I just discover this week that the Dept of State has a FREE photo tool to make your own. I'm renewing my passport and it's on their passport page. http://travel.state....toreq_5333.html

You just need to take a photo on a white wall and upload it. Their tool creates a 2x2 jpg photo you can print yourself or take to a photo kiosk or shop and have printed on a 4x6 sheet. Then cut it out. Don't take your photo super close up or the face will be too big to size down with their tool.

It was a little fiddly tricking my printer into printing a 2x2 image in the middle of 4x6 photo paper. It wanted to fill up the whole space with the image.

The AR-11 is really for after he lives in the US and moves.

At this point his address on the I-129F is where London will mail his instructions (formerly called Packet 3). Once London has received his file from NVC, he could call the embassy and hope they get it corrected. But he doesn't really need that letter for anything other than to know London has the file and is ready for him to proceed. The letter gives a webpage to go to for instructions.

To USCIS it doesn't matter why you got divorced or your sleeping arrangements with your fiance. You are either free to marry (K1 fiance visa) or married (CR1 visa).

K1- enter the US and marry there within 90 days. Can't leave and expect to get back in until he has filed for Adjustment of Status and received his Advance Parole Travel document for re-entry or his greencard.

CR1- marry anywhere, apply for visa, enter the US as a greencard holder authorized to work and exit/re-enter US freely.


Everybody is looking for a way to stay together during the fiance process. It's just not that simple.

I use USPS Priority envelopes...the kind that are light cardboard and maybe 9x12 inches. I also put the papers in an old file folder just to squish them together and make it easier to slide into the Priority envelope without crinkling pages. Delivery confirmation is included in the price. I agree it's a waste of money to overnight with FedEx or pay for return receipt.

We've filled out the I-134 but under point 10, my Fiancee (the USC) has put NONE , we've also ticked no for point 11.

Is there anything we can do to sort this out NOW in NOA1 stage? HELP!


It's not needed until the interview in London. Get a new one from your fiance with more current income proofs around the time your NOA2 comes. Take the new one to hand over on interview day. Tick yes to #11.

Are you sure it was your birth certificate? What if you accidentally sent them a photocopy of the back of your shopping list? It's an easy mistake to make because one blank piece of paper looks just like another one. But if you did and they discovered it was a copy of the wrong blank piece of paper they will think you have lied and then they will investigate you to see what other lies you have told. The outcome might be no visa and a lifetime ban.

Is it really worth the risk? :unsure:

Part of the process is being able to follow instructions, it will get you delayed every time if you don't.


I vote for this. If you can't follow simple instruction explicitly spelled out in one line, you will run into delay in your journey.
Every time, you follow your "assumptions" or "thinking" that it would be okay and deviate from the instruction. You will often get into trouble. Don't do that! :dance:


Just gotta say in my defense, I've done okay with following directions so far. If you click my timeline link on the left, you'll see I've got 26 boxes checked off and colored blue...all with no RFEs or asking an opinion from the forum. Sometimes you'll find forms are one-size-fits-all for multi-purposes and have to cover the entire world. Sometimes you have to connect the dots and understand the directions may not fit your situation exactly, but at the same time comprehend what information the USCIS or DOS needs from you to continue with your application. People who feel a photocopy of a blank page gives the USCIS vital information for approving their petition should include it.

p.s. If you don't send the back, how would the USCIS guess that there is nothing written on the back or seal? Would you then attach another sheet containing a statement that there is nothing in the back? :whistle:


My thoughts were that USCIS wasn't particularly interested in the way the birth certificate looks over the information they need, to know the person is a USC. So if they found (for example) name, place of birth, some kind of certification/seal/embossing/signature from the county where it was registered, then they would be satisfied the petitioner was a USC and could check that off the list.

Now I'm wondering how will USCIS know you didn't accidentally get an extra blank paper slipped into the application?? Guess you'd better write on the blank page "I certify this is an exact copy of the back of my birth certificate" and sign it.

For the record, I still vote for one page if the back is blank, but it's up to the person filing to do what they feel is right.

Hey suit yourself then and copy the blank page. If it's a printed seal, some document papers are designed not to photocopy. If it's an embossed seal, try darkening the copy a tad.

