Apologies for asking lots of questions today. There are a couple of things I am unsure about when applying for the K-1 visa:

1) Do you need to fill out a DS-158? It's on the visajourney example documents, but not on the list of required documents on the London Embassy information webpage for K visa applicants.

2) Do we need to fill out the DS-160? I read somewhere it replaces some forms including the DS-158.

3) For the I-134 Affidavit of Support. My fiancee (petitioner) is a student and so barely meets the poverty line. She has some savings however. Does anyone know just how strict the consular officers are when it comes to supporting evidence? I just don't know what to expect.

Not too strict in London. Bring two proofs of income and a bank statement or whatever shows the savings if she will list her assets.

Income: Employer letter, tax transcript, pay slips are good to choose from.

Is anyone else frustratedly waiting for an interview in London? I've managed to stay quite calm thoughout this process so far but this seriosuly seems to be taking forever. Its been 2 1/2 months since our NoA2 approval and I called the DOS line and my paperwork is still pending and I have not yet got an interview date. I was told that the embassy part was the fast part of the process but it certainly doesn't seem this way. Sorry to rant its just really difficult being in limbo. We cant start really planning anything until we've got the approval so it makes organising a wedding almost impossible!! Please hurry up UK Embassy London!!! Put me out of my misery!!!


Did you verify that each thing was received/recorded by the embassy?
  • DS-230, DS-156, DS-156K, DS-157
  • DS-2001 with cover letter
  • Medical exam results

Did DOS say you were "interview ready"? It's only been a month since you sent in your application. When was your medical exam? The wait for interview clock starts when the last document is in and 3 weeks is not unusual. Sounds like you're very close. Did you give them an anticipated wedding date in the DS-2001 cover letter?

My fiance has his interview in exactly one week!! But, I have a question.

On the website (http://photos.state....ical_letter.pdf) it states to bring your passport, a passport photo, medical questionnaire and your vaccination records, However, on the phone making the appointment the woman told my fiance to make sure to bring his UK police certificate. I didn't see that listed on the website. So, my question is, is there anything else that is not listed that you should bring to the medical with you???


Knightsbridge needs to update their website and London needs to redo that letter. They do confuse people.

I think you've got it all now. That's all except the funds for paying them, unless he needs an explanation of any medical condition from his family doctor. (I pretty much explained that in the document I gave you ages ago.)

Oh yes, we learned the lesson about documentation. My fiance lost her original records, has a big scar on her arm from the chickenpox shot, and they say that is not enough proof.


Normally a big scar on the arm from a shot is the smallpox vaccination which isn't on the list. What shot is she missing? Is it varicella? Did she have the chickenpox disease as a child?

Does he have internet access and a printer in the offices he is closing down? He can download, print, sign and perhaps (?) find a place to mail his signed forms home. You or his mom could put the packet together and his mom could write the check for payment. You can write his letter of intent and email to him. He prints and signs along with the forms.

Don't put the London embassy address.

The important part is saying you intend to marry. The formalities of the letter format are secondary. If you are looking at the VJ sample letter, they are covering two instances of letters with one example.

First instance:
Addressed to the USCIS as part of the i-129F petition process. It will be perfectly fine if your letters just have the name of the government department who handles petitions, without their address. Example:

United States Department of Homeland Security
U.S. Citizenship and Immigration Services


Second instance of a letter of intent:
After the petition is approved and the fiance applies for a visa at the embassy in their country. It's suggested by VJ to write new letters of intent. The second time it would be going to the embassy, hence the embassy address note. In your specific case, London doesn't require or expect new letters of intent so you'll only be doing it for the petition.

When I sent the I-129F, I sent a copy (front and back) of my original birth certificate. I know I'm supposed to be sending the original to my fiance for his interview, but I misplaced it since I made a copy and I can't find it anywhere. At all. I tore my house apart. How important is it that I send the original one? I have another copy that I'm gonna have to send, but will it be a big deal?


