K-1 Fiance(e) Visa Process & ProceduresCan anyone tell me what forms are in Pkt3 for London?

I believe the second part of DS-230 is taken with you to the interview.

A K1 never does DS-230 Part 2. That is for visas like the CR1 spousal visa.

Sorry, what I mean is,,,,im mailing off for my police certificate on wednesday which will take around 2 weeks,,,,should i mail my embassy packet off around the same time?

Well...

If you're willing to sign the statement

I attest that I have all of the documents specified in the Instructions for Visa Applicants and other instructions,
which are applicable in my case, and I am prepared for immigrant visa interview.

on a Department of State form when you don't actually have all the documents, then sure you can send it.

K-1 Fiance(e) Visa Process & ProceduresBooking medical and interview dates

Hi, with regard to London Embassy, is it a good idea to mail my "documents for readiness" to the Embassy a few days prior to my medical appointment day?

regards :luv:

I'd say mail it (DS-2001 + cover letter)just as soon as you're ready (have all your documents in hand.)

K-1 Fiance(e) Visa Process & ProceduresA question about scheduling Interview dates (London)...

Hi I'm still waiting for the London embassy to contact me after our NOA2 approval... I understand pack 3 needs to be send to the embassy once you have completed and have access to everything you need for the interview.

I'm a little confused about the London interview scheduling. Does London give you a date automatically once they have received your medical results?
Do they give you an option to choose the interview date or delay the interview for a month if needed?

I'm going abroad for 3 weeks (we miss calculated how long the whole process takes!) and I'm worried it will effect the visa process/I may not get my passport back to me in good time. I read that if you miss your interview or can't make your date you will have to wait to get a new reference number and up to 4 months to get another date re-scheduled. I certainly don't want to wait that long!

- Thanks

London will not schedule your interview until they have:
  • The application forms DS230 part 1, DS 156, DS156k, DS157
  • The readiness form DS2001 with cover letter
  • The medical results
You can delay 2 or 3 to stall. I would get 1 in so they know you are still playing the visa game.

Or you can do what we did in a similar situation (3 week trip already booked). In a cover letter with the readiness form we (he) put in bold after the general information, and spaced down a bit so it stood out: Please can you schedule the interview after July 15 as I wlll be out of the country prior to that date.

As it turned out our UK VJ buddies who were on our approximate timeline all interviewed the first week in July. London accommodated us with an interview at the end of the month. That way your stuff is in and you aren't waiting after your trip for them to open your readiness form and get around to you.

K-1 Fiance(e) Visa Process & ProceduresDeatails of Medical Exam for K1
Don't get too freaked out Jenny. I've never ever heard of London calling anybody by their VJ name or giving any indication that they had checked them out. That was a story out of Montreal or Vancouver Canada. It's still a good point to be aware of your online privacy. USCIS did admit that they check social media like Facebook at times when adjudicating adjustment of status cases to find clues about the couple and the validity of their marriage.

K-1 Fiance(e) Visa Process & ProceduresDeatails of Medical Exam for K1

I feel like I'm being lectured by my parents right now :bonk:

Well I feel good that I didn't lecture and I'm the old one here. :P

On the questionaire it says: Have you ever misused or abused drugs?

A little recreation in Amsterdam is not misuse or abuse in my book. Taking way too many pain pills for months/years while drinking too much alcohol comes to mind. Getting addicted to prescription meds so you can sleep, but needing uppers to function the next day sounds abusive. Having gone into rehab to get off drugs would warrant a yes to the question.

Anyway, they do not routinely do screenings for drugs. I know of one case where a guy went to his interview after smoking weed late into the night before at his hotel. The CO thought he was acting stoned and sent him straight out to a drug screening. Another guy was being a smart@ss with the Knightsbridge doc who asked how much he drank on a typical evening at the pub. He said something like he could put back 10 or 15 pints in an evening. His fiance claimed he was just popping off and maybe had 10 pints in a week. Well he got sent for a private psyciatric evaluation to determine if he was addicted to alcohol. The evaluations had to go to the US for a ruling whether he was admissable. I don't know if he ever got the visa. How you act and what you say can have repercussions.

