IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 in Texas not Japan
Hello everyone,

I will be marring my fiancé in Japan where she lives but it looks like I will have to file the I-130 in Texas now that DCF is gone.

Does anyone know if Texas is fast or slow with their I-130 reviews?

Thanks!

I also wonder who the agent should be. I am new to the forum and I do not know what a USC is.
My fiancé and I will marry in Japan in April. Once I have filed the I-130 for her immigration would it not be best to have me as the agent?

Thanks!

IR-1 / CR-1 Spouse Visa Process & ProceduresMedical Exams
I have a question about medical exams.
I will be marrying my Fiancé in Japan on April 15th. We had originally planed on filing DCF but that is not possible now.
What we want to do is get her medical exam when we visit Tokyo for our honeymoon. Since she has to fly to Tokyo to get a medical exam we want to do it then so that she does not have to pay for another flight. Can we get her medical exam performed before we file the I-130? Would they accept it?
We will be using one of the medical facilities that were listed on the Tokyo Consulate website.
I have heard that the exams are good for one year.

Thanks!

Hello everyone!

I have a question about the I-130 and other immigration forms. My fiancé wants to list her step-father as her father on the forms but I am unsure if this is correct. When I see a request for her fathers name I think it is her birth father but I am unsure. Maybe it is different in Japan since she is Japanese.
Which should I use?

Why can't we just send our I-130 to California and by-pass Texas?

Seems like a waste of time to send it to Texas.

It is highly recommended to use all capitals where specified on the forms, it helps reduce data entry mistakes.

Is there a list of the ones that require capitals?

The I-864 did not (itself) say tyo use capital letters but a instruction on the USCIS site did say it.

I was looking at the processing times at the California USCIS office.

They seem to be processing the I-130’s that they received on September 13th 2006. Is this correct?

That is about 6 months ago.

At that rate it will take 12 months to get an Immigration visa.

Hello everyone!

Is this guide accurate and up-to-date?

Does anyone have an example of the cover letter?

I want to thank everyone for there help. It is greatly appreciated.
I want to ask one question for clarification:

How would they know that we have an I-130 in process unless we tell them? It is my understanding that they only ask a few questions since they are so busy. I would under no circumstance advocate lying to an official but if all she says is that she is visiting for holiday why worry?
I will make sure that she has as much information about her permanent residence in Japan as well as a return ticket before she arrives.

IR-1 / CR-1 Spouse Visa Process & ProceduresVisa Fraud
Hello everyone!

I just read a very disturbing article today in the local paper. It discussed a family where the man and wife were married in Japan and then she traveled to America on a Fiancé visa. When they tried to get a permanent residency she was denied because they said she had committed fraud by coming to America on a Fiancé visa when she was already married.

My question is this:

My wife and I married in Japan this April and we have filed our I-130 just last week. She plans on traveling to visit me in June for about 70 days on a visitor’s visa. She is not entering to immigrate but to just visit. She has a return ticket and does not plan on staying.

Is this a problem? Since she will not stay in America can they say that she is committing fraud? Since the US government is so warped I am unsure.

Thanks for you opinion and help!

IR-1 / CR-1 Spouse Visa Process & ProceduresApplicant will most likely not be able to enter the US during this time.
QUOTE (MargotDarko @ Sep 18 2007, 04:23 AM) <{POST_SNAPBACK}>
There is nothing wrong with attempting to enter the US after filing. As long as she is eligible to use the visa wavier programme (which she should be as long as she doesn't have a criminal record, previous overstays or anything strange) and can prove strong ties to Japan (return ticket, letter from her employer, copy of a lease/mortgage), she shouldn't have trouble entering the US to visit you for Thanksgiving.

Like hheaven67 said, she just needs to answer the questions directly and honestly. The fact that she's married to a USC and planning to immigrate in the future may never come up. She should definitely not make any attempt to conceal info, just don't offer information without being asked.

I have heard many more stories about people having no trouble visiting than I have heard stories of people being turned away. smile.gif

My wife came to see me here in the US on a visitor’s visa and she had no problem. We had previously filed our I-130 before she came to the US. The immigration officer asked her what her intentions were for visiting and she told them that she was visiting her husband for a while. I can not remember exactly how they found out about the I-130 but they just told here that she had to return in 90 days or she would be in violation and would jeopardize her immigration chances. She had a return ticket and some documentation showing residency in Japan.
My wife is from Iizuka City in Fukuoka Japan so we have similar situations.

Hope this helps and good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresUSCIS NOA1 Date
Hello everyone!

I have a question about the receipt date for our I-130.