Your birth certificate (USC) is not needed at the interview in London. Nor proof of your engagement/relationship. Nor your NOA2. Nor a copy of the I-129F petition.

I know where you're coming from because I was the same way in the beginning when it was all shiny and new dealing with USCIS. A zip-lock bag stapled to a piece of paper will suffice to hold all of them. But if I must admit what I did....
I had some old photo albums with extra pages. They held 3 photos on a page. I slipped the photos all lovely into that and stapled to a piece of computer paper.

Now that it's old hat and I no longer fear USCIS and am bored with them, the photos I sent with Removal of Conditions were cranked out of the color printer on plain paper, several to a page. I wrote below the pic who/where. I don't think it's worth purchasing something. They didn't give me a gold star for photo holders, nor did they send me a big red C-minus marking for the plain paper printouts.

As far as evidence. Photos are nice but your main objective needs to be showing real documentation that you met in person in the last two years. Thus passport stamps, boarding passes, dated receipts during the two years are best. Love notes and phone call proof are just fluff, so don't overload with that so they can't find the harder evidence of meeting in person, which is the requirement.

Hey everyone! Thanks so much for all of the helpful advice! I've talked to my fiance and my mom and we've decided to push the big wedding back until the end of March. That should be enough time, right?? Once he has his visa, he will come over and we'll go to the courthouse to get married so he can start filing all of his paperwork for AOS and to work and then we'll have the big wedding end of March. How does that sound?? Is it all legal and legit? We want to make sure we don't cut any corners and we dot every "I" and cross every "T".


Just check with your officiant as to how he feels about the big wedding when you are already married. Some priests, for example, will not do a wedding mass if the couple is not really getting legally married at that ceremony. Make sure everybody is on the same page as far as the ceremony will go. A spring wedding will be lovely and a wise decision.

We have already planned the entire wedding and sent out the invites. We were so careful before starting this process, talking to friends who had done it before or who were currently going through it, not to mention talking to USCIS beforehand and we were always told the same thing. It will be within 5 months. I even asked USCIS if I could start planning the wedding for 6 months out of receiving the paperwork and they said yes. Stupid USCIS!!!! If we don't get the K 1 in time, we can still get married (he'll come visit under the VWP) and then he'll fly back to Scotland and we file the I-130. USCIS also told me that he can stay AND file for his AOS while it's all processing but I highly doubt that since we haven't been getting the most reliable info from USCIS... which is stupuid b/c they're, well, USCIS!!!



I wonder if USCIS was giving their robotic answer about when the petition would be approved. USCIS are done at that point and don't necessarily know anything about the embassy in London. It is the Dept of State that takes over from petition approval. The visa application doesn't start until London (under Dept of State umbrella) receives your file from NVC and you apply for the visa. There's a lot of waiting around for London to log your case, log your visa application forms as received,wait for your medical results, and then issue your interview which is typically a month from when you get the letter.

If you looked at those graphs I posted earlier, you can see how the times to each step change over a year. What happened to friends before may not hold true for today. We had a visa in 4.5 months start to finish, but that's nothing a person could count on today. I even thought 50 days to approval at VSC was crazy long because the month before us was getting approved in 14-21 days. The month after us took about 85 days and 100+ the next month. It changes quickly sometimes and there is no perfect prediction.

And don't get mislead by people not going through London about calling to make your own appointment. That doesn't happen. You wait for them to assign it. Each embassy is very different.

I think the 5 months you're quoting is to get the petition approved. Then you've got to get through National Visa Center (NVC) and on to London where the beneficiary applies for the K1 visa. That can easily eat up 3 months more time.

Here's some current times based on VJ user timelines. Add it up, but remember those graphs trending up could be even higher when you get there. You can see the times go up and down and there's no prediction of where they will be 3 months from now.