K-1 Fiance(e) Visa Process & ProceduresLondon Interview

Does my fiance need to have my birth certificate or passport AND my co sponsors?

The USC already proved citizenship in the petition, so no to your passport/birth certificate. London doesn't seem too bothered with some of the details on the I-134, but I would include proof of the co-sponsor being a citizen like the I-864 Affidavit of Support definitely requires.

I have a question for you, when did you pay the MRV fee? When you received your appointment letter or after you sent in packet 3? Will they schedule an interview if you haven't paid the fee yet? Or do they wait to schedule an interview until after you've paid the fee? Just trying to gauge if we have some time to pay the fee or if we need to go ahead and scrounge up now if it will affect them actually scheduling our interview?

You can pay after you get the appointment. I've read recent people commenting they did that. The Embassy would write it in the instructions (website) if they were going to withhold interview until payment, like they warn you the medical results must be received. And I haven't read of anybody waiting and waiting on an interview that were told it was because they hadn't paid.

K-1 Fiance(e) Visa Process & ProceduresTIME FROM NOA2 TO EMBASSY

It is now over two weeks since we received our NOA2 from Vermont. Roughly how long does it usually take for the Embassy to receive the details. I e-mailed NVC a week ago asking this question but so far have not received a reply. Should I call them as it appears that they are easier to speak to than the USCIS.

From the document I offered you:

Get your LND case number from the NVC without waiting on their letter.
You can call the NVC and ask your new case number. Call (603) 334-0700, press 1, then 5 to speak to a person. Have your EAC or WAC number ready. DO NOT enter your case number into the automated system. A fiancé case K1 is not put in the system and it will always say the case is not found. Speak to a person. They can confirm when your file was received by NVC and when forwarded to the embassy. They can give you your new LND case number.

Hours: Monday through Friday from 7:30 AM to 12:00 PM (EST).

Best time to call is 7:30 AM to 9:00 AM and 10:00 PM to 12:00 PM ( EST)

Note: Just so you don’t get confused by VJ posts. People getting a spouse visa CR1 will have most of their greencard application items processed at the NVC. They send documents there and pay fees there. Those are the cases that stay at NVC a few weeks and are found in the automated system.

K-1 Fiance(e) Visa Process & ProceduresK1 Visa

I am a first time user of this forum so please accept my apologies if I am asking questions that you have answered a thousand times already.

Fill out your VJ timeline. It helps us answer questions better.

I have my interview with the US Embassy in London on Tuesday 12th July. So far everything has gone pretty smoothly and I have jumped through all the relevant hoops that have been asked of me. At the interview, do they even ask for continued evidence that you are still in the relationship? I have the bill for the ring to prove I have bought it and we are engaged, I am also going to supply my mobile phones bills to prove we talk to each other, and e mails as we talk everyday. Will this be enough or do I need to supply more?.

For London you don't need a bit of that. They won't ask and if you offer it, they will politely tell you thanks, but no thanks. Nor do you need an updated letter of intent unless you dragged out your case...like didn't respond to their letter by mailing in your forms for months and months. (This is where I'd like to see your timeline.)

I am looking at moving around mid September and wondered what passport I will use while I am out there. I really want dual citizenship where as you have 2 passports, an American and English. But from what I have read this will not happen. My English passport does not run out until 2016 so once I have obtained my social Security Number, completed my AOS and obtained my EAD and finally the Green card, do I need to apply for an American passport or is my English one good enough to travel on for the years it is valid? Once my English passport expires do I get an new English one or do you apply for an American one? If someone could explain that would be of great help.

You got great explanations on that. You can apply for citizenship 3 years after you get the greencard. (a little more detailed but that's a general time frame)

I also don't know if I can drive on my English driving license once I am there. I am moving to Wisconsin and don't know if I can insure a car using my English license. I assume I will be able to drive my Fiancée's car under her insurance with my English license. But will I need to apply for an American license to insure and own a car. Or will I under law, have to apply for an American driving license anyway because I have moved over.