Me and my fiance putting together the I-129f. We have her birth certificate ready to photo copy but the I-129f instructions state you need the front and back. Her birth certificate is just 1 page, the front has all the details and the back is just blank. Is she missing something????


Some have writing on the back (like mine). They just want everything. If her data is all on the front then it's fine not to copy a blank page.

On the flip side, I've known London to approve a petition with less than the 125%. The beneficiary presented a joint sponsor's papers--
Officer: We don't need that.
Beneficiary: But my fiance doesn't make enough.
Officer: It's fine.

Lastly, tax returns. I never filed for the year of 2010 as I had made under $3,000 which from I researched, meant it wasn't required for me to file. I'm going to be doing my tax return for 2011 as soon as I get all the documents since it will have been my first full year of working. Do I need to write a reason for why I never filed for 2010 as I had just turned 18 and started working, or would my 2011 taxes be enough? Another thing to consider as well though is I might not get my tax return before his interview. I'm expecting if all goes well the visa will be approved by the beginning of February, since we filed late September. If he got his interview before I received my tax return, what would I do in that case?

Firt off. London does not require a tax return or a reason why not for an I-134. You can prove your current income with a letter from your employer and recent pay stubs. That can get you through the K1 visa, but for AOS you will give amounts from tax returns for 2009, 2010, 2011 or a statement why you were not required to file. You are so borderline that a joint sponsor might be asked for. London has done both ways depending on the officer doing the interview.

Secondly, your timeline predicts a March approval.(That's a petition approval by the way. Your fiance will apply for the visa once the case gets to London.) Even if your petition is approved February 1, the interview in London would likely be April if you were the luckiest, speediest couple around.

You will have time to get your taxes done. Expect your needed tax documents by the first of February. Then sit down and fill in a tax return. Print out a full return like you were going to mail it, sign and date it, then photocopy the whole thing and the W2 from your employer. Done before Valentine's Day!

I've just gone through a few things and her last job was so short lived that there never was a tax return done. So when it comes to AOS, she is ONLY going to have the 2011 Tax Return to offer them. Is this going to be a problem? As I've seen ont he forms it likes the last 3 years tax returns

Not sure how to respond because I'm not sure what you're saying/asking.

2011 tax returns are what we're just now getting ready to fill out. US tax year ends Dec 31 then we wait on employers to send out W2s and financial institutions to send out 1099s for example. It's usually early February before I get all my things needed to finish the return. It is due Apr. 15. If her last short-lived job was in the year 2011, it will be part of her upcoming 2011 return even if she only earned $10. Every penny received in 2011 gets dumped into the "income" pot. By the time you interview she will probably have her 2011 taxes done. One tax return is fine for London. They don't actually require tax return if you have other solid proof of current income.

If she had no income except that short job in calendar year 2010, then she may not have been required to file. For AOS, you will be required to send in the latest tax return (or transcript) which will be her 2011 return. The instructions say you can optionally send in 3 returns if it will help your case. I don't see how a really low return from a previous year would help. BUT the AOS form asks you to list the amounts from three years. If she was not required to file because of zero or low income in 2009 and 2010, the instructions say she must write a statement why she didn't file. It would be something like

I did not file an income tax return in 2010 because I earned $357.29 in 2010 which was below the filing requirement for a single taxpayer. I swear under penalty of perjury that this statement is true.

They want specific amounts earned and the oath in there.

I assume based on your comment the I-134 is the USC one, Would a notarised letter from her employer stating she is full time, and earns XXX salary for her position and her start date be sufficient for one of the pieces of evidence?

As for the second piece, she receives her payslips via electronic means, so I'm wondering if it might be better to ask for a notarised copy of her bank statements for two months to show salary being paid in.

There's one I-134 from her (USC sponsor) not you. The list was confusing because I said it was all your documents...but the form I-134 is hers. Letter from employer as you stated above is good for London. Nothing has to be notarized (except if somebody is taking a kid out of the UK). How about a tax return? Probably 2011 return will be done by your interview. That's two proofs and enough for London. With good income, you don't have to prove it four times.

You'll get a letter from London saying they've received your file from NVC and to get your instructions and forms from their website. Your financials don't matter as the UK citizen, unless you have a lot of cash assets and want to sponsor yourself.

