fiance completely clueless???

I have fille dout most of the forms and found out most of the information for my fiance. I have access to the internet while Renato does not. I helped him fill out all his forms....including th eones for his interview because I am better with paperwork than he is. Plus his handwriting is awful! When I explaint hings to him I have to explain them numerous times so most of the time it is easier to take care of it myself. He tries though

overstay

My fiance had the 1 year work visa after he graduated college. It expired on Jan 4 and his lawyer said he had 30 days to leave the country. Because of flights he left Feb 7. That means he had a 4 day overstay. Will this effect anything since it was only 4 days and it was out of his control?

The state was R$5 each. (Renato had to get one for 2 different states). The federal was free. They have a lit of th eplaces in your city for the locations. The ones listed for Salavdor were incorrect though (none of the phone numbers worked either :whistle:

). So we had to go to several different places. The federal police in Sergipe were very nice. Renato went to the places with a letter printed from the consulate website. They are valid for 90 days.

Laura we had packet 3 ready (we downloaded it form the website) and we checked everyday to see if Rio got the papers from the NVC. After they did we mailed it to them by sed ex we had the interview date 3 days later. It was only a month later so they are giving the interview dates pretty close to packet 3!

Oh and we got the police records when we got the NOA2. We got the state records the same day and the federal records took about 3 days. So you can wait for that. We got the dr exam earlier because the doctor in Salvador was going on a 4 month holiday so we got that done earlier since it is valid for 1 year. Hope this helps!

Airplane ticket

we already bought the ticket....but before we bought it we made sure we could cancel it. we found a deal of 600....to fly from brazil to jfk and then from jfk to atlanta. If we cancel we have to pay 10% but it was worth the risk for us. Most of the time tickets like this are over 1000...the company had a one day sale.

Okay so Renato got to the Consulate at 7:30 this morning. He was pretty far back in the line but because of Carol he knew the order of the documents. He was the second one to turn his in. He waited 30 minutes and was called tot he interview room. he said the guy was not friendly but was not mean either. He walked in and the first thing the guy said was "we have a problem!!!" Poor Renato. We put the dates that each visa was issued and each time he entered the usa but we did not put when he left. Renato just had to guess. So after he fixed that he waited to be called into the room again. He asked nothing about our relationship. He asked why Renato practically lived in the usa using a tourist visa (he was a tennis player.) He asked about his degree and about the college we went to. Now this is where the problem comes in. We used my brother in law as a cosponsor. I sent in his last 3 tax returns. He makes way above th elevel needed. The only problem was he filed jointly with his wife (my sister). My sister is a housewife so none of the income was hers. So to prove it was all Michaels income they needed his w2. Renato said the man started to loosen up and said "I am going to be flexible with you. You are "semi approved right now. You need to go call Stephanie and have her fax his W2 before 1:00 Rio time." So Renato went to the closest payphone and called me. I could tell something was wrong when he called and I though oh no he has been denied!!! Well he explained and I had to leave work.....call my sister...go get Michaels w2 and Fax it to the consulate officer. Once I called Renato and let him know I had faxed it he went back to the consulate. The lady went and checked and said everything wa sokay and they would send it to him on Monday! What a morning......but we are so happy and he will be home on Thursday night

I can not offer any help on this subject, but what you seem to have is a great start. I think it is great on what you have done for your step daughter kudo's to you.

I applaud Loto for developing this guide. I would have loved seeing something like this when I was going through the process with my wife. However, I was lucky and prevailed. Now a new situation for which I can't find a lot of posts on is proving a bonafide relationship with a stepchild. The short story is that my wife's ex-husband was awarded custody of their only daughter (then 10 years old). Here's the real corker...her dad was in prison at the time serving a 15 year sentence for fraud. Regardless, my wife paid child support as ordered by the court never missing a payment up until our marriage when I assumed responsibility for the child support (got all that documentation). We even increased the amount substantially (required to pay approx. $50/mo per decree, I increased it to $150/mo and then to $300/mo). Since our marriage, I have only visited China once and my wife twice (last time was this past Sept). The time my wife and I both visited was great as her daughter was able to spend a lot of time with us. We made arrangements to have her live with my wife's brother (much better environment) than having her live with her Dad's mother (elderly and the family is basically corrupt with strangers coming to the house to gamble).

