Generally for the K-1 it does not apply and I answered that. However I have read here many times that the London consulate prefers you answer that she "WILL" support you.

Yes, the co-sponsor fills out the same forms as the sponsor PLUS must attach proof of US citizenship or Permanent residency. The petitoner provided proof of citizenship with the I-129f but the co-sponsor did not.


It's really VJ "lore" that London requires "intend" to be checked. One guy, Graham of 'Graham and Megan' late 2008, had a new officer who told him that and let him tick the blank box. However, I've read UK forum just about daily for almost 4 years now and have never seen another person questioned for not putting "intend". Many still follow the VJ sample form.

Also proof of citizenship is not generally required of a sponsor on the I-134 like it is for spouse visas on the stricter I-864. A person can even self sponsor with no I-134 at all. Or a do-it-yourself affidavit by a sponsor is allowed as long as it contains all the right information as outline on the London website. And often they hand back the unemployed fiance's I-134 and only keep the one that actually qualifies. The want somebody to accept sponsorship, but it doesn't have to be the fiance.

Just sayin' my opinion based on London experience.

Your charge for the petition is to prove you've met in person in the last two years, not how much in love you are. Stick with hard evidence like boarding passes, passport stamps, a credit card or ATM receipt in her town, and maybe a couple of photos.

Then for your interview take nothing to further prove your relationship, or love, or visits, or photos together or an engagement ring. London doesn't EVER look at that. Positive!

It is highly likely that London will approve an I-134 based on pay stubs and employment letter alone if the income is adequate. A tax return is not an absolute requirement in London. They don't ever ask if you owe the government taxes. He will however 100% need his 2010 before you file AOS to get your greencard. Or if you file after April 15, 2012 the 2011 tax return will be required as well as money figures from 2009 and 2010.

No, it's for tourist, student, etc visas. If you read the review I did, they said the line wranglers were telling everyone to make sure they had the DS-160. That's because most of the people in line aren't there for the Immigrant Visa Unit interview like you. You don't need it.

So I'm putting my K-1 packet together, and am sorting through all our emails and skype conversations...let's just say, there's hundreds of pages. They couldn't possibly want all of those pages! So how do I choose what I conversations/emails I send? Or how many? What has everyone else done? Also, when my fiance goes for the interview, he should take all the originals correct? Thanks!


There are basic requirements to have a petition approved
  • one of you is a US citizen (ex, US birth certificate)
  • you are both free to marry (divorce decrees if any)
  • you both intend to marry within 90 days of entry to the US(letters of intent)
  • you have met in person in the last 2 years (ex, boarding passes, passsport stamps, credit card charges in the other's town, photos)

You don't really have to share your love letters, phone logs, chats, engagement ring or facebook updates.

And when your file gets to London, they don't want anything about your relationship or trips or photos at the interview. They don't want a copy of your I-129F petition or the US citizen's birth certificate because that's already in your file. They do not want a copy of your NOA2. It is needed for Adjustment of Status, so don't send it off to the UK where it could get lost in the move. And yes it's okay for him to visit while the petition is in process.

It's the I-134 for a K1 visa. Actually London just wants a sponsor. If your fiance can't do it, then his dad can be the sole sponsor. Later for AOS your husband will have to do an I-864, as well as his dad as a joint sponsor.

Since you said fiance, I'm guessing K1 and the I-134. (You really should do a timeline and populate the "filed for" by you name. Please.)

You are over the 100% of poverty level which is the mark for the I-134. London can be very flexible on the I-134 as it's temporary coverage of sorts. You will be filing for AOS within a few months with a new, stricter affidavit to cover you until you leave the country, die, become a US citizen, or work roughly 10 years. That's the one you need to plan for (125% of poverty level) because what you have probably won't fly for AOS .

But to get the visa, you just have to convince the officer that you will not likely become a public charge. Showing the paystubs with the extra hours will help convince him/her. If her boss can write something like she is contacted for x number of hours/month but averages y number of hours a month, that would help. Proof of her savings will help a little. Somebody interviewed this year who presented a joint sponsor and they gave it back saying "we don't need this". "But my fiance doesn't make enough." "It's fine." Nobody can say for sure unless they could get inside the head of the officer who will conduct the interview. But you will be there to "sell it" to him/her so be charming and make a good pitch to up your chances. In London it's not a cut and dried numbers thing, but subjective and solely up to the officer.

To the other person asking in this thread...I can't speak for other consulates. I've studied London closely for 4 years, but know nothing about your consulate.

