I dont understand this... I checked my case status on My wife did the interview already and she turned in the papers that they requested and did the medical.. then i check today the status on ceac and it says: READY.. before that it was in AP status.. then it says this: ####### IS GOING ON?? I ALREADY DID THE INTERVIEW AND DID THE MEDICAL!! IS THIS SAYING THERE IS ANOTHER INTERVIEW AND A MEDICAL?

PR is permanent resident.

were you born a USC or were you naturalized? If you are a naturalized citizen then you have an A (alien registration) number that you had as a Legal Permanent Resident. They want that number on the back of the photo if you've have one. If you do not then do not put anything.

It is asking for a petitioner photo only.

They won't want proof of address because it's irrelevant to getting a police record sent overseas. Basically, they're running your fiancee's name/passport info through their database, looking to see if anything pops up. If not, they'll send the police record to her with her full name on, their signature and stamp saying "no entry appears in the Central Crime register"(followed by some paragraphs and such). Since she entered legally with a visa, she could only have been registered as that person if she comitted any crimes, therefore the address is not relevant. Besides, she wasn't a permanent resident and proof of address is dificult to obtain as a visitor.


Theres a part on the aplication of the cr-1 that scares me..

It says if she has ever gotten in trouble with imigration before.. and they list when and ask for docments on that.

Now i thought you guys said it doesnt matter if she got deported or not?? if it didnt then why do they ask that?? I got half a mind just to put down No and get a new passport with blank pages and say she has livedin the philipines all her life.. I mean can they realy find out since it happend in denmarkk?

An au pair enters on a non-immigrant visa in Denmark, meaning she was visiting for the duration of her contract with the family.
And most employers are just families looking for a nanny and they know nothing about immigration. If they had, they knew they were obligated to pay for her return ticket and she wouldn't get caught in such a mess in the first place. They were also obligated to have insurance for her, and have her signed up for the folkeregister which is where she'd be registered with her address. Allthough the family was obligated to pay for her ticket, it was still her responsibility to her have own visa renewed in time.


When she stayed for more than 6 months in another country than country of origin, she has to get a police record from that country. Use the email I provided.


she already done with that work.. and was going in for another contract.. It was her sweetness and niveness that screwed her.. Dont worry i scold her everyday.. saying she was stupid for beliveing in other people.. and i do agree she should of taken action and done this herself... see that is another reason im worried cause she not good with all this paper work stuff.. neither am i.. but the diffrence is im driven and ill do what needs to get done.. and i dont just take peoples word for stuff..

How long was she working as an au pair in Denmark? One of the requirements of the K-1 visa is a police certificate for every country in which the applicant has lived for 6 months or longer past the age of 18. Another is a complete and truthful record of the applicant's town/city & country of residence for the last 5 years (on the G325A) or 10 years (on the actual K-1 forms). No way around either of those. But then, talking about impatience and the difficulties of being separated won't get you very far here, as many of us have spent/are spending many months apart, just to do things the right way and not have to live with the worry that an omission/untruth will come back later to unravel everything. Even if you think you're getting away with something with the USCIS/DOS, you never know how long that will last.

Also, if your divorce is not even final yet, what is the hurry, exactly?


My divorce is final in dec.. thats next month... What if the police reports dont get delievered????? paper work goes missing alot!

The US doesn't care if the was deported from Denmark. Denmark has strict policies regarding overstaying a visa. Any kind of non-immigrant/immigrant matters btw. While it's unfortunate your fiancee got stuck and overstayed, rules are rules. She chose to visit and it was her responsibility to leave just as it would be with any other country.

There's an email address your fiancee can use to contact the Danish police regarding her police record. I'm not all the way familiar with the process however I do know that she will have to send a written statement with her info and sign it, requesting to have her international police report sent to her address, and she'll need to include stamps/postage. A copy of the bio page of passport might be required too but I'm not sure. But the police report itself doesn't cost anything.

