal or family connections or highly scientific education, maybe months to get the visa issued. It is impossible to predict a timeline.

There are three things London must have to give you an interview:
1) application forms
2) medical results
3) DS-2001 readiness for Interview form

You can slowly dribble those in to London. You don't have to send the forms for a month. Include a cover letter to explain why they are slow coming in...you are studying in America, yes you still very much want the K1 visa, but not until the semester ends. Then maybe in November (after you have made a medical appointment) send the DS-2001. Give the Medical date and also the desired date you want to return. It says give wedding date, but if you want to return well before the wedding then make up a sooner wedding date. By keeping them informed along the way, they don't think you changed your mind. They know why it is taking you longer.

Hello All.
I received my hard-copy of the NOA 2 or i-797. I noticed it has a section which states that it will expire on 1/5/13. 
So I have two questions.
 
Currently I am still in America, preparing my stuff to eventually return home, a date which I have still not decided on. My question is, what does this expiration represent? Does it represent the time that I would have to have my interview? What if I can't schedule an interview before then? 
 
Also, I see that it states in the hard copy that I can contact the consulate to forward it to a different consulate. I am from Northern Ireland, and it would be less hassle if I could get processed in Dublin rather than London, something I previously thought was impossible. Has this changed recently, or am I still clutching at straws?

Dublin does not process K1s.

The approved petition is good for 4 months meaning you are "supposed" to have the visa issued in that timeframe. Your letter of instruction (formerly known as packet 3) from London will tell you if you don't have your visa complete in that timeframe, they will need you to bring a new NOTARIZED letter of intent from your American fiancé to your interview and they will revalidate the expired petition. (This is a LONDON thing, so those from other countries--don't think it applies to you.) With that factoid, you can conclude you do not have to have a visa by January.

The medical is NOT step one. The application forms are. In fact, the most effective way to delay an interview (if you wish) is delay having the medical.

You 1000% need to do a DS-260 online form instead of the DS-230. Do NOT do both.

It's an overview to give you an idea of what's to come. The sooner you file, the sooner you are allowed to work and get a driver's license. You'll find a K1 has few privileges in the US, so getting the AOS filed ASAP is a positive step toward integrating faster.

USCIS and NVC are basically done with you and your case. The new info on the London forms should be enough. There is no reason to mail the petitioner anything at this point. When you do adjustment of status, it's like starting a new process so you will start fresh with the current address.

So my medical was denied my notes didn't quite match up with the docs notes. They have said I need to pay £400 to see a phyciatrist to be evaluated. Basically I had depression 9 years ago as a teenager and couldn't remember all the details, this has hurt me so so much has anyone else been through anything like this, I am scared that I won't get an apointment and if I do they will deniy it because I didn't give them full details in the first place. :( x


Knightsbridge doctors don't know you well enough to make a decision on mental health by seeing you at one appointment. Many who admit to depression go in with a short report or letter from their doctor who treated them outlining the scope, treatment and prognosis of the depression. Or Knightsbridge requests a letter from your doctor. It needs the "magic words" that you are not a threat to yourself or others and are not expected to be in the future. It is more unusual to be referred to a psychiatrist, skipping your GP so there must be more to this story. Once a psychiatrist evaluates you and says you are not a threat to yourself or others, then Knightsbridge will be satisfied to pass you on mental health and send your medical results to the embassy. Then you will get an interview appointment.

All your immigration files are delivered from the embassy to you in a "DO NOT OPEN" brown (or white) envelope, along with your passport containing the visa. You turn it over to CBP when you enter the US. that would before you pick up checked luggage so it has to be in carryon.

I hope you don't mind me picking your brain again, but is there an expiry date associated with the visa after you get it but before you enter the US on it (thus starting the 90 day count-down to get married in the US)? I do not intend to wait for a long period or anything, but in terms of giving my noticed period at work and sorting my affairs here and everything it would help to know. If you do not know do you know where I might seek that information?
 
Also, a while ago I was posting about how my fiancée (US petitioner) was interning and thus not earning 125% of the federal poverty income. She could be employed at any time, but if it is the case that this process goes much faster than we were expecting and I end up living 'out of status' in the US (as I would not be able to apply for AoS and get the right to work etc until she is earning that crucial 125%), what repercussions would there be? Would I be able to continue living there until she gets to that 125% mark and then apply for AoS? Again, if you do not know do you know where I might find out?
 
Again, I know I say this a lot but I very much appreciate your time and input!



The visa used to expire 6 months after issue. But now London sets the K1 visa to expire six months from the day of the medical exam because the TB clearance (X-ray) is valid for six months. Control when your visa will expire by not rushing to the medical. So many jump out of order to get that medical appointment even before the case arrives in London and before London has notified the fiancé they are ready for the application. You might be better off doing it in the preferred order.

Your visa requires you to marry in 90 days. There is nothing in law that says you must adjust status immediately. You already know, the sooner the better because you will be in limbo and unable to get on with your US life until you do. For that reason, stalling the visa and continuing earning/saving money in the UK might be the sensible plan. But young people in love aren't always sensible. So that's for you to work out.

Yes, you will have no status in the US after 90 days, but that generally isn't a deportation problem. Nobody is going to start looking for you. There's millions in the US and too many to bother with a K1 visa holder. Maybe if you committed some heinous crime out of status you might draw attention to yourself, so don't do that :P. Many k1s have waited a long time to adjust. they don't get denied because they waited. If you wait a year, USCIS will often require an I-130 petition to be filed concurrently with the AOS. That's more $$$ for the petition fee. The worse thing about waiting to file is you are kind of a "nothing" stuck from getting to the other side so to speak. A K1 zombie?