The link to the documents to gather for the interview is suddenly not working lately but here's the list. Bring what applies to you to the interview. These are your documents, not the USC's--

  • Birth Certificate (version with parent's names on it)
  • Adoption Certificate
  • Passport (with at least 8 months of validity left beyond visa date)
  • Termination of Prior Marriages
  • Military Records
  • Affidavit of Support (I-134 and two good proofs of income)
  • Police Certificates
  • Court and Prison Records
  • Photographs (2 passport style)
  • Translations (of anything not in English)

And go get your shots right now so that's done and dusted well before your medical exam. They aren't needed for the visa, but they're likely free from NHS and will save you a huge hassle when you apply for adjustment of status.

AOS shots:


?MMR (Get a second one 4 weeks after the first since you have plenty of time)

?Td or Tdap or DT or DTP or DtaP (One no longer than 10 years ago, ie.have a booster)

?Varicella (Not available in the UK but excused if you had chickenpox. They take your word for it.)

?Influenza **(Only needed if medical exam is Oct 1- March 31)

Me being me, I like to know whats coming up and what I need to prepare for, basically so I can fill out forms and gather information on my terms, but I'm a little dubious about gathering information BEFORE a NOA2 has even arrived, especially as we are months away.

Do the shots now, but skip the flu shot listed since the season will be over. Maybe the doctor could sign your photos for the police certificate at the same time if you don't have somebody else in mind. Have everything ready and you can post your forms back to London as soon as you hear from them that they have your case. That's better than wasting a month gathering things you could be doing in advance. They won't send a checklist or "packet". It's all on their website and you only get a letter saying use the website.

London does NOT require a tax return with the I-134 or a reason why you don't have one. Two good proofs of current income will do it. So when you get NOA2, gather your most recent three pay stubs and a letter from your employer and sign/date your I-134. It will be fresh information and still have time to get to the UK via snail mail before the interview.
@LorRenee: No need for past employment pay stubs or bank accounts for your London interview.

For the AOS I-864, tax information from 3 returns is asked for on the form, but only one actual return is required to be sent in. See my answer about what to include with the I-864 if you didn't have enough income to file all three years.

We've just put our NOA1 in, however I'm currently living at home (with my parents) and I'm planning on moving into my own apartment a month before he is due to enter the country once we are approved. It appears we will both have to change our addresses. Mine for the permanent address and his being the address he will be moving to (correct?).

If he puts down my current permanent address for where he "intends" to live, but resides in the apartment, will that be an issue?

We're both trying to figure out which way would be the most hassle free way, and what's involved in a change of address in general.

I don't think it will be a problem. You'll still be living with your parents if you get an RFE on the petition, when your petition approval notice arrives in the mail, as well as when NVC sends you mail that the petition has been sent to London. That's about all you'll receive.

At that point it will still be several months before he gets a visa in London. He will just use your parent's address on his paperwork. If by chance you move between then an his interview, he could inform them at the interview that you got an apartment last week and the new address. Nothing is mailed to him at the address he puts so he won't be missing something important.

Then comes his entry to the US. He lists on the I-94 where he will be staying, so another opportunity to give the latest address.

Then he files for Adjustment of Status. It's like starting over so he puts the address where he is living at that time. You don't have to worry that his first K1 papers had you parents' address. Anytime you move after that point, you both inform the USCIS within 10 days. He fills out form AR-11 and you (and any joint sponsor) fills out I-865. Sponsors on the Affidavit of Support (I-864) are required to keep their address current with USCIS.

Well I was looking at the affidavit of support poverty line, and it says you have to make an income of at least 18,000 with a 2 person household? I will be making that THIS year only, but the problem is I did not make that last year. Is there any way I can just bring in a bank statement and/or pay stubs for a certain amount of time from this year rather than bring in my tax returns from the previous years? or will they require that I bring in my W-2's and my tax returns even if I didn't make as much those years as I am now?


For the K1 interview in London, they don't even require a tax return. You can prove current income with pay stubs. A letter from your employer is always a good proof too. It's all about current income, not what you made in previous years.

There is no problem at all being Lithuanian and interviewing in London. People who work or study in the UK do it all the time. Everybody interviews at the Embassy closest to where they reside, no matter their country of birth.

Your age is not going to be a factor other than do you make enough income to prove you can support him? Otherwise line up a sponsor who does and will fill out the I-134 and later the I-864 for him. They aren't detailed enough to ask what he said to the immigration guys when he visited or worry about how old you were when you met him. Some people fret that they were with their fiance while they were still married. USCIS doesn't evaluate morals...only that you are free to marry and have met in person. London especially does not care at all about proving you relationship.

