The child is under 21. The Embassy told my fiancee to submit a DS-160 for the child left off but the concern is she never filled out DS-160's for the other children yet they showed up on the cover letter. Should she go back and fill out DS-160's for each child? They are all under 21.


My husband's children showed up on his letter and they had no intention of getting a visa. If you fill out a DS-160 for each person that wants a visa, then they will get a visa (if eligible) despite what names are on the letter.

The petition part of the process establishes you have a child. It's when you do the London part, you will show the desire for him to have a K2 visa by filling out and submitting a DS-160 for each of you. If it has gone pear shaped by then, you can just do the application form for yourself. In addition to that, a child with derivative status of your visa can "follow to join" up to a year after your visa and immigration so long as he remains under 21 and unmarried. So you have an additional timeframe to work it out with him and the ex.

London does like something in writing from the other parent if a child is leaving the UK. While notaries are not common in the UK, a solicitor witnessing her signature and countersigning would do. That would be presented along with all the other documents at the Interview.

The support forms aren't needed with the petition. You will provide them for him to take to his interview. London accepts a different sponsor than the fiancé, meaning you wouldn't even have to fill out an I-134 for London if you had no income. Your dad could provide the form instead. Yes that is a London thing not done at all consulates.

After marriage, the I -864 support form is filed with his adjustment of status. You and your father will both do one. Your part is to answer the questions truthfully. Unemployed. Income $0. They will not reject his application if you have a joint sponsor, even if you are unemployed.

Also, there is one (semi related) question I have about the process. I know that James will need a copy of his own birth certificate and the original for his interview, but I've seen it implied that he would need the original and copy of my birth certificate as well. Is that the case, or does my fiancé only need HIS birth cert for the interview?

You birth certificate (photocopy) goes with the petition to prove you are a US Citizen. It will be in the file that eventually ends up in London, but not really a part of his visa interview.

For a MIL doing the I-134, it would not hurt to tick "intend". She is not going to be married to the immigrant. Being a third party, so to speak, she could list anything specific she plans to do like provide room and board, a car...whatever. Or write something general like provide for any needs the immigrant will have until she can begin work and support himself.

There is no set rule for London, but that's what I would do.

Having been around the UK forum for many years, I know of someone who was asked "how old is the tattoo"? It seems the concern was it looked brand new and Knightsbridge was concerned about hepatitis or whatever people can get from dirty tattoo places. (sorry, clueless about tattoos). If it is an old tattoo, then never questioned.

Sign up. And later down the line add your new cases for AOS, EAD, AP, removing conditions and citizenship to your account. I have all those in a list on my account. You will get emails and texts if anything significant happens like approval, RFE, (later) card in production. It doesn't always work perfectly if somebody on their end doesn't enter the update. Like we never got the approval or card in production for the greencard. It was a total surprise in the mailbox. 13 months later, they updated and we got notified his greencard was approved. All the other cases worked flawlessly.

I read something on this once. That Is a question for security purposes, just like ones asking countries visited. A person could be put into what is commonly called AP (additional processing or administrative processing) for many weeks following the interview if their answers tick the security red flag. Being from or visiting countries more known for terrorism will get you delayed in London. But the other thing this article said was having specialized scientific skills where explosives, biological or chemical warfare, or other terroristic possibilities might exist could get you screened further through additional databases. That takes more time and a visa is delayed. So pumping yourself up as a highly skilled biologist or biochemist isn't going to make them think you are a valuable scientist and approve the visa more quickly...having an American fiancé is enough. Too many high level scientific skills could delay your visa.

The government is very secretive about their additional processing for security and this was a piece discussing things legal experts have seen become a pattern. It is speculation about what triggers the extra delay and not something you would find published on the Dept of State website.

I've lived in the UK for a number of years and my boyfriend and I will be moving to the US (my home) this year.
 
We would like to begin the petition process now but I live here so I can't very well up and go to the states just to file a petition.
 
Do you know if this process can be started from abroad? Can you provide an address in the UK for all the confirmation documents, etc.?
 
Also, at what point are the questions about finances asked? Can this wait until the interview? For how long do they need to see 125% of the poverty line amount in your account? Many places like to see proof of support income in your account for 28 days by reviewing bank statements. Is this similar?

You will process (just like everybody else going to London) with your Irish passport as long as you reside in the UK. People process there who were born all over and may be in the UK as students for example or from another EU country. I know of people who interviewed in London with passports from India, Pakistan, Brazil, France, Australia, Nigeria, and South Africa.

I can't. I already asked the spanish embassy in Uk. I can only do it during the 6 months before it expires, mine expires in may so I would have to wait until november.

And if you lost your passport?

Anyway, you do not need to show a passport with at least 6 months remaining until your interview day in London. They want to put the visa in a passport that will be valid through your entry to the US and get you through the greencard process. You wouldn't want to be sending off your passport from the US for renewal when you would need it for marriage license, social security card, biometric appointment, Interview, etc.

Since it could be 6-8 months from when you mail off that fiance petition before you are at the visa interview in London, the timing might work out. Nobody knows how long it will take, but if you don't have the proper passport, then you stall the interview date until you do. For London you won't get an interview until they have received your medical exam results and Readiness for Interview form. So don't rush to make a medical appointment or send in the readiness form.