They're usually pretty fast responding to emails so it won't hurt to ask how to obtain the police record. English is fine.

see this is what im talking about.. why do i need a police record/?? she did not visit denmark.. she went ther to work and an opare or somthing like that... what ever that is... and she was gonna get her visa renewed and her employer told her dont worry if it expires.. whell get it taken care of.. well push came to shove and the employer.. lied... and couldnt get the visa extended.. and she was detained by police.. and she said she had to stay in some kind of prison camp for a week or two then deported.. thats some serious shyt.. for overstaying a week..

Im pretty shure she wont know how to write a written statment.. and im very shure she will send it and it willl get lost in the mail or it will take a month or 2 just to get any info back.. that is way to long!! I need to get this thing moving on... Do you know how hard it is being half way around the world away from your loved one waiting day by day??? I just dont got the patients waiting that long..!!

She can only AOS from the original petitioner on the K1 visa. You cannot just marry another US citizen and AOS. If this were to happen, that person would need to leave the US and then the US citizen spouse would need to file the CR1 petition.

She is required to disclose the truth during the process. Isn't that nice when people actually do what is expected of them - like tell the truth?

First, how is overstaying in another country relevant to coming to the US to marry you or be your wife? Stop being paranoid.

Second, even if the Denmark overstay matters - then telling the truth gives her a chance. If she lies and omits information, then she is looking at a lifetime ban.

So, for us US citizens who appreciate it when prospective immigrants tell the truth on their immigration forms, we welcome you to the process.

Immigration does not care about your credit score. Based on what you wrote about your salary, you meet over the 125% poverty level so no issues there.

Personally I think you are over analyzing/complicating the process. The ultimate goal of getting a fiancée/spouse visa is so they will be an immigrant in the US, so why worry about overstay. It's not like she is only coming over as a tourist right?

Depending on the age of her child it's also not a complicated process to bring him/her over once you are married.


Another question .. im not leagally devorced till dec of this year.. but i filed for paper work in july i just had to wait six months.. Now me and my ex are seperated but im not legally devorced and free to marry till dec of this year... Does that matter that i went see her ... before my devorce was final? also .. on my pay stub..it still shows im married and claim 2 on my taxes me and my son.. should i have that changed asap like in dec when im leagally devorced or does that matter? Also my fiance is kid is 9yrs old.

oh and.. do you know any trustworthy people that i can pay or any website i can hire to make shure this paperwork and everything is done correctly? im looking for an agency or lawyer that has a high sucess rate.

She wi;l not need proof of residency (bills etc), all she needs to do is write down the address where she lived. As I said before, it's really no big deal, but lying to US immigration about where she lives IS and can lead to a lifetime ban. Why start your journey with a lie? It's not worth the heartache in the end. I personally would not want to jeopardize my fiancee/spouse visa to the US, and can only recommend filling out all the immigration forms honestly.


Okay you tell me what is she supposed to do.. when they ask for proof of redency and she has no phone numbers to denmark or any connection to denmark anymore?? Then they ask her to file papers and she has 90 days??? What i gotta buy her a plane ticket to denmark so she can go visit the apartment she stayed at? Not even mentioning a ban from denmark since she cant go there anymore... The US government won;t care about her overstay/ being deported from Denmark. There is also no-where on the paperwork where it asks whether you were deported from another country, though you will need to be truthful with where she resided, and possibly get a police cert from Denmark.

If that is the only "red flag" you guys have, then you should be able to file yourself with the help of the Guides here. If you are super busy or not used to filing out detailed paperwork, then a visa prep company can be a good investment to make sure you don't get RFEs, but a lawyer tends to be extra expense and delay things.


she has no friends or family or knows anybody in denmark anymore.. she is going to get a new passport... so the departed stamp will not show up on the passport... Can she just put that she lived in philipines for the whole time? they cant find out right?

Okay so finally i got my us passport.

Now im trying desperatly to file a finance visa or marriage visa for my fiance in the philipines.

Problem im having is.. Do you think i should hire a lawyer or one of those websites to do the paperwork for me?

Also my major concern is.. my filipino fiance had worked in denmark a few months back and she overstayed for a week. Because it was the holidays and she couldnt get her visa renewed in time. So the denmark athoritys interviewed her and made a decision to deport her.

