We mailed our petition on March 28. Received NOA1 on April 09. No touches, no RFE. :help:
Would it do any good at all for me to call the Customer Service center about my case? Or will they just tell me it's 'pending' and send me on my way?

At the least- if they sent a RFE we would have gotten it long before now, right? Right?! :wacko:

Yesterday, I contacted my congressman's office to status their request to expedite my Fiancée VISA. At that point in the morning they had not received a response and it was now approach 7 or 8 days after they had sent the request and was approach a month and half since I sent my request forward. Keep in mind I mailed it, then faxed it, called about and then was told they did not have it, faxed it again 3 more additional times. Every single response I received when I called in the check if they had received it resulted in them telling me, no we do not have it, we did not get it and there is no need for me to cal. Say what? It had then a month sent I sent it in the mail, certified registered mail and overnight, it had been weeks sent I faxed it and at the request of the USCIS faxed it an additional 3 times on different occasions. Mind blowing.

Well as we all know timing seems to be all so crucial these days. So, knowing this show would air tonight, I sent my congressman an email explaining to them I would be joining and would like their help to explain how this could happen, why could not a life request get some answer and that I had, had enough. Keep in mind my Congressman's office is trying to do what they can do to help. I believe they actually understand and bent over back wards to help me. I will shed light on that in a min. Back to the sequence of events yesterday, following a call I made to the back to reality program station in Florida to make sure I knew what they program was about and to speak with someone about what was currently happening with my situation, I was requested by my Congressman's office to forward the letter and doctor's note I sent to the USCIS so they could make further inquiries of the USCIS. Two hours later, I got a call from the USCIS in California and here comes the good news and some surprising answers.

During the call from the USCIS in California the official says to me Sir your fiancée VISA has been approved and we are overnighting it to the NVC. I am of course thrilled. He continues to say, he wants to say he is sorry for all the delays in my case and the problems that have happened. I let him continue to talk. He explains that until today when my Congressman's office sent my letter and the doctor's note the California Service Center they had not received anything. I said your kidding, I not only mailed it but faxed it to them 3 different times. He went on and told me that things were messy over there and there have been a flood of applications. I stopped him in hos tracks and said you knew it was coming, the USCIS can shift surplus efforts to other offices, no excuses will justify what people are going through as a result of bad judgment and actions which represent negligence and conduct unbecoming of their administration. He then agreed and I asked him to please explain to me, if he could, why are they taking so long to receive mail, to process applications and to inform citizens within reason the status for the petition. The 911 thing came up and I told him, 911 is understood but not acceptable for an answer for everything nor is it acceptable for poor processing, poor conduct, negligence in creating an action plan to manage the bulk of applications. If I told my boss, well I just do not know what to do, I would be fired. They need a sense of urgency I told him and one that goes to what citizens expect for their lives. We expect decency, common sense and the right to pursue happiness with our loved ones as anyone would in the world. I then asked him is their anything going on to change this problem. Answer, I do not know. There you go, no urgency, no hard standards to meet, no need to commit. Seems logical , I guess. NOT. I then went on to ask if they would be able to pass on the expedite notice to the file. Guess what, no system or process to do that. He informed me my Congressman's office was instrumental in getting my application processed and they likely could help. However, he thought my idea was a good one. Seems someone need to re-engineer some processing and put some technology and redistribute the workload rather than just waiting for the bubble to burst. What the heck.

In the end, my application is now on it's way to the NVC, but I still need to get it to Bangkok quickly and I pray about that. My mothers cancer is in her brain now. I called her to let her know the news and her response to me was how much longer will it take I am worried I will not be here. I told her I am working it and I am sorry Mom it seems our Government sometimes just does not work the way we would expect it to. So, I will ask my Congressman's office for help again and pray again. I do believe without my Congressman's offices help, the upcoming show, the people on the forum like Suzie, I would not of gotten this far. Thank God for those people. I pray for all of us.