I would call the embassy helpline and ask for the email code so you can write to a person who can give you answers. The person on the phone is not the one to get the final answer from. You will have to ask them what steps you need to take to get you petition extended and ask for a new interview. Be sure and state you indeed want the K1 visa and intend to marry {fiance name} within 90 days of entering the US.

OK thanks guys! I called the embassy to pay for the visa fee, turns out they dont take my card and i dont have another one to pay with so i asked them if i could pay with cash on the day. The guy went and spoke to his boss and said i could do this. I double checked that i heard that right and he said it would be fine. Just thought i would update you's on the issue with that and all seems to be ok now. Bring on the interview!!


Thanks for that info. I suspected they would still take payment on the day. Other visas are still paying at the embassy. But you have confirmed it and that's good info the help the next person. Currently people are thinking they won't be given an interview or let in the door without paying first and I didn't think that was the case.

Pay in advance. London has gone to this for a number of months now but their instructions and webpages are littered with the old information. Your USC fiance can pay (costs $16 for them to answer calls from the US). Or you Mum can pay if she has a credit card. Just make sure your case number and names are given so the payment is recorded to your file. People have used their bosses , parents, or fiance to pay London before.

I will probably choose the overnight mailing so they'll get it right away, so then I will use the Lewisville address correct? I want to have overnight, and be able to track it and see a signature as well.

Express Mail is the name for the overnight version and that is listed as Lewisville. That's going to cost you around $20 over $5-6 for 2-day Priority Mail with a tracking number.


I want to double check and I can send photocopies of all my boarding passes/hotel bill/credit card and bank statements. I have highlited on the copies my name, the dates and the places that were where Daniel is from that say when it was used. :)

Everything is photocopies except your signed forms and letters of intent.

Daniel needs none of that for London. Just keep your originals. He doesn't need a copy of the packet unless you just want him to see it. It won't be asked for at London. The only thing he will need from you for his interview is an I-134 Affidavit of Support and two proofs of your income. You could order a copy of your 2010 tax transcript now because that won't change by interview time. It's free and can be ordered by phone or online at www.irs.gov. You can get 3 years at a time, so might as well order 2008, 2009, 2010 even though they will only look at 2010.

ah, see I was going to put proof of ongoing relationship as well in there, i have pictures of us together, and i think he did take money out once while he was here, will have to ask if he can go back to feb and get that from his bank. and he may have some from NYC and I can get something from that time period as well like the hotel bill that i had to pay for with my card. maybe it'll be easier to show passport stamps as well. . . i'll make copies of my passport pages then to show I was there and get his for the time he was in NYC and here in Feb in my state. The check: Paperclip it to the very top page (cover letter). Do make a copy of the entire packet including the check. Then when you start second guessing yourself, you can look at what you sent.

Mailing: I suggest US post office Priority Mail with the additional service Delivery Confirmation. You get a tracking number that shows when it was delivered. The light cardboard Priority Mail envelope is good to use. I put mine in an old file folder with a big rubber band around the outside. That was to sorta squash the pages together making it easier to insert in the mailer. And I thought it might help keep the check from popping off when they pulled it out. They discard whatever you send it in to make their own file, so don't get fancy with a notebook or something.

Evidence of relationship: If you want something of that nature in your file, send it now. The embassy in London will NOT ask for or look at anything like that at his interview. It's a London thing and I'm positive about it. Send some photos together and maybe a 1-2 page sampling of Skype. Just use a light yellow highlighter to point out what you want them to see. I highlighted all over my stuff (on 3 submissions now to USCIS) and personally think it helps them zero in on what you're proving like dates and places. Maybe you've got a phone bill, e-card, or something you want included. Just don't send 40 pages of that kind of stuff because it's meeting in person they are really trying to see. Once you get your head around the concept of being in the same place on the same date, you may begin to discover other things. We discovered we both had credit card bills showing purchases in Harrods on the same date, so I highlighted those lines on each bill so they wouldn't have to wade through the rest of the charges having nothing to do with us meeting.