Now my concern is.. the usa embassy find out about this during her process for the fiance or marriage visa.. also should she put down that she has been deported? It was another country not even close to the usa it was stupid denmark... so do you think the usa embassy can check on this? Im afraid please help!

Well if the statistics from adjudicator q&a are still true, it's an average of 15 minutes per petition. That's reasonably fast for me. And everyone is entitled to vacation.

 

IM entitled to a vacation too.. and i do take vacations.. Where i work i have deadlines to meet and I make them.  I dont have an excuse like "im a person too"   ... If my boss wants me to finish  fixing 1 machine in 1 hour.. I fix 2 in 1 hour..   People should be more like me..

As always be ABSOLUTELY honest with USCIS, but I'd also advise that you choose your words very, very carefully when responding to them - verbally, or in writing.

You may not have meant it, but there's a potential discrepancy in what you are saying (or at least an ambiguity) which USCIS could use against you. If USCIS thinks you are shifting your position, or changing your answers, that won't be good.

Post 1: "one of the required documents was a selective service paper I honestly had no idea what the heck that was so i googled it".

You then clarify in post 6 that: "I swear to god.. that i never heard I had to sign up for the selective services". You then confirm that you knew exactly what SS was, as you talked about it with your (military) father and took his advice that it didn't apply to LPRs.

There's a big difference between having never heard of selective service; and having heard of selective service - but believing that it was not required of you. Whatever the truth is, tell it exactly. Don't give ambiguous/ contradictory answers that will lead to more questions.



Im saying that.. as in.. I neverheard of the selective services.. till i read it on the required docs i need for my interview.. then the next day i gooled the info about it.. then the next day after that i asked my dad about it.. and he said it and he said he never told me because he tought that pr's do not need to sign up for it..

FYI I am 28 and got my USC earlier this year, and I'd been an LPR since I was 18, so I totally know what it's like to have been an LPR for so long and not knowing some of the rules because your parents took care of that stuff. The thing that's tough about SS is unlike other LPR requirements (for example I never knew about AR-11 until before my interview, and wasn't an issue until after I graduated from college and became my own resident... I filed AR-11 right before my interview and there wasn't an issue), SS however is something that ALL male US residents have to do, not just LPR's... all male citizens also have to register when they turn 18, so it seems very weird that you never went through it. For example when I and my friends turned 18 we all listed the things that being 18 allowed us to do, like buy cigarettes, pornography (don't laugh), vote (well, not me), and GET DRAFTED.

Again I was certainly not the type to be on top of all the immigration proceedings since I was a child for most of it, but signing up for SS was something I definitely remembered doing, and it was not something I remember seeking out to do myself (who would want to do that?). I feel like it was almost a requirement for applying to college, even. Either way it seems very weird that you never had any idea about it (I would understand if you were 19 when you arrived in the US and became LPR, you would have missed most of the hype surrounding it).

Anyway you've been given the procedure so you'll just have to follow that and hope for the best.

EDIT: I just also reread and remembered your dad was in the military! How could you possibly never have known about signing up for selective service? Also you turned 18 in 2003ish which was right when the Iraq war was starting, and again the military and the draft was something everyone our age was talking about... seems just so weird that you'd never heard about this.

Are you sure you didn't do it and just forgot? You can contact SS and put in your social security number and see if you actually WERE registered.



I went to like 3 diffrent highschools cause my step dad always moved around when he was in the military... I swear to god.. that i never heard I had to sign up for the selective services... then again... When do they talk about signing up for this stuff in school? was it near the end of the school year in grade 12? because if it was.. then i wasnt there.. because i went to a continuation school across the street.. before my school year ended.. because I didnt have enough credits to graduate anyway...

My step dad.. I swear to you... told me that.. He didnt tell me to sign up because he thought only US citezens where supposed to sign up.. Because he said it seems weird to him to let PR's sign up because there not a Us citizen and they cant vote .. nor can they attend jury duty... also they are a citizen of another country .. So why would the US if they had a draft? Send sombody from a citizen from another country to go to war for the US ... Can they even trust you? YOur not even a us citizen.. So I agree with my dad.. and I can understand why he thought only Us citizens were supposed to sign up to selective services.