I know nothing about military, but find out numbers for the pension department and get a statement of pension details. Mom could even have something in his paperwork from when he left the military. Doesn't have to be recent if it states a dollar amount and it continues for life. Surely the embassy will know that much anyway....that it's payment forever.

But if his most recent tax return shows over the limit, then that's likely enough. I had a folder full of financial stuff and they weren't interested in anything but the first thing that showed enough and handed the rest back.

They might even approve Jenni on an I-134 in London if she's that close. Do you have any money in the bank to show that can contribute to your keep?? I know you want to cover the bases with the FIL and you'll need him for AOS because it's stricter, so might as well get his stuff now.

We have received our etter from the London embassy directing us to a link online and telling my finance to fill out the first 4 initial forms. Is this letter in place of the physical package 3 that I have heard about regularly during the process. I find this part of the process to be more difficult than actually preparing the petition was!! Frustrated, but we are almost to the end...I think!!

There's 3 basic steps.
  • Fill out DS-156, DS-156K, DS-157, DS-230 Part 1 (page one and 2 only). Mail those to the embassy. Forms only, no evidence, documents, passport photos.
  • Order your police certificate, get your shots, make a medical appointment. Take shot record and police certificate to medical.
  • Gather all documents for the interview and get them in hand. list http://london.usemba...documents.html. Then notify Embassy that you've done everything and are ready to interview by sending in the form DS-2001.

From the instruction page there are many links on the left about the medical, courier, interview, visa fees, FAQs. Sometimes there will be links from those pages on the right for more information. Read ALL of the links. Ask questions in the UK forum because each embassy is very different. You want London answers, not Manila, Juarez, or Mumbai.

Based on my situation do you think that I would have any problems getting the K-1 visa? I have never overstayed, always returned within the 90 day limit and definitely not broken any immigration laws so what do you guys think?

Also I would like to ask if I do get the K-1 visa will they let me in at POE based on my immigration history? I would hate to do all of that waiting and spend all of that money just to be refused by a POE officer.

BF should visit you. Trying for a visitor visa is a waste of time and money. It's likely to be denied because you have a history apparently, of spending too much time in the US. Can you prove very strong ties to the UK with a full time job, lease in your name or home ownership, and a nice bank balance? If denied, then you would have to answer the question "Have you ever been denied a visa?" with "yes" on your K1 application. You said you were denied for abusing VWP. Now you have to pay the price. Try ESTA again in 6 months and see if it goes through after some time out of the US.

A solid tax return is an easy way to prove income, but in your case doesn't prove your current income. For London, you don't even need a tax return at all. Not required. Just prove your income with an employer letter and recent pay stubs and you will be fine.

Later for AOS you will do an I-864 and will give info from 3 years of tax returns on the form or a reason why you didn't have to file. You will submit just the latest tax return. Previous two are optional if they will make you look good. Maybe 5 years ago, 3 returns were required, but that was amended to only the latest year for the I-864.

Ok so I-129F now then file K1 and K2s at the same time and everything just gets processed together? Everything seemed so straightforward till we added the kids to this mix LOL. His solicitor wanted us to get going on this before his next court date for his ex's visitation hearing(which is mid February) so we kind of got tossed into it a bit sooner than planned. We're VERY excited because we've been waiting for the solicitor's approval, we're just scrambling to get started now.


At his interview in London they will require documentation that he has sole custody of the children or a notarized type statement signed by their mother that she grants permission for them to leave the UK. Her statement can be witnessed/signed by a solicitor.

Now im super worried.... My fiance sent the pack to the Dallas Lockbox last week Tuesday 31st Jan as per the instructions... but now im seeing on the website that the last process time for Texas of the I-129f was back in 2010 :o Should she have sent it to California? if so, how can she get the pack back asap to resend to Cali ? Thanks for any help...


the Lockbox is a place where contractors open the mail, check the basics are included, deposit the money, prepare the folder, and generate your receipt. It is not the same as Texas Service Center. Your prepared folder will be forwarded to a service center.