What I'm pointing out here is if his crime involves "MORAL TORPITUDE" which for me is a very broad word which could cover a lot of COnvictions... What you can do is to ask a lawyer if your conviction involves moral Torpitude.

London had a case of one of our VJ members 'Advocator' earlier this year with a crime 20ish years old. The interviewing officer said it did fall under CIMT as fraud, but granted the visa. Many with minor crimes on their record have been granted visas in London. At this point, all the OP can do is go to the interview and discuss it. A lawyer could only speculate on a decision as we are doing because the decision is at the consulate's descretion. If by chance it was a denial, then a lawyer could help prepare a waiver, but they would have to be denied first. It was 21 years ago and London has shown many times in the past that one minor crime with no time served is not a reason for refusal.

I'm confused now. I have submitted the I-129F to the USCIS. We received our NOA1 on July 21 and then our NOA2 on December 8. I've gone back over all of the paperwork and I don't see where we've answered a question to the USCIS with regards to the beneficiary's criminal record as of yet. I looked over the actual I-129F form and the G-325A form. Neither of these asks questions about the beneficiary's criminal background. Have I missed something here? And if we have made a "material misrepresentation" how to we correct that?

It's going to be fine. Just take the right documents to the interview so they can give you an approval. Otherwise they will send you away to order them. You haven't made any misrepresentation yet. Here's your next process to get done asap.

Police Certificates for the United Kingdom: If the ACPO states "No Trace" or "No Live Trace" or does not list in full your arrests/convictions/cautions, you will also be required to furnish copies of the court record(s) covering all charges of which you have been convicted, or which are presently pending against you, if relevant. Another way in which to provide this information is in the form of a Subject Access Statement.

Court and Prison Records: Persons who have been convicted of a crime must obtain a certified copy of each court record and any prison record, regardless of the fact that he or she may have subsequently benefited from an amnesty, pardon or other act of clemency.

Court records should include:

•Complete information regarding the circumstance surrounding the crime of which the applicant was convicted; and
•The disposition of the case, including sentence or other penalty or fine imposed

Court and Prison Records for the United Kingdom: Court Records, usually called a "Memorandum of Conviction" (MOC) in Great Britain and "Certificates of Conviction" in Northern Ireland, must be obtained from the clerk of the court(s) in which you were tried.


The subject acess statement is from ACPO and takes longer to receive than the police certificate took. Basically they need official documentation of the charges and results over your version of the story. Get these papers in hand before you send off the Readiness for Interview document (DS-2001).

My employer can't write one up at the location I work at, and the number my boss gave me said they don't support the company I work for, so I'm kind of stuck here. :help: I'm not too sure what to do about it, because I have everything else I need. Any suggestions on what I can do?


Do you have a 2010 tax return (or transcript) and some recent pay stubs? That's enough for London.

When you click the "processing times" tab and it has the little graphs at the side with the days from NOA1- NOA2 for each service centre as of todays date, is this the most accruate? I know it always says 5 months on the list of visas when you search for california service centre. We filed in July so do we take into account the amount of days it said back then or do we keep following it as it changes?


Follow as it changes. If it shows 73 days today, then it means the people being served today applied 73 days ago or around June 1. If you looked at the graph for June 1, it's at around 90 days. It is trending down at the moment, so the June 1 people saw 90 days when they started but as it's trended down, then approvals are coming at 73 days. You don't really know if it's going to keep coming down or head up over 100 days by the time you get there.

You have a prediction in your timeline that will change too as new timeline data is entered by members.

Giving a date can help, in that London do seem to try to accommodate when possible (although not to the extent of letting you totally jump the queue) and conversely if you tell them you are getting married next year then that can cause them to give you a later interview date, lol. But there are no guarantees, and you certainly don't want to plan on anything. :-)

I stated an "unofficial wedding date" on my cover letter with Packet 3 of 26th August. My interview date is 16th September so I guess without proof of anything solid arranged/booked, that it doesnt make much difference.


The problem here may be the timeline says the forms were sent to London 17 days before the wedding date. They can't accomodate you that much if all the slots are filled.

You could put unemployed/student. They may not even take your fiance's form and just go with the Dad's form. What you've gathered is good for the I-864 but you'll find London isn't as particular on the I-134 and may or may not keep all the stuff. The statement about not filing taxes and the sponsors form even with zero income is I-864, but London doesn't even require a tax return if you supply other proof. I sent a ton of financial evidence and they handed back most of it and the interviewer never saw it.

Document window: they just make sure you brought everything and organize the folder for the interview. You sit down and they pass it to the interviewer.

