Hey guys just wanted to make sure ..I am the petitioner but this is my first year of working and dont make enough to meet the requirements. But my brother who lives separately will be sponsoring my wife. What I wanted to ask is that do I need to send any documentation from my part and is just the I864 from my brother will be enough?

When you mention first year of working does that mean you haven't filed income tax before? IF you haven't it's best to still fill out a tax transcript request form to receive a proof of non-filing as it does mention further proof from IRS in the I-864 directions and a letter written by you explaining why you didn't file.
It's best to be thorough in my opinion.

Also if you started work this year and it hasn't been a full tax year send 6 months of paystubs or paystubs since the start of your job as proof of your income.

It is a tough question, Jen and Geert :)

It completely depends on the beneficiary's Consulate. NVC will co-ordinate with the Consulate to schedule the interview, based on the interview slot availability.

I wanted to know more about how the interview schedualing process went because I have hopes of completing NVC this month and getting an interview sometime in December so what are the chances? Do the consulates have a cut off after a certain amount of interviews are booked for each month? Some consulates are probably busier than others too I'm sure.

There are still several May filers without NOA2 yet and we are part of that also our notice date was May 11, we already put in a service request Oct. 18 they pretty much ignore you if you call them and it hasn't been 30 days as I tried to call USCIS this past Friday as I haven't heard any new news and also contacted congressman on oct. 21 they told me two more weeks? received two touches on Oct. 21,22 and I can only hope that meant something as case status still says initial review which isn't reliable. I hope the remaining May filers left in the dark without an NOA2 can find some resolution soon, good luck~

That's what's worst for me about having the lawyer. The emotional aspect. I hate hate hate feeling like I am not in control of my own destiny. However, once I get the case number from him, I'll be all over it. I've already paid his non-refundable retainer, so I might as well use that up, I guess. But I've made it clear to him that I NEED to be kept in the know...I am waaaay to emotional and OCD to not know and "just trust."

I am babbling now....:blink:

As everyone else mentioned a lawyer when having a simple case/situation is a completely optional matter, sometimes they are helpful and sometimes they can hinder you as they can have human error also. ok cool, so he can go to the local town house and get one if he takes his original?

I don't wanna tell you if they would accept a scanned copy of the original or not, but would rather you be safe and I'd say just go for the certified copy as they can see the authinticity of a certified copy since it comes from the civil registar signed and notorized etc.

One final question - my FIL was born in Brooklyn, lives in NJ, and only has one copy of his birth certificate, can he get a copy online?

you can get certified copies of birth certificates at a civil registars office with the simple short birth info on it, rather than the long form original, usually the certified copy is good.

He needs to only submit a copy, as for that address stuff..they dont have to be at the same address as you to sponsor/co-sponsor you. My mother in law is the main sponsor because my wife is a student and only works a little bit part time.

The whole reason for the sponsor if your wife cant' support you is so that you dont go on welfare or on the system..in case you end up going on that, or fall on financial hardships..you wont get any gov't assistance, your sponsor is responsible for you...or the Govt can come back and get the money off your sponsors...this is all until you file for your citizenship.


I thought you can only fill out an I-864A if the sponsor and join sponsor live at same residence otherwise they just fill out another I-864? Correct me if I am wrong, but it does say in the I-864A directions proof of same residence.

on the form there's a line that your spouse will check specifically copied and pasted it below

Verification of Nonfiling, which is proof from the IRS that you did not file a return for the year. Current year requests are only available
after June 15th. There are no availability restrictions on prior year requests. Most requests will be processed within 10 business days . .

The household size which will include myself is 4. Wife, FIL, MIL + me
From what you posted it seems like it's just you 4 so as long as there are no other dependents then yes just 4.
Do they include copies of their birth certificates, or originals and / or copies of their passports?
If both in-laws are filing they seprately need their financial and civil documents to go with their separate I-864A forms yes, just birth certificate will do passport page is not required get certified BC copy from civil registers office, do not send original.I really appreciate your help on this, its been invaluable! :thumbs:

whoever your having file an I-864a contract between household member and sponsor they have to show their birth certificate as proof of citizenship and proof that they livee with the primary sponsor your spouse, you can use drivers licence or any other kind of civil document showing they all reside at the same address.

OK, Im asking these for my wife as Ive no clue - cos I dont file taxes in the UK.