You are correct. Getting turned away would not prevent you from getting a K1 visa if that is your concern.


the whole reason i started this thread was to get FIRST HAND experience of someone not mentioning they were going to see their fiance, and if the officer KNEW they filed the K-1 visa, or if they just didn't mention it...

Here's my first hand experience. I asked CBP officers on two occasions at the airport "So what do you have on that computer screen? Do you know I have a K1 petition filed?" the answer was "NO. They have dates of previous entries, overstays. list of bad guys and terrorists."

I seriously doubt they have a journal detailing what you said each time you entered on VWP.

I also had a long conversation with a CBP infomation officer once. He said it's just a subjective decision sometimes whether they think a person is a risk of not leaving the US. His example was of creepy looking people who don't look like they can buy a cup of coffee coming for a 90 day holiday. How are they affording a long holiday to the US? They have no job to report, not in school, have no money with them or credit card. That person would be someone questioned because there's nothing to indicate he won't just remain in the US illegally. Other persons are suspicious because they bring in their luggage what appears to be everything they own and not appropriate packing for a two week holiday.

The more often you come and the longer your trips (two months instead of two weeks) the more you might raise suspicion. It's always a decision made by the officer on duty that day.

i really don't feel like straight out announcing i am going to see my fiance, since i mentioned before i have never said that before. so i think my best bet would be to just say friends again...somehow i think i will have a way bigger chance than saying yes i've been coming here for 2 years to visit my friends now i am coming to see my fiance.

I don't think they record your answers but even if they did, you may over-thinking this. In two years of visits to friends, isn't it possible you might fall in love and that former friend becomes your girlfriend or even fiance? Friend, girlfriend, fiance could be a logical progression over years of visits.

The letter of intent needed for the K1 part of visa process... Is this just from the US citizen? and how different is it from the original?

If you don't mess around and let your NOA2 expire (4 months) before you start sending things to London, they don't ask for one. It's not in their list of things to bring for the interview.

You will get a letter from London soon saying they have your file and instructions (on the web) to submit the DS forms, etc. Okay, so say you don't do that until June/July. Then you might need something from your fiance to let them know he is still interested and didn't abandon plans because so much time passed without a response from you. Otherwise you won't need one.

But if you want a letter, it will be just like the first one basically. You, the beneficiary, don't need one. If you read the oath at the end of the DS-156K, you'll see that you will sign and swear in front of the officer that you are free to marry and intend to marry within 90 days. A letter from you stating the same thing would be redundant. The officer will sign that he witnessed you signing.

okay so my US fiance's father is providing the affidavit of support as my fiance is a student. Does my fiance still need to fill in the form even though he doesnt have a job or pay stubs? His father will be a full sponsor.

The answers you have gotten would be true for an I-864 Affidavit of Support. But for the I-134 London, the beneficiary just needs 'a sponsor' to convince the officer "that he or she is not likely at any time to become a public charge." There is no law/rule that says an I-134 from the unemployed fiance would be of any use if there is somebody else doing the sponsor duties. The beneficiary can even self-sponsor in London with no I-134 at all, by showing they have funds of their own.

Meagan-- there are two times you (the US citizen) will provide an Affidavit of Support for your fiance

  • For his interview in London so he will be granted a K1 Fiance Visa. The I-134 is done by you (or another willing sponsor) and the form and proofs of income are mailed to him so he has them to take to the interview. Nobody has to come to London. It's done by mail. If you don't make enough income, then you have to line up somebody who does. If nobody wants to do that because they have never met him, then you have a problem to solve before he will be granted a visa.
  • When he applies for a greencard you do a second Affidavit of Support . That is form I-864 That happens after he arrives with the visa and after you marry. He needs the greencard to stay and live in the US.

i just realized that she didn't ask for form DS-230 part II !! is that normal as well ? are they gonna ask for it with the passport when AP is over?? as i know the CO should help me to fill it in, how is she supposed to help me doing so if i'm not gonna have another interview? did it happen to anyone before? and as i've seen on VJ that most people who got AP, they have been told that they are approved on the interview day, why wasn't i told so? sorry for all the questions but they're all hanging around our heads.


DS-230 Part 2 is never, ever needed from a K1 visa applicant. It's for other visas like Spouse CR1/IR1. You would only do Part 1 which is page 1-2 of the four pages. If you had been missing any paperwork, they would have listed what else they needed so you could get it in.