Interview: My theory is they glance at your papers while they call your number to come back. If all looks okay on the support, they don't ever mention the form I-134. They get a few questions from your I-129 in the file to ask like... how did you meet... what does the fiance do (work, school?)..does she have children... Nothing hard. It's a short conversation, no list of questions. You do finger prints, take oath, sign the form with the oath, and they say approved. It's that easy and quick.

If you read reports/reviews of this year's interviews, they have been accepting just one proof of income.(meaning many don't need tax returns + employer letter + pay slips + bank statements) So all the income documentation you are providing for your joint sponsor may not even go in the file. They just look at it briefly but never go over it or discuss it at the interview part. So I mean they don't make a huge deal of requiring massive amounts of documentation and discussion about it.

Order police certificate NOW. Get working on the forms. It could be 3 weeks before London even acknowledges your case arrived. It arrived 4 days after NVC said it went out.

NVC or DOS can tell you the LND case number. NVC is open later hours.

Get shot records from GP. Get MMR and Td (or Tdap) hopefully free before going to medical appointment. Tell medical people you had chickenpox when you go because that excuses you from varicella shot not available in the UK.

Count on 2 months from now if you get on top of things and are very lucky and 3 months if you wait around to hear from London for instructions. Don't book a wedding. Timelines are too variable. I've seen many miss out on their date.

For London pick TWO from the list: (They will likely only need one if the income is sufficient, but take two)

  • 2010 tax transcript
  • 2010 tax return + W2
  • Letter from employer stating job, salary, permanance of job.
  • 3 months or so of most recent pay stubs.
  • Letter from Social Security or a pension fund if retired.
  • Letter from bank or broker if you are going on assets instead of salary. Date account opened and current balance.
  • Anything else that will show you have financial ability to sponsor

K1s don't submit evidence or documents by mail to London. It all goes to the interview, so take as much as you like when the time comes.

LONDON: One tax return. They'll hand the other two back and the interviewer won't even see them. Either pay stubs or letter from employer will be a good extra proof. Many recent interviews have only been asked for one proof. A letter from employer has sufficed as the only proof recently. If your tax return looks good (or the other proofs), they won't even bring up the I-134 for discussion.

Just pick your best, cheapest, most convenient flight. Wherever the plane first lands on US soil will be a POE.

London won't question your relationship. Don't bother with photos, skype logs, love letters, etc. Not discussed or looked at in London. Just show up with the documents from the list (web link previous post), your passport, receipt of paying the visa fee, and your appointment letter.

Here's my list~~~

Advance preparation for the London part of the K1 process
When your NOA2 is near, it’s a good time to start your preparation.

Petitioner:

  • Order your tax transcripts. Only the most recent tax return is required, but you can order three years at a time for free from the IRS. Tax transcripts are summaries of your whole tax return provided free by the IRS. They can't be faked because it's a copy/summary of your whole tax return picture, basically certified by the IRS because it's issued by them. That's why you don't have to include any 1040, Schedules, W2s or 1099s if you send a transcript. They are free from the IRS. Transcripts take the place of sending a complete tax return.
  • If you call 1-800-908-9946 (the transcript line) , there is an automated system for ordering transcripts. You'll have to enter your Social Security number and the numbers of your street address. It will generate an automated request to mail your transcripts.
  • Start filling out the I-134 Affidavit of Support. It will have to be signed and mailed to the UK the slow way. Get familiar with the form. When the NOA2 is received is a good time to finalize it with the supporting documents and get it in the mail.

UK beneficiary:

  • Get some passport photos taken. You will eventually need

    2 US sized for the Embassy
    1 UK sized for the police certificate
    1 either size for the visa medical exam.
    (and for AOS in the US, 6 more US sized photos)

  • Go to your NHS doctor and get the immunizations you will need for Adjustment of Status. You can get a K1 visa without having any shots, but you will need them before AOS. It’s really wise to take care of it before getting to the US. Many NHS doctors will do them for free, but they are not obligated to do so for immigration purposes. If you had theses shots as a child, Tdap/Td must be no longer than 10 years ago or you have to do them again. Get the shots documented by your doctor to take to your visa medical exam. Here’s the shots needed for 19 through 59 years of age:

    Td or Tdap - Maybe not available in the UK, so get DT, DTP or DtaP and it will be accepted for AOS
    MMR (if born in 1957 or later)
    Varicella – Not routinely given in the UK but have seen reference to it being available; a history of having chickenpox excuses you from the shot. They take your word for it at the visa exam.
    Influenza - During flu season only, October 1 through March 31. This was a new recommendation dated November 2010 for all ages over 6 months. Older lists will say flu shots for over age 50. It changed..