The requirement is having met in person in the last two years. It's not how many times you call each other. Work on things that show you in his town/country or him in yours. He had some credit card bills showing purchases in my town and vice versa for me. That was dated evidence of being in the same town where the other lived. Yes use passport stamps, boarding passes, receipts (credit card or ATM...anything showing meeting. The Skype isn't important if you've got the other. Photocopies of everything is fine.

Sorry I didn't see your further question yesterday. Maybe your confusion is over terms--
Forms= DS-xxxx (mail)
Documents= birth certificate, police cert, divorce decree, proofs of income, etc. (take to interview)

I think the London embassy just doesn't want to be responsible for your original documents or have them get lost in the mail. Nobody evaluates them until you are sitting with the interviewer so they aren't needed ahead of time. They have you bring to the interview and ask you to bring photocopies as well. That way they can look at the original, file the photocopy, and hand you back your originals.

I think your chances are good that your documents are in the file along with you forms. You're not the first to have misunderstood. And one of the DS forms says to attach documents which is a commonly asked question---"The form says send docs and London says don't. What do I do?" The answer is follow how you embassy wants to collect things because they all do it differently.

The first time you are called to a window at the embassy they collect your documents and photocopies. One lady tends to be abrupt or seem in a bad mood. She'll ask for your passport, birth certificate, I-134/proof of income, etc. That's when you politely say "I made a mistake and sent them with my application forms. Will you look through my file for them?" Don't worry about her or her mood. She's a paper organizer and will not interview you or decide if your visa gets approved.

If you have time to re-gather all the documents, then sure for "just in case", but they are probably(99%) in the file.

They tell you on the website not to send any documents to the embassy. Bring them to to interview. Hopefully they will have your documents and proofs filed in your folder. Yes, the I-134 is the correct affidavit of support for a K1 visa. When the document lady looks all frustrated that you didn't bring your required docs, tell her to look through your file for them.

Another issue is you will need a chest x-ray during the medical for the K1. Some people don't like the idea of having an x-ray while pregnant. If you don't have the x-ray you'll need to have it done before you'll get the visa which means waiting until you've given birth.


The Technical Instructions to Panel Physicians addresses the screening for TB.

•Use lead shielding for women of childbearing age.Pregnant women who are asymptomatic* may request that no chest radiograph be taken.
Note this request on medical report form and advise applicant to obtain skin test after arrival in U.S.


If your doctor notes you have no history or symptoms, the testing for TB likely can be waived because TB isn't widespread in the UK.


About shots--

General contraindications for the administration of a vaccine include:

•Pregnancy as a contraindication for receiving live attenuated vaccines for measles, mumps, and rubella, oral poliovirus, varicella, and intranasal influenza


The following conditions are not contraindications for the administration of a vaccine:

Also find out if pre-existing conditions are covered if you can get on the insurance. Even on insurance, it isn't free. You might want to plan on giving birth in the UK where you will have family to help you out at first. It could easily be 3 months after your NOA2 before you get the visa. You will be cutting it so close even if it all went perfectly.

So I have received our NOA2 through the mail and everything, and read a lot on VJ about what to do next, but still just curious about what really happens next. Can someone explain step by step what I should be doing right now, what my fiance should be doing right now, etc? Thanks!


Tell him to go get shots at NHS hopefully free. Start immediately. MMR (2 shots, 4 weeks apart); Tdap or Td. And hopefully he's had chickenpox to get out of the varicella shot. They will take his word for it.

Order police certificate ASAP. Needed before medical exam.

London specific answer:

You pay for the visa in advance by credit card over the phone to the embassy. $350 US dollars (which will be converted to GBP by his credit card company based on the exchange rate.)

The medical is a separate fee paid to the Knightsbridge doctors on the day of the appointment. 210 GBP.