WI will let you drive one year as a "visitor" but once you get residency (greencard) get a WI license.

K-1 Fiance(e) Visa Process & Procedurespacket 3 checklist (London/UK)
I answered your question in the UK forum. Repeat--

Sometimes you will read UK postings saying to send in your check list. That’s from an earlier time when London had an actual list (3 pages) that you ticked off the items you had in hand to let them know you were ready to interview. Now the form is DS-2001 and it serves the same purpose, but you don’t put check marks on it. London does request a cover letter with specific information to accompany the DS2001.

In case you're curious about the old checklist--

I just remembered I have scans of the whole nineteen-page paper P3 London used to mail out. It really was a packet and looked as bad as these scans (terrible photocopies). The checklist is photos 3,4,5 and if you enlarge the photos, you can see little tick boxes in front of the items. https://picasaweb.go...feat=directlink
People used to print my scans to send back instead of waiting for the paper packet. We've always been in a hurry and looking for shortcuts.

K-1 Fiance(e) Visa Process & ProceduresNVC not received petition as yet..

I wasn't sure who to talk to at USCIS as I thought it was now out of their hands?

It may still be in their hands if it's not at NVC. There's only that general number to call for everything and they aren't usually much help. That's why I said TRY because it may be futile. There have been times in the past where CSC took a long time to ship out approved cases. The fact that you don't have a hard copy NOA2 indicates CSC may be lagging a bit or got off-track on your case. But with the holiday, there's only been nine working days which isn't a huge delay.

K-1 Fiance(e) Visa Process & ProceduresNVC not received petition as yet..

Hi there everyone

Wondered if you could help me. Me and my fiance got our NOA2 on 27th May. I have called NVC a few times since (the last time today), and they have no record of it being received as yet and advised me that I had to wait 15 business days from the 27th May before calling back. I'm a bit surprised by this, as I have seen others who had their NOA2 a week or more after ours with petitions already received by the NVC and sent onto the relevant consulate. Just wondered what the next step is if they don't receive it in the next week, or if there is any other way to get our LDN number? I'd like to get cracking on the next part (particularly as I have two months' notice to hand in with my job), so would welcome any opinions.

Thanks!

L

You can't get the LND number until NVC assigns it. If they don't have your case there isn't a LND yet.

You can't get any closer to the visa (forms mailed in) until London acknowleges your case is received from NVC.

You can sort out your shot records with your GP. Get your passport photos made. Order your police certificate. Get the finalized I-134 from the sponsor. Get all the documents in hand you will take to the interview that are listed on this London webpage.

And you can call USCIS to try to chase down why your file hasn't gone to NVC. You did speak to a person at NVC, and didn't just enter numbers in the automated system?? K1s aren't in the automated system.

K-1 Fiance(e) Visa Process & ProceduresEvidence of meeting
I don't think the hotel bill proves much by itself. Did he charge anything on the same day in the same city as the hotel? That would put you in the same city on the same day. We sent two Best Buy receipts that were in the same store (my town), minutes apart that had our names printed out on the receipt. Some store machines print the names on receipts. Then each we printed credit card bills showing purchases in Harrods on the same date. I highlighted the tranactions to point it out and wrote at the bottom "Both in Harrods on Jan.4." The evidence is more about meeting within the past two years, and not how in love you are or how many emails you send each other.

You DO need to send evidence of meeting in person with the I-129F. And just to clarify, that goes to USCIS to get the petition approved. London is a different ballgame and different agency--Dept of State. London does not want any evidence of meeting, chatting, being in love, etc at the interview.

K-1 Fiance(e) Visa Process & ProceduresPassport photo size for his London interview?
Just to add another option--

My husband made his own photos. Google "DIY passport photos" for many ways to do it. If somebody has a good digital camera and something white he can use for a background, then DIY might be something you could do before interview day.

One website crops/modifies the photo you upload to the right 2x2 size. Then you print it at home or go to a local photo place with it on a disk or jumpdrive to get it printed. I think 2 images print out on one 4x6 photo page, then you cut them out.