My prayers are with your family. When I my husband and I first became engaged, my father was bedridden in the hospital with cancer and we did not believe that he was going to be able to make it. Luckily, we found doctors who would try to help him and he survived after surgery and is now cancer free. His left leg is partially paralyzed from nerve damage from the surgery but there was nothing more wonderful than knowing my father would see me married. I hope that you two can have that as well, something like that shouldn't be taken from you by disease, much less by an incompetant government. rose.gif

I think it's very important to tell people about how poorly intending immigrants and their USC fiances/spouses are treated by USCIS' "Customer Service" centers.

When calling in to check on my husbands case during the K-1 process- the woman told me something totally different from what I'd been told just a few days before, and when I asked her why she was telling me something different- she actually started yelling at me like you'd expect a toddler to, saying, "You are a liar! Lying! Liar! Liar! That's a lie!"

I think a lot of the officers treat us badly because they have a cozy government job, with no real requirement to strive for good quality services. It doesn't help that the ones treating us this way, probably get a power trip over the fact that many of us are afraid to complain or 'ask for a supervisor' like we would for ANY other service in this country simply because we don't want to jeopardize our efforts to get our loved ones back to us as soon as possible.

I submitted an entire copy of my passport. Copies of the exit and entry stamps on my and my fiance's passport. Receipt's for my engagement ring and our wedding rings. Train ticket receipts. Tickets for some of the places we visted like aquariums, boat rides, tokyo tower, etc. And I also sent around 6 pictures with our name's, date, and location written on the back. As far as the pictures go I tried to include several pictures over the entire time we've been together (ie. Our first picture, one from several months later, all the way to the last picture taken together).

In front of everything I included a kind of cover sheet with a description of everything I sent.

I haven't heard anything back but if I get a RFE I will go insane.

Like they said, you don't need to even present an affidavit of support until the petition gets to the embassy- that gives you at least three months of job hunting in most cases. Plus, I would seriously consider beating that deadline before the filing fees increase. $170 and $400 is a big difference- and if you don't have a permanent job at the moment the $170 might be a lot easier on your wallet if money is tight.

I know this question has been asked time and time again- but after asking myself and searching the forum I am finding different answers! When our fiance has their interview do we need to send them the I-864 (w/ I-864A if we need a co-sponser) or the I-134 (w/ an additional one filled out by a co-sponser if needed)?

I've been told (and seen) a yes (and a no) to both! Could someone please give me a definitive answer?

I. Which form do you need for the interview? I-864 (and I-864A) or I-134?
II. Is either form acceptable at the interview? (unlikely?)
III. Which form needs to be filed when applying for Adjustment of Status?

Also! I do not get paid a salary- I get paid an hourly wage- should I put my hourly wage or put an estimate of how much I make in a year? I haven't been working at my current job for a year. Should I just put how much I made last year- as bleak as it is? (I was only employed for the last two months of the past year).

Hopefully the answers will be helpful to more than just me. Thanks!

I think this is a lot of VJers worst nightmare. To be apart and have an illness/accident occur. I'm always worried about this situation (my fiance tells me I'm crazy for it). I truly hope that he has a good recovery and doesn't have a reoccurence of his heart troubles. This process is really stressful, but as long as you stay strong and stay there for eachother- it will pay off in the end.

When dealing with USCIS my policy has been give them more information than you may think is necessary. For the statement I think you should fully explain the situation in DETAIL. 1,2,3,5 sound good to me. Explain the situation fully- leave no holes that could give USCIS to believe you are being dishonest or 'forgetting' to mention something crucial.

If you're honest it'll make life easier on you in the long run anyway.

I made a detailed coversheet and just put it all in that order (no tabs, nothing holding it together). I got approved without any trouble at all so I assume that it wasn't a big no no to do it that way. I was pretty confused about what was acceptable at first- but I'm very sure that this time around (when sending my fiance his papers for the interview) i'll have more organization and seperation.

