You are misquoting the question significantly, but as others have said, it's asking about USA. Answer NO but be prepared to deal with the Police Report issue later, if applicable. How long was she in Denmark and WHY was she deported? All this matters, just not for that specific question on that form.



Yea i already got the police record.. it has no entry.. its clean.. she was in denmark for 6 years.. and she got deported cause she didnt renew her visa in time..so tey decided to put her in a camp for few weeks then deport .. she has a 2 year ban in denmark.. so it only shows in the passport.

I believe reading somwhere for the nvc docs that they only want deportation docs for usa.

Okay so my wife got deported in another country in denmark.

I asked rapidvisa my visa checkers

and the quesiton for 16 is: have you every had any immigration problems.

Rapidvisa told me thats only for the USA if she ever got any immigration problems here in the USA. So i put No is this correct?? Since she was only deported only in denmark for overstay not in the usa.

I hope that is correct.. And if its not what can i do i already filed it 2weeks in.

Actually no, but you should be prepared to say why you filed single (you were acting on bad advice). Also you should file an amended return using the appropriate forms as soon as possible (married filing separately is easiest) so you can show at the interview you made a good-faith effort to fix the error. Just put NRA (non-resident alien) in the box for your spouse's SSN.

If you are married, you file married, PERIOD. You file married separately and put NRA for your spouse's tax ID number and they don't have to do anything, or you file married joint and apply for an ITIN (a nonresident tax number that is not a SSN).

I just paid a CPA more than seven hundred dollars to prepare my taxes (I had other issues too). He says it is illegal to claim you are single when you are married on the last day of the tax year. There's plenty of information on this site about the RIGHT way to do it and I can tell you more also, but I have to get ready for work now :D

Explain that Gushikawa is a city in Okinawa and the lady at the SS office wouldn't change it when you asked her. I can't see how they can deny your visa based on that; you didn't lie or contradict yourself; you were born in Okinawa and that's clear.

I was born in a town that no longer exists because it was made part of a larger city a decade or so after I was born. Should I put that I was born in "Camillus" or "Syracuse"? They're both correct and "Camillus" is on my birth certificate. Nobody cares.


I dont think they would deny it.. but i dont wanna keep getting RFE for somthing stupid liek that..

Basically what im trying to ask is.. will they figure it out..

or does it have to be dot to dot.. photo copy matching what you put down on your app.

Okay so basically this..

I got to the ssn office to get my status updated to a us citizen and my birthday was wrong on my ssn ( found out because turbo tax efile system said i had the wrong info on my ssn and couldnt file) so i got that changed..

then.. i filled for my cr-1 with my birth place city as "gushikawa" okinawa japan... cause it asks for what city i was born in.. and thats the city i was born in on okinawa japan and thats what it says on my birth certificate.

But on my ssn i found out my birth city is "okinawa" and country is japan.. Okinawa.. is a island part of japan.. and my city is gushikawa...

The idiot at the ssn office was being an a hole and said i had to get my birth certificate translated there.. for them to change my city.. So she hand my a paper.. and says "is your birth place okinawa japan" I said yes... but the city is wrong.. she said.. i didnt ask you that.. i ask you is your "birth place" there.. so i said yes.. and i just left cause she was pissing me off..

Now.. when the officers check for my birthplace and since i put gushikawa city down on my cr1 and they check on my ssn and it shows okinawa.. is that gonna be a big deal??

Should i wake up early .. wait in the ssn line for like hours and get them to translate it.. and all that.. or should it be fine?

Okay i just attached a picture of my paystub..


now i get paid biweekly so if you look close

i get $915.39 for my regular 12.70 an hour wage

and on "slot tokes" i get another $873

So total for the two weeks i get $1890 .. NOw my question is.. the "slot tokes" part is the tip i get which the department shares and pools so its like an extra $10 an hour for tips plus my $12.75 an hour wage...

now my tips or tokes gets directly put onto my check and they take taxes from it.. now my quesiton is is the uscis only gonna accept my 12.70$ an hour wage.. cause the tips are always diffrent.. even though it does stay around 10$ an hour somtimes even at 12$ hour no lower than 9$ an hour... and its been constant and my w2 shows i make like $48k last year.. will they concider what you made at the end of the year or.. will they not accept the tokes and only concider my 12.70$ an hour wage.. when concidering the support affi.

Married is married. The tax situation for filing as head of household probably does not apply to you. If you need any more explanation beyond what is available on the IRS link I gave you above, I suggest you contact your HR rep, a CPA, or a tax attorney.

That's right, they will consider 2 people instead of 1. The W-4 that you fill out has the instructions and your HR person will help you out.

And YES, I am sure. You can CHOOSE to file single HOH under certain circumstances (if during that tax year your wife does not live with you and your child does), but no, they will not MAKE you file single if you are really married on December 31 of that tax year. It doesn't matter whether your wife has a SSN or not.


Now you said "if your wife doesnt live with you" So I can still change my status on my check to married even thought she does not live with me?

No, if you are married, you are married. You do not file as single if you are considered married for the tax year. If you are still married on the last day of 2013, you are married for tax year 2013.