And I forgot to add---
If you are a K1, then your future spouse will need 6 more US size photos for the AOS/EAD/AP applications. Might as well order more if you get a good deal on quantities, over just getting 2 for the embassy.

K-1 Fiance(e) Visa Process & ProceduresPassport photo size for his London interview?

Okay, that solves my predicament then. He can use the British sized ones for his medical, get the American ones that day at Gould's, and have them signed (just in case!) in time for the interview. Thanks, everyone!

They don't have to be signed for the embassy or the medical! The photo you send off for the UK police certificate is the one that has to be signed by a person that has known you 2 years. Perhaps you are confusing the Embassy photos with the police certificate.

Think about it. He presents photos in person at the embassy and medical. They look at him, they look at the photo. If he looks like the photo, all is well.

He doesn't go in person to ACPO to get his police certificate. They need some kind of control to assure that the photo is of the person applying.

K-1 Fiance(e) Visa Process & ProceduresChanging address once married

Hi all, my fiance and I at the interview stage of the K1 visa process, my fiance is in the Military and we would like to move on base as soon as possilbe, which is 30 days prior to marriage, my question is this - when do we tell the USCIS of a change of address?? As soon as we know our new address, the next time we need to contact them which will be for AOS or would you advise us to stay where we are till we have completed the AOS.

I ask this because on DS-230 Part 1 of the packet 3 forms that is sent to the embassy, question 11 asks where you want your Permanent Resident Card sending, and I've obviously put the address he is currently living at but if we move on base this will be diffrent.

Thanks

#11 is N/A to a K1. It applies to true immigrant visas who will get a greencard mailed shortly after arrival in the US. They use this form too.

#10 is more for information since nothing in the process will be mailed there for K1s. You can give the current address and add a line saying (example) "Moving to Brooks AFB Aug. 2011"

When you file for AOS, use the address (new) where you are living. It's like a brand new process and they will send everything to the address you state on the forms. They won't go back to your petition or visa documents to pick up an address. Just think of AOS as starting over from scratch and go from there. If female, you may have a new married name so apply for AOS in that new name.

K-1 Fiance(e) Visa Process & ProceduresCan DOS see if the medical has arrived at the London embassy?

Besides finding out if the embassy has received your medical results (they usually do within 3 - 4 days), what is it you're trying to find out...? Or is it just for your own personal knowledge that you're curious?

Exctly what I was thinking....Why do you need to know? It seems this current batch of people have to call constantly when it's not going to speed up anything. The Knightsbridge people get the medical to the Embassy without fail. It's now impossible to talk to anybody if you have a real problem because VJ has created this frenzy of calling DOS and the embassy to ask unnecessary questions. Maybe they could put out visas faster if they didn't have to answer so many phone calls or emails. Maybe people with a real need, like a baby due in a month or a husband shipping out to Afghanistan could get helped easier. :ranting:

K-1 Fiance(e) Visa Process & ProceduresCo sponsor question

I have my interview in 2 weeks and while I have all my affidavit of support and tax returns from my fiance his parents are co sponsoring us just in case of any problems. Anyway my question is they file their tax return jointly so just to be sure I have the affidavit filled in by both of them. I ahve been reading the interview reviews and noticed a couple of people mention birth certificates of co sponsored are needed. Is this true? If I need a copy of this I will have to get it sent over this week and also do I need a copy of my fiances birth certificate or passport? Everyday I am thinking of more and more things and fretting that I am missing something.

Thanks so much :)

You'll get better answers if you ask embassy questions in the UK forum. Your fiance's birth certificate is already in your file. They know he's a USC or he couldn't petitioned you. I don't recall any K1s getting called out for failure to prove the co-sponsor's citizenship, but I always suggest it as a good thing to have. A Brit can self sponsor if he has enough assets without any I-134, so it's not super strict about who provides the support. This is different for CR1 applicants which do an I-864. You'll do that for AOS and will provide the BC or US passport of the co-sponsor.