We sent our I-130 to the Texas USCIS and they forwarded it to the California USCIS.
The website has a date of June 11th for receipt but the NOA1 has a date of 6-29-2007. Which will they use?
The website says:

Current Status: Case received and pending.
On June 11, 2007, we received this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. You can use our processing dates to estimate when yours will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
The NOA1 is dated:

Notice date – 6/29/2007

Which one?

I just checked

http://www.uscis.gov...00045f3d6a1RCRD

which appears to be updated weekly.

The bad news for me is that the Vermont Center is still stuck on 7/29/07 while the California Center has gone from 8/19/07 to 8/30/07 in one week.

What makes the date unreliable is that a number of dates went backwards.

"All Other Forms" seems to have gone backwards in California, Texas and Vermont.

As I understand things, the N-400 is the form that is delaying everything else. Those forms moved 1 day in California and didn't move at all in the rest of the country.

A friend of my wife married a British man soon after we were married and she should be able to move to London by the end of the month. It seems like we will be lucky if my wife can come here by our first anniversary.

Yes, it is very frustrating. My wife and I married in Iizuka City; April 16th of this year. I was able to file our I-130 in June. We have a date of June 11th on the USCIS website and we will be luck if we can be together by our first anniversary.

The same thing happened to me. My wife in Japan has received her 3032 but I have not received the AOS bill. They were sent from the NVC on the same day (Nov 5).

When I called the NVC they did not know what had happened. They did offer to send out the AOS bill again.

Will you use James Shortcuts? I am also thinking of using it.

I also want to be sure that the only thing that I need to send in is the AOS bill paper and the Money order for $70.

I will be sending it fast mail from the USPS. I will also use a USPS money order.

Another question: Where on the Money Order would I write the case number?

QUOTE (Goldtrom @ Nov 27 2007, 11:43 AM) <{POST_SNAPBACK}>
You can't file DCF unless you are in the military... Why is everyone telling him to do that????

BTW, I'm in the exact same situation. My GF got pregnant... we got married last month, and now I've been waiting for over 1 month for ANYTHING to come back from USCIS.

If you want to see the birth of you child, stay in Japan. The USCIS is hopeless....

I will quote from the Japanese embassy page:
http://tokyo.usembas...tacs-7114a.html

"Immigration procedures start when you, the U.S. citizen spouse, file an immigrant petition (I-130) for your foreign spouse with the United States Citizenship and Immigration Service (USCIS). Until recently, it was possible to have these petitions approved at the Embassy, but due to recent legislation they must now be approved by a USCIS office before you can begin the visa application process. Since the I-130 does not expire, and this change in the petition process will likely add to the amount of time required to obtain an immigrant visa for your spouse, we urge couples to start as soon as possible after their marriage, even if you do not have any immediate plans to live in America."

Now I just saw this:
http://tokyo.usembas...-ivgeneral.html

But it contradicts the other page... Maybe you should call the embassy and find out which one is correc

"Important Notice

Effective immediately, the consular sections of the American Embassy in Tokyo and the American Consulate General in Naha will accept family-based I-130 petitions filed by American citizens who have been resident in Japan for at least the preceding 6 months. "

I believe that you can file in Japan as long as you meet the residence requirements. It is not necessary that you be in the military. They understand that some people will be in Japan for long periods of time other than for military service.

All of the information is on the Tokyo Consulate website.

If you decide to call Tokyo there is a fee to ask immigration related questions.

I am by no means an expert but my wife and I were all set to file DCF and then got hit by the Adam Walsh thing. We had researched this a little before that happened and we believed that we could file in Tokyo even though I live in the US.

As far as what you will need to prove a relationship:

1. Do you have any bills/bank accounts together?
2. Do you have a rental/housing agreement with both names on it?
3. Anything that shows joint co-habitation and a relationship.

Wedding photos do not have to be professionally done. They can be taken with your own camera.

I met my Japanese wife in June of 2006 and we married in April 2007. The pictures that I sent (wedding and honeymoon) to the USCIS were sufficient to prove our relationship was legitimate. I think that since she is your girlfriend and is pregnant that you can come up with enough evidence to prove a relationship exists.

Good Luck!!!

Hi,

Well, hard to say, you may have squeaked in under the cut off or maybe the message isn't even true, how to tell !

I would personally call the NVC and say I have a friend who received an email that said (as above) and ask if your IV bill is really being sent out or if they are going to wait until January. If enough people ask they will eventually get an answer - good luck, I hope your IV bill is really on its way!

If you do call, please let us know what you find out.

Trailmix,

I called NVC and they said that the IV bill was generated and sent to me last week. I should get it soon, maybe this week.

Looks like if the automated message says it was generated than it will be sent out.
