K-1 Fiance(e) Visa Process & ProceduresCheque cashed
QUOTE (william_wallace @ May 23 2008, 08:47 AM) <{POST_SNAPBACK}>
My fiance told me at long last the cheque has been cashed. Is there any way she can log onto the USCIS website? I'm not sure but I do remember something on here saying that with the details of the cheque, you can create an account. Is this true or do we have to wait for the NOA1? If so what details is needed?

Thanks

So happy for you two!

K-1 Fiance(e) Visa Process & ProceduresI-797C for Biometrics received after filing I-129F
Went to USCIS Application Support Center in Nashville. They did end up taking my fingerprints, but even they did not understand why I, the US citizen, had to have my fingerprints taken. I just look at it this way.... one step closer.

I called USCIS customer service. First spoke to a representative named Rita. She thought it very unusual and transferred me to another representative higher than her position. She did this without me escalating the call.

I then spoke to Ms. Chin who says she is an officer. She said this is very unusual and never heard of the US Citizen having to do fingerprints. She said that when I arrive to the appointment, I should request to speak with a supervisor and tell them I am a US citizen. Ask them, "Is there a mistake in the case, or is it unusual?" She didn't provide any other information other than this is not ordinary for the I-129F process.

I just received a letter yesterday advising me that I have an appointment in Nashville, TN to have my biometrics taken. I have a few of questions:

- I've researched and noticed that most of the letters like mine were received by I-130 filers. We filed the I-129F. We are engaged to be married. He is in Slovenia, EU; I am in the US. Is this normal?

- I've also noticed that it's usually the non-US resident that normally has to go to the biometrics appointment. I am the petitioner (a US citizen).... just wanting to make sure this is all part of the I-129F process. I looked in the FAQs on Visajourney and it doesn't mention this in the process.

- Is this letter the same as an NOA2? It is my 2nd NOA, but I thought that it would say something about being approved.

Although this is another step, I am happy to get this letter cause at least I know they are on top of our case!

this isn't standard procedure, but it does happen sometimes. just do the biometrics and wait for your noa2. good luck.

Whether standard procedure or not, I will certainly be at the appointment because the letter states verbatim - "Please appear at the below application support center at the date and time specified. If you fail to appear as scheduled, your application will be considered abandoned."

Thank you for wishing us luck!

USC's do not have to do biometrics at any point or any time during the K visa process. Some drone in USCIS hit a wrong button and that is not necessarily good for your case at all.

In your case your fiance will likely give fingerprints at the embassy for the State Department when he applies for his K1 visa, then will receive a biometrics appointment letter at your home AFTER he enters the country, you are married, and file for adjustment of status.

Thank you for replying to my post! I didn't think the USC had to do biometrics... glad you verified my thoughts. blink.gif This process can be so confusing sometimes... especially when things like this happen.

K-1 Fiance(e) Visa Process & ProceduresSPONSORS
:help: I am a little confused on the whole sponsor thing. One I was a full time volunteer for all of last year and a good part of this year so I did not make enough money to sponsor my fiancee. One of my relatives is in the military and I am going to ask if he would be the sponsor. But can someone in the military sponsor me? Also I want to file as soon as possible. Should I find the sponsors first? And I might be moving soon. I live in TN right now. So I would apply for the K-1 through the TX office. But I might be moving to Washington, so I would be living in a different service area. Should I file now? Or is it best to wait, since it will affect not only my address but her intended address to live. :( I really could use any help.

K-1 Fiance(e) Visa Process & Proceduressending k-1 visa petition tomorrow
Looks good. 3 area's to mention though. (1) you acctually don't need her birth certificate to file the I-129. She will need the original for the interview later though. (2) COPY COPY COPY. Make 3 copies of everything. The first you send in. The second you send to her before her interview. A few embassys have asked for something from the I-129 package but it varies. And the last copy is in case anything gets lost in the mail. (3) Copy the pictures you are sending. Remember you do not get these back.
I got the NOA2 already. And it took about 3 months so here's hoping for you.

She can use her passport from the Ukrain but if it is still within the first 2 years of you being married make sure that you file for a travel permit for her. Until she is a redident without restrictions she will have to do this or they may not let her re-enter the US.

K-1 Fiance(e) Visa Process & Proceduresfiancee visa or spouse visa - which is faster?
Spouse visa is faster for most country's. But if you are a permanent resident of India, or things like this all have a bearing. Also good to check if the US recognizes the marriage there as an official marriage or not. I can tell you that the K-1 is not fast. Still going through the process.

K-1 Fiance(e) Visa Process & ProceduresIf Your Fiacee wants to visit the US
Just thought I would let everyone know these facts that I got. If you have applyed for a K-1 visa everyone knows it is hard for your fiancee to come visit the US. I talked to an Immigration agent wen I was coming back into the countryand she told me how that you can get your fiancee in to visit.
(1) Your fiance(e) needs to have proof that they are going to return to there country.
Examples: A lease aggreement on a house or appartment. A note from your job that you have a contract with that you are only on vacation. But this only works with countrys that you have to sign a contract to work at a job.
Also, note that a return ticket does not constatute proof that they wil be returning to there country
(2) They will check their bag when they coome to visit.
My fiancee wanted to bring things to leave so she could have them for latter. But this is a bad idea, because they look for signs that they are not going to be leaving.
(3) If your fiance(e) has ever visited the US. Make sure that the little green visiters card was returned when they left the country. If not, and they try to come visit they will automatically reject them.
The reason I metion this is because if they came to visit and then cossed into Canada, they do not take the card which would happen if they flew out of the states. Without this card returned, the US computer system still thinks that you are in the US.
Hope this is helpfull.

K-1 Fiance(e) Visa Process & ProceduresHow do I change my address?
Hi all!