London doesn't even require a tax return with the I-134. Do you have other proof's of the Dad's income showing only his income is enough? Does he have a W-2 form that shows his portion of the joint tax return? I don't think separate I-134s from each parent sounds quite right just because of a joint tax return. Go with one or the other and prove that person's income with a W2, employer letter, or about 3 month's payslips. London isn't real picky if you show them a proof.

PS. don't even think about calling or emailing the embassy as suggested above to answer your question. They charge per minute and give bad information or none.

thank you..
also the piece of paper that you paperclip the passport photo in plastic bag to, do you have to write anything on the blanc page?
Do you need to sign and date every piece of evidence?

I stapled the baggie to the blank page. You can write "Photo of beneficiary Mary Helen Jones" on the page if you like. I didn't sign every page of evidence.

Your cover letter isn't something to fret over. They probably just throw it away when they put your file together the way they want it. It just gives the package a nice introduction, but isn't a deal breaker if you don't have one at all.

So do you send the certificate or take it with you I am confused!

Visa application forms are mailed in. Here's your instructions from the embassy. http://london.usembassy.gov/iv_15.html You can start your forms found on the page. Your documents (Police certificate, birth certificate, etc) are taken to the interview. The list of documents is the second link I gave you above.

Our police certificate came in a week, but you need to get passport photos signed by somebody (in the instructions) and that may use up a bit of time before you send off the ACPO application.

I don't think debts count against you. It's not a crime where your fiance will be in danger if he leaves his country to come live with you. And it's a state issue and not federal government. I don't think USCIS talks to the IRS, much less the state of MA. Just guessing that there is no problem.

I'm 100% sure London will accept her Dad's I-134. He should provide his 2010 tax return with W-2s and a few months of pay stubs as proof of his income. (Those are just two suugested but easy enough to get)

You signed a FORM DS-2001 saying you had all the documents needed ( LIST HERE ) and now you plan go to the interview without having an adequate Affidavit of Support? You won't be approved at your interview unless your fiance has enough income and proof of it. Her father's I-134 needs to be original so it will have to get to you by snail mail across the pond. BUT as a K1, you are going to need an I-864 very shortly to apply for AOS, so squeaking by the K1 interview doesn't solve the need for a co-sponsor if income isn't 125%. Might as well meet the higher standard is my opinion.

I would never advise going to an interview without a really strong Affidavit of Support because if anything, that's what London seems to be most interested in checking, rather than further proofs of the relationship for example.

K-1 Fiance(e) Visa Process & ProceduresIncome requirements applying to I-134
I've read that same 100% thing many times. I kinda think London would be okay with 100%. I recall an interview a few months back where they gave back the co-sponsor's I-134 and documents and said they didn't need them. He/she said but my fiance doesn't make enough. Embassy person said, "It's fine."

London doesn't even require an I-134. A sponsor can write their own if they include all the necessary verbiage. And if the beneficiary has enough money they can sponsor themselves without a US sponsor. so they aren't overly strict.

K-1 Fiance(e) Visa Process & ProceduresWho to Call to delay K1 interview?

Due to personal reasons i need to delay out interview until possibly feb 2012 at the earliest.

Can i do this and if so, how?

I have already sent Packet 3 in to London, along with DS-2001 but since then our circumstances have changed where i dont want to have the visa issued before feb next year as i would like to visit Texas under the VWP in october for a couple months.

Ben

i think when you get your packet 4 with the interview date you can call the extortion line get an email code from them and send in an email request, no idea really just just a rough guess

Jock

Jock is correct.

Benj, I thought I had explained that several days ago. Wait for your appointment, then reschedule. It's on the right of this page http://london.usemba.../interview.html

K-1 Fiance(e) Visa Process & ProceduresHow long did it take you to get your interview at the US Embassy in London after your medical?

My fiance is from England! We filed for our k1 back in October, 2010. Needless to say, this process is taking FOREVER for us. We've been very unlucky. But that aside, he had his medical today and it went really well! It did get me to thinking about other people in England having their medical and then going off to the interview. We've not heard back from the Embassy yet.