They do take less taxxes from you at work if you where to file as married instead of single right??

The form is for tax year 2012, so it doesn't care about anything in 2013. It only cares whether you were married on December 31, 2012. You were not married on December 31, so you cannot claim you were. If you supplied more than half of the living expenses for your wife and/or child in 2012, you can claim them as dependents, but you must file single.

You can claim married at work for withholding, because you are married now, and you can do this as soon as you want. Talk to your HR person about it.

Your tax status does not depend on whether your wife has a SSN.


YEs i did pay for more than half my living expanses for my son.. and i did claim him as a dep.. so Head of house hold is correct right?


Also.. if i change my status to married on my tax at work.. and shes not here by the time i file for 2013 .. does that mean i have to file as signle.. and pay a huge sum back?

Rah, you say you were actually single on December 31 of 2012. Your single HOH filing is fine FOR 2012.

If your wife is still not in the country on December 31, 2013, and you are still married, you will have to file as married for 2013. (No, I am not saying this will happen, it's just an example.) You MUST file as married for each tax year in which you were married on December 31.

Don't worry about what your W-2 at work says. It only matters that you put the correct thing on your actual tax form that you file. My pay stubs say single too, as a matter of fact, and my CPA didn't think anything was wrong with that. It is legal to be married and have tax withheld as single. It is not legal to be married and put single on your tax return. If your other supporting information is good (joint lease or property ownership, joint bills, joint insurance, joint bank accounts), don't worry about this. I'm not.

You can file married joint or separate with your wife in 2013 if you are married on December 31. She will probably have an SSN by then, but if not, you have a whole year to plan what to do. I just did it myself. Don't worry about it yet because tax rules may change by then.

Just make sure your other information is in order, and you should be fine. Relax.


Well basically now my quesiton is this:

1. I filled this tax return (the current one for 2012) as single head of house hold and yes i was signle on dec 28 through dec 31 2012. Now my quesiton is.. when i filed for the taxes i filed on jan 31 2013. Now does the form ask if your married now? or If i was married in 2012??? Also even though i filed for a devorce back in july of 2012 .. and finally got my decree in dec 2012 .. does that count as single?? cause it seems like i have been married a little more than half the month of 2012 well exactly half.. or does it still concider im married till dec 28 2012 when my decree take place?

Also.. can i claim married on my paystub? so they take less taxes from me??? cause signles claiming double the amount .. and it hurts.. Or maybe should i wait till after she gets to the usa with a valid ssn before i change my status to married?

Okay..

So in july of 2012 i filed for a divorce. I live in california so it takes 6months to get a divorce decree . So i finally got a certified copy of my divorce decree on Dec 28 2012. Then i got married in the philipines on January 21 2013.

Now i filled my taxes as signle head of house HOld "cause i have 1 kid" So bascially when i send my tax transcript for 2012 for the supoort affidvite or whatever what not .. its fine right? cause i was signle for 2012 ..

So my few questions are... Should i have changed my w-2 or w-9 (iforgot which changes your status on your paycheck at work) to single back in july.. or single after dec 28 2012 (since thats when i got my decree). Also i changed it to signle in december.. but should i change it back to married??? since im married now? But see the issue is I heard many people tell me since my wife is not here yet and she has no connection to the usa besides being with me and my marriage took place abroad.. I should put as married or file for taxes as married till she is approved on the cr1 and she steps foot in the usa..

I just dont want to be denied because it shows i am single on my paystubs i send in on the support aff. So please tell me cause i still have a few months to change it on my paystubs.

I didnt write my A number on the back.. i thought since i was a natralized us citizen i get treated the same... darn it!!! I can smell the RFE.. what do i do??/?
I sent them a copy of my Natralization certificate... I hope maybe that will suffice.

But also remember that the co-sponsor can be any US citizen or greencard holder living in the USA, they need not be a close relative. Have your husband reach out to neighbours, old co-workers, college friends, church family...


Do you have to have that job for a certin time to concider it ?

To the nvc it says you have to send a copy of the biographics page of the passport to the nvc.

Now does that mean.. They only want the first page of the passport that hass your passport number your pic and name? Or do they need all the pages copied?

Also Since in my case i got married to my spouse alien abroad.. she has her old passport as for example "mary jane rugar"

But now she will take my last name as: mary rugar toyota (if my last name was toyota)

And on my i-130 I put her name on the app as : mary rugar toyota

So can we use her old unexpired passport with the name "mary jane rugar" or do i need to apply for another passport with her new name "mary rugar toyota" and send it in?

I did put down on the i130 for when it asked for any aditional used names: mary jane rugar.

IF on your I130 application you put your spouses name that your trying to apply for as her new married name with your last name on it.

But the passport she has shows her last name with her maiden last name.. will the NVC still accept that or will i have to submit to the nvc the passport with her new married name?

The reason being is.. IN the philipines she lost her passport and she getting anew passport but in order for her to get a new passport with her new married name she has to get this certificate call the CFO but she cannot make it to the cfo.. But she can get a new passport with her single maiden name..

So will that be acceptable or will the nvc rfe me because the name on the passport does not have the same name as on the 1130 app
