Co-sponsor is required in your case, a letter explaining why you didn't file (because you didn't make enough income if thats the case) and you can also get proof of non filing by filling out a tax transcript request form. NVC says that it takes around 20 days from receipt of the packets in the mail so I wanted to know if people have had their AOS and IV applications entered into the system sooner than what they tell us?

I mailed the AOS and IV off saturday nov. 13 and they received it on Monday nov. 15, I just called NVC and was told that it was still not in the system yet, is it possible that an NVC operator wouldn't have updated info on case status?

Anyways just want to hear some news on this as I'm wanting to keep track of the time it'll take to get entered into the system and begin processing.

I agree with the statement of breathing. I disagree with calling the NVC dumb. These folks may be entangled within a buearacracy but they follow the rules as a robot does to protect their own jobs. Darling, you provided a lot of information in a single email. Compress it without comments and re-post. We are here to help you and we have a weekend to get it straight. It may be necessary to post in the three rfe statements....you did not get an RFE...your application was shutdown so many things went wrong.


I think it is kinda "dumb" for lack of a more proper word and being frustrated because it wastes a lot of time, money and effort on our part as well as theirs, it's not efficient, but thats besides the point a lot of people don't like being entangled in beauracracy myself included, I like everyone else just want to walk out of this in one piece. I took the time to "breathe" as calling NVC made it less confusing as to what they wanted exactly which was just to go ahead and resend the birth certificates to continue processing, so thats what I'll try first. I'm not sure what you mean in your last few sentences if you were talking to me or solteq since your quoted their post.

Okay, step 1: Breathe.

Step 2: If you sent a lot of this stuff already it's possible they are just dumb. I got three checklists from NVC all for stuff they'd already gotten from me. When I responded to them by resending the specific info requested, they opened my closed case, then closed it two weeks later each time.

I would suggest calling them and pointing out the page number (if you numbered your pages) where they can find the requested information.

The irritating part is that you probably can't just email the documents to them.

I think this probably falls under the they are just dumb category, and they expect us to walk on hot coals sometimes I guess. Thanks for the info I'm going to re-send copies of petitioner and co sponsor birth certificates tomarrow morning, wish us luck that it'll be a speedy case close :blush:
I feel a lot better having called them because I thought they wanted more financial evidence but it was just the "supposedly missing" of my birth cerficate as proof of relationship to co-sponsor/petitioner, not as bad as I thought it was thank God. Thanks for your support~

I really don't understand why we got this RFE because I provided the things they asked for and also some of it don't make sense. Here's a copy and paste of the RFE, I'm freaking out a bit so anyone who can help me figure this out please help relieve some stress for us!
Is there some way to get out of this by calling NVC or am I gonna have to send it all over again, or just the information they included here, they act like I didn't send an I-864 and yet I did with all financial doc's that i had available to give, and I heard here on visa journey that other netherlands filers didn't have to initiate getting a police certificate, because applicant's can't personally request them.

okay I called NVC and they were helpful, but it's still stupid, they said hubby has to call "police station" to request police certificate but he's going to just call consulate and inquire about it on monday, since their not open again till then, but NVC operator said it won't delay processing and that I just need to resend my birth certificate as proof of relation to co-sponsor (which is ridiculous because I sent it 100% for sure, but alas I'll express mail it immediately tomarrow morning.

Has anyone had this type of RFE before? =/

Do they usually send more than one email when you get a Checklist response letter? Just wondering because we got another one today, but was the exact same as first email, I'm thinking it's just automated to make sure we get it.

Also I was wondering that since they sent the checklist that means they've revieved everything else and wouldn't by chance send another RFE right? They would have already made sure nothing else was missing before issuing the checklist?

I still don't get why they want us to request the Netherlands police certificate as the way I read it they were suppose to send an email inquiry to the Consulate..?
can someone clarify the below in "red" for me because I read it as saying their suppose to request it not us? Husband is going to call the consulate tomarrow anyways though, I hope they don't give us the run around.

Our RFE checklist barcode cover sheet has the same address as sending the IV/AOS packet. On the NVC filers for OCtober forum it seems that SIF is arriving for most people 8 days after NVC have entered the RFE into their systems which is taking about 12 days from receiving. So probably looking at 20 days for SIF I would guess?

Well thats the part I'm confused about, They requested two things on the checklist I mailed off the first thing on saturday, but nothing regarding the police certificate because I didn't know I needed to write a letter or anything to send it with the checklist, so do I send both checklist items this time or just the police certificate request letter, with coversheet? As they should have received the other checklist item in the mail, I just want to know if I can do it this way or would it cause NVC confusion??

I printed up the page to include with the letter, hopefully they will except it from me the petitioner to save time, since I'm also listed as agent. Should I include the other checklist info again just in case or is it okay if checklist items are split up since I had mailed the birth certificates in with the coversheet a few days ago? How should I handle this?

