K-1 Fiance(e) Visa Case Filing and Progress ReportsConversation with USCIS yesterday about VSC

So I called yesterday to get a bit of clarification. I'm not one of the December January filers that got transfered but I wanted to know what the heck was going on with all the petitions that were being jumped over. This was the actual response, word for word, that I got from the woman.

"I find it very hard to believe that anyone with a January date got approved at VSC. I can see here that currently they are working on OCTOBER 15."

I kept telling her that on pages like this one, I'm seeing other dates and if we could get at least an estimate of how much time we have left to wait (ballpark). She said that any January filer will most likely have to wait an additional "3 to 4 months." (Which I find abosolutely ludicrous ).

Thought I should share my conversation. I'm furious and disappointed. Everything you can imagine. I also contacted my congressman and senator WEEKS ago but have received NO response from either. I hope that maybe one of you guys can contact yours and maybe they'll pay attention to you. This is getting ridiculous.

I've already put one in just be careful to state your address correctly. The lovely lady that took my service request didn't understand me well and they changed my address so I had to change it again with another service request and that is still "pending".

Well that's disappointing. You would think that each passing year it would get better and go faster but I guess we will all learn the greatest amount of patience during this process. I understand that my next question really doesn't have anything to do with this thread but I'm new to the site so please bear with me but once you get your NOA2 usually how long (ballpark figure) does it take to get your interview? I know it depends on the embassy and country but again, ballpark. I just haven't found a pretty clear answer anywhere. Thanks again all!

Thanks for the info! Really needed it. I wish this was a quick and easy process. I got so excited lol Roughly how long have people been waiting? I've heard so many different things from five months to seven but there is a BIG difference between five months and seven months. (or at least I think so).

Hey all. January filer as well. I also received "On February 6, 2013, your Alien Registration Number was changed relating to your I129F.... etc"
Does anyone have any idea what is going on? Has anyone on this thread actually received their NOA2? Seems waaaaaay too awesome for that to come true.

Hi there. Yes e-mail is your best bet but also make sure you "double check" their responses. I was talking to them and a response they sent me sounded a little off. I double checked online and then wrote them back saying I saw something completely different and they said "oh yeah yeah that's right" so just be careful :)

Thank you Matt (or Maya ;) ) I appreciate your help. So everything moves relatively fast after the NOA2? I honestly was a bit scared with that part because here in Spain (as you WELL know) "funcionarios" tend to move at a snail like pace and I was so concerned they were going to take a long time. So I, the petitioner, am basically done with paperwork? YEAH! hahah thanks again for answering. I definitely didn't know they give you the visa on the spot. That is EXCELLENT news. I really don't want to be apart from him for too long. How long until you got your NOA2? Thanks again!

Hello all! Please bear with me here. So, we sent off our i129f in January. They received it and we got our NOA1 in early February. I'm obviously looking at a minimum of six months but I'm wondering if someone could help me (preferably from Spain) on exactly what happens, what you need to do after receiving your NOA2. Also, I'm moving back to the States in August, and won't be able to attend my fiance's interview. Is that bad or can he just tell the CO what's going on. Thanks again for all your help.

Thank you to everyone that responded. Just in case other Spain filers come along and read this, in Spain you have to wait for your case number. Also you have to go at least 2 days before your visa interview. Thanks again all!

K-1 Fiance(e) Visa Process & ProceduresSupport
Hello again everybody! I have another question. So as for the affidavit of support, I would initially need to have a co-sponsor because I do not make enough money here in Spain HOWEVER, by the time the interview comes along, I will have moved back to the States and my fiance will be here. 1.) Do I need to notify anybody when I'm back in the U.S. even though they already have my U.S. residence as the mailing address? 2.) If I recently started working at a new job, and it wasn't on the initial application, does that look bad? Especially since it's back in the States? 3.) If I do not make nearly enough money what does the co-sponsor have to fill out? I don't understand why I would need to fill out anything if I don't make enough money. Thank you all so much for your help!

Honestly he only had the ESTA. Did it online. Apparently he got lucky or something as obviously many many people are saying that is not the case. Better be safe than sorry so follow what the others are telling you  good luck!

As residents of Spain and if they are traveling to the U.S. and then back to Spain they only need the ESTA. They'll ask them the standard questions at the airport in the U.S. and when they get back to Spain they just have to show their residency cards.

Also, just e-mail the embassy. They write back really quickly and are very friendly and they can let you know FOR SURE if you are a bit concerned.

K-1 Fiance(e) Visa Process & ProceduresI-134

Yeah, after talking to my dad, he said I'd just need to state that the 2 years prior to 2012 I had no taxable income as far as the 684 goes. I'll go ahead and get started on that. Since no hard copies seem to be necesary for the I-134 other than the form itself, I'll go ahead and send that to my fiancee in Spain along with the letter from my employer and recent paystubs...and I guess the copy of the I-129F that I sent to the USCIS while I'm at...and get a copy from the IRS. Should be arrive in the mail in time for me to scan it and email to her before her interview...

man we are finally seeing the light at the end of the tunnel...

thanks for all the advice

Let me know how it goes Andrew! Good luck!

K-1 Fiance(e) Visa Process & ProceduresI-134

Hello,
Both of you need to summit your tax returns whether you meet the requirement or not and not just your father, that is why it's called co-sponsor if you notice. you and your father will summit your most recent tax returns along with I-134 FORM at the of your fiancé interview to the US embassy.
After he has gain entry into United State and he is trying to file for adjustment of status, both of you will also need to summit your last 3years tax returns
along with I-864 FORM if income is still below minimum requirement and if not then it will be just.

His last three years tax returns? I'm confused he doesn't have any. He doesn't have to in Spain. And I do not have any for 2012. Any info is helpful.

I don't have a tax return for this year for example because I didn't file. Unemployed and don't get assistance from the government. I smell a lawyer and problems now.

Once my fiance gets his interview I will be back in the States with a new job. My father will be our sponsor but here are my questions... I keep reading I need three years tax returns? Myself and my fathers? Or just my dad since he is the sponsor? I also read that just the most recent is sufficient. Can someone clarify exactly what needs to be taken with the I-134? Not what is optional what is necessary. Thank you!

K-1 Fiance(e) Visa Process & ProceduresWhere to send I-129F

It depends on where the petitioner lives. I sent mine to Texas (being in Florida) and they end up transfering it to the corresponding office. (Mine ended up being Vermont). If it says Texas because of the state you live in, send it there.

K-1 Fiance(e) Visa Process & ProceduresACTUAL answer for i-864 not speculation

Thanks for your answer penguin. I didn't file because I don't live in the US and I'm currently looking into having to file for living overseas (I had NO idea). I was just wondering 1.) why on earth would I need to since I'm not techinically sponsoring him. I know I have to because I'm the petitioner but I thought that the "evidence" would be from my dad not myself since I didn't make any money.

K-1 Fiance(e) Visa Process & ProceduresACTUAL answer for i-864 not speculation

I've posted a question similar to this one and have been looking but can't seem to get a concrete answer. When it come to filing the i-864 my father is going to be the joint sponsor since I do not make enough money. I did not file taxes in 2012 (April 2013) so I wouldn't send any tax information for that year. My father, did because he DID work and make money. I know I have to fill out the i864 because I'm the petitioner but will I have a problem if I don't send my last three tax returns. I'll send my dad's because he's the sponsor. Thank you thank you thank you for your help!