My relationship with my stepdaughter has steadily grown stronger but I wanted to give her time and space to decide if she would ever want to immigrate to the US. Last year she started talking about the prospect and since then she has really set her hopes very high on coming to the US to finally live in a normal family environment and be with her Mom whom she adores. Her Dad was paroled this year and he made things incredibly difficult for her to gather needed documentation to get a passport. We finally ended up sending him money as encouragement to perform and he did. My stepdaughter has come to see her Dad for what he really is...a criminal. He even stole money from her a couple of times. She refers to me as her Dad instead of using my first name and has sent me great emails although her English is not so good, she makes a good attempt at telling me how much she loves me.

So there's the short version, now what things can I be doing to establish a bonafide relationship with my stepdaughter whom I genuinely love as do my own daughters? We have filed our petition for her immigration in October and with the electronic processing available, it won't be long before she has her interview. Aside from financial child support records, regular long distance phone calls and sporadic emails, what else would be good to gather up for her interview. Oh, I plan on getting numerous affidavits from my family and friends regarding my relationship and how I feel about my wife and stepdaughter. I brag about both a lot to anyone who might ask. Thanks in advance for any suggestions.

Some of this stuff requires our spouses to have ssn and if there still living in another country, how can we do joint on a lot of things. Like I have married on my auto insuracne and i have the discount but becasue he is not here and does not have a DL he is not listed on my insurance as a driver or anything. So with the distance and no ssn what can i do as joint???

I-130 Checklist

A friend of mine just got a RFE and they requested birth certificate and copy's of her passport. They are not using the passport as establishing your citizenship, they use it to prove you went to your spouses country by the stamps you recieved. Hope that helps.

Actually we have the passport photos ready and the email notification paper as well. I accidentally left them off my list. I need to make a copy of both sides of MY birth certificate or my spouses? I read on the I-130 instructions that if I have my birth cert. I didnt need to make any copies of my passport.

Ok that i realize there is some target countries they need to pay attenion to. So here is a question; how is the best way to prove a bona fide marriage if your there for a short limited time and there is not a offical weeding for wedding invites and things like that. I know many that get maried on there last days in the country.

Neither attorney nor the guide will prevent the RFE. In other terms, people who have followed the guide have got RFE. Also, people who have used the attorney also have got RFE.

Why? Every case is unique. There is a background check process as part of the I-130 petition and some times "innocent people" also will be stuck. Also, USCIS has their own rules to check the bona-fide relationship if the cases are from "certain countries". Everybody, including me, has to overcome this additional check to get the I-130 approval and subsequently to get the visa from the Consulate.

To me, just 2 secondary evidences (marital relationship) may be sufficient to overcome at one point of time. When I apply for next time, these 2 evidences may be insufficient and need to produce more.

So, I advise everybody to have as many evidences as needed to overcome the issues and to prove the "bona-fide marital relationship".

Footenote: If you don't have those bona-fide relationship, even the guide or attorney will also be helpless!

RFE's happen and it is better then a flat out denile. Is there any way that we can take info from what the RFE's are asking for and pinn a thread like that to help ppl in the future. Or has that already been done and I have not come across it yet.

Fair point - however - its only a guide - you have to remember that. its not a derectorate.

If you want or need specific information - then i suggest the uscis websites are the places to go. Here, people on the whole only offer advice and GUIDANCE. Support too.

Of course as with any message board theres always the local oddball that thinks they know it all, but you have to take the rough with the smooth.

If you get an RFE, you get an RFE. You have to - if you want to further your immigration process - deal with it. theres no point really moaning about getting one and trying to find a solution to stop it. Its simple, there isnt one, you can only do the best you can.

First of all, this IR1/CR1 process is very simple procedure and most of the people do not need attorney to do this.

When attorney needed:
1) One doesn't know the IR1/CR1 procedure clearly.
2) If one has complex cases such as previous overstay or any other complex cases.

If it was as simple as the guide says it is, there would not be so many RFE's. I know a couple of ppl that has used the guides and have RFE"s and the letters these ppl are being sent out is almost 3 pages of things they want. The high rate of RFE's, is the changes taking place with USCIS right now. They want ever little detail of the marriages and if something did not happen they want to know why and have it notirized. And the guides need to be updated. But that is just my opinion.

HELP: I'm a student filing for CR1

If you file CR-1 in the interview they are going to want to know why he wants to come to the states to live. If he says it is not for premenate reasons they will denie the visa. And it is best to not lie. I think the one person gave you a very solid way to get him a tourist visa. And if you go to the tourist visa forum you will see that many ppl have gotten tourist visa'a after being married.