I don't keep up with NOA2 times anymore, but yes, it's fast any way you look at it. From now...mayby 3 months to a visa. There's so many exceptions to timelines, but I wouldn't plan on Christmas in the US. Here's my list of what to work on right now so you are prepared as soon as London says they are ready for your fiancé.


Advance preparation for the London part of the K1 process
When your NOA2 is near, its a good time to start your preparation. 

Petitioner
  • Order your tax transcripts.  Only the most recent tax return is required, but you can order three years at a time for free from the IRS. Tax transcripts are summaries of your whole tax return provided free by the IRS. They can't be faked because it's a copy/summary of your whole tax return picture, basically certified by the IRS because it's issued by them. That's why you don't have to include any 1040, Schedules, W2s or 1099s if you send a transcript. They are free from the IRS. Transcripts take the place of sending a complete tax return. While London does not require a tax return or transcript, it is a good proof to use.

    If you call 1-800-908-9946 (the transcript line) , there is an automated system for ordering transcripts. You'll have to enter your Social Security number and the numbers of your street address.  It will generate an automated request to mail your transcripts.  You can also order online on the IRS website  http://www.irs.gov/i...=232168,00.html

  • Start filling out the I-134 Affidavit of Support.  It will have to be signed and mailed to the UK the slow way.  Get familiar with the form.  When the NOA2 is received is a good time to finalize it with the supporting documents and get it in the mail.
  • Don't obsess printing Skype logs, emails, photos, or Facebook status. London does not want to look at that. Really they don't.  London does not want to see a copy of your I-129F petition or NOA2. They got that in the file from NVC.
UK beneficiary:  

  • Get some passport photos taken.  You will eventually need
    2 US sized for the Embassy
    1 UK sized for the police certificate
    1 either size for the visa medical exam. 
    (and for AOS in the US, 6 more US sized photos)

Also available at Snappy Snaps, Photo-Me booths, Jessops, Gould's Pharmacy (by the embassy), near the Bond St Tube station (Oxford St) which is closest Tube to the medical exam.




  • Go to your NHS doctor and get the immunizations you will need for Adjustment of Status. You can get a K1 visa without having any shots, but you will need them before AOS. Its really wise to take care of  it before getting to the US so you can aviold civil surgeon hassles and $$$.  Many NHS doctors will do them for free, but they are not obligated to do so for immigration purposes.  If you had these shots as a child, Tdap/Td  must be no longer than 10 years ago or you have to do them again.  Get the shots documented by your doctor to take to your visa medical exam. Heres the shots needed for 19 through 59 years of age: 
    Td or Tdap - or  get DT, DTP or DtaP and it will be accepted for AOS also
    MMR (if born in 1957 or later) Get a second shot 4 wks later if you have time before your medical.  It's two doses in your life, but if you get the first and 4 weeks haven't passed by your medical, they will waive the second dose for "insufficient time interval".
    Varicella Not routinely given in the UK ;  a history of having chickenpox excuses you from the shot. They take your word for it at the visa medical exam. 
    Influenza - During flu season only, October 1 through March 31. This was a new recommendation dated November 2010 for all ages over 6 months.  Older lists will say flu shots for over age 50. It changed.



  • Order your police certificate.  It takes some preparation because you need a passport photo signed off on by somebody officialish whos known you two years.  Heres the website.  Read the instructions.   • Look at your passport and make sure it will have 8 months remaining after visa issuance. If not get it renewed now. If you've damaged it or gotten it wet, or the edges are wrinkled,  it will need to be renewed. London is fussy about that.

    Make photocopies of any document you want back. They will verify the original and file the photocopy.

You were approved. After approval there are a few things for them to do---send you a notice, update the status, pack up your file and send it to NVC. NVC will give you a new Dept of State case number. That part should only be a 3 day pit stop at NVC, but sometimes cases have gotten hung up there. Then it is off to London. London will notify the beneficiary when they are ready for things to be submitted to the embassy. Maybe NVC is trying to discourage so many callers who call 1, 2, 3 times a day for weeks. They will notify the petitioner when they have sent the case on, and the new case number will be included. The embassy will notify the beneficiary when the case is received and the new case number will be included. So it isn't required to call them. Maybe they decided they can't handle so many curious callers and are trying to cut back. You didn't call USCIS everyday for an update because you knew they wouldn't tell you. So NVC has decided to get tougher like that. Could be their plan....if we won't tell them, they will quit calling. Then we can shift call resources to processing cases faster.

Ok We are so near the end of this process to be hitting a brick will just sucks!
I have an interview date and time in just over a week. The letter didn't arrive.
I cannot pay fee's because we do not have a DS-160 number.
I cannot get through to anyone as the transitional process is happening.
Anyone worked this transitional process out yet and if you have can you please help me to understand what to do next. Thank you x

Did you follow them exactly, specifically choosing "pay for a K1 visa" BEFORE scheduling the courier? If you do courier first, you get into non-immigrant visa territory for student or B1/B2 applicants and can't get to K1 payment. That was the problem people were having last month or so when this was new. Unless they did a change this week, it should work. Many had to start over with a different email address because if you take a wrong turn, the software is unforgiving.

If that doesn't work, they will still take your money at a payment window on the day of the interview.

Also, did you actually submit an online DS-160 or a previous version of the application forms?

What is missing, the appointment letter?