  • Order your police certificate. It takes some preparation because you need a passport photo signed off on by somebody officialish who’s known you two years. Here’s the application. Not true. How old is your book?

The only thing a USC provides for the interview in London is the I-134 and two proofs of income. All the rest is documents from the person interviewing.

The Department of State is over all foreign consulate among other functions. Once your petition is approved, your case is no longer with USCIS. It is handed off to the DOS at the National Visa Center (NVC). That's why you get a new case number, a DOS number like LNDxxxxxxx in your case. DOS being the "parent" government office over your visa has access to everything entered into the database in London or elsewhere. So if London logs in your case, issues you an interview, receives your medical results, or prints your visa it will show up at the Dept of State in the US.

You do not need to call them, meaning it's not a required step. It's only for the curious because DOS can't change anything, just report what's been done. NVC will inform the petitioner when they sent the file to the consulate and the DOS case number by mail. London will inform the beneficiary by mail when they are ready for the visa application to be sent to them, as well as the new case number. London will inform the beneficiary by mail when they have assigned an interview date and the courier will inform the beneficiary when the visa has been handed over to them for delivery. But if you just can't stand waiting on the letters, then calling DOS is cheaper than paying the embassy in London to answer the phone.

Please forgive me if these questions have already been asked, but we are in the process of putting together everything for packet 3. I have several questions, so I've been trying to do some research. In the process, I've read numerous posts tonight about what to send and what not to send. Some of the posts I've read seem to contradict, perhaps because answers have come from people who have gone through different embassies. We will be going through the embassy in London. Here are my questions:


This is LONDON specific information. Ignore other consulate procedures.


1. Am I correct in thinking that for packet 3 we ONLY need to send the following forms: DS-230 Part I, DS-156 (in duplicate), DS-156K, DS-157 (in duplicate) and DS-2001?
Correct but the first four get the ball rolling. The DS-2001 is not supposed to go in until all the documents for the interview are IN HAND. So if you don't already have police certificate, I-134, etc don't send DS-2001 until you do. It can go later along with the cover letter they request with it.

2. Does that mean that my fiance will take DS-230 Part II with him to the interview? Never needed for K1, only Part 1

3. When it asks for "proof of engagement to your finace(e)", what exactly are they looking for? Other than writing a letter of intent to marry, I can't think of anything that would PROVE our engagement.
London doesn't want that. They don't want ANY proof of your relationship. No photos, emails, Skype, etc. Nor do they need a letter saying you intend to marry.

4. Besides listing these forms in the cover letter, is there anything else that we need to write in the cover letter? I've seen conflicting posts about indicating the wedding date in the letter, so should we or shouldn't we? Also, can we use this letter to reaffirm our intent to marry, or do we need to write separate letters of intent like the ones we sent with the I-129F (Petition)?
Read London's instructions about the DS-2001 and what they want with that form.(Cover letter) No conflict if you will get the info straight from London. See Step Two on this page http://london.usembassy.gov/iv_15.html

My fiance has already had his medical in London (this past Thursday, August 18), so I'm thinking that the results will be sent to the Embassy soon. I think all that is left to do is put this packet together and get it in the mail. :)
Takes about 4 days for the medical to reach the embassy. Then you may have to wait several weeks to get an appointment letter...like 3-4 in many cases (after everything is in).

The money he has isn't from a job it is from an inheritance. I didn't fill out an I-134 with our petition or his packet 3 we sent his bank statements and a letter from his bank. No worries not cheeky we are here to help eachother. I read some where that he has to be able to prove 125% and mutiply that by three but I've only seen it once and don't know how true it is. So I figured 18,400x3 is 55,200 and he has almost 4 times that when converted into dollars. Thanks for the feedback I guess we will know Tuesday for sure. I know everyone here has either been through it or is currently going through the same thing its just nice to have someone reply and know your not alone. No worries. That amount of cash will do easily. Your math figures are the basic I-864 rules when using assets for AOS and are published. The self-sponsoring for London K1 isn't a printed figure. I've heard of people from years back getting by on less than $10k. But I haven seen any figures given in the last three years. When you said "large amount of funds" I wasn't sure because some people consider $5,000 a large amount. For AOS, get a joint bank account and get enough money transferred into it (into your pot so to speak) so you can qualify on assets.

Hello all I have a specific question about the affidavit of support. I am the USC and I currently cannot support my UK Fiance 125% above the poverty line, I know I could use a co-sponsor, problem is my immediate family doesn't qualify either. However my fiance has a large amount of funds that are readily available. Would USCIS accept that as adequate proof of support?. Please any information on this would help calm my mind alot. This is the only thing we have worried about, his k1 interview is Tuesday and we are both a bit shaken. We know we can provide proof of our relationship and we are legit it would just help to have some information on this paticular area?