Go to USCIS's site and change the address yourself (there's an option on the left side bar menu on the main page). How someone could get a law degree when they aren't competent enough to put a correct address on something as important as this is beyond me. :blink:

It was an exaggeration. I'm just annoyed is all. I think it's almost worse when he's visiting me. This last week has been a dream, but a mere snapshot of what our life will be like when he gets here. IF he ever gets here at this rate.


I know the feeling :-/ I think if they actually went more into detail about where everyone is in this whole process, it would ease a lot of tension. Example: currently waiting to be worked, currently running background investigation, etc.

It definitely goes to the NVC first. All visas go through the NVC on their way to embassies. You should call the NVC and check. I'm sure it's in their system now. They can tell you when it arrived and when it went out if it has already.


I just called using the automated. After I entered my receipt number, it stated no record found. I'm waiting to speak with an operator now.

I just got the noa2 in the mail (actually knew I got it on the 31st). Something with it is odd. Everyone is saying it goes to NVC first. There's not even mention of NVC on mine. It says, "The above petition has been approved, and forwarded to the listed consulate." (btw their grammar is incorrect... odd to me on an "official" document")

Anyway, my question... does everyone's say this? Is it just known it goes to the NVC first?

So my Congressman inquired for me and this is the response that they got. (See Below) This is so frustrating!!! It does say that it was assigned to an officer but I am really not sure if that means anything. Wish I had better news.

United States Citizenship and Immigration Services (USCIS) records reflect that the I-129F was received on August 11, 2010 and was recently assigned to an officer on January 21, 2011, and is currently under review.



Please look for action on this case in the next 30 days.


You at least got more action than me. Yours is at least on someone's desk now.

I've emailed 2 congressman and 2 senators and also called one of the senators. No replies... I don't know what else to do. If this was a free thing, then sure I can understand being pushed around. But we all paid the HIGHER fees due to submitting earlier... that means we get pushed around even more.

I have an update. I called USCIS assistance line. Spoke with a drone that was reading my case off the screen. I told her it was outside of processing time. She then read more off the screen. I asked to speak with an immigration officer. She was hesitant but after me being pushy, she sent me through to one. The officer said I should receive a response from the VSC within two weeks, if I do not I should contact them again. They gave me a reference number.

So, maybe something will happen!


About previous post: I agree, instead of refunding they should make the interview process speed up :luv:

So... I propose that USCIS give us a refund for however many days they are over. What was it when we paid... $435? So, $435/150 processing days = days each person pays to wait. I would like the $2.90 back for every day over they are in our processing!

I work for a government office (the helpdesk aspect as well). The people in this government agency actually care! Why can't the USCIS?!

I get to go back and see her before we get the approval. My supervisor gave me the Ok to have a week of unpaid leave off to go to Russia. Her family is excited to have me come out.
I went in the hottest part of the summer now go in the dead of winter to Moscow.

This was great news for her and I. Now just 31 days to see my bride to be again.

My timeline says they will be working on or petition (Based on timeline data, your I129f may be adjudicated between January 17, 2011 and January 25, 2011*.)

Do you all know what I should take papers that she will need of me so I can take to her directly so she is ready for her interview later?
I have to give her a copy of all that I sent in my papers with the I129-F papers? Is this correct? I know I have to give them the I134 form too.

You can put the ticker in by going to the drop down arrow beside your username in the top right.
Click "My Settings" - This should take you to the settings screen.
Click the "Profile" tab.
Click on the left pane "Change Signature."

They're working on those damn Temp. Protective Status visas at the moment since they had a major backlog on them. So...hopefully once they finish or are almost finished doing those, they get back onto the K-1 Petitions.

Looks like they had 112,000 I-821 (TPS) petitions in September, 114,000 in August. Says on their site they have done 84,000 so far in September and 70,000 in August...hopefully they will be caught up enough within a week or so to get back to pumping out I-129Fs because they are behind on those now.

Btw, seems I-821s have a 'Finish/approval goal' of 3 months, which might be why they moved onto them.

I miss being with my fiance :( I wish they really did process FIFO but it's more like it gets passed out and just sits one someones desk. Getting an NOA2 seems like winning the lottery because it's seeming so rare!