Why weren't you told approved? Maybe the lady was more efficient and knew it's not over 'til it's over since you aren't actually approved yet. Maybe Lebanon is a big red flag of a country always checked through AP. Maybe the others who were told approved were later flagged for additional screening by a supervisor. Nobody knows because every case is different. We on VJ haven't read every word in your files, so we certainly can't guess beyond you were born in Lebanon because non-UK born are often given Additional Processing.

I don't have any experience with that. I've followed London over 3 years and have seen many not born in the UK have AP. Many are not even told that at the interview. They hear "you're approved" then don't get the passport/visa back, so find out their processing is taking longer. I have seen people from Pakistan, India, Australia. For a while (2009) it seemed like anybody not born in the UK got delayed. This year I've seen a south American and Nigerian have no delay so it is not absolutely everybody. I guess if your parent's name was exactly that of a suspected terrorist, they might investigate further to make sure your family member is not the one they are watching. It's all speculation because the US govt won't divulge their security details. They wouldn't tell you "we have an undercover operation watching a man named Johnny Jonas so since that's your father's name...." That would be compromising their investigation. It's all a bit secretive, so they don't give reasons or timelines of when to expect to be finished.

London never asks for evidence of the relationship. Your only problem is being foreign born (not in the UK). They tend to do further security checks called "additional processing." You've done everything correctly. Now you just wait on the security checks. They won't give you any clues about what they are checking or how long it will take. You just have to wait. Here's a list of countries that are often checked:

  • Individuals born in one of the seven countries currently designated as state sponsors of terrorism, Cuba, Iran, Iraq, Libya, North Korea, Sudan, or Syria.
  • Individuals born in one of the “List of 26” countries which the USCIS has not publicized but includes Arab and Muslim countries including: Afghanistan, Algeria, Bahrain, Eritrea, Lebanon, Morocco, North Korea, Oman, Qatar, Somalia, Tunisia, the United Arab Emirates, Yemen, Pakistan, Saudi Arabia, Bangladesh, Egypt, Indonesia, Jordan, and Kuwait among others.

Along with our I-129F packet, we sent a huge packet of evidence that proves we met each other and have a genuine relationship. His interview is a week from Tuesday at the US embassy in London, and he was wondering whether or not he needs to being the same stuff we already submitted in the petition. We haven't visited each other since we sent it, so we have no new evidence besides chat logs. We talk on webcam everyday so we never use phone calls, and sadly there is no proof of that. So should he bring the original proof we submitted, or will they already have access to it during his interview?

Any other suggestions on what else to bring?

Also! Will he need to show his bank information, or will most of it be about MY bank information and not his?

London will not ask you for one speck of evidence that you have met, are engaged, are on Skype all the time, etc. Nothing.

You only need to prove your current income. You can do that with a tax return, letter from employer, pay stubs. Bank statements work if they show regular direct deposit of pay checks for example. If your income was quite low, and he had a big stash of cash, then his bank statements might help convince the officer he won't become a public charge. If your income is enough, then he doesn't need to show anything.

So we received our NAO2 this week and will start to look towards the next step, but i have a quick question about the I-134 support form. I live in England and my fiancee in New York, she is a student there, is she eligible to complete the form if she is not earning an income, but instead spending thousands on school, or will i need to find another sponsor, someone from her family for example?

I wrote you a letter including the notary statement they asked for. Just type all that and let the notary fill in the bottom after you sign in front of him.

Shots:

  • MMR
  • Tdap (or Td or DTP)
  • Varicella shot. Tell Knightsbridge he had chickenpox to excuse the jab. They take your word.
  • Flu (because it's flu season) He can get that anywhere if the NHS won't do it..ASDA, grocery store
MMR is a multi-shot thing. But if he gets to Knightsbridge before his 4 weeks wait between shots has passed, they should mark it "insufficient time interval". Make sure he goes to Knightsbridge less than 4 weeks after his MMR jab. Otherwise he needs 2 jabs. USCIS will excuse any further jabs for that insufficient time interval reason. The Knightsbridge person will insist he has to get it befor AOS and write all over his form that he needs it. Not true. If he has MMR, Tdap/Td, and VH marked by Varicella he will get through AOS just fine. Even the flu shot will be excused because it won't still be flu season (ends Mar 31) by the time you do AOS.