Okay I've posted about this a couple of days ago, but got some more updates on the situation today regarding getting a Netherlands "PC"



This is how it went

Friday 10th -
Received NVC email with the Checklist response letter saying they needed a Police certificate from beneficiary and proof of relationship to household member from the AOS documents (I had sent birth certificates as proof).

I contacted NVC, they told us to call the Consulate in Amsterdam to request a Police certificate, the opperator said it wouldn't delay any of the other documents so I went ahead and mailed off the checklist items, birth certificates needed for the AOS which I had included in the first place, but they must have lost them, and asked for them on the "checklist response letter".

Today 14th -
Husband called Consulate this morning they tell him that he needed to go to the NVC website to read directions on requesting a police certificate (they weren't any help because we already knew what the directions said, but neither the Consulate or the NVC operator seemed to understand?...)

I called the NVC again earlier today as a follow up from Friday and explained to the operator that my husband called the consulate and they said to look up what to do on the NVC website, and she tells me to follow those directions :blink: okay so I tell her I read the directions and it said that we the applicants can't request a police certificate that the NVC needs to email the consulate and request on our behalf. The operator after having me wait a min. told me that a letter needed to be writen to the NVC saying that we called the consulate and to request a police certificate, (which is wierd because here I was talking to the NVC on the phone why do I have to write a letter to them?) I asked the operator if we could email the request,she was like "no", you have to mail it. (but husband had already sent an NVC inquiry email in the morning before I called NVC). She (the operator) wasn't helpful on how to exactly word the letter either and seemed to be annoyed at my confusion, and the phone call left me with a headache.

So they pretty much gave us the run around and left me confused because why would they ask us to request it if we can't in the first place, and I've read that other netherlands applicants haven't had this situation or maybe I read wrong, if anyone can offer any advice or has had this problem any extra info would be helpful. I guess I'll just wing the letter if anyone can offer advice on what to write, thanks.

Couldn't hurt to try thats for sure and if anyone could choose for an expidite they would choose it in a heartbeat unfortunately not everyone can get that option and might feel a little annoyed that other's do, but this isn't an equal opprotunity process, anyone going/or have gone through it knows that by now.

You don't need any of our approval to try so best of luck on whatever you decide to do :thumbs:

we got the interview date on feb. 14 and are trying to prepare right now for husbands medical exam we read the info on the consulate website and it says we need several forms DS-2053, DS-3024, DS-3025 and DS-3026. It mentions that the NVC gives out these forms but when and if they do? We only were emailed the interview letter from NVC and the interview prep info on the NVC website doesn't list these forms so how do we obtain current versions of them?

I just wanted to say that with Valentines coming up a lot of vjers who might have to be apart from their loved ones and even those who will be with each other, it should be a time for renewed hope and reflection on why we are putting ourselves through such a trial and that is to be with our significant other at the end of the journey. :innocent:

One of the greatest things a human being can aspire to in life is to love and be loved in return and that is why most of us are here to finalize and to close that gap that separates us from the ones we love.

I was wondering if the difference could be because of the filing status? A lot of the posters from the Netherlands seem to have K1 as their filing status as while our's is IR-1 so I'm wondering if that might have been why they asked us to request a police certificate? It's confusing either way, but the letter they requested us to send should be received today and hopefully that'll get the NVC to request it on our behalf, I hope. If any other Netherlands couples went through this please let us know about it, Thanks.

Yes, in the Netherlands you don't have to go after the police certificates yourself, that is all done for you.

I thought I'd post here hoping anyone can advice me on Netherlands Police certificates, we got a RFE from the NVC saying that they needed the police certificate and I thought that for the netherlands we didn't have to initiate it and that was the NVC's job to request it through the consulate, husband is going to call the consulate tomarrow morning, I hope they can give us an answer as to what we are suppose to do? Anyways just wanted to know if any of you have had this problem regarding the police certificate, where did we go wrong?

For a period like that, I would rent a vacation home somewhere close.
I believe there is a big recreation park close to Bourtange, so that might be an option.
But it depends mostly on the time you want to go, if it is june, july or august, it will be hard to rent something.

In Haren I would check out the Postillion Hotel or Google Van der Valk Hotels, the one closest to Bourtange is in Westerbroek.

But if you do a Google search on Motel or Hotel Groningen you will find several options.

If you are going to spend a few weeks there this summer, enjoy, it is a beautiful area and don't forget to visit Groningen, it is a great city with a lot of culture and beautiful old buildings.
As is Bourtange off course, if I lived there, I sure wouldn't move :lol:


Unfortunately I'm not able to go visit this summer because we are saving up for immigration fee's and plane tickets toward me going to the interview at the consulate in the future with him. I've only been to Holland in the winter months which is just as beautiful but, it would have been nice to see in spring/summer. I'm starting a new job in the beginning of June also so wouldn't be good to take a vacation so soon =/.
I enjoyed visiting Groningen during the time I was there got to go to the top of martini tower and go to the art museum and shopping. Bourtange is also charming and beautiful but, it is a bit further from everything else.
I'm just trying to look at options where to stay as I don't know how accomodating his parents will be (personal reasons), but thanks for the advice, a vacation home might be a good option as I'll probably be going during the off season, still expensive though =/.