I did a search on this issue and I'm still not clear. My fiance is set to arrive in the States this Friday. I moved to a new address after he had his interview. Which dept. should I call to inform them of my (our) new address? Do I send a form somewhere or just wait until we send in the Adjustment of Status packet? I'm figuring that I should do it before then as the govt. will probably want to know that he will not be at the address we used in the K-1 packet. Any ideas?? Thanks in advance!

K-1 Fiance(e) Visa Process & ProceduresNew filer....
Hi! My fiance and I are new to the board and mailed our I-129f on June 6, 2008. He is from the Netherlands and I filed with the Vermont processing center. I was really nervous when I mailed it, hoping and praying that I put in enough documentation to make the powers-that-be happy so that they will approve his visa. I think I must have checked every piece of paper 5 times to make sure I had everything just right. I found the example forms (I-129f Cover letter, etc.) to be helpful with the preparations. A word of advice for those about to file...save as many of your flight tickets, hotel receipts, etc. as possible and gather them in advance to make life much easier for yourself!

Fingers crossed!

Extention Letter
We're getting ready to request for an extention of NOA2
and using the example form in this site

But we aren't sure about how to write on;

?Vital data
?Period of Validity

AOS local office
We still haven't got the visa
but we're so worried about local office when we do AOS.

My fiance lives in Eastern Tennessee,
and we're wondering if Memphis, TN is the only office we could go to for the interview.
Is it possible to go to some other offices in different states?
And how many times do we need to visit the office?

Thank you for answering in advance smile.gif

You don't need to send a letter to extend the validity of an approved I-130 or I-129F. The Consular Officers do it routinely as needed.

You'll probably have two visits to USCIS office(s) during the AOS process. The case will be assigned to the one that covers the district in which you live. This may or may not be in the same State. Not all USCIS offices do these interviews, so it is possible your first visit for biometrics will be at a smaller and closer office. Ours was.

Thank you so much!!!
Then I don't understand why the letter I got from them says; I can extend if needed.....

Ah, I'm so relieved to hear about AOS offices.
Thank you again smile.gif

Please provide the details of any letter you received. Since you have no timeline, I'm not certain it isn't something different. Then, please fill in your profile and timeline to help us help you and to add to the data used to predict the timelines of others.

I got a Packet, which I think it's called Packet 3,
and in that packet, there was visa intrsuctions
and it explained about 'Validity of the approved I-129F petition'.
Therefore, we get that as we need to extend by requesting them.

Could you please explain how you meant; 'Since you have no timeline'? blush.gif
What would you like to about our timeline/profile?

Thank you so much!!! smile.gif

K-1 Fiance(e) Visa Process & ProceduresPeriod of Validity?
Hello everyone! My fiancee is usually the one who posts here, but I thought I would today. Anway, she lives in Japan, and we are trying to get a K-1 visa. Our NOA2 letter arrived last month, and now, I'm preparing all the financial support info to send. She'll go have her medical check next week, and then prepare for the injections she needs. She wants to finish all of her injections before coming to the U.S. but since the Hepatitis A and B injections take 6 months to complete, we are concerned if we need to file for an extention. On the example extention letter, it say this...

"It is my understanding that pursuant to 9FAM 41.81 N3.1 (Period of validity), the consulate can extend the approval notice for another 4 months, if my fiancé and I remain legally free to marry and continue to plan to marry after my fiancé enters the United States."

My question is this, how do I find the Period of validity? And how would I write that on the extenstion letter?

I apologize for such a long post, but any help would be greatly appreciated. Thank you!

The CSC received my application on November 20, 2006. As of yet I have only received my NOA-1. While looking at the

I have heard nothing from the USCIS and when I check the status of my application online it simply states received and pending. I have looked at the USCIS web page which says they are currently processing applications received on or before July 17, 2006. But when I look at the VJ website and filter for my service center, California, I see tons of people who applied after July, including August, September, October and November that have received their NOA2. My application was received November 20, 2006, and I am seeing applications on VJ that were received after that that have already received their NOA2. When I talk to USCIS they say that the information on VJ can not be true because they are processing last July's applications. They tell me that there is no way the information on VJ website that is posted by individuals is true if the say they applied after July 17, 2006, and have already received their NOA2. I talked with my Congressman's office and they stated the same thing as USCIS. I am not upset about it but I am just looking for some clarification on the issue because I am new to everything and I guess I am just confused. Can anyone help me understand?

how do you deal with skeptical family/ friends/ strangers (who cares) who automatically assume you're being used to obtain a greencard? i feel like i'm constantly justifying myself and our relationship; yet, people, including my father make insulting comments regularly... as if this lonely, agonizing process wasn't difficult enough.

Hi! I am new here but just wanted to let you know that my fiance and I had this very same problem.
I know that everybody loves me and worries that I am being used and I try to understand that. But it did bother me as well and finally they all did come to realize that we are serious and very much in love. My Costel says that we will show them our love when we get our visa. It even went as far as two of my cousins running what they thought was a background check on him and sent me an email telling me to beware and to read this attachment because it could be a matter of life or death....they had the wrong man of course.....it was another older man with the same name but it still caused tears because they told me that they were going to tell my parents. This really worried me because I just knew that I would never get this all straightened out and to let them know that my love was not the same man. Needless to say I let my cousins know that I did not like this and never metal in my business again. I know that they were worried about me going to Spain to meet him for the first time but still that did not help me to understand their reasoning at the time. Now it is all straighten out and as I told you earlier they know now that we are very much in love. One of them even fixed us a binder with all the info and forms from the USCIS site which really helped out because we did not know the first thing we needed to do and have even sent us a box of Wedding presents already. Anyway just wanted you to know that you are not alone. It will work out-------just do alot of ignoring and praying.