What was the date of your medical?
What was the date of your interview?

I've heard most people are told whether or not they will be approved or denied at the interview and usually 2 weeks later have their visa in hand. I hope this is true for us!

I suggest you move over to the UK Forum where there's lots of chatter on this subject. Just start reading threads and looking at timelines. No need to start a new thread. Join in with the group.

K-1 Fiance(e) Visa Process & ProceduresMilitary background - will it take longer??

Oooooo this process is testing my patience!!! ;)

You are getting terribly antsy and obsessed. (I've been reading your daily posts.) I'll tell you my trick to get approval when I was like you. Stop checking your case status every hour and trying to figure it out. Force yourself to get off VJ or looking at case status for one week. Magically your approval will come while you're not looking.

"A watched pot never boils" --origin unknown

The exact origin of the phrase is unclear, but the meaning is very clear indeed:

A pot of water is going to boil in exactly the same length of time whether or not you watch it, but if you are so impatient that you need to keep watching in the hope it will boil more quickly it will seem to take forever to come to boiling point.

The phrase, "A watched pot never boils" contains a warning against giving in to impatience; it'll do you no good at all and will only serve to make you and those around you uncomfortable.

Of course, if you occupy yourself with something else while waiting for the pot to boil, it will be boiling away like mad before you know it.

K-1 Fiance(e) Visa Process & ProceduresLondon interview, proof of financial support.?problem?

Thank you all for your responses.

I called the million pound a minute phone number. They were super helpful, well super friendly and gave me an email address and ID code to send an explanation/question to.

Hoping the will just hold them.
I'm preparing duplicates to take with me just in case. Though the phone operator suggested (no guaranteed) that they could hold or send them back to me.

Thank you again.
Cheers Phil

Not sure people are understanding your question by telling you about providing support documents. You have everything needed for approval, but the documents just went to the embassy by mail instead of going in your hand. It's not the first time it's happened and you know they aren't lost in the mail because you wouldn't be given an interview if the package hadn't been received by the embassy. They just prefer you keep hold of your important docs, but it's not a crisis they already have them. Now having the embassy return them back to you is taking a chance that they actually make it back in time via Royal Mail and don't get lost.

What is your fear?? That they won't let you in the door? Again, you are NOT the first person to make this mistake. It's not a crisis.

K-1 Fiance(e) Visa Process & ProceduresLondon interview, proof of financial support.?problem?
Agree with David. The documents will be in your files. You'll get called to a window to turn in documents. Tell them you mistakenly sent them and to look in the file. You don't really need original and duplicate of the Affidavit of Support. Only things you might want back like your birth certificate.

K-1 Fiance(e) Visa Process & ProceduresK-1 visa process

Oh ok, i didnt know that, so i will phone for the medical interview tomorrow and send off the DS-2001 once i have the date for the medical. I thought you could send it off before you have the medical and then book the medical?? I guess i will try and call them first thing tomorrow before i send off the form. Thanks for the tip though :)

It tells you on the embassy instructions http://london.usembassy.gov/iv_15.html Read the whole page and follow all links.

When you have obtained all of the required documents and are prepared for the visa interview, you are required to complete the Notification of Applicant(s) Readiness, Form 2001 and mail it to the Immigrant Visa Unit together with a covering letter containing your email address, if applicable, date of your wedding and date of the medical examination.

London must have 3 things before you will get an interview letter (aka Packet 4)
Your application forms
Your DS-2001 Readiness formwith cover letter
Results of your medical exam (sent by Knightsbridge directly to the embassy)

K-1 Fiance(e) Visa Process & ProceduresContacting the London embassy to see if it's arrived?
It takes 4 days to get there. They may not have opened the mail and logged it so you're kinda wasting money to find out nothing. Start your forms, get your photos taken, order police certificate, get your shots from GP, schedule the medical.....

London's P3 is this webpage http://london.usembassy.gov/iv_15.html

And this http://london.usemba....gov/iv_15.html

And start reading the UK forum