My mother in law, father in law and wife live in the same house. so thats the household size of 3, right, they dont include me in that - even though I shall be staying there.
According to the directions on the AOS you only count household size of sponsors using their income to support you and your spouse are also included in house size, if sponsors have dependents on their tax return they count them too. So if your spouses parents claim each other as a dependent or are both gonna be sponsors you would add them based on those facts.
Wife fills out the i864, is on ssi so doesnt file taxes. She needs to write letter to explain why.
Yes write a letter explaining why she didn't file taxes, but also you still need to request transcripts as proof of nonfiling they ask for that in the directions, you get the proof of non filing by filling out the tax transcript request for I forget the form #.
Father in law fills out i864a, encloses copies of his past 3 years tax returns.

IF it's just the father in law using his income then yes he needs to fill out I-864A
Father in law has to make 125% above the poverty line for the household size of 3 for the state of New Jersey?
Household counts you the beneficiary also so you must count yourself your spouse any other sponsors and their dependents if they have them on a recent tax return
it would be advisable for my mother in law to fill out an i864a too I believe.

Both are retired.

I think that covers my questions, Ive asked something similar before, but a)didnt understand it and b) cant find it! :bonk:


Once those forms have been filled out, I think they now have to be sent to me.

I know I've seen the answer to this question, but I can't find it in the forums. My wife did not file a tax return for 2009 because she was a student and didn't make any money. I know someone pointed someone to a form off the IRS website that you can download and present an official IRS form for not having filed for a certain year.

Anyone got that info? Thanks.


I personally filed for a "proof of non filing" for last 3 tax years which can be done through this form (listed as verification of non-filing on the form itself)

I also included a writen explination that I didn't work and didn't meet the income requirements to file a tax return.

They might except just the written explination, but I added the extra proof from IRS transcripts just to be safe.

A proof of Nonfiling notes that,(there's no record of a filed form for this SS# and that the document can be used as a proof of non-filing.)

So I finally got my NOA2 this weekend in the mail. Its dated 11/9. Now back in mid September I went to visit my wife in Pakistan. During that trip I had all the forms filled out and had her sign everything. DS3032, DS230, I864 etc. all are signed and ready for the NVC. The only problem is that they are all dated September 15 2010. Will having a date from 2 months ago cause any problems? Would it be ok if I use these forms or should I print and fill out news ones?

I think a couple of months is fine, just check that the forms are not expired on USCIS/NVC website some older forms are still excepted though, also don't know if that was a typo but you the Petitioner sign I-864 not the beneficiary.

So was it the IRS tax transcripts that you didn't send in? What was it that you sent to them?
Or did you just forget to fill it in the year and total income on the I-864?

It will take some time for NVC to enter into their system, then NVC operator will be able to tell you it is in their system.

I was able to track when my AOS and IV was received at NVC address and shows that it made it there little less than an hour ago, so when can I call or check online to confirm it through NVC also? Would a customer service rep be able to tell me if it was received?

we sent off our I-130 a couple of months before our 2year wedding anniversary which was july 2010 I noticed on our NVC coversheets they said IR-1 at the bottom so I assumed hopefully they know that we are now IR-1.

How your's was mixed up I wouldn't know without more info about the dates since you dont have a timeline or signature listed dates.

It's fine to send both IV and AOS together as long as you print up the NVC AOS and IV coversheets that have case number and barcode on them. They can be printed up in the payment portal below where your AOS and IV would show paid.

When people say sign in fail or SIF this is refering to the NVC payment portal. This means that your case at the NVC has been completed and you are now waiting on the interview. Once you get SIF call nvc a day later to confirm.

When I was at this stage I wondered about this in general. Please note this isn't for my benefit but for others who may have the exact same question I did. When we paid our fees they were accepted around the same time frame. Which meant our forms and supporting documents were both ready to be sent.

The question is can you send both packages at the same time in the same mailer? We sent ours a week apart as we weren't sure if it would cause a problem to send both. Upon which we got a false RFE email just today that the Ds-230 was not received yet (when in fact it was AVR confirmed it along with our tracking and delivery confirmation).

So do you normally have to send them one after the other or can you send them both at the same time? (in the same mailing envelope.)


I Just express mailed AOS and IV together and a little anxious about it, as a precaution I wrote in a thick black marker "Contains: AOS and IV Documents" on the front and back of the envelope so hopefully they'll take note of it, it's guaranteed to be there by Monday before 3pm so I hope it'll all go well.

Patience might be a virtue, but this process leaves one humble and pretty much at the mercy of a beauracratic disaster, maybe things will speed up for new filers though as we hit a slow point while at USCIS, and we are thankful to be out of it now.

Co-sponsor is required in your case, a letter explaining why you didn't file (because you didn't make enough income if thats the case) and you can also get proof of non filing by filling out a tax transcript request form. Also by reading the directions on the I-864 it gives you decent directions on what type of financial documents they want.