Or go to your interview and if they don't find the passport acceptable, they will say to send in via their courier when you have a new passport and they will issue the visa. More hassle there because your TB clearance part of the medical expires after 6 months, so another timing issue for you to work out.

Trying to invoke some 6 month agreement when you are going through your greencard application would be a lot of bother even if it worked. You will want a new passport when you enter the US I would think.

My personal opinion-- think it would be risky just because of the long visit. She spent 101 days in the US out of a 126 day period. 80% of that time period. AND she was already questioned in secondary. AND she has no responsibilities to return to.

Another visit so soon is not about leaving before or having a visa intent, but using VWP for more than it's intended. It looks like she is trying to "live" in the US more than her home country. If she has money to burn, and doesn't mind the 9.5 hour flight only to get on the next plane home, then try it. It is totally up to the CBP officer and what he thinks.

Maybe save some money for the immigration costs and your new life is a good plan. Unless of course you already earn enough for the Affidavit of Support and a have a place to live. Then saving isn't a factor.

For an I-134 (fiance) interviewing in LONDON, the beneficiary (Brit) can self sponsor if he has significant savings or assets. The salary at a job he will be leaving wouldn't count. There are several threads in the UK forum where it is discussed and some telling their successful experience doing so. Example, one had a pending house sale. There is no published amount on an I -134 but some have done it for less than 3x poverty level.

I am the only no to "is it worth trying for a tourist visa?". Didn't have time to explain earlier.

Reason that is my opinion is I see time after time on here (almost 6 yrs) where tourist visas are denied in London with little discussion. It's a visa waiver country and they don't hand out tourist visas easily because most UK citizens should be eligible for VWP. Maybe if you had a very compelling reason like medical treatment you could only get in the US or business purposes. But to visit a fiancé and previous visas denied ....well there is reason to think you might have immigration in mind. Anyway if you don't mind a trip to London and losing the fee, try it. I was surprised myself when I found so many didn't get approved in London. Would love to hear a positive experience.

Your K1 isn't influenced by the other visas. If you meet the requirements...fiancé earns enough, no health issues, clean police record, etc...then it should be a cake walk.

The embassy in LONDON does not ask for proof of US citizenship for the sponsor on form I-134 for K1 visa. Positive. They would even accept proof of the beneficiary's assets for self-sponsorship with no I-134 at all.

If it was an I-864 Affidavit of Support for a spouse, then a joint sponsor would need to prove US citizenship or permanent residency because the I-864 has stricter requirements. You will have an I-864 for AOS and will submit US residency proof with with your AOS if you have a joint sponsor.

Do you know if after my Fiance's interview and after he has recieved the Fiance Visa in his passport, can he still "visit" the states and come in officially on the fiance visa at a later date or once he has the visa and visits the states then does that automatically starts the 90 days?
 
I ask bc we are planning to get married in July, and have him move here in May. (approx 80 days before our intended wedding date)
but he wants to visit in March and this could be after his interview date.. ( we are awaiting the interview date at the moment)

If you aren't ready for an interview and visa so quickly, then don't send the readiness for interview form to London immediately or have a medical exam. That will stall the interview assignment.

You can also request a date to fall after March ? because he will be out of the country. We did exactly that because a trip had been booked long before NOA2. Then it became apparent an interview would likely fall during the trip. So he requested an interview date be assigned after his return. London will work with you if you make a request via their online contact form. You can't really speak to anybody by phone in the immigrant visa unit. If you call, you will get the non-immigrant people who will confuse you with other visa information.

I don't think so, I believe you will list them on your DS-160. 
 
It's a new form that replaces a few old ones that the beneficiary had to complete.  On those old forms you merely listed the children intending to immigrate on the old DS-156K form. 
 
Go tot he USCIS website and look over the new 160 form.....it's not needed until prior to the interview so you have many months to investigate.



Each does an application. Prior to the form changes, each did a separate visa application as well.

Children are listed on the petition so only one I-129F. When you get to the visa application in London, each applies with an I-160, pays a visa fee, has a medical exam, and provides relevant documents like birth certificate. Over age 16 need their own police certificate. Under age 14 do not have to go in person for the interview.

Unless you have sole custody of the kids, London will want to know the father is aware they are immigrating to the US and grants his approval/permission. Normally this is accomplished by having him sign a letter in front of a solicitor who also signs as witness. In the US it would be a notary, but that isn't something they have in the UK so a solicitor is used.

So this is kinda weird--
I have a saved PDF of the I-129f which shows the boxes for the phone digits American style and extension.

But going straight to http://www.uscis.gov/i-129f the form there (dated same as my PDF) has a big box that will hold 20 characters.

In Texas?
Go to the county clerk's office (may or may not be in the courthouse)
Show passport as ID. Jessica can show driver license or passport and must give her SSN.
Purchase marriage certificate.
Wait 72 hours or get a waiver from a judge.
Get married. Officiant signs license putting date and time. (it's the 72 hour thing)
Take license back to where you bought it and have it registered.
They may give you the marriage certificate while you wait or may have to mail it to you.


If you happen to get your SSN before the marriage, then you also tell them the number. You don't have to have it first.

As far as the passport photos ---I stapled a baggie part way down a full size piece of paper and put the page behind each G-325a like it was another piece of the application. I think I wrote "passport photos of petitioner Mary Smith" in the blank area below the baggie.
