PhilippinesDual citizenship question

Kevo:

My apology for giving outdated info, contacted my sis in law (a lawyer in Philippines)

If your child is born after October 15, 1986 with at least 1 Filipino citizen parent. the child is also a Filipino citizen

She didn't give me info if the child is born before October 15, 1986, I didn't inquire since I'm assuming your child was born recently

PhilippinesDual citizenship question

My child was born in Guam; I?m USC and my wife LPR

This is only based on our experience and wanted to share it with you

This is 10 years ago so the law by that time could have been changed

My child is not ?dual citizen? he is US citizen even with Filipina mother

RA 9225 ?Citizenship Retention and Re-acquisition Act? doesn?t apply to my child because RA 9225 apply only to former Filipino citizen became Naturalized to USC

I filed a petition at the Bureau of Immigration in Philippines for my child to be recognized as a Filipino citizen based on the child Filipino parent (mother)

It took about 6 months

Someone made a comment to get a Philippines Passport;

DFA will not issue a Philippine passport to someone born in the foreign country regardless of having one Filipino parent

The child Filipina mother still needs to file a petition to recognize the child to be a Filipino citizen

Again, this info in 10 years old, go to Philippine Immigration website, click contact and send your inquiry via email, they will reply to you approximate 14 days

PhilippinesSons biological dad :( pls help

No. US law does not recognize the stepfather as the legal father. The only way for a stepfather to be a legal father is a legal adoption.

I'm sorry aaron, I'm only referring for immigration purposes only, you do not need to adopt a child to be a legal father if you meet the three prolong test
I'm sure that the step-father met those prolong test

Validity of an adoption and the three-prong test. Though the INA does not define
?adopted? or ?adoption,? BIA precedent establishes that an adoption must create ?a legal
status comparable to that of a natural legitimate child? between the adopted and the
adopter. Matter of Mozeb, 15 I&N Dec. 430 (BIA 1975). Thus, it does not matter what
name anyone gives to an adoption. For immigration purposes, what matters is whether
or not the order determining the custody or care of a child satisfies the three-prong test:
? It creates a legal permanent parent-child relationship between a child and someone
who is not already the child?s legal parent, and
? It terminates the legal parent-child relationship with the prior legal parent, and
? It does the above under the law of the country or place granting the adoption.
The law in some jurisdictions allows a step-parent to adopt the children of his or her
spouse, if the legal parent-child relationship with the other legal/biological parent has
been terminated by death or legal action. The continuing legal parent-child relationship
between the child and the adopting step-parent?s spouse does not preclude recognition
of the adoption.

PhilippinesSons biological dad :( pls help

Your husband petitioned your son as a step-son, I believed US law recognized your husband as a legal father of your child

PhilippinesTickets purchased outside the Philippines

Should be no problem, however you may want to call the airline and make sure she had a reservation

Also have your fiancee bring 1620 pesos (not sure how much now may be some of the member can provide you this info) for travel tax

since the ticket is issued outside Philippines

All she need is the itinerary or confirmation number

note: China Airlines does require verification if the credit card is not belong to the passenger unless paid in cash

this is only based on my own experience, since I work for the airline I always get ticket outside Philippines

I'm assuming your fiancee is flying via PAL since I don't see any lay-over

call PAL, USA 1-800-4-359-725 (24 hours), Manila (632) 855-8888

PhilippinesVISA APPROVED. How long before visa is received?
Well as a US citizen, I was able to go thru the guards and talk to someone from the American Services Unit. I'm not sure if they will allow you to enter without an appointment but you can try! This is a recent post at ustraveldocs.com addressed to NIV applicants, maybe you can try emailing them? Tell them about your situation. If it says issued, I'm sure it will arrive soon. Do not stress out. My fiancée is 33weeks pregnant and had a preterm labor scare because of stressing out. Its one of our medical issues.

"The U.S. Department of State is currently experiencing technical problems with its visa system, which are affecting global operations. This issue is worldwide and is not specific to any particular country or visa category. We recognize and deeply regret the inconvenience to travelers. We are doing everything possible to return passports with visas as soon as we are able to complete processing. We regret that we are currently unable to predict how long the delay will be.

Applicants, who interviewed with the U.S. Embassy after July 21 and would like their passports returned to them without the U.S. visa, may contact CONSManilaNIV@state.gov with their name and passport number. Please use the subject Request for Passport in your email.

Applicants, who have an urgent need to travel to the United States, may contact CONSManilaNIV@state.gov with their name, passport number, and nature of the emergency. Please use the subject Request for Passport in your email. Please understand that only true emergencies of an extraordinary humanitarian nature can be considered for exceptional handling.

We appreciate your patience as we work to resolve this matter and apologize for the inconvenience."

PhilippinesVISA APPROVED. How long before visa is received?
It happened to my fiancées aunt but that was 28yrs ago.

We have the same message, Gemini18. It was a surprise to us when they called. It was probably because I went to the Embassy last Friday and was able to talk to an actual human being! Someone who doesn't give generic responses. I told him about my fiancées medical situation and assured me that they will prioritize our visa once everything is up and running.
...or maybe they just had enough of our emails and phone calls that they wanted us to stop ASAP. Lol

K-3 Spousal Visa Case Filing and Progress ReportsDoes anybody know how to track my visa delivery?

I did not sign any 2go form at the embassy..
I also check 2go website using my passport and case number but it says "invalid"..

I was worried because i read some forums here and they said some got it 4 days, some 6 days.. Mine ks 7 days now..

Even if you didn't sign any 2go form from the embassy, embassy has contracted 2go for their services sending out visa/s

Continue checking 2go tracking using you MNL200??? or passport number

Tahoma is right sometimes it takes a while, but continue check 2go tracking services

one day you will say, thanks God I got my visa

Waivers (I-601 and I-212) and Administrative Processes (221g)need to know what it means please

Please don't use tiny, fancy, script... It is difficult for native English speakers to read, let along those with English as a second language... Important things should not be overlooked because the type you choose is virtually unreadable... Thanks...

Then don't read it