Unfortunately for you, London really only cares about the Affidavit of Support. They won't look at proof of or discuss your relationship other than a couple of standard questions like "how did you meet?". Did you send an I-134 and proof of your income? For a K1 visa, it's only 100% of the poverty level. A joint sponsor doesn't have to be a relative. London will also allow the beneficiary to self sponsor if he can take good evidence of his funds. there is no set amount, so I can't advise on what they will accept. Please let us know if he does get approved on his funds and how much if that's not too cheeky to ask. It would be helpful to hear an actual amount that was enough.

You bigger problem will be just around the corner when he adjusts status in the US to get his greencard. That requires another Affidavit of Support (I-864) at the 125% level. If you happen to live in the same house with an immediate relative you can pool your monies/incomes. Or you can try to find a non-relative, but they have to make enough to cover their household plus your husband....the whole sum, not added to yours.

On the London embassy's 156K form it says you need to attach Evidence of Financial Support and Evidence of Engagement but it doesnt give any type of description of what theyre looking for as 'evidence.' Also I thought for a K-1 Fiance visa you didnt have to provide any financial information. Any body have any experience with a fiance from the UK going through this process?

My interview is on the 12th July at the American embassy in London for a K1 visa. I have put together all the relevant paperwork but noticed for the I-134, my Fiancée could only supply me with the last years tax return and the last years W2.

She is a nurse and has quite a highly paid job and we are well above the poverty line required. We also have a letter from her employer for on going employment which states her salary, along with her last 6 months wage slips (I can get more if needs be).

She doesn't have the older one's and won't be able to get them in time for the interview date. Is this going to be a problem at the interview and will they deny my application because of this. Is there anything else that I, or my Fiancée can supply which may be acceptable or are we taking a massive risk as it's 3 years worth and no other exceptions?

Your help is appreciated.


STOP reading these posts from people who have not interviewed at the London embassy. A tax return (or transcript) isn't even a requirement. If you did take 3 years, they would hand back all but 2010 and say "we don't need this." What you have is more than you will even need.

And to clear up the transcript discussion (not because you need one for London) here is the online request form. The transcripts will come in about a week. This online order can't be used if she has moved to a new address since she filed her 2010 tax return because they mail to the last address she had when she filed. If she no linger lives there, call the number they give.

My fiancee has her 2010 tax return transcript but she does not have the actual 1040 form and W-2. my question is, can i only use the 2010 tax return transcript for the I-134? or must i submit her 2010 tax form 1040 and W-2 as well ???

A 2010 tax transcript from the IRS is all the tax documentation you need for London. A 2010 1040, etc would be redundant. Take one other proof like employer letter or paystubs for good measure. You can be approved in London without any tax documentation, but it's a good prrof so use it.

All of those things mentioned in posts above are true of the I-864 when you get to the Adjustment of Status point in the US. Petitioner will fill out a form even if they wrote ZERO income on it.

However LONDON has accepted an I-134 for a K1 visa only from the person who is providing the support, ie the father. I wish I could remember the specific VJ member, but London handed back the "no income" I-134 and said "we don't need this one" and kept the parent's documents. It was somebody I had discussed this with in PMs and they wrote back to tell me how it went, so details may not be in a review. I believe you interpreted London's position correctly above. They will accept anybody who is willing to agree to supply support, including the beneficiary if he has assets/cash. You can always have the petitioner fill out an I-134 and have it in your folder in case they don't like the father's alone. I think they will be okay with what you have.

Not a guy, but it was stated that the USC barely meets the mininmum plus has savings. That means she does NOT fall short on salary and has some savings to show too. I actually didn't say the embassy would approve, but that LONDON is not terribly strict. Approval is subjective and will be up to the officer. They have approved someone this year not even having the minumum and said they didn't want the co-sponsor forms. The beneficiary even said "but she doesn't make enough" and the officer said "it's fine".

Apologies for asking lots of questions today. There are a couple of things I am unsure about when applying for the K-1 visa:

1) Do you need to fill out a DS-158? It's on the visajourney example documents, but not on the list of required documents on the London Embassy information webpage for K visa applicants.

2) Do we need to fill out the DS-160? I read somewhere it replaces some forms including the DS-158.

Not too strict in London. Bring two proofs of income and a bank statement or whatever shows the savings if she will list her assets.

Income: Employer letter, tax transcript, pay slips are good to choose from.