I don't disagree with what is posted on the DOS website and I know that some consulates only look that the sponsors income is 1X the poverty guideline. The I-134 is only used to determine visa eligibility isn't it? Doesn't it expire when the K-1 expires on entry? The I-864 used for AOS is the binding document and it requires 1.25X. Is it possible that a petitioner who makes 1.1X poverty gets the visa issued and then can't get AOS?


I agree with everything you said. And yes, I think people get a visa then scramble for help when they get to AOS. I've seen it on here a number of times. Consulates can vary in what they will accept for a visa.

Anh map I had someone disagree with me yesterday when I commented that they needed to be at the 125% level. Is it different between consulates? Do some require 125% and others 100%? A member yesterday said that USCIS told her it was 100% for the I-134 but I tried to explain that for AOS you would have to use I-864 which requires 125% and thats what you would be judged upon at the interview.

Do the same income requirements apply to Form I-134 as apply to Form I-864?

No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when a Form I-864 is needed. Applicants using Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.

I don't know what you're taking. Each person may have slightly different things. A letter from employer is 1 page. A tax transcript is 1-2 pieces of paper. That would get someone by with 3 pieces of paper plus the form I-134.

Nothing to be scared by. It's so anti-climatic to most people. Even if you forgot a document, it's like an RFE--send it in and they issue the visa once they get it.

I have read that you may also need to take copies of the forms that have already been submitted with packet 3 like DS-156 DS 230 etc (I don't remember them all off the top of my head.) Is this true because it doesn't say on the list iv-19 ??

It is not a requirement. People take them just to have a spare in case they happened to be missing from the file. It's rare, but it has happened.

Review the list (READ the details) of what to bring. Make sure your birth certificate has what they say it should. Make sure your passport has the length of time remaining before expiration. It's all on the webpage here:

Thanks everyone, I guess being born outside the UK could mean extra checks. Yet I've been in the UK since 1975 and a fully fledged UK citizen.


It's happened pretty often with people born in India or Pakistan going through London to have additional security checks. There is no way to find out how long or exactly what documents they might be waiting on. It's pretty secretive because it's about security and they can't say something like "your name is the same as somebody we are watching."

Go over this list from London and make sure your fiance has everything that applies to him. You'll notice they don't list all that extra stuff. Don't be nervouss about London. People always finish and say it was anti-climatic and they don't know what they were worried about. It's a tense tingly time anticipating it, but soooo easy. You sound well prepared. Now make sure he gets his stuff together. A common screw up--not bringing the long form birth certificate. Must have his parents' name on it. There's a short form commonly used for school in the UK and many have no clue there's another version available. And they don't read the document list details because it plainly says parents names on it.

I know I need to send the I-134, original packet for the I-129f, letter of intent and support of the visa, proof of relationship since filing for the I-129F, etc. Here are my questions:

Only the I-134 and proof of income from you. New letter of intent only if you delayed processing for a l-o-n-g time where they might wonder why you didn't send in your packet 3 for like 6 months or something after they notified him to proceed with his forms.


1) do I have to send my original 2010 tax returns or copies?

The only original tax return is one signed and sent to IRS. So anything else is a copy. It's fine. Sign it.


2) Can I black out everything except for check deposits in my bank account? Feels weird having strangers see what I spend my money on (nothing bad, just weird!)

London will only need 2 proofs of your income if that. If you have a tax return and either pay slips or employer letter you can skip the bank statement and not worry about them looking at it.


3)We haven't seen each other since we filed (end of April). Will not having new pictures of the two of us hurt our case?

Absolutely ZERO proof of continuing relationship is asked for or looked at in London.


I have to send my ORIGINAL birth certificate, right? How long until I get it back?

No, it's not needed. Don't send it.


Don't fall into the "better safe than sorry" trap. Your fiance will be fine with only the I-134 and two proofs of income from you. He will not need all the other things you are planning to send. Positive. Read the reviews. Many mention they took way to much stuff that wasn't needed.