Do any of you know if there are inexpensive extended stay hotels (like 2-3 week terms) in the Netherlands and I know saying inexpensive is a long shot because most things in Holland are a expensive =/. I know in the U.S. they have these at good rates, but I don't know about over there. If anyone has any tips it'd be helpful.

Hi and welcome to the group! There are a few other Dutch/American filers on here that filed CR1/IR1 I think.....and there is at least one other couple (WoodenTulips) that are currently going through the initial process. A lot of us are already reunited with our husband/wives but with having been through the process, we're more than happy to help in any way we can!

I know that Applicants can't obtain a police certificate themselves in the netherlands, but when I called NVC they mentioned we have to initiate it so how does this work and when/how early should we start requesting it?

just to note we are going to be Mailing IV packet out soon and it's not at NVC yet.

Anyone with prior experience on this matter would be appriciated on your advice.

Hi just wanted to say that the wait isn't easy usually the worst part of this process and it just seems like it's gotten a bit crazier at the services centers, but just keep up with your case you have every right to know the details and be in the loop, your lawyer should tell you everything also, demand it you are paying him/her. He was not a US citizen or LPR during 2010 (edit: and he did not earn any US income) so his income will not be reported to the IRS. In order for you two to file a joint return (and get the deduction for the both of you) he needs a SSN or ITIN. If he has now entered the US then use his SSN.


he has his IR-1 visa to immigrate he's in the process of packing things before moving over here (he's in the Netherlands right now), but I'm estimating he won't be able to immigrate here till mid-late April due to packing and shipping his things and we already said we wanted to apply for an SSN on the IV form, but I wanted to know if thats only activated when he moves here going through POE at airport?
He's eligible for an SSN right? It mentioned on IRS website to not fill out an itin if your eligable for an SSN so I'm confused on what I should do, that and the Tax filing deadline is in april.

I hope this clarifies our situation a bit better.

I put married filing jointly on my W-4 as we have been married for over 2 years now , I want his foreign income excluded since he was not a u.s. resident for 2010 but I wanted the benefit of filing joint, so can I count him as a u.s. resident for 2010 and exclude his income?

and what should I do about the itin or ssn number?

I'm trying to get all the forms together to finish my tax return for 2010 and since I did married filing jointly I need to make sure I get all the right forms, I did some reading in some other threads but I just want clarification on our specific situation.

I'm the u.s. citizen and I worked in the U.S. at the start of June 2010 and husband was in his country in the Netherlands for all of 2010 except when he visited from Dec. 8 2009 - Feb. 8 2010 but only as a tourist.

I want to use the foreign income exclusion as he received government benefits which are taxable in his country, but it's a small amount and way under the $90,000+

What forms do I need for sure and what else is included to send in with my tax return and can we do this without having to file for an itin number?

so far I think we need, correct me if I am wrong.

-1040EZ
-2555 foreign earned income
-A declaration to treat non u.s. resident as a u.s. resident (is this something we write ourselves and who signs it?)

Any help/advice on the steps I need to take would be appreciated as I just want to get this done and over with.

Does he has the sealed envelope from Embassy?? if so there is no problem cause in that envelope is all his info,even his medical records :thumbs: he have to give that sealed envelope to the Immigration Officer at his POE.

Do you know this for 100% sure, yes he has the sealed envelope, but I have his booklet which as all his vaccinations listed in it and the medical exam Doctor had told him to have the vaccination booklet with him at the point of entry.

I suppose I can make scanned copies of these records and send them to him online, it's better than nothing right now, if they want to see the booklet I'll just take them to the airport with me in case they will obtain them from me.

ran into a problem and needing to solve it at the last minute.

Husbands poe is this Saturday, I attended the interview with him and so we had combined all the paperwork together and so when separating it before I went home I ended up with his vaccination records although it seems he has everything else, since it's Wednesday already there's not enough time to ship this paperwork to him I wouldn't want to risk him not getting it in time before his flight, is there a way to get this to him from the airport where I could go through security to hand him this document or hand it to the immigration officer at the poe immigration post, not sure what to do as it has been hectic and we only realized this at the last minute, if anyone knows what we can do let us know please.

would they possibly have vaccination copies in the sealed envelope, I'm not sure about this either, but I have the originals in hand and need to get them to my husband somehow.

Unless your country participate in NVC Electronic Processing, DS-230 signature must be original.

but you can save some time by having your husband sign/date it and then snail mail it to you so that you'll have it when your at NVC stage.

The DS-3032 Choice of agent can be signed scaned and emailed though, I had success with that.
